59	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	53		SECTION 1. AMENDATORY 59 O.S. 2011, Sectio n 1928, is
61	54		amended to read as follows:
62	55		Section 1928. A. As used in this act section and Sections 1 -
63	56		280.1 through 1-280.3 of Title 63 of the Oklahoma Stat utes:
64	57		1. a. "Applied behavior analysis" means the design,
65	58		implementation, and evaluation of instruc tional and
66	59		environmental modifications to produce socially
67	60		significant improvements in human behavior through
	61	+	skill, acquisition, a nd the reduction of problematic
	62	+	behavior. An applie d behavior analysis program shall:

95		-	skill, acquisition, and the reduction of problematic
96		-	behavior. An applied behavior analysis program shall:
97	89		(1) be based on empirical research inc luding the
98	90		direct observation and measurement of behavior as
99	91		well as a functional behavior assessment, and
100	92		(2) utilize antecedent s timuli, positive
101	93		reinforcement, and other consequenc es to produce
102	94		behavior change.
103	95		b. Applied behavior analysis does not include cognitive
104	96		therapies or psychological testing, neuropsychology,
105	97		psychotherapy, sex therapy, psychoanalysis,
106	98		hypnotherapy, and lo ng-term counseling as treatment
107	99		modalities;
108	100		2. "Board" means the nationally accredited Behavior Analyst
109	101		Certification Board;
110	102		3. "Human services professio nal" means an individual licensed
111	103		or certified by the state as one of the following:
112	104		a. a licensed physical therapist or physical therapist
113	105		assistant pursuant to Sections 887.1 through 887. 18 of
114	106		Title 59 of the Oklahoma Statut es this title,
115	107		b. an occupational therapist, occupational therapy
116	108		assistant, or occupational therapy aide pursuant to
117	109		Sections 888.1 through 8 88.15 of Title 59 of the
118	110		Oklahoma Statutes this title,
	111	+	c. a licensed clinical social worker, licensed masters
	112	+	social worker, or social work asso ciate pursuant to

157	148		f. a licensed professional counselor or licensed
158	149		professional counselor candidate pursuant to Sections
159	150		1901 through 1920 of Title 59 of the Oklahoma Statutes
160	151		this title,
161	152		g. a licensed marital and family therap ist or licensed
162	153		marital and family the rapist candidate pursuant to
163	154		Sections 1925.1 through 1925.18 of Title 59 of the
164	155		Oklahoma Statutes this title, or
165	156		h. a licensed behavioral practitioner or licensed
166	157		behavioral practitioner ca ndidate pursuant to Sections
167	158		1930 through 1949.1 of Title 59 of the Oklahoma
168	159		Statutes this title;
	160	+	4. "Certified assistant behavior analyst " "Board Certified
	161	+	Assistant Behavior Analyst" or "BCaBA" means an individual who is
	162	+	certified by the nationally accredited Beha vior Analyst

196		-	4. "Certified assistant behavior analyst " "Board Certified
197		-	Assistant Behavior Analyst " or "BCaBA" means an individual who is
198		-	certified by the nationally accredited Behavior Analyst
199	189		Certification Board as a Board -Certified Assistant Behavior Analyst
200	190		and certified Board and certified by the Developmental Disabilities
201	191		Services Division of the Department of Human Services;
202	192		5. "Licensed behavior analyst " "Board Certified Behavior
203	193		Analyst" or "BCBA" means an individual who is certi fied by the
204	194		nationally accredited B ehavior Analyst Certification Board a s a
205	195		Board-Certified Behavior An alyst Board and licensed by the
206	196		Developmental Disabilities Services Division of the Department; and
207	197		6. "Registered Behavior Technician" or "RBT" means a
208	198		paraprofessional who is certified by the Board and practices under
209	199		the close, ongoing supervision of a Board Certified Behavior
210	200		Analyst. The Registered Behavior Technician is primarily
211	201		responsible for the direct imp lementation of behavior -analytic
212	202		services designed and prescribed by a Board Certified Behavior
213	203		Analyst; and
214	204		7. "Supervisee" means a person who acts under the extended
215	205		authority of a licensed behavior analyst to provide applied behavior
216	206		analysis services or a person who is in training to provi de such
217	207		services Board Certified Assistant Behavior Analyst or Registered
218	208		Behavior Technician who acts under the authority and supervision of
219	209		a Board Certified Behavior Analyst to provide applied behavior
	210	+	analysis services, or a Board Certified Assistant Behavior Analyst
	211	+	or Registered Behavior Technician applicant to provide such services
	212	+	as defined by the Board.

