27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 15 O.S. 2021, Section 777.4, i s
30	57		amended to read as follows:

32	58		Section 777.4 A. No person for the duration of a declaration
33	59		of emergency by the Go vernor of this state or by the Presid ent of
34	60		the United States and for thirty (30) days ther eafter shall sell,
35	61		rent, or lease, or offer to sel l, rent, or lease, for delivery in
36	62		the emergency area, any goods, services, dwelling units, or storage
37	63		space in the emergency area at a rate or price wh ich is more than
38	64		ten percent (10%) above the rate or p rice charged by the person for
39	65		the same or similar goods, services, dwelling units, or storage

40	93		spaces immediately prior to the declaration of emergency unless the
41	94		increase in the rate or price is attrib utable:

43	95		1. To price increases in applicable regional, national or
44	96		international petroleum and natural gas commodity markets; or

46	97		2. Only to factors unrelated to the emergency and does not
47	98		include any increase in profit to the seller or owner.

49	99		B. Upon the expiration of t he period described in subsection A
50	100		of this section and for one hundred eighty (180) day s thereafter, no
51	101		person shall, within the emergency area, rent or lease or offer to
52	102		rent or lease any dwelling unit or storage space or sell or offer to
53	103		sell goods for use within the emergency area to repai r, restore,
54	104		remodel, or construct any dwelling uni t for a price of more than ten
55	105		percent (10%) above the pri ce charged by that person for the
56	106		dwelling unit, storage space, or goods immediately prior to the
57	107		declaration of emergency unless the increase in th e price is
58	108		attributable to:

60	109		1. Price increases in applicable regional, national, or
61	110		international petroleum and natural gas commodity markets; or

63	111		2. Factors unrelated to the emergency and does not include any
64	112		increase in profit to t he seller or owner.

66	113		C. A rate or price increase approved by the appropr iate
67	114		governmental agency is not a violation of this act.

69	142		D. This section shall not apply to growers, producers, or
70	143		processors of raw or processed food products, except for retail
71	144		sales of such products to a consumer.

73	145		E. This section shall not apply to sa les, rentals, or leases of
74	146		goods from a catalog when the c atalog is made available in the
75	147		normal course of business both prior to and after the declaration of
76	148		emergency to all persons regardless of location in the emergency
77	149		area.

79	150		F. This section shall not apply to advertised rates and prices
80	151		which are subject to a published expiration date within or
81	152		immediately prior to the declaration of emergency.

83	153		SECTION 2. It being immediately necessary for the preservation
84	154		of the public peace, health or safety, an emergency is hereby
85	155		declared to exist, by re ason whereof this act shall take effect and
86	156		be in full force from and after its passage an d approval.
