An Act relating to ABLE accounts and programs; 
requiring executive agencies, boards, commissions and 
departments to make information available regarding 
ABLE accounts; specifying methods for distribution of 
information; requiring contracting entities to 
provide information regarding ABLE accounts; 
providing for codification; providing an effective 
date; and declaring an emergency. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Sec tion 4001.6 of Title 56, unless there 
is created a duplica tion in numbering, reads as follows: 
A.  Any agency, board, commission, department or entity 
organized within the executive branch that has contact with persons 
who might be able to utilize the provisions of the Oklahoma ABLE Act 
and establish an account for an eligible beneficiary shall have 
information readily accessible to persons with whom th e agency might 
have contact, in the form of a brochure or other publication or by

making information about the program available o n the agency website 
or both. 
B.  Subsection A of this section shall be applicable to: 
1.  The State Department of Education; 
2.  The Oklahoma State D epartment of Health; 
3.  The Department of Hu man Services; 
4.  The Department of Mental Health and Substance Abuse 
Services; 
5.  The Department of Rehabilitation Services; and 
6.  The Oklahoma Department of Veterans Affairs. 
C.  Any entity that enters into contract with the governmental 
entities described by subsection A of this section shall also, as a 
condition of the contract, make information available using the same 
or similar methods as those used by the executive branch entities. 
SECTION 2.  This act shall become effective July 1, 2023. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
