5051 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5152 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -1-105, is
5253 amended to read as follows:
5354 Section 1-1-105. When used in the Oklahoma Children 's Code,
5455 unless the context otherwise requires:
5556 1. "Abandonment" means:
5657 a. the willful intent by words, actions, or omissions not
5758 to return for a child, or
5859 b. the failure to maintain a signifi cant parental
5960 relationship with a child through visitation or
6061 communication in which incidental or token visits or
6162 communication are not considered significant, or

8890 c. the failure to respond to noti ce of deprived

9092 2. "Abuse" means harm or threatened harm to the health, safety,
9193 or welfare of a child by a person respo nsible for the child 's
9294 health, safety, or welfare, including but not limited to
9395 nonaccidental physical o r mental injury, sex ual abuse, or sexual
9496 exploitation. Provided, however, that nothing contained in the
9597 Oklahoma Children's Code shall prohibit any par ent from using
9698 ordinary force as a means of discipline including, but not limited
9799 to, spanking, switchin g, or paddling.
98100 a. "Harm or threatened harm to the health or safety of a
99101 child" means any real or threa tened physical, mental,
100102 or emotional injury or da mage to the body or mind that
101103 is not accidental including but not limited to sexual
102104 abuse, sexual exploi tation, neglect, or dependency.
103105 b. "Sexual abuse" includes but is not limited t o rape,
104106 incest, and lewd or indecent acts or proposals made to
105107 a child, as defined by law, by a person responsible
106108 for the health, safety, or welfare of the child.
107109 c. "Sexual exploitation" includes but is not limited to
108110 allowing, permitting, encouraging, o r forcing a child
109111 to engage in prostitution, as defined by law, by any
110112 person eighteen (18) years of age or older or by a
111113 person responsible for the health, safety, or welfare

139142 engaging in the lewd, obsce ne, or pornographic, a s
140143 defined by law, photographing, filming, or depict ing
141144 of a child in those acts by a person responsible for
142145 the health, safety, and welfare of the child;
143146 3. "Adjudication" means a finding by the court that the
144147 allegations in a petiti on alleging that a ch ild is deprived are
145148 supported by a preponderance of the evidence;
146149 4. "Adjudicatory hearing " means a hearing by the court as
147150 provided by Section 1 -4-601 of this title;
148151 5. "Age-appropriate or developmentally appropriate " means:
149152 a. activities or items that are generally accepted as
150153 suitable for children of t he same age or level of
151154 maturity or that are determined to be developmentally
152155 appropriate for a child, b ased on the developm ent of
153156 cognitive, emotional, physical, and behavioral
154157 capacities that are typical for an age or age group,
155158 and
156159 b. in the case of a specific child, activities or items
157160 that are suitable for that child based on the
158161 developmental stages at tained by the child with
159162 respect to the cognitive, emotional, physical, and
160163 behavioral capacities of the specific child.

187191 In the event that any age -related activities have implications
188192 relative to the academic curriculum of a child, nothing in this
189193 paragraph shall be construed to authorize an officer or employee of
190194 the federal government to mandate, direct, or control a state or
191195 local educational agency, o r the specific instructional content,
192196 academic achievement standards and assessments, curriculum, or
193197 program of instruction of a school;
194198 6. "Assessment" means a comprehensive review of child safety
195199 and evaluation of family functioning and protective capac ities that
196200 is conducted in response to a child abuse or neglect referral that
197201 does not allege a serious and immediate safety threat to a child;
198202 7. "Behavioral health" means mental health, substance abuse, or
199203 co-occurring mental health and substance abuse diagnoses, and the
200204 continuum of mental health, substance abuse, or co -occurring mental
201205 health and substance abuse treatment;
202206 8. "Child" means any unmarried person under eighteen (18) years
203207 of age;
204208 9. "Child advocacy center" means a center and the
205209 multidisciplinary child abuse team of which it is a member that is
206210 accredited by the National Children 's Alliance or that is comple ting
207211 a sixth year of reaccreditation . Child advocacy cente rs shall be
208212 classified, based on the child population of a district attor ney's
209213 district, as follows:

