5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. AMENDATORY 59 O.S. 2011, Sectio n 1928, is
6154 amended to read as follows:
6255 Section 1928. A. As used in this act section and Sections 1 -
6356 280.1 through 1-280.3 of Title 63 of the Oklahoma Stat utes:
6457 1. a. "Applied behavior analysis" means the design,
6558 implementation, and evaluation of instruc tional and
6659 environmental modifications to produce socially
6760 significant improvements in human behavior through
61+skill, acquisition, a nd the reduction of problematic
62+behavior. An applie d behavior analysis program shall:

96-behavior. An applied behavior analysis program shall:
9789 (1) be based on empirical research inc luding the
9890 direct observation and measurement of behavior as
9991 well as a functional behavior assessment, and
10092 (2) utilize antecedent s timuli, positive
10193 reinforcement, and other consequenc es to produce
10294 behavior change.
10395 b. Applied behavior analysis does not include cognitive
10496 therapies or psychological testing, neuropsychology,
10597 psychotherapy, sex therapy, psychoanalysis,
10698 hypnotherapy, and lo ng-term counseling as treatment
10799 modalities;
108100 2. "Board" means the nationally accredited Behavior Analyst
109101 Certification Board;
110102 3. "Human services professio nal" means an individual licensed
111103 or certified by the state as one of the following:
112104 a. a licensed physical therapist or physical therapist
113105 assistant pursuant to Sections 887.1 through 887. 18 of
114106 Title 59 of the Oklahoma Statut es this title,
115107 b. an occupational therapist, occupational therapy
116108 assistant, or occupational therapy aide pursuant to
117109 Sections 888.1 through 8 88.15 of Title 59 of the
118110 Oklahoma Statutes this title,
111+c. a licensed clinical social worker, licensed masters
112+social worker, or social work asso ciate pursuant to

196-4. "Certified assistant behavior analyst " "Board Certified
197-Assistant Behavior Analyst " or "BCaBA" means an individual who is
198-certified by the nationally accredited Behavior Analyst
199189 Certification Board as a Board -Certified Assistant Behavior Analyst
200190 and certified Board and certified by the Developmental Disabilities
201191 Services Division of the Department of Human Services;
202192 5. "Licensed behavior analyst " "Board Certified Behavior
203193 Analyst" or "BCBA" means an individual who is certi fied by the
204194 nationally accredited B ehavior Analyst Certification Board a s a
205195 Board-Certified Behavior An alyst Board and licensed by the
206196 Developmental Disabilities Services Division of the Department; and
207197 6. "Registered Behavior Technician" or "RBT" means a
208198 paraprofessional who is certified by the Board and practices under
209199 the close, ongoing supervision of a Board Certified Behavior
210200 Analyst. The Registered Behavior Technician is primarily
211201 responsible for the direct imp lementation of behavior -analytic
212202 services designed and prescribed by a Board Certified Behavior
213203 Analyst; and
214204 7. "Supervisee" means a person who acts under the extended
215205 authority of a licensed behavior analyst to provide applied behavior
216206 analysis services or a person who is in training to provi de such
217207 services Board Certified Assistant Behavior Analyst or Registered
218208 Behavior Technician who acts under the authority and supervision of
219209 a Board Certified Behavior Analyst to provide applied behavior
210+analysis services, or a Board Certified Assistant Behavior Analyst
211+or Registered Behavior Technician applicant to provide such services
212+as defined by the Board.

248-or Registered Behavior Technician applicant to provide such services
249-as defined by the Board .
250239 B. Each person wishing to practice as a licensed behavior
251240 analyst or a certified assistant behavior analyst Board Certified
252241 Behavior Analyst or a Board Certified Assistant Behavior Analyst
253242 shall apply to the Developme ntal Disabilities Services Division of
254243 the Department of Human Services using a form and in a manner
255244 prescribed by the Division Developmental Disabilities Services and
256245 shall furnish evidence satisfactory to t he Division Developmental
257246 Disabilities Services that such person:
258247 1. Is of good moral character;
259248 2. Is at least twenty-one (21) years of age;
260249 3. Has passed the Board exa mination and is certified by the
261250 Board as a Board-Certified Board Certified Behavior Analyst or a
262251 Board-Certified Board Certified Assistant Behavior Analyst, as
263252 applicable; and
264253 4. 2. Has not had a professional l icense or certification
265254 refused, revoked, suspended, or restri cted and does not ha ve a
266255 complaint, allegation , or investigation pend ing in any regulatory
267256 jurisdiction in the United States or in another country f or reasons
268257 that relate to unprofessional condu ct unless the Division finds, to
269258 its satisfaction, that the conduct has been corre cted or that
270259 mitigating circumstances exist that prevent its resolution; and
260+5. Has at least the minimum graduate or undergradu ate degree,
261+appropriate for the level of certification, from an accredit ed

