51		-	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52		-	SECTION 1. AMENDATORY 62 O.S. 2021, Section 3103, as
53		-	amended by Section 1, Chapter 306, O.S.L. 2022 (62 O.S. Supp. 2022,
54		-	Section 3103), is amended to read as follows :
55		-	Section 3103. As used in the Oklahoma Pension Legislation
56		-	Actuarial Analysis Act:
57		-	1. "Amendment" means any amendment, including a substitute
58		-	bill, made to a retirement bill by any committee of the House or

	95	+	SECTION 1. AMENDATORY 62 O.S. 2021, Section 3103, as
	96	+	amended by Section 1, Chapter 306, O.S.L. 2022 (62 O.S. Supp. 2022,
	97	+	Section 3103), is amende d to read as follows :
	98	+	Section 3103. As used in the Oklahoma Pension Legislation
	99	+	Actuarial Analysis Act:
	100	+	1. "Amendment" means any amendment, including a substitute
	101	+	bill, made to a retirement bill by any committee of the House or
	102	+	Senate, any conference committee of the House or Senate or by the
	103	+	House or Senate;
	104	+	2. "RB number" means that number precede d by the letters "RB"
	105	+	assigned to a retirement bill by the respective staffs of the
	106	+	Oklahoma State Senate and the Oklahoma House of Representatives when
91	107		the respective staff office prepares a retirement bill for a member
92	108		of the Legislature;
93	109		3. "Legislative Actuary" means the firm or entity that enters
94	110		into a contract with the Legislative Service Bureau pursuant to
95	111		Section 452.15 of Title 74 of the Oklahoma Statutes to provide the
96	112		actuarial services and other duties provided for in the Oklahoma
97	113		Pension Legislation Actuarial Analysis Act;
98	114		4. "Nonfiscal amendment" means an amendment to a retirement
99	115		bill having a fiscal impact, which amendment does not change any
100	116		factor of an actuarial investigation specified in subsection A of
101	117		Section 3109 of this title;
102		-	5. "Nonfiscal retirement bill" means a retirement bill:
103		-	a. which does not affect the cost or funding factors of a
104		-	retirement system,
105		-	b. which affects such factors only in a manner which does
106		-	not:
107		-	(1) grant a benefit increase under the retirement
108		-	system affected by the bill,
109		-	(2) create an actuarial accrued liability for or
110		-	increase the actuarial accrued liability of the
111		-	retirement system affected by the bill, or
112		-	(3) increase the normal cost of the retirement system

	145	+	retirement system,
	146	+	b. which affects such factors only in a manner which does
	147	+	not:
	148	+	(1) grant a benefit increase under the retirement
	149	+	system affected by the bill,
	150	+	(2) create an actuarial accrued liability for or
	151	+	increase the actuarial accrued liability of the
	152	+	retirement system affected by the bill, or
	153	+	(3) increase the normal cost of the retirement system
	154	+	affected by the bill,
141	155		c. which authorizes the purchase by an active member of
142	156		the retirement system, at the actuarial cost for the
143	157		purchase as computed pursuant to the statute in effect
144	158		on the effective date of the measure allowing such
145	159		purchase, of years of service for purposes of reaching
146	160		a normal retirement date in the applicable retirement
147	161		system, but which cannot be used in order to compute
148	162		the number of years of service for purposes of
149	163		computing the retirement benefit for the member,
150	164		d. which provides for the computation of a service-
151	165		connected disability retirement benefit for members of
152	166		the Oklahoma Law Enforcement Retirement System
153		-	pursuant to Section 2-305 of Title 47 of the Oklahoma
154		-	Statutes if the members were unable to complete twenty
155		-	(20) years of service as a result of the disability,
156		-	e. which requires membership in the defined benefit plan
157		-	authorized by Section 901 et seq. of Title 74 of the
158		-	Oklahoma Statutes for persons whose first elected or
159		-	appointed service occurs on or after November 1, 2018,
160		-	if such persons had any prior service in t he Oklahoma
161		-	Public Employees Retirement System prior to November
162		-	1, 2015,
163		-	f. which provides for a one-time increase in retirement

252	262		from the Oklahoma Firefighters Pension and
253		-	Retirement System as a paid firefighter.
254		-	As used in this subparagr aph, "funded ratio" means the
255		-	figure derived by dividing the actuarial value of
256		-	assets of the applicable retirement system by the
257		-	actuarial accrued liability of the applicable
258		-	retirement system,
259		-	g. which modifies the disability pension standard for
260		-	police officers who are members of the Oklahoma Police
261		-	Pension and Retirement System as provi ded by Section 3
262		-	50-115 of this act Title 11 of the Oklahoma Statutes,
263		-	h. which provides a cost-of-living benefit increase
264		-	pursuant to the provisions of:
265		-	(1) Section 49-143.7 of Title 11 of the Oklahoma

309		-	A nonfiscal retirement bill shall include any retirement bill
310		-	that has as its sole purpose the appropriation or distribution or
311		-	redistribution of monies in some manner to a retirement system for
312		-	purposes of reducing the unfunded liability of such system or the
313		-	earmarking of a portion of the revenue from a tax to a reti rement
314		-	system or increasing the percentage of the revenue earmarked from a
315		-	tax to a retirement system;
316		-	6. "Reduction-in-cost amendment" means an amendment to a
317		-	retirement bill having a fiscal impact which reduces the cost of the RBH No. 8002

350	356		affecting a retirement system. A retirement bill shall not mean a
351	357		bill or resolution that impacts the revenue of any state tax in
352	358		which a portion of the revenue generated fr om such tax is earmarked
353		-	for the benefit of a reti rement system;
354		-	8. "Retirement bill having a fiscal impact" means any
355		-	retirement bill creating or establishing a retirement system and any
356		-	other retirement bill other than a nonfiscal retirement bill; and
357		-	9. "Retirement system" means the Teachers' Retirement System of
358		-	Oklahoma, the Oklahoma Public Employees Retirement System, the
359		-	Uniform Retirement System for Justices and Judges, the Oklahoma
360		-	Firefighters Pension and Retirement System, the Oklahoma Police
361		-	Pension and Retirement System, the Oklahoma Law Enf orcement
362		-	Retirement System, or a retirement system established after January
363		-	1, 2006.

406	435		Statutes who are seventy-five (75) years of age or older shall
407	436		receive Five Hundred Dollars ($500.00), whi ch shall not be included

409	438		benefit increase to be calculated pursuant to paragraph 4 o f this
410	439		section. The retirement benefit increase for members receiving a
411	440		benefit pursuant to Section 49 -101 of Title 11 of the Oklahoma
412	441		Statutes shall be One Hundred Fifty Dollars ($15 0.00);
413	442		3. The retirement benefit increase shall not be a modification
414	443		of the final average compensation used in order to compute the
415	444		retirement benefit of the member; and
416	445		4. The retirement benefit increa se may only be computed by
	446	+	using the then-applicable gross annual retirement benefi t for the
	447	+	member divided by the whole number twelve (12). The resulting
	448	+	amount may be paid to the retired member in addition to the
	449	+	retirement benefits otherwise payable to the member.