236241 a. nonurban centers in districts with child populations
237242 that are less than s ixty thousand (60,00 0), and
238243 b. midlevel nonurban centers in districts with chil d
239244 populations equal to or greater than sixty thousand
240245 (60,000), but not including Oklahoma and Tulsa
241246 Counties;
242247 10. "Child with a disability " means any child who has a
243248 physical or mental impairment which substantially limits one or more
244249 of the major life activities of the child, or who is regarded as
245250 having such an impairment b y a competent medical professional;
246251 11. "Child-placing agency" means an agency that arranges for or
247252 places a child in a fos ter family home, family -style living program,
248253 group home, adoptive home, or a successful adu lthood program;
249254 12. "Children's emergency resource center" means a community-
250255 based program that may provide emergency care and a safe and
251256 structured homelike envir onment or a host home for children
252257 providing food, clothing , shelter and hygiene products to each child
253258 served; after-school tutoring; counseling services; life -skills
254259 training; transition services; assessments; family reunification;
255260 respite care; transpor tation to or from school, doctors '
256261 appointments, visitation s and other social, school, court or other
257262 activities when necessary; and a stable environment for children in
258263 crisis who are in custody of the Department of Human Services if
259264 permitted under the D epartment's policies and regulations, or who

286292 have been voluntarily placed by a parent or cus todian during a
287293 temporary crisis;
288294 13. "Community-based services" or "community-based programs"
289295 means services or programs which maintain commun ity participation or
290296 supervision in their planning, operation, and evaluation .
291297 Community-based services and pro grams may include, but are not
292298 limited to, emergency shelter, crisis intervention, group work, case
293299 supervision, job placement, recruitment and training of voluntee rs,
294300 consultation, medical, educational, home -based services, vocational,
295301 social, preventive and psychological guidance, training, co unseling,
296302 early intervention and diversionary substance abuse treatment,
297303 sexual abuse treatment, transit ional living, indepe ndent living, and
298304 other related services and programs;
299305 14. "Concurrent permanency planning " means, when indicated, the
300306 implementation of two plans for a child entering foster care . One
301307 plan focuses on reuniting the parent and child; t he other seeks to
302308 find a permanent out-of-home placement for the child with bot h plans
303309 being pursued simultaneou sly;
304310 15. "Court-appointed special advoc ate" or "CASA" means a
305311 responsible adult volunteer who has been trained and is supervised
306312 by a court-appointed special advoc ate program recognized by the
307313 court, and when appointed by the court, serves as an officer o f the
308314 court in the capacity as a guardia n ad litem;

335342 16. "Court-appointed special advocate program " means an
336343 organized program that meets both national and state court-appointed
337344 special advocate program standards , administered by either an
338345 independent, not-for-profit corporation, a dependent pro ject of an
339346 independent, not-for-profit corporation or a unit of local
340347 government, which recruits, screen s, trains, assigns, supervises and
341348 supports volunteers to be available for appointment by the court as
342349 guardians ad litem;
343350 17. "Custodian" means an individual other than a parent, legal
344351 guardian or Indian custodian, to whom legal custody of the child has
345352 been awarded by the court. As used in this title, the term
346353 "custodian" shall not mean the Department of Human S ervices;
347354 18. "Day treatment" means a nonresidential program which
348355 provides intensive services to a child who resides in the child 's
349356 own home, the home of a relativ e, group home, a foster home or
350357 residential child care facility . Day treatment programs inc lude,
351358 but are not limited to, educationa l services;
352359 19. "Department" means the Department of Human Services;
353360 20. "Dependency" means a child who is homeless or wit hout
354361 proper care or guardianship through no fault of his or her parent,
355362 legal guardian, or c ustodian;
356363 21. "Deprived child" means a child:
357364 a. who is for any reason destitute, homeless, or
358365 abandoned,

