105	179		SECTION 1. AMENDATORY 59 O.S. 2011, Section 328.3, as
106	180		last amended by Section 1, Chapter 397, O.S.L. 2019 (59 O.S. Supp.
107	181		2020, Section 328.3), is amended to read as follows:

109	182		Section 328.3. As used in the State Dental Act, the following
110	183		words, phrases, or terms, unless the context otherwise indicates,
111	184		shall have the follo wing meanings:
112		-
113	185		1. "Accredited dental college " means an institution whose
114	186		dental educational pro gram is accredited by th e Commission on Dental
115	187		Accreditation of the American Dental Association;
116		-
117	188		2. "Accredited dental hygiene program " means a dental hygiene
118	189		educational program which is accredited by the Commission on Dental
119	190		Accreditation of the America n Dental Association;
120		-
121	191		3. "Accredited dental assisting program " means a dental
122	192		assisting program which is accredited by the Commission on Dental
123	193		Accreditation of the American Dental Association;
124		-
125	194		4. "Board" means the Board of Dentistry;
126		-
127	195		5. "Certified dental assistant" means a dental assistant who
128	196		has earned and maintains current certified dental assistant
129	197		certification from the Dental Assisting National Board (D ANB);

131	198		6. "Coronal polishing" means a procedure limited to the removal
132	199		of plaque and stain from exposed tooth surfaces, utilizing a slow

138	229		dentist;

140	230		7. "Deep sedation" means a drug-induced depression of
141	231		consciousness during which patients cannot be easily aroused but
142	232		respond purposefully following repeated or painfu l stimulation. The
143	233		ability to independently maintain ventilator function may be
144	234		impaired. Patients may require assista nce in maintaining a patent
145	235		airway, and spontaneous ventilation may be inadequate.
146	236		Cardiovascular function is usually maintained;
147		-
148	237		8. "Dentistry" means the practice of dentistry in all of its
149	238		branches;
150		-
151	239		9. "Dentist" means a graduate of an accredited denta l college
152	240		who has been issued a license by the Board to practice dentistry as
153	241		defined in Section 328.19 of this title;
154		-
155	242		10. "Dental ambulatory surgical center (DASC) " means a facility
156	243		that operates exclusively for the purpose of fur nishing outpatient
157	244		surgical services to patients. A DASC shall have the same
158	245		privileges and requirements as a dental office and additionally must
159	246		be an accredited facility by the appropriate entity;

161	247		11. "Dental office" means an establishment owned and op erated
162	248		by a dentist for the practice of dentistry, which may be composed of

164	276		and dental operating rooms where dental operations are performed;

166	277		12. "Dental hygienist" means an individual who has fulfilled
167	278		the educational requirements and is a graduate of an accredited
168	279		dental hygiene program and who has passed an examination and has
169	280		been issued a license by the Board and who is authorized to practice
170	281		dental hygiene as hereinafter defined;
171		-
172	282		13. "Dental assistant or ora l maxillofacial surgery assistant "
173	283		means an individual working for a dentist, under the dentist 's
174	284		direct supervision or direct visual su pervision, and performing
175	285		duties in the dental office or a treatment facility , including the
176	286		limited treatment of patien ts in accordance with the provisions of
177	287		the State Dental Act. A dental assistant or oral maxillofacial
178	288		surgery assistant may assist a d entist with the patient; provided,

181	289		this shall be done only under the direct supervision or direc t
182	290		visual supervision and control of the dentist and only in accordance
183	291		with the educational requirements and rules promulgated by the
184	292		Board;

186	293		14. "Dental laboratory" means a location, whether in a dental
187	294		office or not, where a dentist or a dental laborator y technician
188	295		performs dental laboratory technology;
189		-
190	296		15. "Dental laboratory technician " means an individual whose
191	297		name is duly filed in the official records of the Board, which
192	298		authorizes the technician, upon the laboratory prescription of a

194	326		must be rendered only to the prescribing dentist and not to the
195	327		public;

197	328		16. "Dental laboratory technology " means using materials and
198	329		mechanical devices for the construction, reproduction or repair of
199	330		dental restorations, applian ces or other devices to be worn in a
200	331		human mouth;
201		-
202	332		17. "Dental specialty" means a specialized practice of a branch
203	333		of dentistry, recogni zed by the Board, where the dental college and
204	334		specialty program are accredited by the Commissio n on Dental
205	335		Accreditation (CODA), or a dental specialty recognized by the Board,
206	336		requiring a minimum number of hours of approved education and
207	337		training and/or recognition by a nationally recognized association
208	338		or accreditation board;

