41	69		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

43	70		SECTION 1. AMENDATORY 74 O.S. 2011, Section 78, as last
44	71		amended by Section 1, Chapter 124, O.S .L. 2018 (74 O.S. Supp. 2020,

49	100		Section 78. A. There is hereby created and established within
50	101		the Office of Management and Enterprise Services, the Fleet
51	102		Management Division. The Division shall provide oversight of and
52	103		advice to state agencies that own, operate and utilize motor
53	104		vehicles, except for the Department of Public Safety, the Department
54	105		of Transportation, the Oklahoma State Bureau of Narcotics and
55	106		Dangerous Drugs Control, the Military Department of the State of
56	107		Oklahoma, the Oklahoma State Bureau of Investigation, the
57	108		Commissioners of the Land Office and The Oklahoma State System of
58	109		Higher Education.

60	110		B. The Director of the Office of Management and Enterprise
61	111		Services shall:

63	112		1. Appoint and fix duties an d compensation for a Fleet Manager
64	113		who shall serve as the administrative head of the division;
65		-
66	114		2. Hire personnel as necessary to provide fleet services;
67		-
68	115		3. Acquire facilities to maintain vehicles;
69		-
70	116		4. Promulgate rules for efficient and economical operati ons to
71	117		provide fleet services; and

73	118		5. Report to the Governor, Speaker of the House of
74	119		Representatives, and President Pro Tempore of the Senate those
75	120		agencies that fail to comply with the provisions of law and the
76	121		rules of the Fleet Management Division reg arding submission of
77	122		reports, vehicle use, and vehicle maintenance.

81	151		1. Establish uniform written vehicle acquisition, leasing,
82	152		maintenance, repairs, and disposal standards for use by all state
83	153		agencies to justify actual need for vehicles;

85	154		2. Establish standards for routine vehicle inspection and

88	156		3. Provide standards and forms for recordkeeping of fleet
89	157		operation, maintenance, and repair costs for mandatory use by all

92	158		state agencies to report the dat a to the Fleet Management Division
93	159		on a monthly basis;

95	160		4. Provide standards and utilize methods for disposal of
96	161		vehicles pursuant to the Oklahoma Surplus Property Act and any other
97	162		applicable state laws;

99	163		5. Establish mandatory maintenance contracts throu ghout the
100	164		state for all agencies to access for vehicle repairs and service at
101	165		discounted rates and parts;
102		-
103	166		6. Require all agencies with in -house repair and service
104	167		facilities to assign a value to the preventive maintenance services,
105	168		track those services wi th a dollar value, and report costs to the
106	169		Fleet Manager for the prior month no later than the twentieth day
107	170		following the close of each month;

109	171		7. Promulgate rules requiring all state -owned motor vehicles to
110	172		be marked in a uniform, highly visible manner, except for certain
111	173		vehicles driven by law enforcement agencies or other agencies
112	174		requiring confidentiality;

116	204		thousand (12,000) miles annually a nd report to the Fleet Manager

120	207		responsibilities of the Director of the Office of Management and
121	208		Enterprise Services.

123	209		D. The Fleet Manager shall:

125	210		1. Develop specifications for contracts for vehicle maintenance
126	211		for state vehicles not serviced or maintained by state agencies;

128	212		2. Conduct on-site inspections to verify state agency or
129	213		supplier compliance with Division standards for inspections,
130	214		maintenance and recordkeeping;

132	215		3. Assess state agency needs for vehicles and types of
133	216		vehicles;

137	217		4. Assign, transfer or lease vehicles to a state agency to meet
138	218		the needs of the state agency;

140	219		5. Unless otherwise provided by law, determine whether a state
141	220		agency may use or operate a vehicle without state identifying
142	221		markings, bearing a license plate used by a privately owned vehicle
143	222		to perform the duties of the state agency without hindrance;

145	223		6. Report to the Director of the Office of Management and
146	224		Enterprise Services occurrences of agencies failing to comply with
147	225		the provisions of law and the rules of the Fleet Management Division

148	253		regarding submission of reports, vehicle use, and vehicle
149	254		maintenance;

151	255		7. Offer guidelines to agencies to assist in determining the
152	256		most cost-effective and reasonable modes of travel for single trips
153	257		from the following options: state vehicle, private rental, or
154	258		mileage reimbursement; and
155		-
156	259		8. Provide, upon the request of the Governor, the President Pro
157	260		Tempore of the Senate or the Spea ker of the House of
158	261		Representatives, reports from data the Fleet Manager collects.

