3999 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

41100 SECTION 1. AMENDATORY 63 O.S. 2021, Secti on 2-402, as
42101 amended by Section 3, State Question No. 780, In itiative Petition
43102 No. 404, is amended to read as follows:

45103 Section 2-402. A. 1. It shall be unlawful for any person
46-knowingly or intentionally to possess a controlled dangerous ENR. H. B. NO. 2153 Page 2
104+knowingly or intentionally to possess a controlled dangerous
47105 substance unless such substance was obtained d irectly, or pursuant
48106 to a valid prescription or order from a practitioner, while acting
49107 in the course of his or her prof essional practice, or except as
50108 otherwise authorized by this act Section 2-101 et seq. of this
51109 title.

53110 2. It shall be unlawful for any p erson to purchase any
54111 preparation excepted from the provi sions of the Uniform Controlled
55112 Dangerous Substances Act pursua nt to Section 2-313 of this title in
56113 an amount or within a time interval other than that permitted by
57114 Section 2-313 of this title.

59115 3. It shall be unlawful for any person or business to sell,
60116 market, advertise or label any product containing ephedrine, its
61117 salts, optical isomers, or salts of op tical isomers, for the
62118 indication of stimulation, mental alertness, weight loss, appetite
63119 control, muscle development, energy or other indication which is not
64120 approved by the pertinent federal OTC Final Monograph, Ten tative
65121 Final Monograph, or FDA -approved new drug application or its legal

66148 equivalent. In determining compliance with this requirement, the
67149 following factors shall be considered:

69150 a. the packaging of the product,

71151 b. the name of the product, and
72-
73152 c. the distribution and promotion of the product,
74153 including verbal representations made at the point of
75154 sale.

77155 B. 1. Any person who violates this s ection is guilty of a
78156 misdemeanor punishable by confineme nt for not more than one (1) year
79157 and by a fine not exceeding O ne Thousand Dollars ($1,000.00) .

81158 2. Any person who violates this section a second time within
82159 ten (10) years, upon conviction, shall be guilty of a misdemeanor.
83160 The court may, with the consen t of the defendant, order the
84161 defendant to complete a substa nce abuse assessment and evaluation
85162 and to complete a diversion program for up to one (1) year following
86163 the date of conviction in lieu of other punishments. At the
87164 discretion of the court, the diversion program may include drug
88165 testing as a requirement. If the defendant refuses or fails to
89166 complete the assessment and evaluation or diversion program, the
90-court may impose punishment as provided for in paragraph 1 of this ENR. H. B. NO. 2153 Page 3
167+court may impose punishment as provided for in paragraph 1 of this
91168 subsection. The provisions of this paragraph shall not apply to
92169 violations related to the possession of marijuana .

96198 punishable by a fine not exceeding One Thousand Dollars ($1,000.00),
97199 imprisonment in the county jail for a minimum of thirty (30) days ,
98200 or by both such fine and imprisonment. The court may, with the
99201 consent of the defendant, order the defendant to complete a
100202 substance abuse assessment and evaluation and to com plete a
101203 diversion program for up to three (3) years following the date of
102204 conviction. At the discretion of the court, the diversion program
103205 may include drug testing as a requirement . If the defendant refuses
104206 or fails to complete the assessment and evalua tion or diversion
105207 program, the court may impose punishment as provided for in
106208 paragraph 1 of this subsection. The provisions of this paragraph
107209 shall not apply to violations related to the possession of
108210 marijuana.

110211 4. a. Any person who violates this section a fourth time
111212 within ten (10) year s shall, upon conviction, be
112213 guilty of a felony p unishable by a fine not exceeding
113214 Five Thousand Dollars ($5,000.00), imprisonment in the
114215 custody of the Department of Corrections for not less
115216 than one (1) year nor mo re than five (5) years , or by
116217 both such fine and imprisonment .

