3154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33-SECTION 1. There is hereby appro priated to the Oklahoma Water
34-Resources Board from any monies not otherwise appropriated from the
35-Statewide Recovery Fund created pursuant to Enrolled House Bill No.
36-3349 of the 2nd Session of the 58th Oklahoma Legislature, the sum of
37-Fifty Million Dollars ($50,000,000.00) or so much thereof as may be
38-necessary to establish grant programs that facilitate the design,
39-construction, and maintenance of water and wastewater
55+SECTION 1. There is hereby appro priated to the Oklahoma
56+Water Resources Board from any monies not otherwise appropriated
57+from the Statewide Recovery Fund created pursuant to Enrolled House
58+Bill No. 3349 of the 2nd Session of the 58th Oklahoma Legislature,
59+the sum of Fifty Million Dollars ($50,000,000.00) or so much thereof
60+as may be necessary to establish grant programs that facilitate the
61+design, construction, and maintenance of water and wastewater

4163 deficient dams regulated by the Oklahoma Water Resources Board.

4390 SECTION 2. From the funds approp riated by Section 1 of this
4491 act, the Oklahoma Water Resources Board is hereby authorized to
4592 expend Twenty-five Million Dollars ($25,000,000.00) for a grant
4693 program for communities with a population of seven thousand (7,000)

4994 or less as reported in the most recent decennial census published by
5095 the United States Bureau of the Census or to rural water districts
5196 with less than 2,300 non-pasture taps for projects that meet the
5297 federal eligibility requirements of the U.S. Treasury’s Coronavirus
5398 State and Local Fiscal Recovery Funds Final Rule for water and
5499 wastewater investments. The Board may reserve not more than four
55100 percent (4%) from this expenditure authority for purposes of
56101 administering the program.

58102 SECTION 3. From the funds appropriated by Section 1 of this
59103 act, the Oklahoma Water Resources Board is hereby authorized to
60104 expend Twenty Million Dollars ($20,000,000.00) for a grant program
61105 for communities with a population greater than seven thousand
62106 (7,000) as reported in the most recent dec ennial census published by
63107 the United States Bureau of the Census or to rural water districts
64108 with more than 2,300 non-pasture taps for projects that meet the
65109 federal eligibility requirements of the U.S. Tre asury’s Coronavirus
66110 State and Local Fiscal Recove ry Funds Final Rule for water and
67111 wastewater investments. The Board may reserve not more than four
68112 percent (4%) from this expenditure authority for purposes of
69113 administering the program.

71140 SECTION 4. From the funds appropriated by Section 1 of this
72141 act, the Oklahoma Water Resour ces Board is hereby authorized to
73142 expend Five Million Dollars ($5,000,000.00) for a grant program for
74143 communities that own dams with the latest condition assessment o f
75144 poor or unsatisfactory. Priority for funding shall be given to
76145 communities that have a population of less than seven thousand
77146 (7,000) as reported in the mos t recent decennial census published by
78147 the United States Bureau of the Census . Projects funded by the
79148 grant program shall be limited to up to One Million Dollars
80149 ($1,000,000.00) per community and must meet the federal eligib ility
81150 requirements of the U.S. Treasury’s Coronavirus State and Local
82151 Fiscal Recovery Fund s Final Rule. The Board may reserve not more
83152 than seven and one-half percent (7.5%) from this expenditure
84153 authority for purposes of administer ing the program.

86154 SECTION 5. The Oklahoma Water Resources Board shall promulgate
87155 rules and establish procedures for evaluating and awarding grant
88156 applications for grant programs provided for in Sections 2, 3, and 4
89157 of this act.

93158 SECTION 6. There is hereby appropriated to the Oklahoma Water
94159 Resources Board from any monies not otherwise appropriated from the
95160 Statewide Recovery Fund created pursuant to Enrolled House Bill No.
96161 3349 of the 2nd Session of the 58th Oklahoma Legislature, the sum of
97162 Twenty Million Dollars ($20,000,000.00) or so much thereof as may be
98163 necessary to match tribal investment in rural water infrastructure

100191 Projects shall meet the federal eligibility requirem ents of the U.S.
101192 Treasury’s Coronavirus State and Local Fiscal Recovery Funds Final

104194 SECTION 7. There is hereby appropriated to the Oklah oma Water
105195 Resources Board from any monies not otherwise appropriated from the
106196 Statewide Recovery Fund created pursuant to Enrolled House Bill No.
107197 3349 of the 2nd Session of the 58th Oklahoma Legislature, the sum of
108198 Twenty-five Million Dollars ($25,000,000.00) or so much thereof as
109199 may be necessary to promote water conservation, encourage economic
110200 longevity, and ensure reliable food supply by converting portions of
111201 an open ditch irrigation system to pipe within the Lugert-Altus
112202 Irrigation District. Projects funded shall meet the federal
113203 eligibility requirements of the U.S. Treasury’s Coronavirus State
114204 and Local Fiscal Recovery Fund s Final Rule.
