99-SECTION 1. NEW LAW A new section of law to be codified
100-in the Oklahoma Statu tes as Section 1024.6 of Title 21, unless there
101-is created a duplication in numbering, reads as follows:
102-A. As used in this section:
103-1. "Adult performance" means any performance that contains
104-obscene material, if done in view of a minor or in a public place;
10595 2. "Obscene material" shall have the same mea ning as such term
10696 is defined in subsection B of Sectio n 1024.1 of Title 21 of the
10797 Oklahoma Statutes;
10898 3. "Minor" means an unmarried person under eighteen (18) years
10999 of age; and
110100 4. "Public place" means any area or space that the general
111101 public may freely access without payment for admission; provided,
112102 however, any place that limits access pursuant to an admission s
113103 process or that restricts minors from entering the area or space to
114104 participate or take part i n any event shall be exempt from the
115105 provisions of this section.
116106 B. 1. It shall be unlawful for a person to engage in an adult
117107 performance which contains obscene material , or for any political
118108 subdivision of this state to allow, permit, organize, or authorize
119109 the viewing of an adult performance which contains obscene material,
120-on public property or in a public place where a minor, as part of
121-the general public, wi ll be exposed to view such adult performance.

157154 D. The provisions of this section shall preempt any ordinance,
158155 regulation, or restriction that was lawfully adopted or license that
159156 was issued by a political s ubdivision of this state prior to the
160157 effective date of this act that is in conflict with the provisions
161158 of this section.
162159 SECTION 2. It being immediately necessary for the preservation
163160 of the public peace, health or safety, an emergency is hereby
164161 declared to exist, by reason whereof this act shall take effect and
165162 be in full force from and after its passage an d approval.

258-SECTION 3. AMENDATORY 21 O.S. 2021, Section 1024.1, is
259-amended to read as follows:
260-Section 1024.1. A. As used in Sections 1021 , 1021.1 through
261-1021.4, Sections 1022 through 1024 1024.4, and Sections 1040.8
262-through 1040.24 of this title, “child pornography” means and
263-includes any visual depiction or individual image stored or
264-contained in any format on any medium including, but not limited to,
265-film, motion picture, videotape, photograph, negative, undeveloped
266-film, slide, photographic product, repro duction of a photographic
267-product, play or performance wherein a minor under the age of
268-eighteen (18) years is engaged in any act with a person, other than
269-his or her spouse, of sexual intercour se which is normal or
270-perverted, in any act of anal sodomy, in any act of sexual activity

297-with an animal, in any act of sadomasochistic abuse including, but
298-not limited to, flagellation or torture, or the condition of being
299-fettered, bound or otherwise phy sically restrained in the context of
300-sexual conduct, in any ac t of fellatio or cunnilingus, in any act of
301-excretion in the context of sexual conduct, in any lewd exhibition
302-of the uncovered genitals in the context of masturbation or other
303-sexual conduct, or where the lewd exhibition of the uncovered
304-genitals, buttocks or, if such minor is a female, the breast, has
305-the purpose of sexual stimulation of the viewer, or wherein a person
306-under the age of eighteen (18) years observes such acts or
307-exhibitions. Each visual depiction or individual image shall
308-constitute a separate item and multiple copies of the same identical
309-material shall each be counted as a separate item.
310-B. As used in Sections 1021 through 1024.4 and Sections 1040.8
311-through 1040.24 of this tit le:
312-1. “Obscene material” means and includes any representati on,
313-performance, depiction or description of sexual conduct, whether in
314-any form or on any medium including still photographs, undeveloped
315-photographs, motion picture s, undeveloped film, videota pe, optical,
316-magnetic or solid-state storage, CD or DVD, or a purely photographic
317-product or a reproduction of such product in any book, pamphlet,
318-magazine, or other publication or electronic or photo -optical
319-format, if said such items contain the following ele ments:

346-a. depictions or descriptions of sexual conduct wh ich are
347-patently offensive as found by the average person
348-applying contemporary community standards,
349-b. taken as a whole, have as the dominant theme an appeal
350-to prurient interest in sex, or in minors create a
351-prurient interest in sex, as found by the average
352-person applying contemporary community standards, and
353-c. a reasonable person would find the materia l or
354-performance taken as a whole lacks serious literary,
355-artistic, educational, political, or scientific
356-purposes or value; provided, however, such standard
357-shall not apply when an adult knowingly provides
358-material that qualifies as obscene to a minor without
359-written informed consent by the minor’s parent or
360-guardian.
361-The standard for obsceni ty applied in this section shall not appl y
362-to child pornography;
363-2. “Performance” means and includes any display, live or
364-recorded, in any form or medium;
365-3. “Sexual conduct” means and includes any of the following:
366-a. acts of sexual intercourse including any int ercourse
367-which is normal or perverted, actual or simula ted,
368-b. acts of deviate deviant sexual conduct, including oral
369-and anal sodomy,

396-c. acts of masturbation,
397-d. acts of sadomasochistic abuse including but not
398-limited to:
399-(1) flagellation or torture by or upon any person who
400-is nude or clad in undergarments o r in a costume
401-which is of a revealing nature, or
402-(2) the condition of being fettered, bound, or
403-otherwise physically restrained on the p art of
404-one who is nude or so clothed,
405-e. acts of excretion in a sexual context, or
406-f. acts of exhibiting human genitals or pubic areas; and
407-4. “Explicit child pornography” means material which a law
408-enforcement officer can immediately identify upon fir st viewing
409-without hesitation as child pornography.
410-The types of sexual conduct described in paragraph 3 of this
411-subsection are intended to include situations when, if appropriate
412-to the type of conduct, the conduct is performed alone or between
413-members of the same or opposite sex or between humans and animals in
414-an act of apparent sexual stimulation or gratification.
415-SECTION 4. This act shall become effective November 1, 2023.
