An Act relating to health insurance; proh ibiting 
accident and health insurer from discriminating 
against insured based on vaccination or immunity 
status; providing for codification; and declaring an 
emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1203.1 of Title 36, unless there 
is created a duplication in numbering, reads as follows: 
No insurer licensed to do business in this state that issues 
policies of individual or group accident and health insurance, as 
defined in Section 703 of Title 36 of the Oklahoma Statutes, shall 
unfairly discriminate against an insured or applicant for insurance 
based solely on the vaccination or immunity stat us of the insured 
by: 
1.  Denying, canceling or failing to renew an accident and 
health insurance policy;

2.  Basing renewal rates, premiums, policy fees or rates charged 
for any policy or contract of accident or health ins urance; or 
3.  Failing to compensate or compensa ting at a lower rate any 
health care provider, as defined in Section 12 19.6 of Title 36 of 
the Oklahoma Statutes, for a covered service. 
SECTION 2.  It being immediately n ecessary for the preservation 
of the public peace, health or safety, a n emergency is hereby 
declared to exist, by reason whereof this act shall take effect an d 
be in full force from and after its passage and approval.
