29	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33	56		SECTION 1. AMENDATORY 82 O.S. 2021, Section 896.16, is
34	57		amended to read as follows:

38	58		A. 1. Until replaced or changed as provided for in subsection
39	59		C of this section, the Grand River Dam Authority is authorized and
40	60		directed to charge an annua l use fee of Thirty-five Dollars ($35.00)
41	61		per commercially owned and operated flotation device on the Illinois
42	62		River within Adair, Cherokee and Delaware Counties.
	63	+	2. The operation of a commercial flotation dev ice without
	64	+	displaying a proper license issued by the Authority shall result in
	65	+	a fine not to exceed One Hundred Dollars ($100.00). The fine shall

61	99		B. For the Flint Creek and Illinois River within Adair,
62	100		Cherokee and Delaware Counties and those portions of Barr en Fork
63	101		Creek within Cherokee County, the Authority is authorized and
64	102		directed to charge until replaced or changed as provided for in
65	103		subsection C of this section:

69	104		1. An annual use fee of Ten Dollars ($10.00) per noncommercial,
70	105		privately owned device; or

74	106		2. A use fee of One Dollar ($1.00) per day for all
75	107		noncommercial, privately owned flotation devices floating upon a
76	108		designated scenic river. Landowners located immediately adjac ent to
77	109		a designated scenic river shall not be required to pay any fee for
78	110		private use as authorized in this section or otherwise by law.

82	111		C. Under the provisions of Section 5 of this act Section 896.2
83	112		of this title granting the Authority the power to estab lish licenses
84	113		and set fees, the Authority may promulgate rules for the collection
85	114		and administration of the fees imposed pursuant to th e provisions of
86	115		this section or may promulgate rules establishing licenses ,
87	116		providing for the issuance, r enewal, revocation, denial and

88	144		suspension of licenses, and setting fees that change or replac e the
89	145		licenses and fees imposed pursuant to the provisions of this
90	146		section. Upon final adoption of rules changing or replacing any or
91	147		all of the licenses and fees im posed pursuant to the provisions of

	148	+	this section, the Authority shall cease to impose, col lect or charge
93	149		the license and fee that was changed or rep laced by rule. Rules
94	150		promulgated by the Authority pursuant to this section shall be in
95	151		accordance with the Administrative Procedures Act.

99	152		D. Until replaced or changed as provided for in subsection C of
100	153		this section, the Grand River Dam Authority may char ge a fee for use
101	154		of camping sites located in public use and access areas controlled
102	155		by the Authority in an amount that does not exceed the rate charged
103	156		by the Oklahoma Tourism and Recreation Departm ent for camping sites.

107	157		E. For the purposes of the Scenic Rivers Act, "commercial
108	158		flotation device" means a canoe, boat, kayak, inner tube, raft or
109	159		other similar device suitable for the transportation of a person or
110	160		persons on waterways which is available for hire by the public for
111	161		use on scenic rivers.

115	162		SECTION 2. It being immediately necessary for the preservation
116	163		of the public peace, health or safety, an emergency is hereby
117	164		declared to exist, by reason whereof this act shall take effect a nd
118	165		be in full force from and after its passage and approval.
