62	108		provided in the Oklahoma Firearms Act of 1971, defined in Section

72	115		Oklahoma Self-Defense Act shall not apply to imitation pistols,
73	116		flare guns, underwater fishing guns or blank pis tols.

103	164		provisions of the Oklahoma Self -Defense Act shall not be c onstrued
104	165		to authorize any person to:

106	166		1. Carry or possess any weapon other than an authorized pistol
107	167		firearm as defined by the provisions of Section 1290.2 1289.3,
108	168		1289.4 or 1289.5 of this title;

144	220		Oklahoma State Bureau of Investigation pursuant to the provisions of
145	221		the Oklahoma Self-Defense Act, provided the person is in compliance

147	250		license has not expired or been subsequentl y suspended or revoked;

150	252		2. The person is twenty-one (21) years of age or older, and is
151	253		either:

153	254		a. active military, or
154		-
155	255		b. a member of the Reserve or National Guard to include
156	256		Drill Status Guard and Reserve, Active Guard Reserves
157	257		or Military Technicians,

159	258		and presents a valid military ident ification card that shall be
160	259		considered a valid handgun license issued authorized pursuant to the
161	260		Oklahoma Self-Defense Act provisions of Section 1272 of this title.

163	261		B. A person in possession of a valid state photo identification
164	262		card, driver license, or valid handgun license or who meets the
165	263		criteria and presents a valid military identification card as
166	264		provided for in this section and is in compliance with the
167	265		provisions of the Oklahoma Self-Defense Act shall be authori zed to
168	266		carry such concealed or uncon cealed handgun firearm while scouting
169	267		as it relates to hunting or fishing or while hunting or fishing.

171	268		C. The person shall be require d to have possession of his or
172	269		her valid handgun license or, valid military identifica tion card as
173	270		provided for qualified persons in this section and a, valid driver
174	271		license, or state photo identification card at all times when in
175	272		possession of an authorized pistol a firearm. The person shall

179	303		section on demand of a law enforcement officer; provided, however,

181	305		criminal activity, an individual carrying an unconcealed or
182	306		concealed handgun firearm shall not be disarmed or physically
183	307		restrained unless the individual fails to display a one of the
184	308		following:

186	309		1. A valid handgun license or a;
187		-
188	310		2. A valid military identification car d;
189		-
190	311		3. A valid driver license; or
191		-
192	312		4. A valid state photo ident ification card,

194	313		as provided for qualified persons in this section in re sponse to
195	314		that demand. Any violation of the provisions of this subsection may
196	315		be punishable as a criminal offense as auth orized by Section 1272 of
197	316		this title or pursuant to any other a pplicable provision of law.

199	317		Upon the arrest of any person for a violati on of the provisions
200	318		of this subsection, the person may show proof to the court that a
201	319		valid handgun license and the other required, a valid military
202	320		identification card, a valid driver license, or a valid state photo
203	321		identification card has been issued to such person and the person
204	322		may state any reason why the valid handgun license, a valid military
205	323		identification card, valid driver license, or valid state photo

207	352		section or the other required ide ntification was not carried by the
208	353		person as required by the Oklahoma Self -Defense Act. The court
209	354		shall dismiss an allege d violation of Section 1272 of this title
210	355		upon payment of court costs, if proof of a valid handgun license and
211	356		other required, a valid military identification card, a valid driver
212	357		license, or valid state photo identification card is shown to the
213	358		court within ten (10) days of the arrest of the person. The court
214	359		shall report a dismissal of a charge to the Bureau for consideration
215	360		of administrative proceedings against the licensee.

217	361		D. It shall be unlawful for any person to fail or refuse to
218	362		identify the fact that the person is in actual possession of a
219	363		concealed or unconcealed firearm pursuant to the authority of the
220	364		Oklahoma Self-Defense Act during the course of any arrest,
221	365		detainment, or routine traffic stop. Said identification to the law
222	366		enforcement officer shall be required upon the demand of by the law
223	367		enforcement officer. No person shall be required to identify
224	368		himself or herself a s a handgun licensee or as lawfully in
225		-	possession of any other firearm if the law enfo rcement officer does ~~ENR. H. B. NO. 1789 Page 6~~
	369	+	possession of any other firearm if the law enfo rcement officer does
226	370		not demand the information. No person shall be required to identify
227	371		himself or herself as a handgun licensee being in possession of a
228	372		firearm when no handgun firearm is in the possession of the person
229	373		or in any vehicle in which the pe rson is driving or is a passenger.

231	402		citation for an amount not exceeding One Hundred Dollars ($100.00).

233	403		E. Any law enforcement officer coming in contact with a person
234	404		whose handgun license is suspended, or revoked, or expired, or who
235	405		is in possession of a handgun license which has not be en lawfully
236	406		issued to that person, shall confiscate the license and ret urn it to
237	407		the Oklahoma State Bureau of Investigation for appropriate
238	408		administrative proceedings against the licensee when the l icense is
239	409		no longer needed as evidence in any criminal pro ceeding.