118218 b. Upon a verdict or plea of guilty or upon a plea of
119219 nolo contendere, but before a judgment of guilt of a
120220 violation of this paragr aph, the court may, without
121221 entering a judgment of guilt and with the consent of

122248 the defendant, defer further proceedings upon the
123249 specific conditions prescribed by the court not to
124250 exceed a three-year period. The court may, with the
125251 consent of the defend ant, order the defendant to
126252 complete a substance abuse asse ssment and evaluation
127253 and to complete a diversi on program for up to three
128254 (3) years.

130255 c. Upon successful completion of the court-ordered
131256 substance abuse assessment and evaluation and
132-diversion program within the time prescribed, the
133-felony charge shall be changed to a misdemeanor . If

361+SECTION 3. AMENDATORY 21 O.S. 2021, Secti on 1704, is
362+amended to read as follows:
363+Section 1704. Grand larceny is larceny committ ed in either of
364+the following cases:
365+1. When the property taken i s of a value of One Thousand
366+Dollars ($1,000.00) Seven Hundred Fifty Dollars ($750.00) or
367+greater; or
368+2. When such property, although not of a v alue of One Thousand
369+Dollars ($1,000.00) Seven Hundred Fifty Dollars ($750.00) or
370+greater, is taken from the pe rson of another.

398+SECTION 4. AMENDATORY 21 O.S. 2021, Section 1705, is
399+amended to read as follows:
400+Section 1705. A. Grand larceny is a felony punishable as
401+follows:
402+1. If the value of the property is less than One Thousand
403+Dollars ($1,000.00) Seven Hundred Fifty Dollars ($750.00) , the
404+person shall be punished by imprisonment in th e county jail for a
405+term not to exceed one (1) year or by incarceration in the county
406+jail for one or more nigh ts or weekends pursuant to Section 991a -2
407+of Title 22 of the Oklahoma Statutes, at the option of the co urt, or
408+by a fine not to exceed One Thousa nd Dollars ($1,000.00), or by both
409+such imprisonment and fine;
410+2. If the property is one or more firearms, the property is
411+taken from the person of another, or the value o f the property is
412+One Thousand Dollars ($1 ,000.00) Seven Hundred Fifty Dollars
413+($750.00) or more but less than Two Thousand Five Hundre d Dollars
414+($2,500.00), the person shall be punished by impri sonment in the
415+custody of the Department of Corrections for a term not to exceed
416+two (2) years or in th e county jail for a term not to exceed one (1)
417+year, or by a fine not to exceed One Thousand Dollars ($1,000.00),
418+or by both such imprisonment and fine;
419+3. In the event the value of the property is Two Thousand Fi ve
420+Hundred Dollars ($2,500.00) or more but less than Fifteen Thousand

447+Dollars ($15,000.00), the person shall be punished by imprisonmen t
448+in the custody of the Department of Corrections for a term not to
449+exceed five (5) years or in the county jail for a ter m not to exceed
450+one (1) year, or by a fine not to exceed One Thousand Dollars
451+($1,000.00), or by both such imprisonment and fine; or
452+4. If the value of the property is Fifteen Thousand Dollars
453+($15,000.00) or more, the person shall be punished by imprison ment
454+in the custody of the Department of C orrections for a term not to
455+exceed eight (8) years, or by a fine not to exceed One Thousand
456+Dollars ($1,000.00), or by both such imprisonment and fine.
457+B. The person shall also be ordered to pay restitution to th e
458+victim as provided in Section 991f of Ti tle 22 of the Oklahoma
459+Statutes.
460+SECTION 3. AMENDATORY 21 O.S. 2021, Section 1706, is
461+amended to read as follows:
462+Section 1706. A. Petit larceny shall be punishable by a fine
463+of not less than Ten Dollars ($10.00) or more than Five Hundred
464+Dollars ($500.00), or imprisonment in th e county jail not to exceed
465+six (6) months, or by both such fine and impr isonment, at the
466+discretion of the court.
467+B. Upon a third or subsequent conviction for petit larceny, the
468+person shall be guilty of a f elony.
469+SECTION 4. It being immediately necessary for th e preservation
470+of the public peace, health or safety, an emergency is hereby
471+
