4370 SECTION 1. AMENDATORY 74 O.S. 2011, Section 78, as last
4471 amended by Section 1, Chapter 124, O.S .L. 2018 (74 O.S. Supp. 2020,

49100 Section 78. A. There is hereby created and established within
50101 the Office of Management and Enterprise Services, the Fleet
51102 Management Division. The Division shall provide oversight of and
52103 advice to state agencies that own, operate and utilize motor
53104 vehicles, except for the Department of Public Safety, the Department
54105 of Transportation, the Oklahoma State Bureau of Narcotics and
55106 Dangerous Drugs Control, the Military Department of the State of
56107 Oklahoma, the Oklahoma State Bureau of Investigation, the
57108 Commissioners of the Land Office and The Oklahoma State System of
58109 Higher Education.

60110 B. The Director of the Office of Management and Enterprise
61111 Services shall:

63112 1. Appoint and fix duties an d compensation for a Fleet Manager
64113 who shall serve as the administrative head of the division;

66114 2. Hire personnel as necessary to provide fleet services;

68115 3. Acquire facilities to maintain vehicles;

70116 4. Promulgate rules for efficient and economical operati ons to
71117 provide fleet services; and

73118 5. Report to the Governor, Speaker of the House of
74119 Representatives, and President Pro Tempore of the Senate those
75120 agencies that fail to comply with the provisions of law and the
76121 rules of the Fleet Management Division reg arding submission of
77122 reports, vehicle use, and vehicle maintenance.

81151 1. Establish uniform written vehicle acquisition, leasing,
82152 maintenance, repairs, and disposal standards for use by all state
83153 agencies to justify actual need for vehicles;

85154 2. Establish standards for routine vehicle inspection and

88156 3. Provide standards and forms for recordkeeping of fleet
89157 operation, maintenance, and repair costs for mandatory use by all

92158 state agencies to report the dat a to the Fleet Management Division
93159 on a monthly basis;

95160 4. Provide standards and utilize methods for disposal of
96161 vehicles pursuant to the Oklahoma Surplus Property Act and any other
97162 applicable state laws;

99163 5. Establish mandatory maintenance contracts throu ghout the
100164 state for all agencies to access for vehicle repairs and service at
101165 discounted rates and parts;

103166 6. Require all agencies with in -house repair and service
104167 facilities to assign a value to the preventive maintenance services,
105168 track those services wi th a dollar value, and report costs to the
106169 Fleet Manager for the prior month no later than the twentieth day
107170 following the close of each month;

109171 7. Promulgate rules requiring all state -owned motor vehicles to
110172 be marked in a uniform, highly visible manner, except for certain
111173 vehicles driven by law enforcement agencies or other agencies
112174 requiring confidentiality;

114202 8. Require agencies to produce and maintain written
115203 justification for any vehicle that travels fewer than twelve
116204 thousand (12,000) miles annually a nd report to the Fleet Manager
117205 such information by October 1 of each year; and

119206 9. Address any other matter or practice which relates to the
120207 responsibilities of the Director of the Office of Management and
121208 Enterprise Services.

123209 D. The Fleet Manager shall:

125210 1. Develop specifications for contracts for vehicle maintenance
126211 for state vehicles not serviced or maintained by state agencies;

128212 2. Conduct on-site inspections to verify state agency or
129213 supplier compliance with Division standards for inspections,
130214 maintenance and recordkeeping;

132215 3. Assess state agency needs for vehicles and types of
133216 vehicles;

137217 4. Assign, transfer or lease vehicles to a state agency to meet
138218 the needs of the state agency;

140219 5. Unless otherwise provided by law, determine whether a state
141220 agency may use or operate a vehicle without state identifying
142221 markings, bearing a license plate used by a privately owned vehicle
143222 to perform the duties of the state agency without hindrance;

145223 6. Report to the Director of the Office of Management and
146224 Enterprise Services occurrences of agencies failing to comply with
147225 the provisions of law and the rules of the Fleet Management Division

148253 regarding submission of reports, vehicle use, and vehicle
149254 maintenance;

151255 7. Offer guidelines to agencies to assist in determining the
152256 most cost-effective and reasonable modes of travel for single trips
153257 from the following options: state vehicle, private rental, or
154258 mileage reimbursement; and

156259 8. Provide, upon the request of the Governor, the President Pro
157260 Tempore of the Senate or the Spea ker of the House of
158261 Representatives, reports from data the Fleet Manager collects.

