1949 An Act relating to s chools; amending Section 1,
2050 Chapter 333, O.S.L. 2014 (70 O.S. Supp. 2020, Section
2151 24-100.7), which relates to suicide awareness and

2353 school district boards of education to adopt certain
2454 policy; requiring boards of education to provide

3967 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

4168 SECTION 1. AMENDATORY Section 1, Chapter 333, O.S.L.
4269 2014 (70 O.S. Supp. 2020, Section 24 -100.7), is amended to read as

4598 Section 24-100.7. A. The board of education of each school
4699 district in this state may shall adopt a policy regarding suicide

49100 awareness and training , requiring staff training and the reporting
50101 of student drug abuse.

52102 B. The board of education of each school district in this state
53103 may shall provide schoolwide district-wide training to all students
54104 in grades seven through twelve and staff on a biennial basis
55105 addressing suicide awareness and prev ention. The Department of
56106 Mental Health and Substance Abuse Services shall develop and make
57107 available to school districts curriculum for staff which addresses
58108 suicide awareness and prevention, without cost to the school
59109 districts. The course outline for the curriculum shall be made
60110 available to the public online through the school district website.
61111 Beginning with the 2014-2015 2021-2022 school year, every school
62112 district may shall:

64113 1. Provide a suicide prevention training program which includes
65114 as a core element research-based evidence-based approaches and that
66115 is developed by the school district ;

68116 2. Provide the curriculum made available by the Department of
69117 Mental Health and Substance Abuse Services; or

71118 3. Provide a suicide prevention training program that is
72119 selected by the school district from a list maintained by the
73120 Department of Mental Health and Substance Abuse Services to students
74121 and school district staff that addresses suicide awareness and

75149 prevention. The training program may be combined wit h any other
76150 training provided by the school district addressing bullying
77151 prevention.

79152 C. Beginning with the 2022 -2023 school year, the board of
80153 education of each school district may provide training to address
81154 suicide awareness and prevention to students i n grades seven through
82155 twelve.

84156 D. Teachers, counselors, principals, administrators and other
85157 school personnel shall be immune from employment discipline and any
86158 civil liability for:
87-
88159 1. Calling the 911 emergency telephone number, law enforcement
89160 or the Department of Human Services if they believe a student poses
90-

92161 a threat to themselves or others or if a student has committed or
93162 been the victim of a violent act or threat of a violent act;
94-
95163 2. Providing referral, emergency medical care or other
96164 assistance offered in good faith to a student or other youth; or

98165 3. Communicating information in good faith concerning drug or
99166 alcohol abuse or a potential safety threat by or to any student to
100167 the parents or legal guardians of the student, law enforcement
101168 officers or health care providers.

103169 D. E. No person shall have a cause of action for any loss or
104170 damage caused by any act or omission resulting from the
105171 implementation of this section or resulting from any training, or

106199 lack thereof, required by this section, unless th e loss or damage
107200 was caused by willful or wanton misconduct.

109201 E. F. The training required pursuant to this section, or the
110202 lack thereof, shall not be construed to impose any specific duty of
111203 care.

113204 F. School districts G. The board of education of each sch ool
114205 district may enter into agreements with designated Youth Services
115206 Agencies for the provision of intervention and prevention services.

117207 G. H. Teachers, counselors, principals, administrators , or
118208 other school personnel, upon determining that a student is at risk
119209 of attempting suicide, shall notify the parents or legal guardians
120210 of the student immediately upon determining that such risk exists.

122211 SECTION 2. This act shall become effective July 1, 2021.

124212 SECTION 3. It being immediately necessary for the preservation
125213 of the public peace, health or safety, an emergency is hereby
126214 declared to exist, by reason whereof this act shall take effect and
127215 be in full force from and after its passage and approval.
