83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. AMENDATORY 74 O.S. 2021, Section 10001, is
85	85	amended to read as follows:
86	86	Section 10001. A. By December 31, 2022, the Director of the
87	87	Office of Management and Enterprise Services ( OMES) shall initiate a
88	88	request for proposal for a third -party vendor to perform background
89	89	checks on behalf of all stat e agencies, boards, commissions, higher
90	90	education institutions, career technology, or common education
91	91	institutions. The purpose of this request for proposal is to

143	143	standardize the background check p rocess for state employees and
144	144	private sector partners wh o contract with the state. OMES is
145	145	authorized to enter into a contract for such services, pursuant to
146	146	the provisions of law.
147	147	B. Notice of the request for proposal shall be published in the
148	148	manner provided for competitive bidding. The contract shall be
149	149	awarded to the responsible offeror whose proposal i s determined to
150	150	achieve the desired goal of standardization of the background check
151	151	process for the state.
152	152	C. Any agency, board, commission, higher e ducation institution,
153	153	career technology or common educat ion institution shall contract
154	154	with the third-party vendor who is selected by OMES to perform
155	155	background checks. The state court system is encouraged to use the
156	156	third-party vendor to perform backgrou nd checks.
157	157	D. Any agency, board, commission, higher edu cation institution,
158	158	career technology or common ed ucation institution may contract with
159	159	a third-party vendor who is a member in good standing with the
160	160	National Association of Professional Background S creeners to perform
161	161	any and all employment screenings , background checks and credit
162	162	checks.
163	163	E. The Director shall promulgate rules and establish procedures
164	164	to implement the request for proposal pursuant to th is section.
165	165	SECTION 2. AMENDATORY 10A O.S. 2021, Section 1-8-109, is
166	166	amended to read as follows:

218	218	Section 1-8-109. A. Unless prohibited by state or federal law,
219	219	the Department shall develop, where feasible, an agency -wide process
220	220	for conducting background checks, fingerprinting, and personal care
221	221	applications. Any background checks conducted shall be in
222	222	compliance with Section 1 of this act.
223	223	B. The Department shall maintain limits on the number of
224	224	children a person is authorized to care for; however, a person shall
225	225	be permitted to provide multiple services where authorized.
226	226	SECTION 3. This act shall become effec tive November 1, 2022.
