31	60		SECTION 1. AMENDATORY 59 O.S. 2021, Section 725.1, is
32	61		amended to read as follows:

34	62		Section 725.1. A. Every person who writes or prints, or causes
35	63		to be written or printed, his or her name (whether or not the word
36	64		"Doctor", or an abbreviation thereof, is used in co nnection
37	65		therewith) in connection with , as engaging in, or holding himself or
38	66		herself out as engaging in, any of the branches of the healing art

54	105		SECTION 2. AMENDATORY 59 O.S. 20 21, Section 725.2, is

58	108		may use the word "Doctor", or an abbreviation thereof, and shall
59	109		have the right to use, whether or not in conjunction wi th the word

113	205		Therapy by a person licensed to practice phy sical therapy under the
114	206		Physical Therapy Practice Act who has earned a Doctor of Physical
115	207		Therapy degree from a program approved by a national accreditin g
116	208		body recognized by the State Board of Medical Licensure and
117	209		Supervision.

119	210		B. Unless otherwise specifi cally provided in a particular
120	211		section or chapter of the Oklahoma Statutes, the word "doctor" or
121	212		"doctors" shall mean and include each of the nine ten classes of
122	213		persons listed in subsection A and the word "physician" or
123	214		"physicians", as provided in subsec tion C of this section. Any
124	215		other person using the term doctor, or a ny abbreviation thereof,
125	216		shall designate the authority under which the title is used or the
126	217		college or honorary degree that gives rise to use of the title.

137	252		section unless such pers on is otherwise authorized to use such
138	253		designation pursuant to th is section.

140	254		D. For purposes of this section, "provider" means and includes:

142	255		l. Each of the nine ten classes of persons listed in subsection
143	256		A of this section and referred to in subsectio ns B and C of this
144	257		section; and

146	258		2. Any other person using the term doctor or any abbreviation
147	259		thereof.

149	260		E. Persons in each of the nine ten classes listed in subsec tion
150	261		A of this section, and referred to in subsections B and C, of this
151	262		section shall identify through written notice, which may include the
152	263		wearing of a name tag, the type of license under which the doctor is
153	264		practicing, utilizing the designations provided in subsections A, B
154	265		and C of this section. Each applic able licensing board is
155	266		authorized by rule to determine how its license holders may comply
156	267		with this disclosure requirement.

158	268		F. 1. Any advertisement for health care services naming a
159	269		provider shall:

169	304		branch of the healing art in which the person is

172	307		in subsection A of this section, or referred to in
173	308		subsections B and C of this section.

175	309		2. The term "advertisement" includes any printed document
176	310		including letterhead, video clip, or audio clip created by, for, or

179	311		at the direction of the provider or providers and advert ised for the
180	312		purpose of promoting the services of the doctor or provider.

182	313		G. 1. It shall be unlawful for any medical doctor, doctor of
183	314		osteopathic medicine, doctor of dental surgery, doctor of dental
184	315		medicine, doctor of optometry, doctor of podiatry, or doctor of
185	316		chiropractic to make any de ceptive or misleading statement, or
186	317		engage in any deceptive or misleading act, that deceives or mislead s
187	318		the public or a prospective or current patient, regarding the
188	319		training and the license under which the person is a uthorized to
189	320		practice.

196	351		b. making a false statement regarding the education,
197	352		skills, training, or licensure of a pe rson, or

199	353		c. in any other way describin g the profession, skills,
200	354		training, expertise, education, or licensure of a
201	355		person in a fashion that ca uses the public, a
202	356		potential patient, or current patient to believe that
203	357		the person is a medical doctor, doctor of o steopathic
204	358		medicine, doctor of dental surgery, doctor of dental
205	359		medicine, doctor of optometry, doctor of podiatry, or
206	360		doctor of chiropractic when that person does not hold
207	361		such credentials.

209	362		H. Notwithstanding any other provision of this section, a
210	363		person licensed in this state to perform spe ech pathology or
211	364		audiology services is designa ted to be a practitioner of the healing
212	365		art for purposes of making a referral for speech pathology or
213	366		audiology services pursuant to the provisions of the Individuals
214	367		with Disabilities Education Act, Amendment of 1997, Public Law 105-
215	368		17, and Section 504 of the Rehabilitation Act of 1973.

222	398		Section 731.2. A. Proof that any class of persons identified
223	399		in Section 725.2 of this title appends to their name the word
224	400		"Doctor", the abbreviation "Dr.", or any other word, abbreviation or
225	401		designation, which word, abbreviation or designation, indicate t hat
226	402		such person is qualified for diagnosis or treatment, as herein
227	403		defined, shall constitute prima facie evidence that such person is
228	404		holding himself or herself out, with in the meaning of this act
229	405		Sections 731.1 through 731.6 of thi s title, as qualified to engage
230	406		in diagnosis or treatment.

232	407		B. Nothing in this section shal l be construed to prevent a
233	408		person specified in paragraphs 7 through 9 10 of subsection A of
234	409		Section 725.2 of this title from appending to such person 's name the
235	410		word "Doctor", so long as such person follows such name and
236	411		designation with the letters signi fying the recognized doctoral
237	412		degrees specified in paragraphs 7 through 9 10 of subsection A of
238	413		Section 725.2 of this title.

240	414		SECTION 4. AMENDATORY 59 O.S. 20 21, Section 731.5, is
241	415		amended to read as follows:

243	416		Section 731.5. Nothing in this act Sections 731.1 through 731.6
244	417		of this title shall apply to:

246	418		1. Any commissioned officer in any of the healing arts licensed
247	419		as such in the United States Army, Navy, Marines, Public Health
248	420		Service, or Marine Hospital Service, in the discharge o f the
249	421		professional duties of such officer;

259	455		4. Any physician's trained assistant who is assisting a
260	456		licensed physician to render services within the licensed scope of
261	457		practice of the physician, if the assistant is under the supervision

266	459		5. Any student in any recognized school of the healing arts in
267	460		carrying out prescribed courses of study provided such school is a
268	461		recognized institution by the statutes of Oklahoma, and its
269	462		practitioners are duly licensed as prescribed by law;

271	463		6. The practice of those who endeavor to prevent, or cure ,
272	464		disease or suffering, by spiritual means or prayer; or
273		-
274	465		7. Any legally qualified person specified in paragraphs 7
275	466		through 9 10 of subsection A of Secti on 725.2 of this title in the
276	467		discharge of the professional duties of the person, so long as such
277	468		person is employed by any state or governmental agency, or any
278	469		recognized college or university.

280	470		SECTION 5. AMENDATORY 59 O.S. 2021, Section 887.14, is

295	510		SECTION 6. AMENDATORY 63 O.S. 20 21, Section 1-116, is

301	514		1. "Board" means the State Board of Health;

303	515		2. "Commissioner" means the State Commissioner of Health;

329	561		assigned for purposes of statistical and data analy sis, which
330	562		protects and maintains patient and physician anonymity. Identifying
331	563		information shall remain confidential as provided in Section 1 -120

334	565		8. "Information providers" means and includes health ca re
335	566		providers, third-party payors or public-supported providers required
336	567		to report or submit information to the Division of Health Care
337	568		Information pursuant to the Oklahoma Health Care Information Sys tem

340	570		9. "Division" means the Division of Health Care Information;