247		-	analysis services, or a Board Certified Assistant Behavior Analyst
248		-	or Registered Behavior Technician applicant to provide such services
249		-	as defined by the Board .
250	239		B. Each person wishing to practice as a licensed behavior
251	240		analyst or a certified assistant behavior analyst Board Certified
252	241		Behavior Analyst or a Board Certified Assistant Behavior Analyst
253	242		shall apply to the Developme ntal Disabilities Services Division of
254	243		the Department of Human Services using a form and in a manner
255	244		prescribed by the Division Developmental Disabilities Services and
256	245		shall furnish evidence satisfactory to t he Division Developmental
257	246		Disabilities Services that such person:
258	247		1. Is of good moral character;
259	248		2. Is at least twenty-one (21) years of age;
260	249		3. Has passed the Board exa mination and is certified by the
261	250		Board as a Board-Certified Board Certified Behavior Analyst or a
262	251		Board-Certified Board Certified Assistant Behavior Analyst, as
263	252		applicable; and
264	253		4. 2. Has not had a professional l icense or certification
265	254		refused, revoked, suspended, or restri cted and does not ha ve a
266	255		complaint, allegation , or investigation pend ing in any regulatory
267	256		jurisdiction in the United States or in another country f or reasons
268	257		that relate to unprofessional condu ct unless the Division finds, to
269	258		its satisfaction, that the conduct has been corre cted or that
270	259		mitigating circumstances exist that prevent its resolution; and
	260	+	5. Has at least the minimum graduate or undergradu ate degree,
	261	+	appropriate for the level of certification, from an accredit ed

298		-	5. Has at least the minimum graduate or undergraduate degree,
299		-	appropriate for the level of certification, from an accredited
300	288		institution of higher learning in a qualifying field of study, as
301	289		determined by the Board.
302	290		C. A person holding a state license or state certi fication
303	291		shall apply for renewal of the state license or state certification
304	292		on or before April 30 of each odd -numbered year. The application
305	293		shall be accompanied by a renewal fee to be set by the Division
306	294		Developmental Disabilities Services in accordance with paragraph 3
307	295		of subsection F of th is section.
308	296		D. A person licensed or certified by the Developmental
309	297		Disabilities Services Division of the Department under this section
310	298		shall:
311	299		1. Maintain active s tatus and fulfill all requirements for
312	300		renewal of national certification or recertification with the Board;
313	301		and
314	302		2. Conduct professional activities in accordance w ith accepted
315	303		standards such as the Guidelines for Responsible Conduct and
316	304		Professional Disciplinary Standards of the Board Board's
317	305		Professional and Ethical Compliance Code for Behavior Analysts.
318	306		E. 1. No person shall claim the ti tle of licensed behavior
319	307		analyst or certified ass istant behavior analyst Board Certified
320	308		Behavior Analyst or Board Certified Assistant Behavior Analyst
321	309		unless that person meets the applicable requirements in this
	310	+	section. No person shall practice applied behavior analysis without
	311	+	obtaining a license or certification in accordance with this

349		-	section. No person shall practice applied behavior analysis without
350		-	obtaining a license or certification in accordance with this
351	338		section. Supervisees may only provide applied behav ior analysis
352	339		under the supervision of a licensed behavior analyst Board Certified
353	340		Behavior Analyst. This section shall not restrict the practice of
354	341		applied behavior analysis by human services professionals, provided
355	342		such individuals are working within the scope of their professions
356	343		and the practice of applied behavior analysis is commensurate with
357	344		their level of trainin g and experience.
358	345		2. A violation of this su bsection shall be punishable by a fine
359	346		of not more than Five Hundred Dollars ($500.00), the sus pension or
360	347		revocation of a license or certification issued pursuant to this
361	348		section, or both such fine and loss of li censure or certification.
362	349		F. The Division state licensure board operated by t he
363	350		Developmental Disabilities Services shall:
364	351		1. Investigate all complaints relating to :
365	352		a. the practice or supervision of applied behavior
366	353		analysis by any person licensed by th e Developmental
367	354		Disabilities Services Division of the Department as a
368	355		behavior analyst or certified by the Division as an
369	356		assistant behavior analyst Board Certified Behavior
370	357		Analyst or certified as a Board Certified Assistant
371	358		Behavior Analyst, or
	359	+	b. any person alleged to be practicing or providing
	360	+	supervision without a state license or state
	361	+	certification;

399		-	b. any person alleged to be practicing or providing
400		-	supervision without a state license or state
401		-	certification;
402	388		2. Refer any substantiated complaints to the Board ; and
403	389		3. Charge reasonable fees for a license or for certification,
404	390		not to exceed One Hundred Dollars ($100.00).
405	391		G. 1. A person having a qualifying degree, as provided for in
406	392		paragraph 5 of subsection B of this section, and participating in
407	393		the applied behavior analysis treatment pilot proje ct established in
408	394		Section 3 of this act shall be exempt from the requirements of this
409	395		section while such person is actively participating in the project.
410	396		2. Persons employed by a school district in this state who
411	397		provide services solely to the school dist rict under the Individuals
412	398		with Disabilities Education Act (IDEA), 20 U.S.C., Section 1400 et
413	399		seq., shall be exempt from the requirements of this section.
414	400		H. The supervisee shall not design intervention or assessment
415	401		plans. It shall be the responsibility of the supervising Board
416	402		Certified Behavior Analyst to determine which other tasks the
417	403		supervisee may perform as a function of the supervisee's training,
418	404		experience and competence. The Board Certified Behavior Analyst
419	405		shall be responsible for the work performed by the supervisee on the
420	406		cases overseen by the Board Certified Behavior Analyst.
421	407		I. A Board Certified Behavior Analyst, Board Certified
422	408		Assistant Behavior Analyst or Registered Behavior Technician who is
	409	+	a guardian or parent shall not provi de services to his or her own
	410	+	child or ward.

452	437		J. The Department Director of Human Services shall promulgate
453	438		rules to implement the provisions of this section.
454	439		SECTION 2. This act shall become effective November 1, 2021.
