4039 An Act relating to health insurance; proh ibiting
4140 accident and health insurer from discriminating
4241 against insured based on vaccination or imm unity
4342 status; providing for codification; and declaring an

5049 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5150 SECTION 1. NEW LAW A new section of law to be codified
5251 in the Oklahoma Statutes as Section 1203.1 of Title 36, unless there
5352 is created a duplication in numbering, reads as follows:
5453 No insurer licensed to do business in this state that issues
5554 policies of individual or group accident and health insurance, as
5655 defined in Section 703 of Title 36 of the Oklahoma Stat utes, shall
5756 unfairly discriminate against an insured or applicant for insurance
5857 based solely on the vaccination or immunity stat us of the insured
5958 by:
6059 1. Denying, canceling or failing to renew an accident and
6160 health insurance policy;
61+2. Basing renewal rates, premiums, policy fees or rates charged
62+for any policy or contract of accident or health ins urance; or

88-2. Basing renewal rates, premiums, policy fees or rates charged

9090 3. Failing to compensate or compensa ting at a lower rate any
9191 health care provider, as defined in Section 12 19.6 of Title 36 of
9292 the Oklahoma Statutes , for a covered service.
9393 SECTION 2. It being immediately n ecessary for the preservation
9494 of the public peace, health or safety, a n emergency is hereby
9595 declared to exist, by reason whereof this act shall take effect an d
9696 be in full force from and after its passage and approval.