160262 E. The Director of the Office of Management and Enterprise
161263 Services may enter into agreements with any political subdivision of
162264 this state for the purpose of providing flee t services established
163265 by the Fleet Management Division pursuant to this section and rules
164266 promulgated pursuant to this section.

166267 F. The Director of the Office of Management and Enterprise
167268 Services, through the Fleet Management Division, may enter into
168269 partnership agreements with political subdivisions and private
169270 entities for the purposes of applying for, participating in, and
170271 administering federal grant funds. The partnership agreements and
171272 activities authorized in this subsection are hereby declared to be a
172273 public purpose.

174274 G. The Office may offer public access to alternative fueling
175275 infrastructure owned and operated by the Office in areas of the
176276 state in which access to an alternative fueling infrastructure is

181306 operated by the Office if a privately owned alternative fueling
182307 infrastructure locates within a five -mile radius of the
183308 infrastructure operated by the Department.

185309 H. When used in relation to the Fleet Management Division:

187310 1. “Alternative fueling infrastructure ” shall mean a fill
188311 station or charge station used to deliver or provide alternative
189312 fuels as defined in Section 130.2 of this title; and

191313 2. “Alternative fuel vehicle ” shall mean a motor vehicle
192314 originally designed by the manufacturer to operate lawfully and
193315 principally on streets and highways which is propelled by an
194316 alternative fuel as defined in Section 130.2 of this title.

196317 SECTION 2. AMENDATORY 74 O.S. 2011, Section 78a, as last
197318 amended by Section 2, Chapter 124, O.S.L. 2018 (74 O.S. Supp. 2020,
198319 Section 78a), is amended to read as follows:

200320 Section 78a. A. State agencies with authority to own motor
201321 vehicles shall submit a requisition to the Director of the Office of
202322 Management and Enterprise Services prior to acquisition of a motor
203323 vehicle. The requisition shall state the type of vehicle, the
204324 intended purpose of the vehicle, a statement that the agency has
205325 actual need for the vehicle, the s upplier of the vehicle, that the
206326 state agency has sufficient funds to acquire and maintain the

210356 B. The Director of the Office of Management and Enterprise
211357 Services shall review the requisition and approve or deny the
212358 request of the state agency within fifteen (15) days of receipt.

214359 C. The provisions of subsections A and B of this section shall
215360 not apply to the Department of Public Safety, the Commissioners of
216361 the Land Office, the Oklahoma State Bureau of Narcotics and
217362 Dangerous Drugs Control or the Oklahoma Military Department.

219363 D. The provisions of subsections A and B of this section shall
220364 not apply to CompSource Oklahoma if CompSource Oklahoma is operating

223365 pursuant to a pilot program authorized by Sections 3316 and 3317 of
224366 this title.

226367 E. The Oklahoma Military Department shall annually report to
227368 the President Pro Tempore of the Senate, the Speaker of the House of
228369 Representatives and the Secretary of Finance the amount of savi ngs
229370 realized from its authority to purchase motor vehicles. If such
230371 report is not filed or does not document such savings, the authority
231372 of the Department to purchase motor vehicles shall cease to be in
232373 effect on January 1, 2022.

234374 SECTION 3. AMENDATORY 74 O.S. 2011, Section 78b, as last
235375 amended by Section 3, Chapter 124, O.S.L. 2018 (74 O.S. Supp. 2020,

238404 Section 78b. A. A state agency shall notify the Fleet
239405 Management Division of the Of fice of Management and Enterprise
240406 Services not less than thirty (30) days prior to any vehicle
241407 disposal by the state agency.

243408 B. A state agency shall not dispose of a passenger car, truck,
244409 pickup, or other vehicle the state agency owns until it has been in
245410 use for sixty thousand (60,000) miles or at least twenty -four (24)
246411 months have elapsed since the day the claim was approved for the
247412 payment thereof, unless the vehicle has damage and repairs that will
248413 exceed Two Thousand Five Hundred Dollars ($2,500.00), or the
249414 Director of the Fleet Management Division of the Office of
250415 Management and Enterprise Services provides written authorization
251416 for disposal.

253417 C. The provisions of subsections A and B of this section shall
254418 not apply to the Commissioners of the Land Off ice, the Military
255419 Department of the State of Oklahoma or CompSource Oklahoma if
256420 CompSource Oklahoma is operating pursuant to a pilot program
257421 authorized by Sections 3316 and 3317 of this title.
