2956 SECTION 1. AMENDATORY 15 O.S. 2021, Section 777.4, i s
3057 amended to read as follows:

3258 Section 777.4 A. No person for the duration of a declaration
3359 of emergency by the Go vernor of this state or by the Presid ent of
3460 the United States and for thirty (30) days ther eafter shall sell,
3561 rent, or lease, or offer to sel l, rent, or lease, for delivery in
3662 the emergency area, any goods, services, dwelling units, or storage
3763 space in the emergency area at a rate or price wh ich is more than
3864 ten percent (10%) above the rate or p rice charged by the person for
3965 the same or similar goods, services, dwelling units, or storage

4093 spaces immediately prior to the declaration of emergency unless the

4395 1. To price increases in applicable regional, national or
4496 international petroleum and natural gas commodity markets; or

4697 2. Only to factors unrelated to the emergency and does not
4798 include any increase in profit to the seller or owner.

4999 B. Upon the expiration of t he period described in subsection A
50100 of this section and for one hundred eighty (180) day s thereafter, no
51101 person shall, within the emergency area, rent or lease or offer to
52102 rent or lease any dwelling unit or storage space or sell or offer to
53103 sell goods for use within the emergency area to repai r, restore,
54104 remodel, or construct any dwelling uni t for a price of more than ten
55105 percent (10%) above the pri ce charged by that person for the
56106 dwelling unit, storage space, or goods immediately prior to the
57107 declaration of emergency unless the increase in th e price is
58108 attributable to:

60109 1. Price increases in applicable regional, national, or
61110 international petroleum and natural gas commodity markets; or

63111 2. Factors unrelated to the emergency and does not include any
64112 increase in profit to t he seller or owner.

66113 C. A rate or price increase approved by the appropr iate
67114 governmental agency is not a violation of this act.

69142 D. This section shall not apply to growers, producers, or
70143 processors of raw or processed food products, except for retail
71144 sales of such products to a consumer.

73145 E. This section shall not apply to sa les, rentals, or leases of
74146 goods from a catalog when the c atalog is made available in the
75147 normal course of business both prior to and after the declaration of
76148 emergency to all persons regardless of location in the emergency
77149 area.

79150 F. This section shall not apply to advertised rates and prices
80151 which are subject to a published expiration date within or
81152 immediately prior to the declaration of emergency.

83153 SECTION 2. It being immediately necessary for the preservation
84154 of the public peace, health or safety, an emergency is hereby
85155 declared to exist, by re ason whereof this act shall take effect and
86156 be in full force from and after its passage an d approval.