160	262		E. The Director of the Office of Management and Enterprise
161	263		Services may enter into agreements with any political subdivision of
162	264		this state for the purpose of providing flee t services established
163	265		by the Fleet Management Division pursuant to this section and rules
164	266		promulgated pursuant to this section.

166	267		F. The Director of the Office of Management and Enterprise
167	268		Services, through the Fleet Management Division, may enter into
168	269		partnership agreements with political subdivisions and private
169	270		entities for the purposes of applying for, participating in, and
170	271		administering federal grant funds. The partnership agreements and
171	272		activities authorized in this subsection are hereby declared to be a
172	273		public purpose.

174	274		G. The Office may offer public access to alternative fueling
175	275		infrastructure owned and operated by the Office in areas of the
176	276		state in which access to an alternative fueling infrastructure is

180	305		allowing public access to an alternative fueling infrastructure
181	306		operated by the Office if a privately owned alternative fueling
182	307		infrastructure locates within a five -mile radius of the
183	308		infrastructure operated by the Department.

185	309		H. When used in relation to the Fleet Management Division:

187	310		1. “Alternative fueling infrastructure ” shall mean a fill
188	311		station or charge station used to deliver or provide alternative
189	312		fuels as defined in Section 130.2 of this title; and
190		-
191	313		2. “Alternative fuel vehicle ” shall mean a motor vehicle
192	314		originally designed by the manufacturer to operate lawfully and
193	315		principally on streets and highways which is propelled by an
194	316		alternative fuel as defined in Section 130.2 of this title.

196	317		SECTION 2. AMENDATORY 74 O.S. 2011, Section 78a, as last
197	318		amended by Section 2, Chapter 124, O.S.L. 2018 (74 O.S. Supp. 2020,
198	319		Section 78a), is amended to read as follows:

200	320		Section 78a. A. State agencies with authority to own motor
201	321		vehicles shall submit a requisition to the Director of the Office of
202	322		Management and Enterprise Services prior to acquisition of a motor
203	323		vehicle. The requisition shall state the type of vehicle, the
204	324		intended purpose of the vehicle, a statement that the agency has
205	325		actual need for the vehicle, the s upplier of the vehicle, that the
206	326		state agency has sufficient funds to acquire and maintain the

210	356		B. The Director of the Office of Management and Enterprise
211	357		Services shall review the requisition and approve or deny the
212	358		request of the state agency within fifteen (15) days of receipt.

214	359		C. The provisions of subsections A and B of this section shall
215	360		not apply to the Department of Public Safety, the Commissioners of
216	361		the Land Office, the Oklahoma State Bureau of Narcotics and
217	362		Dangerous Drugs Control or the Oklahoma Military Department.

219	363		D. The provisions of subsections A and B of this section shall
220	364		not apply to CompSource Oklahoma if CompSource Oklahoma is operating

223	365		pursuant to a pilot program authorized by Sections 3316 and 3317 of
224	366		this title.

226	367		E. The Oklahoma Military Department shall annually report to
227	368		the President Pro Tempore of the Senate, the Speaker of the House of
228	369		Representatives and the Secretary of Finance the amount of savi ngs
229	370		realized from its authority to purchase motor vehicles. If such
230	371		report is not filed or does not document such savings, the authority
231	372		of the Department to purchase motor vehicles shall cease to be in
232	373		effect on January 1, 2022.

234	374		SECTION 3. AMENDATORY 74 O.S. 2011, Section 78b, as last
235	375		amended by Section 3, Chapter 124, O.S.L. 2018 (74 O.S. Supp. 2020,

238	404		Section 78b. A. A state agency shall notify the Fleet
239	405		Management Division of the Of fice of Management and Enterprise
240	406		Services not less than thirty (30) days prior to any vehicle
241	407		disposal by the state agency.

243	408		B. A state agency shall not dispose of a passenger car, truck,
244	409		pickup, or other vehicle the state agency owns until it has been in
245	410		use for sixty thousand (60,000) miles or at least twenty -four (24)
246	411		months have elapsed since the day the claim was approved for the
247	412		payment thereof, unless the vehicle has damage and repairs that will
248	413		exceed Two Thousand Five Hundred Dollars ($2,500.00), or the
249	414		Director of the Fleet Management Division of the Office of
250	415		Management and Enterprise Services provides written authorization
251	416		for disposal.

253	417		C. The provisions of subsections A and B of this section shall
254	418		not apply to the Commissioners of the Land Off ice, the Military
255	419		Department of the State of Oklahoma or CompSource Oklahoma if
256	420		CompSource Oklahoma is operating pursuant to a pilot program
257	421		authorized by Sections 3316 and 3317 of this title.

259	422		SECTION 4. This act shall become effective Nov ember 1, 2021.