210	339		18. "Direct supervision" means the supervisor y dentist is in
211	340		the dental office or treatment facility and, during the appointment,
212	341		personally examines the patient, diagnoses any cond itions to be
213	342		treated, and authorizes the procedures to be performed by a dental
214	343		hygienist, dental assistant, or oral max illofacial surgery
215	344		assistant. The supervising dentist is continuously on -site and
216	345		physically present in the dental office or treatment facility while
217	346		the procedures are being performed and, before dismissal of the
218	347		patient, evaluates the results of the den tal treatment;

220	374		19. "Direct visual supervision " means the supervisory dentist
221	375		has direct ongoing visual oversight which shall be maintai ned at all

224	376		times during any procedure authorized to be performed by a dental
225	377		assistant or an oral maxillofacial surgery assistant;
226		-
227	378		20. "Fellowship" means a program designed for post -residency
228	379		graduates to gain knowledge and experience in a specialized fie ld;
229		-
230	380		21. "General anesthesia" means a drug-induced loss of
231	381		consciousness during which patients a re not arousable, even b y
232	382		painful stimulation. The ability to independently maintain
233	383		ventilator function is often impaired. Patients often require
234	384		assistance in maintaining a patent airway, and positive pressure
235	385		ventilation may be required because of dep ressed spontaneous
236	386		ventilation or drug-induced depression of neuromuscular function.
237	387		Cardiovascular function may be impaired;
238		-
239	388		22. "General supervision" means the supervisory dentist has
240	389		diagnosed any conditions to be treated within the past thirteen (13)
241	390		months, has personally authorized the procedures to be performed by
242	391		a dental hygienist, and will evaluate the results of the dental
243	392		treatment within a reasonab le time as determined by the nature of
244	393		the procedures performed, the needs of the patient, and t he
245	394		professional judgment of the supervisory dentist. General
246	395		supervision may only be used to supervise a hygienist and may not be
247	396		used to supervise an oral max illofacial surgery assistant or dental
248	397		assistant;

250	424		23. "Indirect supervision " means the supervisory dentist is in
251	425		the dental office or treatment facility and has personally diagnosed
252	426		any conditions to be treated, authorizes the procedures to be
253	427		performed by a dental hygienist, remains in the dental office or
254	428		treatment facility while the procedures ar e being performed, and
255	429		will evaluate the results of the dental treatment within a
256	430		reasonable time as determined by the nature of the procedures
257	431		performed, the needs of the patient, and the professional judgment
258	432		of the supervisory dentist. Indirect supervi sion may not be used
259	433		for an oral maxillofacial surgery assistant or a dental assistant;
260		-
261	434		24. "Investigations" means an investigation proceeding,
262	435		authorized under Sections 328.15A and 328.43a of this title, to
263	436		investigate alleged violations of the State Den tal Act or the rules
264	437		of the Board;

268	438		25. "Laboratory prescription " means a written description,
269	439		dated and signed by a dentist, of dental laboratory technology to be
270	440		performed by a dental laboratory technician;
271		-
272	441		26. "Minimal sedation" means a minimally depre ssed level of
273	442		consciousness, produced by a pharmacological method, that retains
274	443		the patient's ability to independently and continuously maintain an
275	444		airway and respond normally to tactile stimulation and verbal
276	445		command. Although cognitive function and coor dination may be
277	446		modestly impaired, ventilator and cardiovascular functions are
278	447		unaffected;

280	474		27. "Mobile dental anesthesia provider " means a licensed and
281	475		anesthesia-permitted dentist, physician or certified registered
282	476		nurse anesthetist (CRNA) that has a mob ile dental unit and prov ides
283	477		anesthesia in dental offices and facilities in the state;
284		-
285	478		28. "Mobile dental clinic " means a permitted motor vehicle or
286	479		trailer utilized as a dental clinic, and/or that contains dental
287	480		equipment and is used to provide dental s ervices to patients on -site
288	481		and shall not include a mobile dental anesthesia provider. A mobile
289	482		dental clinic shall also mean and include a volunteer mobile de ntal
290	483		facility that is directly affiliated with a church or religious
291	484		organization as defined by Section 501(c)(3) or 501 (d) of the United
292	485		States Internal Revenue Code, the church or religious organization
293	486		with which it is affiliated is clearly indicated on the exterior of
294	487		the mobile dental facility, and such facility does not receive any
295	488		form of payment either directly or i ndirectly for work provided to
296	489		patients other than donations through the affiliated church or
297	490		religious organization; provided, that the volunteer mobile dental
298	491		facility shall be exempt from any registration fee required under
299	492		the State Dental Act;

301	493		29. "Moderate sedation" means a drug-induced depression of
302	494		consciousness during which patients respond purposefully to verbal
303	495		commands, either alone or accompanied by light tactile stimulation.

