AS INTRODUCED 
 
An Act relating to state government; amending 74 O.S. 
2021, Section 10001, which relates to state entities 
contracting with third -party vendors for employment 
screenings; requiring the Director of the Office of 
Management and Enterprise Services to initiate 
certain request for proposal; stating purpose; 
authorizing OMES to enter into contra ct; establishing 
procedure for providing notice an d for awarding 
contract; requiring certain state entities to use 
vendor selected by OMES; encouraging state court 
system to use contracted vendor ; amending 10A O.S. 
2021, Section 1-8-109, which relates to process for 
conducting background checks; requiring compliance 
with state law; and providing an effective d ate. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     74 O.S. 2021, Section 10001, is 
amended to read as follows: 
Section 10001. A.  By December 31, 2022, the Director of the 
Office of Management and Enterprise Services ( OMES) shall initiate a 
request for proposal for a third -party vendor to perform background 
checks on behalf of all stat e agencies, boards, commissions, higher 
education institutions, career technology, or common education 
institutions.  The purpose of this request for proposal is to

standardize the background check p rocess for state employees and 
private sector partners wh o contract with the state.  OMES is 
authorized to enter into a contract for such services, pursuant to 
the provisions of law. 
B.  Notice of the request for proposal shall be published in the 
manner provided for competitive bidding. The contract shall be 
awarded to the responsible offeror whose proposal i s determined to 
achieve the desired goal of standardization of the background check 
process for the state. 
C.  Any agency, board, commission, higher e ducation institution, 
career technology or common educat ion institution shall contract 
with the third-party vendor who is selected by OMES to perform 
background checks.  The state court system is encouraged to use the 
third-party vendor to perform backgrou nd checks. 
D. Any agency, board, commission, higher edu cation institution, 
career technology or common ed ucation institution may contract with 
a third-party vendor who is a member in good standing with the 
National Association of Professional Background S creeners to perform 
any and all employment screenings , background checks and credit 
checks. 
E. The Director shall promulgate rules and establish procedures 
to implement the request for proposal pursuant to th is section. 
SECTION 2.     AMENDATORY     10A O.S. 2021, Section 1-8-109, is 
amended to read as follows:

Section 1-8-109. A.  Unless prohibited by state or federal law, 
the Department shall develop, where feasible, an agency -wide process 
for conducting background checks, fingerprinting, and personal care 
applications. Any background checks conducted shall be in 
compliance with Section 1 of this act. 
B.  The Department shall maintain limits on the number of 
children a person is authorized to care for; however, a person shall 
be permitted to provide multiple services where authorized. 
SECTION 3.  This act shall become effec tive November 1, 2022.
