105179 SECTION 1. AMENDATORY 59 O.S. 2011, Section 328.3, as
106180 last amended by Section 1, Chapter 397, O.S.L. 2019 (59 O.S. Supp.
107181 2020, Section 328.3), is amended to read as follows:

109182 Section 328.3. As used in the State Dental Act, the following
110183 words, phrases, or terms, unless the context otherwise indicates,
111184 shall have the follo wing meanings:

113185 1. "Accredited dental college " means an institution whose
114186 dental educational pro gram is accredited by th e Commission on Dental
115187 Accreditation of the American Dental Association;
116-
117188 2. "Accredited dental hygiene program " means a dental hygiene
118189 educational program which is accredited by the Commission on Dental
119190 Accreditation of the America n Dental Association;
120-
121191 3. "Accredited dental assisting program " means a dental
122192 assisting program which is accredited by the Commission on Dental
123193 Accreditation of the American Dental Association;

125194 4. "Board" means the Board of Dentistry;

127195 5. "Certified dental assistant" means a dental assistant who
128196 has earned and maintains current certified dental assistant
129197 certification from the Dental Assisting National Board (D ANB);

131198 6. "Coronal polishing" means a procedure limited to the removal
132199 of plaque and stain from exposed tooth surfaces, utilizing a slow

140230 7. "Deep sedation" means a drug-induced depression of
141231 consciousness during which patients cannot be easily aroused but
142232 respond purposefully following repeated or painfu l stimulation. The
143233 ability to independently maintain ventilator function may be
144234 impaired. Patients may require assista nce in maintaining a patent
145235 airway, and spontaneous ventilation may be inadequate.
146236 Cardiovascular function is usually maintained;

148237 8. "Dentistry" means the practice of dentistry in all of its
149238 branches;

151239 9. "Dentist" means a graduate of an accredited denta l college
152240 who has been issued a license by the Board to practice dentistry as
153241 defined in Section 328.19 of this title;

155242 10. "Dental ambulatory surgical center (DASC) " means a facility
156243 that operates exclusively for the purpose of fur nishing outpatient
157244 surgical services to patients. A DASC shall have the same
158245 privileges and requirements as a dental office and additionally must
159246 be an accredited facility by the appropriate entity;

161247 11. "Dental office" means an establishment owned and op erated
162248 by a dentist for the practice of dentistry, which may be composed of

163275 reception rooms, business offices, private offices, laboratories,
164276 and dental operating rooms where dental operations are performed;

166277 12. "Dental hygienist" means an individual who has fulfilled
167278 the educational requirements and is a graduate of an accredited
168279 dental hygiene program and who has passed an examination and has
169280 been issued a license by the Board and who is authorized to practice
170281 dental hygiene as hereinafter defined;
171-
172282 13. "Dental assistant or ora l maxillofacial surgery assistant "
173283 means an individual working for a dentist, under the dentist 's
174284 direct supervision or direct visual su pervision, and performing
175285 duties in the dental office or a treatment facility , including the
176286 limited treatment of patien ts in accordance with the provisions of
177287 the State Dental Act. A dental assistant or oral maxillofacial
178288 surgery assistant may assist a d entist with the patient; provided,

181289 this shall be done only under the direct supervision or direc t
182290 visual supervision and control of the dentist and only in accordance
183291 with the educational requirements and rules promulgated by the
184292 Board;

186293 14. "Dental laboratory" means a location, whether in a dental
187294 office or not, where a dentist or a dental laborator y technician
188295 performs dental laboratory technology;
189-
190296 15. "Dental laboratory technician " means an individual whose
191297 name is duly filed in the official records of the Board, which
192298 authorizes the technician, upon the laboratory prescription of a

193325 dentist, to perform dental laboratory technology, which services
194326 must be rendered only to the prescribing dentist and not to the
195327 public;

197328 16. "Dental laboratory technology " means using materials and
198329 mechanical devices for the construction, reproduction or repair of
199330 dental restorations, applian ces or other devices to be worn in a
200331 human mouth;
201-
202332 17. "Dental specialty" means a specialized practice of a branch
203333 of dentistry, recogni zed by the Board, where the dental college and
204334 specialty program are accredited by the Commissio n on Dental
205335 Accreditation (CODA), or a dental specialty recognized by the Board,
206336 requiring a minimum number of hours of approved education and
207337 training and/or recognition by a nationally recognized association
208338 or accreditation board;

210339 18. "Direct supervision" means the supervisor y dentist is in
211340 the dental office or treatment facility and, during the appointment,
212341 personally examines the patient, diagnoses any cond itions to be
213342 treated, and authorizes the procedures to be performed by a dental
214343 hygienist, dental assistant, or oral max illofacial surgery
215344 assistant. The supervising dentist is continuously on -site and
216345 physically present in the dental office or treatment facility while
217346 the procedures are being performed and, before dismissal of the
218347 patient, evaluates the results of the den tal treatment;

220374 19. "Direct visual supervision " means the supervisory dentist
221375 has direct ongoing visual oversight which shall be maintai ned at all

224376 times during any procedure authorized to be performed by a dental
225377 assistant or an oral maxillofacial surgery assistant;