313	528		by scaler or periodontal curette on the crown and root surfaces of
314	529		human teeth including rotary or power -driven instruments. This
315	530		procedure may only be performed by a dentist or dental hygienist;

317	531		31. "Patient" or "patient of record" means an individual who
318	532		has given a medical history and has been examined and accepted by a
319	533		dentist for dental care;

321	534		32. "Residencies" are programs designed for advanced clinical
322	535		and didactic training in general dentistry or other specialties or
323	536		other specialists at the post-doctoral level recognized by the
324	537		Commission on Dental Accreditation (CODA) or the Board;
325		-
326	538		33. "Supervision" means direct supervision, direct visual
327	539		supervision, indirect supervision or general supervision; and
328		-
329	540		34. "Teledentistry" means the remote delivery of dental patient
330	541		care via telecommunications and other technology for the exchange of
331	542		clinical information and i mages for dental consultation, preliminary
332	543		treatment planning and patient monitoring; and
333		-
334	544		35. "Treatment facility" means:

336	545		a. a federal, tribal, state or local public health

366	588		l. such other places as are authorized by the Board.

368	589		SECTION 2. AMENDATORY 59 O.S. 2011, Section 328.21, as
369	590		last amended by Section 3, Chapter 397, O.S.L. 2019 (59 O.S. Supp.
370	591		2020, Section 328.21), is amended to read as follows:
371		-
372	592		Section 328.21. A. No person shall practice dentistry or
373	593		dental hygiene without first applying for and obtaining a license
374	594		from the Board of Dentistry.

376	621		B. Application shall be made to the Board in writing and shall
377	622		be accompanied by the fee established by the rules of the Board,
378	623		together with satisfactory proo f that the applicant:

380	624		1. Is of good moral character;

382	625		2. Is twenty-one (21) years of age, or over, at the time of
383	626		making application to practice dentistry or e ighteen (18) years of
384	627		age, or over, if the applicant is to practice dental hygiene;
385		-
386	628		3. Has passed a written theoretical examination and a clinical
387	629		examination approved by the Board; and
388		-
389	630		4. Has passed a written jurisprudence examination over the
390	631		rules and laws affecting dentistry in this state.

392	632		C. An application from a candidate who desires to secu re a
393	633		license from the Board to practice dentistry or dental hygiene in
394	634		this state shall be accompanied by satisfactory proof that the
395	635		applicant:

492	773		F. The Board shall require every applicant for a license to
493	774		practice dentistry or dental hygiene to submit, for the files of the
494	775		Board, a copy of a dental degree or dental hygiene degree, an
495	776		official transcript, a recent photograph duly identif ied and
496	777		attested, and any other information as required by the Board.

498	778		G. Any applicant who fails to pass the jurisprudence
499	779		examination may apply for a second e xamination, in which case the
500	780		applicant shall pay a reexamination fee as established by the
501	781		statutes or rules of the State Dental Act.

503	782		H. Any applicant who fails to pass the clinical examination as
504	783		described in paragraph 4 of subsection C of this section may be
505	784		given credit for such subjects as the Board may allow, but such
506	785		credits shall be extended only to the succeeding ex aminations. If
507	786		the applicant fails to pass a second examination, before further re -
508	787		examination, the Board may require evidence of add itional education,
509	788		as specified by the Board. After a third examination, the Board may
510	789		deny the applicant another examina tion.

561	878		examination format, not to exceed one (1) year.

563	879		L. During a year in which governmental officials h ave declared
564	880		a health pandemic, a state or federal disaster, or other natural or
565	881		man-made disaster, the Board shall h ave the authority through a
566	882		resolution to change or make allowances in requirements of all
567	883		candidates for licensure and issue temporary lic enses for extended
568	884		periods of time or as needed until the event passes. The resolution
569	885		shall have a beginning and an end date and shall automatically
570	886		expire no less than thirty (30) days after the end of the disaster
571	887		is declared by governmental officials.

718	1124		persons of the state. The special volunteer license shall be:

720	1125		1. Issued by the Board of Dentistry to eligible persons;

722	1126		2. Issued without the payment of an application fee, license
723	1127		fee or renewal fee;

725	1128		3. Issued or renewed without any continuing education
726	1129		requirements for a period less than one (1) calendar year; and

728	1130		4. Issued for one (1) calendar year or part thereof.

756	1177		4. Acknowledgement and documentation that the dentist or dental
757	1178		hygienist will not receive or have the expectation to receive any
758	1179		payment or compensation, either direct or indirect, for any dental
759	1180		services rendered under the special volunteer license; and
760		-
761	1181		5. A listing of all locations and dates that the person will be
762	1182		completing volunteer work under the special volunteer license.