385393 b. who does not have the proper paren tal care or
386394 guardianship,
387395 c. who has been abused, neglected, or is dependent,
388396 d. whose home is an unfit place fo r the child by reason
389397 of depravity on the part of the parent or legal
390398 guardian of the child, or other person responsible for
391399 the health or welfare of the child,
392400 e. who is a child in need of special care and treatment
393401 because of the child 's physical or mental condition,
394402 and the child's parents, legal guardian, or other
395403 custodian is unable or willfully fails to provide such
396404 special care and treatmen t. As used in this
397405 paragraph, a child in need of special care and
398406 treatment includes, but is not limited to, a child who
399407 at birth tests positive for al cohol or a controlled
400408 dangerous substance and who, pursuant to a drug or
401409 alcohol screen of the child and an assessment of the
402410 parent, is determined to be at risk of harm or
403411 threatened harm to the health or safety of a child,
404412 f. who is a child with a disabi lity deprived of the
405413 nutrition necessary to sustain life or of the medical
406414 treatment necessary to remedy or relieve a life-
407415 threatening medical condition in order to cause or
408416 allow the death of the child if such nutri tion or

435444 medical treatment is generally p rovided to similarly
436445 situated children without a disability or children
437446 with disabilities; provided that no medical treatment
438447 shall be necessary if, in the reasonable medical
439448 judgment of the attending physician, such treatment
440449 would be futile in saving the life of the child,
441450 g. who, due to improper parental care and guardianship,
442451 is absent from school as spe cified in Section 10 -106
443452 of Title 70 of the Oklahoma Statutes, if the child is
444453 subject to compulsory school atte ndance,
445454 h. whose parent, legal guardian or custodian for good
446455 cause desires to be relieved of custody,
447456 i. who has been born to a parent whose pa rental rights to
448457 another child have been involuntarily terminated by
449458 the court and the conditions which led to t he making
450459 of the finding, which resulted in the termination of
451460 the parental rights of the parent to the other child,
452461 have not been corrected, or
453462 j. whose parent, legal guardian, or custodian has
454463 subjected another child to abuse or neglect or has
455464 allowed another child to be subjected to abuse or
456465 neglect and is currently a respondent in a deprived
457466 proceeding.

484494 Nothing in the Oklahoma Children 's Code shall be construed t o
485495 mean a child is deprived for the sole reason the parent, legal
486496 guardian, or person having custody or control of a child, in good
487497 faith, selects and depends upon spiritual means alone through
488498 prayer, in accordance with the tenets and p ractice of a recogni zed
489499 church or religious denomination, for the treatment or cure of
490500 disease or remedial care of such child.
491501 Evidence of material, ed ucational or cultural disadvantage as
492502 compared to other children shall not be sufficient to prove that a
493503 child is deprived; t he state shall prove that the child is deprived
494504 as defined pursuant to this title.
495505 Nothing contained in this paragraph shall preve nt a court from
496506 immediately assuming custody of a child and ordering whatever action
497507 may be necessary, inc luding medical treat ment, to protect the
498508 child's health or welfare;
499509 22. "Dispositional hearing " means a hearing by the court as
500510 provided by Section 1-4-706 of this title;
501511 23. "Drug-endangered child" means a child who is at risk of
502512 suffering physical, psy chological or sexual harm as a result of the
503513 use, possession, distribution, manufacture or cultivation of
504514 controlled substances, or the attempt of a ny of these acts, by a
505515 person responsible for the health, safety or welfare of the child,
506516 as defined in this section. This term includes circumstances
507517 wherein the substance abuse of the person responsible for the

534545 health, safety or welfare of the child int erferes with that person's
535546 ability to parent and provide a safe and nurturing environment for
536547 the child;
537548 24. "Emergency custody" means the custody of a child prior to
538549 adjudication of the child following issuance of an o rder of the
539550 district court pursuant to Section 1-4-201 of this title or
540551 following issuance of an order of the district court pursuant to an
541552 emergency custody hearin g, as specified by Section 1 -4-203 of this
542553 title;
543554 25. "Facility" means a place, an institut ion, a building or
544555 part thereof, a set of buildings, or an area whether or not
545556 enclosing a building or set of buildings used for the lawful cust ody
546557 and treatment of children;
547558 26. "Failure to protect" means failure to take reasonable
548559 action to remedy or pr event child abuse or neglect, and includes the
549560 conduct of a nonabusing parent or guardian who knows the identity of
550561 the abuser or the person neg lecting the child, b ut lies, conceals or
551562 fails to report the child abuse or neglect or otherwise take
552563 reasonable action to end the abuse or negle ct;
553564 27. "Family-style living program" means a residential program
554565 providing sustained care and supervision to residents in a homelike
555566 environment not located in a building used for commercial activity;
556567 28. "Foster care" or "foster care services " means continuous
557568 twenty-four-hour care and supportive services provided for a child