227378 20. "Fellowship" means a program designed for post -residency
228379 graduates to gain knowledge and experience in a specialized fie ld;
229-
230380 21. "General anesthesia" means a drug-induced loss of
231381 consciousness during which patients a re not arousable, even b y
232382 painful stimulation. The ability to independently maintain
233383 ventilator function is often impaired. Patients often require
234384 assistance in maintaining a patent airway, and positive pressure
235385 ventilation may be required because of dep ressed spontaneous
236386 ventilation or drug-induced depression of neuromuscular function.
237387 Cardiovascular function may be impaired;
238-
239388 22. "General supervision" means the supervisory dentist has
240389 diagnosed any conditions to be treated within the past thirteen (13)
241390 months, has personally authorized the procedures to be performed by
242391 a dental hygienist, and will evaluate the results of the dental
243392 treatment within a reasonab le time as determined by the nature of
244393 the procedures performed, the needs of the patient, and t he
245394 professional judgment of the supervisory dentist. General
246395 supervision may only be used to supervise a hygienist and may not be
247396 used to supervise an oral max illofacial surgery assistant or dental
248397 assistant;

250424 23. "Indirect supervision " means the supervisory dentist is in
251425 the dental office or treatment facility and has personally diagnosed
252426 any conditions to be treated, authorizes the procedures to be
253427 performed by a dental hygienist, remains in the dental office or
254428 treatment facility while the procedures ar e being performed, and
255429 will evaluate the results of the dental treatment within a
256430 reasonable time as determined by the nature of the procedures
257431 performed, the needs of the patient, and the professional judgment
258432 of the supervisory dentist. Indirect supervi sion may not be used
259433 for an oral maxillofacial surgery assistant or a dental assistant;

261434 24. "Investigations" means an investigation proceeding,
262435 authorized under Sections 328.15A and 328.43a of this title, to
263436 investigate alleged violations of the State Den tal Act or the rules
264437 of the Board;

268438 25. "Laboratory prescription " means a written description,
269439 dated and signed by a dentist, of dental laboratory technology to be
270440 performed by a dental laboratory technician;

272441 26. "Minimal sedation" means a minimally depre ssed level of
273442 consciousness, produced by a pharmacological method, that retains
274443 the patient's ability to independently and continuously maintain an
275444 airway and respond normally to tactile stimulation and verbal
276445 command. Although cognitive function and coor dination may be
277446 modestly impaired, ventilator and cardiovascular functions are
278447 unaffected;

280474 27. "Mobile dental anesthesia provider " means a licensed and
281475 anesthesia-permitted dentist, physician or certified registered
282476 nurse anesthetist (CRNA) that has a mob ile dental unit and prov ides
283477 anesthesia in dental offices and facilities in the state;
284-
285478 28. "Mobile dental clinic " means a permitted motor vehicle or
286479 trailer utilized as a dental clinic, and/or that contains dental
287480 equipment and is used to provide dental s ervices to patients on -site
288481 and shall not include a mobile dental anesthesia provider. A mobile
289482 dental clinic shall also mean and include a volunteer mobile de ntal
290483 facility that is directly affiliated with a church or religious
291484 organization as defined by Section 501(c)(3) or 501 (d) of the United
292485 States Internal Revenue Code, the church or religious organization
293486 with which it is affiliated is clearly indicated on the exterior of
294487 the mobile dental facility, and such facility does not receive any
295488 form of payment either directly or i ndirectly for work provided to
296489 patients other than donations through the affiliated church or
297490 religious organization; provided, that the volunteer mobile dental
298491 facility shall be exempt from any registration fee required under
299492 the State Dental Act;

301493 29. "Moderate sedation" means a drug-induced depression of
302494 consciousness during which patients respond purposefully to verbal
303495 commands, either alone or accompanied by light tactile stimulation.

313528 by scaler or periodontal curette on the crown and root surfaces of
314529 human teeth including rotary or power -driven instruments. This
315530 procedure may only be performed by a dentist or dental hygienist;

317531 31. "Patient" or "patient of record" means an individual who
318532 has given a medical history and has been examined and accepted by a
319533 dentist for dental care;

321534 32. "Residencies" are programs designed for advanced clinical
322535 and didactic training in general dentistry or other specialties or
323536 other specialists at the post-doctoral level recognized by the
324537 Commission on Dental Accreditation (CODA) or the Board;
325-
326538 33. "Supervision" means direct supervision, direct visual
327539 supervision, indirect supervision or general supervision; and
328-
329540 34. "Teledentistry" means the remote delivery of dental patient
330541 care via telecommunications and other technology for the exchange of
331542 clinical information and i mages for dental consultation, preliminary
332543 treatment planning and patient monitoring; and

334544 35. "Treatment facility" means:

336545 a. a federal, tribal, state or local public health

368589 SECTION 2. AMENDATORY 59 O.S. 2011, Section 328.21, as
369590 last amended by Section 3, Chapter 397, O.S.L. 2019 (59 O.S. Supp.
370591 2020, Section 328.21), is amended to read as follows:

372592 Section 328.21. A. No person shall practice dentistry or
373593 dental hygiene without first applying for and obtaining a license
374594 from the Board of Dentistry.

376621 B. Application shall be made to the Board in writing and shall
377622 be accompanied by the fee established by the rules of the Board,
378623 together with satisfactory proo f that the applicant:

380624 1. Is of good moral character;

382625 2. Is twenty-one (21) years of age, or over, at the time of
383626 making application to practice dentistry or e ighteen (18) years of
384627 age, or over, if the applicant is to practice dental hygiene;

386628 3. Has passed a written theoretical examination and a clinical
387629 examination approved by the Board; and

389630 4. Has passed a written jurisprudence examination over the
390631 rules and laws affecting dentistry in this state.

392632 C. An application from a candidate who desires to secu re a
393633 license from the Board to practice dentistry or dental hygiene in
394634 this state shall be accompanied by satisfactory proof that the

406641 Examination or the National Board Dental Hygiene Examination.