241	410		F. Nothing in this section shall be construed to authorize a
242	411		law enforcement officer to inspect any weapon properly concealed or
243	412		unconcealed without probable cause that a crime has been co mmitted.

252	417		A. The state or any political subdivision of the state, as
253	418		defined in Section 152 of Title 51 of the Oklahoma Statu tes, and its
254	419		officers, agents and employees shall be immune from and not subject

257	421		1. Failure to prevent the licensing of an individual for whom
258	422		the receipt of the license is unlawful pursuant to the provisions of
259	423		the Oklahoma Self-Defense Act or any other provision of law of this

263	453		person pursuant to the provisions of the Oklahoma Self-Defense Act

268	457		on Law Enforcement Education and Training to conduct training under
269	458		the Oklahoma Self-Defense Act, or injury from any misfire or

276	464		4. Any action or fi nding pursuant to a hearing conducted in
277	465		accordance with the Adminis trative Procedures Act as required in the

280	467		B. Firearms instruc tors certified by the Council on Law
281	468		Enforcement Education and Training to conduct training for the
282	469		Oklahoma Self-Defense Act shall be immune from and not subject to
283	470		liability to third persons resulting or arising from any claim based
284	471		on an act or omission of a trainee.

286	472		C. The provisions of this subsecti on shall not apply to claims
287	473		pursuant to the Administ rative Workers' Compensation Act.

296	505		The Legislature finds as a matter of public policy and fact that
297	506		it is necessary to provide statewide uniform standards for issuing
298	507		licenses to carry carrying concealed or unconcealed handguns
299	508		firearms for lawful self-defense and self-protection, and further
300	509		finds it necessary to occupy the field of regulation of the bearing
301	510		of concealed or unconcealed handguns firearms to ensure that no
302	511		honest, law-abiding citizen who qualifies pursuant to the provisions
303	512		of the Oklahoma Self -Defense Act is subjectively or arbitrarily
304	513		denied his or her rights. The Legislature does not delegate to the
305	514		Oklahoma State Bureau of Investigation any authority to regul ate or
306	515		restrict the issuing of handgun licenses except as provided by the
307	516		provisions of this act the Oklahoma Self-Defense Act. Subjective or
308	517		arbitrary actions or rules which encumber the is suing process by
309	518		placing burdens on the applicant beyond those re quirements detailed
310	519		in the provisions of the Oklahoma Self-Defense Act or which create
311	520		restrictions beyond those specified in this act the Oklahoma Self-
312	521		Defense Act are deemed to be in confli ct with the intent of this act
313	522		the Oklahoma Self-Defense Act and are hereby prohibited. The
314	523		Oklahoma Self-Defense Act shall be liberally construed to carry out
315		-	the constitutional right to bear arms for self -defense and self- ~~ENR. H. B. NO. 1789 Page 8~~

316	525		protection. The provisions of the Oklahoma Self-Defense Act are

320	555		However, the conditions that mandate the administrative actions
321	556		of license denial, suspension, revocation or an administrative fine
322	557		are intended to protect the health, safety and public welfare of the
323	558		citizens of this state. The restricting conditions specified in the
324	559		Oklahoma Self-Defense Act generally involve the criminal history,
325	560		mental state, alcohol or substance abuse of the applicant or
326	561		licensee, a hazard of domestic violence, a danger to police
327	562		officers, or the ability of the Oklahoma State Bure au of
328	563		Investigation to properly administer the Oklahoma Self -Defense Act.
329	564		The restricting conditions that establish a risk of injury or harm
330	565		to the public are tail ored to reduce the risks to the benefit of the
331	566		citizens of this state.

340	571		A. The State of Oklahoma shall hereby recognizes recognize any

352	609		authorized to contin ue to carry a concealed or unconcealed firearm
353	610		and license in this state; provided the license from the other state

356	613		persons in Section 1290.8 of this title, remains valid. The firearm
357	614		must either be carried unconcealed or concealed, and upon coming in

373	656		upon instruction from the law enforcement officer , the person must
374	657		disclose the fact that he or she is in possession of a concealed or
375	658		unconcealed firearm pursuant to the nonpermitting laws of the state
376	659		in which he or she is a legal resident. The person shall pre sent
377	660		proper identification by a valid photo ID as proof that he or she is
378	661		a legal resident in such a non-permitting state. The Department of
379	662		Public Safety shall keep a current list of non -permitting states for
380	663		law enforcement officers to confirm that a st ate is nonpermitting.

382	664		C. D. Any person who is twenty -one (21) years of age or older
383	665		having a valid firearm license from another state may apply for a
384	666		handgun license in this state immediately upon establishing a
385	667		residence residency in this state.