584596 in foster placement including, but not limited to, the care,
585597 supervision, guidance, and rearing of a foster child by the foster
586598 parent;
587599 29. "Foster family home" means the private residence of a
588600 foster parent who provides foster care services to a child . Such
589601 term shall include a nonkinshi p foster family home , a therapeutic
590602 foster family home, or the home of a relative or other kinship care
591603 home;
592604 30. "Foster parent eligibility assessment" includes a criminal
593605 background investigation including, but not limited to, a national
594606 criminal history records search bas ed upon the submission of
595607 fingerprints, home assessments, and any other assessment required by
596608 the Department of Human Se rvices, the Office of Juvenile Affairs, or
597609 any child-placing agency pursuant to the provisions of the Oklahoma
598610 Child Care Facilities Li censing Act;
599611 31. "Guardian ad litem" means a person appointed by the court
600612 pursuant to the provisions of Section 1 -4-306 of this title having
601613 those duties and responsibilities as set forth in that section . The
602614 term "guardian ad litem" shall refer to a court-appointed special
603615 advocate as well as to any other person appointed pursuant to the
604616 provisions of Section 1-4-306 of this title to serve as a guardian

632645 32. "Guardian ad litem of the estate of the child " means a
633646 person appointed by the court t o protect the property interests of a
634647 child pursuant to Section 1 -8-108 of this title;
635648 33. "Group home" means a residential facility licensed by the
636649 Department to provide full -time care and community -based services
637650 for more than five b ut fewer than thirte en children;
638651 34. "Harm or threatened harm to the health or safety of a
639652 child" means any real or threatened physical, mental, or emotional
640653 injury or damage to the body or mind that is not accidental
641654 including, but not limited to, sexual abuse, sexual exploitation,
642655 neglect, or dependency;
643656 35. "Heinous and shocking abuse " includes, but is not limi ted
644657 to, aggravated physi cal abuse that results in serious bodily,
645658 mental, or emotional injury . "Serious bodily injury " means injury
646659 that involves:
647660 a. a substantial risk of death,
648661 b. extreme physical pain,
649662 c. protracted disfigurement,
650663 d. a loss or impairment of the function o f a body member,
651664 organ, or mental faculty,
652665 e. an injury to an internal or external organ or the
653666 body,
654667 f. a bone fracture,
655668 g. sexual abuse or sexual exploitation,

682696 h. chronic abuse including, but not limited to, physical,
683697 emotional, or sexual abuse, or sexual exploitation
684698 which is repeated or continuing,
685699 i. torture that includes, but is not limited to,
686700 inflicting, participating i n or assisting in
687701 inflicting intense physical or emotional pain upon a
688702 child repeatedly over a period of time fo r the purpose
689703 of coercing or terrorizing a child or for the purpose
690704 of satisfying the craven, cruel, or prurient desires
691705 of the perpetrator or a nother person, or
692706 j. any other similar aggravated circumstance;
693707 36. "Heinous and shocking neglect " includes, but is not limited
694708 to:
695709 a. chronic neglect that includes, but is not limited to,
696710 a persistent pattern of family functioning in which
697711 the caregiver has not met or susta ined the basic needs
698712 of a child which results in harm to the child,
699713 b. neglect that has resu lted in a diagnosis of the child
700714 as a failure to thrive,
701715 c. an act or failure to act by a parent that results in
702716 the death or near death of a ch ild or sibling, seri ous
703717 physical or emotional harm, sexual abuse, sexual
704718 exploitation, or presents an imminent r isk of serious
705719 harm to a child, or

