17	47		definition; stating ownership of state data;
18	48		requiring state agencies to comply with statutory
19	49		obligations; authorizing the Office of Management and
20	50		Enterprise Services to promulgate rules to establish
21	51		certain standards; authorizing the sharing of data
22	52		between state agencies upon request; requiring
23	53		submission of specified information on certain form;
24	54		requiring the Office of Management and Enterprise
25	55		Services to grant or deny request; providing that
26	56		certain powers are in addition to existing powers;
27	57		requiring compliance with certain laws; providing
28	58		exceptions; providing for codification; and providing
29	59		an effective date.

35	64		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

37	65		SECTION 1. NEW LAW A new section of law to be codified
38	66		in the Oklahoma Statutes as Section 34.210 of Title 62, unless there
39	67		is created a duplication in numbering, reads as follows:

41	68		A. As used in this section, “state data” means all data files
42	69		hosted, procured, owned , processed, secured, stored, or created by

43	96		this state or its state agencies, while in the course of state
44	97		business and shall include any and all data not otherwise prohibited
45	98		from such classification or required to be kept confidential by

48	99		state or federal law. Such data shall be the property of this state
49	100		unless prohibited by law .

51	101		B. While this state is the owner of state data, individual
52	102		state agencies shall comply with their respective statutory
53	103		obligations in managing state data including responding t o open
54	104		records requests, reporting and responding to data breaches , and any
55	105		other statutory obligations required when hosting, accessing,
56	106		storing, collecting, or processing state data.

58	107		C. The Chief Information Officer for the State of Oklahoma may
59	108		establish standards and criteria for sharing state data between state
60	109		agencies. Agency requests to share state data shall be denied if the
61	110		stated purpose does not meet the established standards and criteria
62	111		for sharing state data as established by the CIO. State agencies may
63	112		decline requests to share state data if the state data requested is
64	113		otherwise privileged, required to be kept confidential, or prohibited
65	114		from being shared by state or federal law.

67	115		D. The powers provided in this section shall be in addition to
68	116		and not in substitution for any powers provided to the Office of
69	117		Management and Enterprise Services or the Chief Information Officer by
70	118		rule or law.

72	145		E. No powers provide d in this section shall exempt or supersede
73	146		a state agency’s statutory responsibil ity to protect data and to
74	147		comply with requirements of the Oklahoma Open Records Act or
75	148		applicable state or federal law.

77	149		F. The provisions of this section shall not be applicable to
78	150		the judicial department of state government or any entity organized
79	151		within the judicial department and shall not be applicable to the
80	152		legislative department or any entity organ ized within the
81	153		legislative department.

83	154		SECTION 2. This act shall become effective Nove mber 1, 2022.
