27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 47 O.S. 2021, Section 6-111, is
30	57		amended to read as follows:
31		-
32	58		Section 6-111. A. 1. The Department of Public Safety sha ll,
33	59		upon payment of the required fee, issue to every applicant
34	60		qualifying therefor a Class A, B, C or D driver license or
35	61		identification card as applied for, which license or card shall bear
36	62		thereon a distinguishing alphanumeric identification assigned to the
37	63		licensee or cardholder, date of issuance and date of expiration of
38	64		the license or card, the ful l legal name, signature or computeriz ed
39	65		signature, date of birth, residence address , unless specified as an

40	93		exception in the Code of Federal Regulations per 6 C.F.R., Section
41	94		37.17, sex, a computerized color image of the licensee or cardholder
42	95		taken in accordance with Department rules and security features as
43	96		determined by the Department. The image shall depict a full front
44	97		unobstructed view of the entire fac e of the licensee or cardholder;
45	98		provided, a commercial learner permit shall not bear the image of
46	99		the licensee. When any person is iss ued both a driver license and

49	100		an identification card, the Department shall ensure the information
50	101		on both the license an d the card are the same, unless otherwise
51	102		provided by law.

53	103		2. A driver license or identification c ard issued by the
54	104		Department on or after March 1, 2004, shall bear thereon the county
55	105		of residence of the licensee or cardholder.
56		-
57	106		3. The Department may canc el the distinguishing number, when
58	107		that distinguishing number is another person ’s Social Security
59	108		number, assign a new distinguishing al phanumeric identification, and
60	109		issue a new license or identification card without charge to the
61	110		licensee or cardholder.

63	111		4. The Department may promulgate rules for inclusion of the
64	112		height and a brief description of the licensee or cardholder on the
65	113		face of the card or license identifying the licensee or cardholder
66	114		as deaf or hard-of-hearing.

68	115		5. It is unlawful for any perso n to apply, adhere, or otherwise
69	116		attach to a driver license or identification card any decal,

70	144		sticker, label, or other attachment. Any law enforcement officer is
71	145		authorized to remove a nd dispose of any unlawful decal, sticker,
72	146		label, or other attachment f rom the driver license of a person. The
73	147		law enforcement officer, the employing agency of the offic er, the
74	148		Department of Public Safety, and the State of Oklahoma shall be
75	149		immune from any liability for any loss suffered by the licensee,
76	150		cardholder, or the o wner of the decal, sticker, label, or other
77	151		attachment caused by the removal and destruction of the decal,
78	152		sticker, label, or other atta chment.

80	153		6. The Department of Public Safety may d evelop by rule a
81	154		procedure which complies with the provisions of subsec tion G of
82	155		Section 6-101 of this title whereby a person may apply for a renewal
83	156		or replacement Oklah oma Class D license or Oklahoma ident ification
84	157		card.

86	158		B. 1. The Department may issue or authorize the issuance of a
87	159		temporary permit or license to an applic ant for a driver license
88	160		permitting such applicant to operate a motor vehicle while the
89	161		Department is completing its investigation and d etermination of all
90	162		facts relative to such applic ant’s privilege to receive a license,

93	163		or while a permanent driver licen se is being produced and delivered
94	164		to the applicant. Such permit or license must be in the immedia te
95	165		possession of the driver while ope rating a motor vehicle, and it
96	166		shall be invalid when the applicant’s permanent driver license has
97	167		been issued and delive red or for good cause has been refused.

99	195		2. The Department may issue or authorize the issuance of a
100	196		temporary identification card to an applicant, permitting the holder
101	197		the privileges otherwise granted by identification cards, while a
102	198		permanent driver lice nse is being provided and delivered to the
103	199		applicant. Such card shall be invalid when the applican t’s
104	200		permanent identification card has been issued and delivered, or for
105	201		good cause has been refused.

107	202		C. 1. The Department may issue a restricted commercial driver
108	203		license to drivers eighteen (18) years of age or older for any of
109	204		the following specific fa rm-related service industries:
110		-
111	205		a. farm retail outlets and suppliers,
112		-
113	206		b. agri-chemical businesses,
114		-
115	207		c. custom harvesters, and
116		-
117	208		d. livestock feeders.
118		-
119	209		The applicant shall hold have held a valid Oklahoma driver
120	210		license for at least one year. Applicants with more than two (2)
121	211		years of driving experience shall have a good driving record for the
122	212		most recent two (2) years and shall meet all the requirements for a
123	213		commercial driver license . The restricted commercial driver license
124	214		shall not exceed a total of one hundred eighty (180) days within any
125	215		twelve-month period the maximum total days that federa l law allows.
126	216		Applicants for the restricted commercial driver license shall be
127	217		exempt from the knowledge and skills test . Application of the

128	245		restricted commercial driver license does not have to be used in
129	246		consecutive days; use of permit shall be declare d at application.

131	247		2. A “good driving record” as used in this subsection shall
132	248		mean an applicant:

134	249		a. has not had more than one license,

138	250		b. has not had any license sus pended, revoked, or
139	251		cancelled,
140		-
141	252		c. has not had any conviction for any type of
142	253		disqualifying offenses or serious traffic violations,
143	254		or

145	255		d. has not had any conviction for a violation of state or
146	256		local law relating to motor vehicle traffic control,
147	257		other than a parking violation, arising in connection
148	258		with any traffic accident, and has no record of an
149	259		accident in which they were at fault.