732747 d. any other similar aggravating circumstance;
733748 37. "Individualized service plan " means a document written
734749 pursuant to Section 1-4-704 of this title that has the same meaning
735750 as "service plan" or "treatment plan" where those terms are used in
736751 the Oklahoma Children's Code;
737752 38. "Infant" means a child who is twelve (12) months of age or
738753 younger;
739754 39. "Institution" means a residential facility offering care
740755 and treatment for more than twenty residents;
741756 40. a. "Investigation" means a response to an allegation of
742757 abuse or neglect that involves a serious and immediate
743758 threat to the safety of the child, making it necessa ry
744759 to determine:
745760 (1) the current safety of a child and the risk of
746761 subsequent abuse or neglect, and
747762 (2) whether child abuse or neglect occurred and
748763 whether the family needs prevention- and
749764 intervention-related services.
750765 b. "Investigation" results in a written response stating
751766 one of the following findings:
752767 (1) "substantiated" means the Department has
753768 determined, after an investigation of a report of
754769 child abuse or neglect and based upon some
755770 credible evidence, that child abuse or neglect

833850 41. "Kinship care" means full-time care of a child by a kinship

835852 42. "Kinship guardianship " means a permanent guardianship as
836853 defined in this section;
837854 43. "Kinship relation" or "kinship relationship " means
838855 relatives, stepparen ts, or other responsible adults who have a bond
839856 or tie with a child and/or to whom has been ascribed a family
840857 relationship role with the child's parents or the child; provided,
841858 however, in cases where the Indian Child Welfare Act applie s, the
842859 definitions contained in 25 U.S.C., Section 1903 shall control;
843860 44. "Mental health facility " means a mental health or substance
844861 abuse treatment facility as defined by the Inpatient Mental Health
845862 and Substance Abuse Treatment of Minors Act;
846863 45. "Minor" means the same as the term "child" as defined in
847864 this section;
848865 46. "Minor in need of treatment " means a child in need of
849866 mental health or substanc e abuse treatment as defined by the
850867 Inpatient Mental Health and Substance Abuse Treatment of Minors Act;
851868 47. "Multidisciplinary child abuse team " means any team
852869 established pursuant to Section 1 -9-102 of this title of three or
853870 more persons who are trained in the prevention, identification,
854871 investigation, prosecution, and treatment of physical and sexual

883901 to child abuse. For purposes of this definition, "freestanding"
884902 means a team not used by a child advocacy center for its
885903 accreditation;
886904 48. "Near death" means a child is in serious or critical
887905 condition, as certified by a phys ician, as a result of abuse or
888906 neglect;
889907 49. a. "Neglect" means:
890908 (1) the failure or omission to provide any of the
891909 following:
892910 (a) adequate nurturance and af fection, food,
893911 clothing, shelter, sanitation, hygiene, or
894912 appropriate education,
895913 (b) medical, dental, or behavioral health care,
896914 (c) supervision or appropriate caretakers to
897915 protect the child from harm or threatened
898916 harm of which any reasonable and prudent
899917 person responsible for the child's health,
900918 safety or welfare would be aware , or
901919 (d) special care made necessary for the child's
902920 health and safety by the physical or mental

932951 (a) the use, possession, sale, or manufacture of
933952 illegal drugs,
934953 (b) illegal activities, or
935954 (c) sexual acts or materials that are not age-
936955 appropriate, or
937956 (3) abandonment.
938957 b. "Neglect" shall not mean a child who engages in
939958 independent activities, exc ept if the person
940959 responsible for the child 's health, safety or welfa re
941960 willfully disregards any harm or threatened harm to
942961 the child, given the child's level of maturity,
943962 physical condition or mental abilities . Such
944963 independent activities include but are not limited to:
945964 (1) traveling to and from school including by
946965 walking, running or bicycling ,
947966 (2) traveling to and from nearby comme rcial or
948967 recreational facilities,
949968 (3) engaging in outdoor play,
950969 (4) remaining at home unattended for a r easonable
951970 amount of time,
952971 (5) remaining in a vehicle if the temperature inside
953972 the vehicle is not or will not be come dangerously

