114199 imitation or homemade pistol firearm in violation of state law;

147250 license has not expired or been subsequentl y suspended or revoked;

150252 2. The person is twenty-one (21) years of age or older, and is

153254 a. active military, or

155255 b. a member of the Reserve or National Guard to include
156256 Drill Status Guard and Reserve, Active Guard Reserves
157257 or Military Technicians,

159258 and presents a valid military ident ification card that shall be
160259 considered a valid handgun license issued authorized pursuant to the
161260 Oklahoma Self-Defense Act provisions of Section 1272 of this title.

163261 B. A person in possession of a valid state photo identification
164262 card, driver license, or valid handgun license or who meets the
165263 criteria and presents a valid military identification card as
166264 provided for in this section and is in compliance with the
167265 provisions of the Oklahoma Self-Defense Act shall be authori zed to
168266 carry such concealed or uncon cealed handgun firearm while scouting
169267 as it relates to hunting or fishing or while hunting or fishing.

171268 C. The person shall be require d to have possession of his or
172269 her valid handgun license or, valid military identifica tion card as
173270 provided for qualified persons in this section and a, valid driver
174271 license, or state photo identification card at all times when in

179303 section on demand of a law enforcement officer; provided, however,

181305 criminal activity, an individual carrying an unconcealed or
182306 concealed handgun firearm shall not be disarmed or physically
183307 restrained unless the individual fails to display a one of the

188310 2. A valid military identification car d;

190311 3. A valid driver license; or

192312 4. A valid state photo ident ification card,

195314 that demand. Any violation of the provisions of this subsection may
196315 be punishable as a criminal offense as auth orized by Section 1272 of
197316 this title or pursuant to any other a pplicable provision of law.

199317 Upon the arrest of any person for a violati on of the provisions
200318 of this subsection, the person may show proof to the court that a
201319 valid handgun license and the other required, a valid military
202320 identification card, a valid driver license, or a valid state photo
203321 identification card has been issued to such person and the person
204322 may state any reason why the valid handgun license, a valid military
205323 identification card, valid driver license, or valid state photo

206351 identification card as provided for qualified persons in this
207352 section or the other required ide ntification was not carried by the
208353 person as required by the Oklahoma Self -Defense Act. The court
209354 shall dismiss an allege d violation of Section 1272 of this title
210355 upon payment of court costs, if proof of a valid handgun license and
211356 other required, a valid military identification card, a valid driver
212357 license, or valid state photo identification card is shown to the
213358 court within ten (10) days of the arrest of the person. The court
214359 shall report a dismissal of a charge to the Bureau for consideration
215360 of administrative proceedings against the licensee.

217361 D. It shall be unlawful for any person to fail or refuse to
218362 identify the fact that the person is in actual possession of a
219363 concealed or unconcealed firearm pursuant to the authority of the
220364 Oklahoma Self-Defense Act during the course of any arrest,
221365 detainment, or routine traffic stop. Said identification to the law
222366 enforcement officer shall be required upon the demand of by the law
223367 enforcement officer. No person shall be required to identify
224368 himself or herself a s a handgun licensee or as lawfully in
225-possession of any other firearm if the law enfo rcement officer does ENR. H. B. NO. 1789 Page 6
369+possession of any other firearm if the law enfo rcement officer does
226370 not demand the information. No person shall be required to identify
227371 himself or herself as a handgun licensee being in possession of a
228372 firearm when no handgun firearm is in the possession of the person
229373 or in any vehicle in which the pe rson is driving or is a passenger.

230401 Any violator of the provisions of this subsection may be issued a
231402 citation for an amount not exceeding One Hundred Dollars ($100.00).

233403 E. Any law enforcement officer coming in contact with a person
234404 whose handgun license is suspended, or revoked, or expired, or who
235405 is in possession of a handgun license which has not be en lawfully
236406 issued to that person, shall confiscate the license and ret urn it to
237407 the Oklahoma State Bureau of Investigation for appropriate
238408 administrative proceedings against the licensee when the l icense is
239409 no longer needed as evidence in any criminal pro ceeding.

241410 F. Nothing in this section shall be construed to authorize a
242411 law enforcement officer to inspect any weapon properly concealed or
243412 unconcealed without probable cause that a crime has been co mmitted.

