30	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	58		SECTION 1. AMENDATORY 57 O.S. 2011, Section 332.18, as
33	59		last amended by Section 1, Chapter 42, O.S.L. 2015 (57 O.S. Supp.
34	60		2020, Section 332.18), is amended t o read as follows:
35		-
36	61		Section 332.18. A. The Director of the Department of
37	62		Corrections shall have the authority to request the Executive
38	63		Director of the Pardon and Parole Board to place an inmate on the
39	64		Pardon and Parole Board docket for a medical reason, o ut of the
40	65		normal processing procedures. Documentation of the medical
41	66		condition of such inmate shall be certified by the medical director

42	94		of the Department of Corrections. The Pardon and Parole Board shall
43	95		have the authority to bring any such inmate befor e the Board at any
44	96		time, except as otherwise provided in subsection B of this section.

48	97		B. When a request is made for a medical parole review of an
49	98		inmate who is dying or is near death or is medically frail or is
50	99		medically vulnerable as defined in subsecti on F of this section as
51	100		certified by the medical director of the Department of Corrections
52	101		or whose medical condition has rendered the inmate no longer an
53	102		unreasonable threat to public safety, the Executive Director shall
54	103		place such inmate on the first ava ilable parole review docket for a
55	104		compassionate parole consideration. Inmates who meet the criteria
56	105		set out in this section are not subject to the two -stage hearing
57	106		process in subsection C D of Section 332.7 of this title.

59	107		C. No person shall be eligible for consideration for medical
60	108		parole without the concurrence of at least three members of the
61	109		Pardon and Parole Board. The vote on whether or not to consider
62	110		such person for parole and the names of the concurring Board members
63	111		shall be set forth in the wr itten minutes of the meeting of the
64	112		Board at which the issue is considered.

66	113		D. In the event that due to changes in the medical condition of
67	114		the parolee granted medical parole or for other reasons, it is
68	115		determined that the continuation of the medical paro le presents an
69	116		increased risk to the public, the parolee shall be subject to parole
70	117		revocation. In such case, the Department of Corrections shall

71	145		follow the revocation procedure for violators of parole set forth in
72	146		Section 516 of this title.

74	147		E. The provisions of this section shall not apply to inmates
75	148		serving a sentence of life without possibility of parole.

77	149		F. As used in this section:
78		-
79	150		1. “Medically frail” means an individual with a medical
80	151		condition which precludes the individual from performing two or more
81	152		activities of daily living on their own;
82		-
83	153		2. “Medically vulnerable ” means an individual with one or more
84	154		medical conditions which makes the individual more likely to
85	155		contract an illness or disease while incarcerated that could lead to
86	156		death or cause an individual to become medically frail. The
87	157		provisions of this subsection shall only apply during a catastrophic
88	158		health emergency as declared by the Governor of this state pursuant

91	159		to the provisions of Section 6403 of Title 63 of the Oklahoma
92	160		Statutes;

94	161		3. “Medical condition” includes, but is not limited to,
95	162		debilitating health conditions occurring as a result of the
96	163		following:

98	164		a. disabling mental disorders including dementia,
99	165		Alzheimer’s disease or similar degenerative brain
100	166		disorders,
101		-
102	167		b. Human Immunodeficiency Virus (HIV) or Acquired Immune
103	168		Deficiency Syndrome (AIDS),

121	205		sclerosis (MS) or amyotrophic lateral sclerosis (ALS),

124	207		k. any other condition related to a weakened immune
125	208		system or condition that requires or is expected to
126	209		require specialty care or recurrent hospitalizations;

128	210		4. “Activities of daily living ” means basic personal care and
129	211		everyday activities including tasks such as eating, toileting,
130	212		grooming, dressing, bathing and transferring from one physical
131	213		position to another including moving from a reclining position to a

134	214		sitting or standing position, that a person cannot perform on his or
135	215		her own; and

137	216		5. “Dying” or “near death” means an individual with a medical
138	217		condition and who has an estimated life expectancy of six (6) months
139	218		or less.
