40	39		An Act relating to health insurance; proh ibiting
41	40		accident and health insurer from discriminating
42	41		against insured based on vaccination or imm unity
43	42		status; providing for codification; and declaring an

50	49		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	50		SECTION 1. NEW LAW A new section of law to be codified
52	51		in the Oklahoma Statutes as Section 1203.1 of Title 36, unless there
53	52		is created a duplication in numbering, reads as follows:
54	53		No insurer licensed to do business in this state that issues
55	54		policies of individual or group accident and health insurance, as
56	55		defined in Section 703 of Title 36 of the Oklahoma Stat utes, shall
57	56		unfairly discriminate against an insured or applicant for insurance
58	57		based solely on the vaccination or immunity stat us of the insured
59	58		by:
60	59		1. Denying, canceling or failing to renew an accident and
61	60		health insurance policy;
	61	+	2. Basing renewal rates, premiums, policy fees or rates charged
	62	+	for any policy or contract of accident or health ins urance; or

91	91		health care provider, as defined in Section 12 19.6 of Title 36 of
92	92		the Oklahoma Statutes , for a covered service.
93	93		SECTION 2. It being immediately n ecessary for the preservation
94	94		of the public peace, health or safety, a n emergency is hereby
95	95		declared to exist, by reason whereof this act shall take effect an d
96	96		be in full force from and after its passage and approval.
