60 | 53 | | SECTION 1. AMENDATORY 59 O.S. 2011, Sectio n 1928, is |

208 | 198 | | paraprofessional who is certified by the Board and practices under |
---|
209 | 199 | | the close, ongoing supervision of a Board Certified Behavior |
---|
210 | 200 | | Analyst. The Registered Behavior Technician is primarily |
---|
211 | 201 | | responsible for the direct imp lementation of behavior -analytic |
---|
212 | 202 | | services designed and prescribed by a Board Certified Behavior |
---|
213 | 203 | | Analyst; and |
---|
214 | 204 | | 7. "Supervisee" means a person who acts under the extended |
---|
215 | 205 | | authority of a licensed behavior analyst to provide applied behavior |
---|
216 | 206 | | analysis services or a person who is in training to provi de such |
---|
217 | 207 | | services Board Certified Assistant Behavior Analyst or Registered |
---|
218 | 208 | | Behavior Technician who acts under the authority and supervision of |
---|
219 | 209 | | a Board Certified Behavior Analyst to provide applied behavior |
---|
250 | 239 | | B. Each person wishing to practice as a licensed behavior |
---|
251 | 240 | | analyst or a certified assistant behavior analyst Board Certified |
---|
252 | 241 | | Behavior Analyst or a Board Certified Assistant Behavior Analyst |

253 | 242 | | shall apply to the Developme ntal Disabilities Services Division of |

254 | 243 | | the Department of Human Services using a form and in a manner |
---|
255 | 244 | | prescribed by the Division Developmental Disabilities Services and |