9851005 Nothing in this paragraph shall b e construed to mean a child is
9861006 abused or neglected for the sole reason the parent, legal guardian
9871007 or person having custody or control of a child, in good faith,
9881008 selects and depends upon spiritua l means alone through prayer, in
9891009 accordance with the tenets an d practice of a recognized chu rch or
9901010 religious denomination, for the t reatment or cure of disease or
9911011 remedial care of such child . Nothing contained in this paragraph
9921012 shall prevent a court from immediately assuming custody of a child,
9931013 pursuant to the Oklah oma Children's Code, and ordering whatever
9941014 action may be necessary, in cluding medical treatment, to protect the
9951015 child's health or welfare;
9961016 50. "Permanency hearing" means a hearing by the court pursuant
9971017 to Section 1-4-811 of this title;
9981018 51. "Permanent custody" means the court-ordered custody of an
9991019 adjudicated deprived child when a parent-child relationship no
10001020 longer exists due to termination of parental rights or due to the
10011021 death of a parent or parents;
10021022 52. "Permanent guardianship " means a judicially c reated
10031023 relationship between a chi ld, a kinship relation of the child, or

10351056 child's parent cohabitates or any other adult residing in the home
10361057 of the child; an agent or employee of a public or private
10371058 residential home, institution, facili ty or day treatment program as
10381059 defined in Section 175.20 of Title 10 of th e Oklahoma Statutes; or
10391060 an owner, operator, or employee of a child care facility as defined
10401061 by Section 402 of Title 10 of th e Oklahoma Statutes;
10411062 54. "Plan of safe care" means a plan developed for an infant
10421063 with Neonatal Abstinence Syndrome or a Fetal Alco hol Spectrum
10431064 Disorder upon release from the care of a health care provider that
10441065 addresses the health and substance use treatment needs of the infant
10451066 and mother or caregiver;
10461067 55. "Protective custody" means custody of a child taken by a
10471068 law enforcement offi cer or designated employee of the court without
10481069 a court order;
10491070 56. "Putative father" means an alleged father as that term i s
10501071 defined in Section 7700 -102 of Title 10 of the Oklaho ma Statutes;
10511072 57. "Qualified residential treatment program " means a program

10851107 b. has registered or licensed nursing staf f and other
10861108 licensed clinical staff who:
10871109 (1) provide care within the sc ope of their practice
10881110 as defined by the laws of this state,
10891111 (2) are on-site according to the treatment model
10901112 referred to in subparagraph a of this paragraph,
10911113 and
10921114 (3) are available twenty-four (24) hours a day and
10931115 seven (7) days a week,
10941116 c. to the extent appropriate, and in accordance with the
10951117 child's best interest, facilitates participa tion of
10961118 family members in the child 's treatment program,
10971119 d. facilitates outreach to the family members o f the
10981120 child including siblings, documents how the outreach
10991121 is made including contact information, and maintains
11001122 contact information for any known biolog ical family of
11011123 the child,

11401163 (3) The Council on Accreditation (COA), or
11411164 (4) any other federally ap proved independent, not-
11421165 for-profit accrediting organization;
11431166 58. "Reasonable and prudent parent standard " means the standard
11441167 characterized by careful a nd sensible parental decisions that
11451168 maintain the health, safety, and best interests of a child while at
11461169 the same time encour aging the emotional and developmental g rowth of
11471170 the child. This standard shall be used by t he child's caregiver
11481171 when determining whether to allow a child to participate in
11491172 extracurricular, enrichment, cultural, and social activities . For
11501173 purposes of this definition, the term "caregiver" means a foster
11511174 parent with whom a child in foster care has been placed, a

11811205 59. "Relative" means a grandparent, great -grandparent, brother
11821206 or sister of whole or half blood, aunt, uncle or any other person