298-5. Has at least the minimum graduate or undergraduate degree,
299-appropriate for the level of certification, from an accredited
300288 institution of higher learning in a qualifying field of study, as
301289 determined by the Board.
302290 C. A person holding a state license or state certi fication
303291 shall apply for renewal of the state license or state certification
304292 on or before April 30 of each odd -numbered year. The application
305293 shall be accompanied by a renewal fee to be set by the Division
306294 Developmental Disabilities Services in accordance with paragraph 3
307295 of subsection F of th is section.
308296 D. A person licensed or certified by the Developmental
309297 Disabilities Services Division of the Department under this section
310298 shall:
311299 1. Maintain active s tatus and fulfill all requirements for
312300 renewal of national certification or recertification with the Board;
313301 and
314302 2. Conduct professional activities in accordance w ith accepted
315303 standards such as the Guidelines for Responsible Conduct and
316304 Professional Disciplinary Standards of the Board Board's
317305 Professional and Ethical Compliance Code for Behavior Analysts.
318306 E. 1. No person shall claim the ti tle of licensed behavior
319307 analyst or certified ass istant behavior analyst Board Certified
320308 Behavior Analyst or Board Certified Assistant Behavior Analyst
321309 unless that person meets the applicable requirements in this
310+section. No person shall practice applied behavior analysis without
311+obtaining a license or certification in accordance with this

349-section. No person shall practice applied behavior analysis without
350-obtaining a license or certification in accordance with this
351338 section. Supervisees may only provide applied behav ior analysis
352339 under the supervision of a licensed behavior analyst Board Certified
353340 Behavior Analyst. This section shall not restrict the practice of
354341 applied behavior analysis by human services professionals, provided
355342 such individuals are working within the scope of their professions
356343 and the practice of applied behavior analysis is commensurate with
357344 their level of trainin g and experience.
358345 2. A violation of this su bsection shall be punishable by a fine
359346 of not more than Five Hundred Dollars ($500.00), the sus pension or
360347 revocation of a license or certification issued pursuant to this
361348 section, or both such fine and loss of li censure or certification.
362349 F. The Division state licensure board operated by t he
363350 Developmental Disabilities Services shall:
364351 1. Investigate all complaints relating to :
365352 a. the practice or supervision of applied behavior
366353 analysis by any person licensed by th e Developmental
367354 Disabilities Services Division of the Department as a
368355 behavior analyst or certified by the Division as an
369356 assistant behavior analyst Board Certified Behavior
370357 Analyst or certified as a Board Certified Assistant
371358 Behavior Analyst, or
359+b. any person alleged to be practicing or providing
360+supervision without a state license or state
361+certification;

399-b. any person alleged to be practicing or providing
400-supervision without a state license or state
401-certification;
402388 2. Refer any substantiated complaints to the Board ; and
403389 3. Charge reasonable fees for a license or for certification,
404390 not to exceed One Hundred Dollars ($100.00).
405391 G. 1. A person having a qualifying degree, as provided for in
406392 paragraph 5 of subsection B of this section, and participating in
407393 the applied behavior analysis treatment pilot proje ct established in
408394 Section 3 of this act shall be exempt from the requirements of this
409395 section while such person is actively participating in the project.
410396 2. Persons employed by a school district in this state who
411397 provide services solely to the school dist rict under the Individuals
412398 with Disabilities Education Act (IDEA), 20 U.S.C., Section 1400 et
413399 seq., shall be exempt from the requirements of this section.
414400 H. The supervisee shall not design intervention or assessment
415401 plans. It shall be the responsibility of the supervising Board
416402 Certified Behavior Analyst to determine which other tasks the
417403 supervisee may perform as a function of the supervisee's training,
418404 experience and competence. The Board Certified Behavior Analyst
419405 shall be responsible for the work performed by the supervisee on the
420406 cases overseen by the Board Certified Behavior Analyst.
421407 I. A Board Certified Behavior Analyst, Board Certified
422408 Assistant Behavior Analyst or Registered Behavior Technician who is
409+a guardian or parent shall not provi de services to his or her own
410+child or ward.

452437 J. The Department Director of Human Services shall promulgate
453438 rules to implement the provisions of this section.
454439 SECTION 2. This act shall become effective November 1, 2021.