252417 A. The state or any political subdivision of the state, as
253418 defined in Section 152 of Title 51 of the Oklahoma Statu tes, and its
254419 officers, agents and employees shall be immune from and not subject

257421 1. Failure to prevent the licensing of an individual for whom
258422 the receipt of the license is unlawful pursuant to the provisions of
259423 the Oklahoma Self-Defense Act or any other provision of law of this

263453 person pursuant to the provisions of the Oklahoma Self-Defense Act
264454 or by any person who obtains a firearm;

267456 course conducted by a firearms instructor certified by the Council
268457 on Law Enforcement Education and Training to conduct training under
269458 the Oklahoma Self-Defense Act, or injury from any misfire or

459+malfunction of any handgun firearm on a training course firing range
271460 supervised by a certified firearms instructor under the provisions
272461 of the Oklahoma Self-Defense Act, or any injury resulting from

276464 4. Any action or fi nding pursuant to a hearing conducted in
277465 accordance with the Adminis trative Procedures Act as required in the
278466 Oklahoma Self-Defense Act.

280467 B. Firearms instruc tors certified by the Council on Law
281468 Enforcement Education and Training to conduct training for the
282469 Oklahoma Self-Defense Act shall be immune from and not subject to
283470 liability to third persons resulting or arising from any claim based
284471 on an act or omission of a trainee.

286472 C. The provisions of this subsecti on shall not apply to claims
287473 pursuant to the Administ rative Workers' Compensation Act.

296505 The Legislature finds as a matter of public policy and fact that
297506 it is necessary to provide statewide uniform standards for issuing
298507 licenses to carry carrying concealed or unconcealed handguns
299508 firearms for lawful self-defense and self-protection, and further
300509 finds it necessary to occupy the field of regulation of the bearing
301510 of concealed or unconcealed handguns firearms to ensure that no
302511 honest, law-abiding citizen who qualifies pursuant to the provisions
303512 of the Oklahoma Self -Defense Act is subjectively or arbitrarily
304513 denied his or her rights. The Legislature does not delegate to the
305514 Oklahoma State Bureau of Investigation any authority to regul ate or
306515 restrict the issuing of handgun licenses except as provided by the
307516 provisions of this act the Oklahoma Self-Defense Act. Subjective or
308517 arbitrary actions or rules which encumber the is suing process by
309518 placing burdens on the applicant beyond those re quirements detailed
310519 in the provisions of the Oklahoma Self-Defense Act or which create
311520 restrictions beyond those specified in this act the Oklahoma Self-
312521 Defense Act are deemed to be in confli ct with the intent of this act
313522 the Oklahoma Self-Defense Act and are hereby prohibited. The
314523 Oklahoma Self-Defense Act shall be liberally construed to carry out

317553 cumulative to existing rights t o bear arms and nothing in the
318554 Oklahoma Self-Defense Act shall impair or diminish those righ ts.

320555 However, the conditions that mandate the administrative actions
321556 of license denial, suspension, revocation or an administrative fine
322557 are intended to protect the health, safety and public welfare of the
323558 citizens of this state. The restricting conditions specified in the
324559 Oklahoma Self-Defense Act generally involve the criminal history,
325560 mental state, alcohol or substance abuse of the applicant or
326561 licensee, a hazard of domestic violence, a danger to police
327562 officers, or the ability of the Oklahoma State Bure au of
328563 Investigation to properly administer the Oklahoma Self -Defense Act.
329564 The restricting conditions that establish a risk of injury or harm
330565 to the public are tail ored to reduce the risks to the benefit of the
331566 citizens of this state.

357614 must either be carried unconcealed or concealed, and upon coming in
358615 contact with any peace o fficer of this state, the person must
359616 disclose the fact that he or she is in possession of a concea led or

373656 upon instruction from the law enforcement officer , the person must
374657 disclose the fact that he or she is in possession of a concealed or
375658 unconcealed firearm pursuant to the nonpermitting laws of the state
376659 in which he or she is a legal resident. The person shall pre sent
377660 proper identification by a valid photo ID as proof that he or she is
378661 a legal resident in such a non-permitting state. The Department of
379662 Public Safety shall keep a current list of non -permitting states for
380663 law enforcement officers to confirm that a st ate is nonpermitting.

382664 C. D. Any person who is twenty -one (21) years of age or older
383665 having a valid firearm license from another state may apply for a
384666 handgun license in this state immediately upon establishing a
385667 residence residency in this state.