151	260		3. The restricted commercial driver license shall not be valid
152	261		for operators of commercial motor vehicles beyond one hundred fifty
153	262		(150) miles from the place of business or the farm currently being
154	263		served. Such license shall be limited to Class B or C vehicles.
155	264		Holders of such licenses who transport hazardous materia ls which are
156	265		required to be placarded shall be limited to the following:
157		-
158	266		a. diesel fuel in quantities of one thousand (1,000)
159	267		gallons or less,

161	295		b. liquid fertilizers in vehicles with total capacities
162	296		of three thousand (3,000) gallons or less, and

164	297		c. solid fertilizers that are not mixed with any organic
165	298		substance.

167	299		No other placarded hazardous materials shall be transported by
168	300		holders of such licenses.

170	301		D. The Department may issue a non-domiciled commercial le arner
171	302		permit or a non-domiciled commercial driver l icense to:
172		-
173	303		1. An H2A-Temporary Agricultural worker lawfully present in the
174	304		United States as indicated on an original, valid and unexpired I-94
175	305		immigration status document issued by the United States Custo ms and
176	306		Immigration Service; and
177		-

180	307		2. A J-1 Exchange Visitor Program participant lawfully present
181	308		in the United States as indicated on a valid and unexpired J -1
182	309		Visitor Visa issued by the United States Customs and Immigration
183	310		Service and who is enrolled in a n agricultural education training
184	311		program.

186	312		A person applying for such permit or license must comply with
187	313		all testing and licensing requirements in accordanc e with applicable
188	314		federal regulations, state laws and Department rules. The issued
189	315		license shall be valid until the expiration of the visa for the non -
190	316		domiciled worker. The Department may promulgate rules for t he
191	317		implementation of the process to carry ou t the provisions of this
192	318		section.

194	346		E. 1. The Department shall develop a procedure whereby a
195	347		person applying for an original, renewal or replacement Cl ass A, B,
196	348		C or D driver license or identification card who is required to
197	349		register as a convicted sex off ender with the Department of
198	350		Corrections pursuant to the provisions of the Sex Offenders
199	351		Registration Act and who the Department of Corrections designa tes as
200	352		an aggravated or habitual offender pursuant to subsect ion J of
201	353		Section 584 of Title 57 of the Okla homa Statutes shall be issued a
202	354		license or card bearing the words “Sex Offender”.
203		-
204	355		2. The Department shall notify every person subject to
205	356		registration under the provisions of Section 1 -101 et seq. of this
206	357		title who holds a current Class A, B, C or D driver license or
207	358		identification card that such person is required to surrender the
208	359		license or card to the Department within one hundred eighty (180)
209	360		days from the date of the notice.

211	361		3. Upon surrendering the license or card for the reason set
212	362		forth in this subsection, application may be made with the
213	363		Department for a replacement license or card bearing the w ords “Sex
214	364		Offender”.
215		-
216	365		4. Failure to comply with the requirements set forth in such
217	366		notice shall result in cancel lation of the person ’s license or card.
218	367		Such cancellation shall be in effect for one (1) year, after which
219	368		time the person may make application with the Department for a new
220	369		license or card bear ing the words “Sex Offender”. Continued use of

221	397		a canceled license or card shall constitute a misdemeanor and shall,

224	398		upon conviction thereof, be punishable by a fine of not less than
225	399		Twenty-five Dollars ($25.00), nor more than Two Hundred Dollars
226	400		($200.00). When an individual is no longer required to register as
227	401		a convicted sex offender with the Department o f Corrections pursuant
228	402		to the provisions of the Sex Offenders Registration Act, the
229	403		individual shall be eligible to receive a driver license or
230	404		identification card which does not bear the words “Sex Offender”.

232	405		F. Nothing in subsection E of this section sh all be deemed to
233	406		impose any liability upon or give rise to a cause of action against
234	407		any employee, agent or official of the Department of Corrections f or
235	408		failing to designate a sex offender as an aggravated or ha bitual
236	409		offender pursuant to subsection J of Section 584 of Title 57 of the
237	410		Oklahoma Statutes.

239	411		G. A person subject to an order for the installat ion of an
240	412		ignition interlock device shall be requir ed by the Department to
241	413		submit their driver license for a rep lacement. The replacement
242	414		driver license shall bear the words “Interlock Required” and such
243	415		designation shall remain on the driver license for the duration of
244	416		the order requiring the ignition in terlock device. The replacement
245	417		license shall be subject to the same expiration and renewal
246	418		procedures provided by law. Upon completion of the requirements for
247	419		the interlock device, a person may apply fo r a replacement driver
248	420		license.

250	448		H. The Department shall develop a procedure whereby a person
251	449		applying for an original, renewal or replacement Class D drive r
252	450		license who has been granted modified driving privileges under this
253	451		title shall be issued a Class D driver license which identifies the
254	452		license as a modified license.

256	453		SECTION 2. This act shall become effective July 1, 2022.

258	454		SECTION 3. It being immediately necessary for the preservation
259	455		of the public peace, health or safety, an emergency is hereby
260	456		declared to exist, by reason whereof this act shall take effect and
261	457		be in full force from and after its passage and approval.