764	1183		C. The Board of Dentistry shall have jurisdiction over
765	1184		dentists, dental hygienists, dental assistants , and dental
766	1185		technicians who volunteer their professional services in the state.
767	1186		Dental assistants and dental technicians shall work under the direct
768	1187		supervision of a dentist.

770	1188		D. Dental assistants may be issued a volunteer permit at the
771	1189		request of an entity that provides dental services to the needy.

787	1230		promulgated by the Board. Only those functions authorized by law or
788	1231		administrative rule shall be performed by the named person approved

794	1234		during volunteer procedures.

799	1237		H. At any time, the Board shall revoke a volunteer license
800	1238		based on documentation of failure to participate according to state

817	1277		assistant permit must have a supervising oral maxillofacial surgeon
818	1278		with a current Oklahoma license and complete the requirements set
819	1279		forth by the Board.

821	1280		C. The application shall be made to the Board in writing and
822	1281		shall be accompanied by the fee established by the Board, together
823	1282		with the satisfactory proof that the applicant:

825	1283		1. Passes a background check with criteria established by the
826	1284		Board; and

828	1285		2. Has completed all of the training requirements for the oral
829	1286		maxillofacial surgery assistant permit as established by the Board.

831	1287		D. An oral maxillofacial surgery assistant permit shall be

850	1327		may be eligible for an expanded function assisting a dentist who

999	1573		dental school, may assist in all duties of a dental assistant

1002	1575		3. A dental student intern, having finished the second year of
1003	1576		dental school, may assist in all duties permitted in paragraph 2 of
1004	1577		this subsection, radiation safety, coronal polishing and sealants.

1006	1578		E. A dental student intern, resident or fellowship permit shall
1007	1579		automatically expire when the permit hol der is no longer
1008	1580		participating in the program offered by the college of dentistry,
1009	1581		the accredited dental college or the institution.

1451	2268		SECTION 11. AMENDATORY 59 O.S. 2011, Section 328.36a, is

1454	2270		Section 328.36a. A. A dentist may utilize a dental laboratory
1455	2271		technician and a dental laboratory to perform or provide dental
1456	2272		laboratory technology . Except as provided in subsection C of
1457	2273		Section 328.36 of this title, a dentist who utilizes the services of
1458	2274		a dental laboratory technician or dental laboratory shall furnish a

1478	2318		C. The patient's name or the identification number of the
1479	2319		laboratory prescription shall appear on all dental models and
1480	2320		correspond to all dental restorations, appliances or other devices
1481	2321		being constructed, reproduced or repaired. Any den tal model,
1482	2322		restoration, appliance or other device i n the possession of a dental
1483	2323		laboratory technician or dental laboratory without a laboratory
1484	2324		prescription and corresponding number on the model, restoration,
1485	2325		appliance or device shall be prima facie eviden ce of a violation of
1486	2326		the State Dental Act. After c ompletion, the prescribed work product

1517	2373		and certify that the information is accurate by including the
1518	2374		signature of a reasonable part of the primary contractor.

1520	2375		E. The Board shall make readily ava ilable a sample form on the
1521	2376		Board's website for use by any licensee at no cost.

1523	2377		F. A dentist may produce, transfer and retain copies of the
1524	2378		form electronically.

1526	2379		G. A dentist may refer a patient to a dental laboratory for the
1527	2380		purpose of selecting the shad ing or matching shades of a prosthetic

1542	2417		this state, with the exception of those listed in paragraph 2 of
1543	2418		this subsection, shall submit a completed renewal appl ication with
1544	2419		information as may be required by the B oard, together with an annual
1545	2420		renewal fee established by the rules of the Board. Upon receipt of
1546	2421		the annual renewal fee, the Board shall issue a renewal certificate
1547	2422		authorizing the dentist, dental hygien ist, dental assistant, or oral
1548	2423		maxillofacial surgery assistant to continue the practice of
1549	2424		dentistry or dental hygiene, respectively, in this state for a
1550	2425		period of one (1) year. Every license or permit issued by the Board
1551	2426		shall begin on January 1 and expi re on December 31 of each year.

1553	2427		2. Beginning July 1 , 2017, resident and fellowship permits
1554	2428		shall be valid from July 1 through June 30 of each year and dental
1555	2429		student intern permits shall be valid from August 1 through July 31

1699	2663		D. F. Any dentist, dental hygienist, dental assistant , or oral
1700	2664		maxillofacial surgery assistant whose license or permit is
1701	2665		automatically canceled by reason of failure, neglect or refusal to
1702	2666		secure the renewal certificate may be reinstated by the Board at any
1703	2667		time within one (1) year from the date of the expiration of the
1704	2668		license, upon payment of the annual renewal fee and a penalty fee
1705	2669		established by the rules of the Board. If the dentist, dental