256 | 245 | | shall furnish evidence satisfactory to t he Division Developmental |
---|
257 | 246 | | Disabilities Services that such person: |
---|
258 | 247 | | 1. Is of good moral character; |
---|
259 | 248 | | 2. Is at least twenty-one (21) years of age; |
---|
260 | 249 | | 3. Has passed the Board exa mination and is certified by the |
---|
261 | 250 | | Board as a Board-Certified Board Certified Behavior Analyst or a |
---|
262 | 251 | | Board-Certified Board Certified Assistant Behavior Analyst, as |
---|
263 | 252 | | applicable; and |
---|
264 | 253 | | 4. 2. Has not had a professional l icense or certification |
---|
265 | 254 | | refused, revoked, suspended, or restri cted and does not ha ve a |
---|
266 | 255 | | complaint, allegation , or investigation pend ing in any regulatory |
---|
267 | 256 | | jurisdiction in the United States or in another country f or reasons |
---|
268 | 257 | | that relate to unprofessional condu ct unless the Division finds, to |
---|
269 | 258 | | its satisfaction, that the conduct has been corre cted or that |
---|
270 | 259 | | mitigating circumstances exist that prevent its resolution; and |
---|
300 | 288 | | institution of higher learning in a qualifying field of study, as |
---|
301 | 289 | | determined by the Board. |
---|
302 | 290 | | C. A person holding a state license or state certi fication |
---|
303 | 291 | | shall apply for renewal of the state license or state certification |
---|
304 | 292 | | on or before April 30 of each odd -numbered year. The application |
---|
305 | 293 | | shall be accompanied by a renewal fee to be set by the Division |
---|
306 | 294 | | Developmental Disabilities Services in accordance with paragraph 3 |
---|
307 | 295 | | of subsection F of th is section. |
---|
308 | 296 | | D. A person licensed or certified by the Developmental |
---|
309 | 297 | | Disabilities Services Division of the Department under this section |
---|
310 | 298 | | shall: |
---|
311 | 299 | | 1. Maintain active s tatus and fulfill all requirements for |
---|
312 | 300 | | renewal of national certification or recertification with the Board; |
---|
313 | 301 | | and |
---|
314 | 302 | | 2. Conduct professional activities in accordance w ith accepted |
---|
315 | 303 | | standards such as the Guidelines for Responsible Conduct and |
---|
316 | 304 | | Professional Disciplinary Standards of the Board Board's |
---|
317 | 305 | | Professional and Ethical Compliance Code for Behavior Analysts. |
---|
318 | 306 | | E. 1. No person shall claim the ti tle of licensed behavior |
---|
319 | 307 | | analyst or certified ass istant behavior analyst Board Certified |
---|
320 | 308 | | Behavior Analyst or Board Certified Assistant Behavior Analyst |
---|
321 | 309 | | unless that person meets the applicable requirements in this |
---|
351 | 338 | | section. Supervisees may only provide applied behav ior analysis |
---|
352 | 339 | | under the supervision of a licensed behavior analyst Board Certified |
---|
353 | 340 | | Behavior Analyst. This section shall not restrict the practice of |
---|
354 | 341 | | applied behavior analysis by human services professionals, provided |
---|
355 | 342 | | such individuals are working within the scope of their professions |
---|
356 | 343 | | and the practice of applied behavior analysis is commensurate with |
---|
357 | 344 | | their level of trainin g and experience. |
---|
358 | 345 | | 2. A violation of this su bsection shall be punishable by a fine |
---|
359 | 346 | | of not more than Five Hundred Dollars ($500.00), the sus pension or |
---|
360 | 347 | | revocation of a license or certification issued pursuant to this |
---|
361 | 348 | | section, or both such fine and loss of li censure or certification. |
---|
362 | 349 | | F. The Division state licensure board operated by t he |
---|
363 | 350 | | Developmental Disabilities Services shall: |
---|
364 | 351 | | 1. Investigate all complaints relating to : |
---|
365 | 352 | | a. the practice or supervision of applied behavior |
---|
366 | 353 | | analysis by any person licensed by th e Developmental |
---|
367 | 354 | | Disabilities Services Division of the Department as a |
---|
368 | 355 | | behavior analyst or certified by the Division as an |
---|
369 | 356 | | assistant behavior analyst Board Certified Behavior |
---|
370 | 357 | | Analyst or certified as a Board Certified Assistant |
---|
371 | 358 | | Behavior Analyst, or |
---|
402 | 388 | | 2. Refer any substantiated complaints to the Board ; and |
---|
403 | 389 | | 3. Charge reasonable fees for a license or for certification, |
---|
404 | 390 | | not to exceed One Hundred Dollars ($100.00). |
---|
405 | 391 | | G. 1. A person having a qualifying degree, as provided for in |
---|
406 | 392 | | paragraph 5 of subsection B of this section, and participating in |
---|
407 | 393 | | the applied behavior analysis treatment pilot proje ct established in |
---|
408 | 394 | | Section 3 of this act shall be exempt from the requirements of this |
---|
409 | 395 | | section while such person is actively participating in the project. |
---|
410 | 396 | | 2. Persons employed by a school district in this state who |
---|
411 | 397 | | provide services solely to the school dist rict under the Individuals |
---|
412 | 398 | | with Disabilities Education Act (IDEA), 20 U.S.C., Section 1400 et |
---|
413 | 399 | | seq., shall be exempt from the requirements of this section. |
---|
414 | 400 | | H. The supervisee shall not design intervention or assessment |
---|
415 | 401 | | plans. It shall be the responsibility of the supervising Board |
---|
416 | 402 | | Certified Behavior Analyst to determine which other tasks the |
---|
417 | 403 | | supervisee may perform as a function of the supervisee's training, |
---|
418 | 404 | | experience and competence. The Board Certified Behavior Analyst |
---|
419 | 405 | | shall be responsible for the work performed by the supervisee on the |
---|
420 | 406 | | cases overseen by the Board Certified Behavior Analyst. |
---|
421 | 407 | | I. A Board Certified Behavior Analyst, Board Certified |
---|
422 | 408 | | Assistant Behavior Analyst or Registered Behavior Technician who is |
