33101 SECTION 1. AMENDATORY 26 O.S. 20 21, Section 2-106, is
34102 amended to read as follows:

36103 Section 2-106. A. The State Election Board shall perform such
37104 duties as may be prescribed by law.

39105 B. 1. No agency, board, or commission or other entity of state
40106 government, or officer of this state, or state employee, or a county
41107 election board, shall enter into a legal agre ement, consent decree,
42108 or settlement of any kind which would alter or amend election
43109 procedures prescribed by the Legislature in statute. Any such
44110 agreement, consent decree or settlement entered into in violation of
45111 this subsection shall be void and unenforceable.

49112 2. Neither the Governor nor a ny officer of the state nor any
50113 political subdivision of the state, nor any court created by the
51114 Oklahoma Constitution or by statute , shall amend or alter the
52115 election procedures prescribed by the Legislature in statute, except
53116 where specifically authorize d by statute.

55117 C. Either chamber of the Legislature, acting by the Speaker of
56118 the Oklahoma House of Representativ es or the President Pro Tempore
57119 of the Oklahoma State Senate or both su ch persons jointly, may
58120 intervene in any action, suit , or proceeding that challenges or
59121 attempts to modify election procedures presc ribed by statute.

220+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
221+SECTION 3. AMENDATORY 26 O.S. 2011, Section 2 -106, is
222+amended to read as follows:
223+Section 2-106. A. The State Election Board shall perform such

225+B. 1. No political subdivision , agency or officer of this
226+state including but not limited to the Governor, the Attorney
227+General, the State Election Board, a district attorney or a county
228+election board, shall enter into a legal agre ement or court
229+settlement that prescribes election proced ures that conflict with
230+procedures prescribed by the Legislature in statute.