11841208 60. "Residential child care facility " means a twenty-four-hour
11851209 residential facility where children live together with or are
11861210 supervised by adults who are not their parents o r relatives;
11871211 61. "Review hearing" means a hearing by the court pursuant to
11881212 Section 1-4-807 of this title;
11891213 62. "Risk" means the likelihood that an incident of child abuse
11901214 or neglect will occur in th e future;
11911215 63. "Safety threat" means the threat of seriou s harm due to
11921216 child abuse or neglect occ urring in the present or in the very near
11931217 future and without the intervention of another person, a child would
11941218 likely or in all probability sustain severe or permanent disability
11951219 or injury, illness, or death;
11961220 64. "Safety analysis" means action taken by th e Department in
11971221 response to a report of alleged child abuse or neglect that may
11981222 include an assessment or investigation based upon an analysis of the
11991223 information received according to priority guidelines and other
12001224 criteria adopted by the Department;

12281253 by the Department using a structured, evidence -based tool to
12291254 determine if the child is subject to a safety threat;
12301255 66. "Secure facility" means a facility whi ch is designed and
12311256 operated to ensure th at all entrances and exits from the facility
12321257 are subject to the exclusive control of the staff of the fa cility,
12331258 whether or not the juvenile being detained has freedom of movement
12341259 within the perimeter of the facility, or a facility which relies on
12351260 locked rooms and buildings, fences, or physical restraint in order
12361261 to control behavior of its residents;
12371262 67. "Sibling" means a biologically or legally related bro ther
12381263 or sister of a child . This includes an individual who sa tisfies at
12391264 least one of the following co nditions with respect to a child:
12401265 a. the individual is considered by state law to be a
12411266 sibling of the child, or
12421267 b. the individual would have been consid ered a sibling
12431268 under state law but for a termination or other
12441269 disruption of parental rights, such as the death of a
12451270 parent;
12461271 68. "Specialized foster care " means foster care provided to a
12471272 child in a foster hom e or agency-contracted home which:
12481273 a. has been certified by the Developmental Disabilities
12491274 Services Division of the Department of Human Services,
12501275 b. is monitored by the Division, and

12791305 69. "Successful adulthood program " means a program specifically
12801306 designed to assist a child to enhance those skills and abilities
12811307 necessary for successful adult living . A successful adulthood
12821308 program may include, but shall not be limited to, s uch features as
12831309 minimal direct staff supervision, and the provision of supportive
12841310 services to assist children with activities necess ary for finding an
12851311 appropriate place of residence, completing an education or
12861312 vocational training, obtai ning employment, or obtaining other
12871313 similar services;
12881314 70. "Temporary custody" means court-ordered custody of an
12891315 adjudicated deprived child;
12901316 71. "Therapeutic foster family home" means a foster family home
12911317 which provides specific treatment services, pursua nt to a
12921318 therapeutic foster care contract, which are designed to remedy
12931319 social and behavioral problems of a foste r child residing in the
12941320 home;
12951321 72. "Trafficking in persons" means sex trafficking or severe
12961322 forms of trafficking in persons as described in Sect ion 7102 of
12971323 Title 22 of the United States Code:
12981324 a. "sex trafficking" means the recruitment, harboring,
12991325 transportation, provision, obtaining, patronizing or

13291356 (1) sex trafficking in which a commercial sex act is
13301357 induced by force, fraud, or coercion, or in which

13321359 attained eighteen (18) years of age, or
13331360 (2) the recruitment, harboring, transportation,
13341361 provision, obtaining, patronizing or soliciting
13351362 of a person for labor or services, through the
13361363 use of force, fraud, or coercion for the purpose
13371364 of subjection to involuntary servitude, peonage,
13381365 debt bondage, or slavery;
13391366 73. "Transitional living program " means a residential p rogram
13401367 that may be attached to an existing facility or operated solely for
13411368 the purpose of assisting children to develop the skills a nd
13421369 abilities necessary for successful adult living . The program may
13431370 include, but shall not be limited t o, reduced staff sup ervision,
13441371 vocational training, educational services, employment and employment
13451372 training, and other appropriate independent living sk ills training
13461373 as a part of the transitional living program; and
13471374 74. "Voluntary foster care placement " means the temporary
13481375 placement of a child by the parent, legal guardian or custodian of
13491376 the child in foster care p ursuant to a signed placement agreement
