16563 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16664 SECTION 1. AMENDATORY 63 O.S. 2021, Secti on 2-402, as
16765 amended by Section 3, State Question No. 780, In itiative Petition
16866 No. 404, is amended to read as follows:
16967 Section 2-402. A. 1. It shall be unlawful for any person
17068 knowingly or intentionally to possess a controlled dangerous
17169 substance unless such substance was obtained d irectly, or pursuant
172-to a valid prescription or order from a practitioner, while acting
173-in the course of his or her prof essional practice, or except as

97+to a valid prescription or order from a practitioner, while acting
98+in the course of his or her prof essional practice, or except as
20099 otherwise authorized by this act Section 2-101 et seq. of this
201100 title.
202101 2. It shall be unlawful for any p erson to purchase any
203102 preparation excepted from the provi sions of the Uniform Controlled
204103 Dangerous Substances Act pursua nt to Section 2-313 of this title in
205104 an amount or within a time interval other than that permitt ed by
206105 Section 2-313 of this title.
207106 3. It shall be unlawful for any person or business to sell,
208107 market, advertise or label any product containing ephedrine, its
209108 salts, optical isomers, or salts of optical isomers, for the
210109 indication of stimulation, mental alertness, weight loss, appetite
211110 control, muscle development, energy or other indication which is not
212111 approved by the pertinent federal OTC Final Monograph, Ten tative
213112 Final Monograph, or FDA -approved new drug application or its legal
214113 equivalent. In determ ining compliance with this requirement, the
215114 following factors shall be considered:
216115 a. the packaging of the product,
217116 b. the name of the product, and
218117 c. the distribution and promotion of the product,
219118 including verbal representations made at the point of
220119 sale.
221-B. 1. Any person who violates this s ection is guilty of a
222-misdemeanor punishable by confineme nt for not more than one (1) year
223-and by a fine not exceeding O ne Thousand Dollars ($1,000.00) .

147+B. 1. Any person who violates this s ection is guilty of a
148+misdemeanor punishable by confineme nt for not more than one (1) year
149+and by a fine not exceeding O ne Thousand Dollars ($1,000.00) .
250150 2. Any person who violates this section a second time within
251151 ten (10) years, upon conviction, shall be guilty of a misdemeanor.
252152 The court may, with the consen t of the defendant, order the
253153 defendant to complete a substa nce abuse assessment and evaluation
254154 and to complete a diversion program for up to one (1) year following
255155 the date of conviction in lieu of other punishments. At the
256156 discretion of the court, the diversion program may include drug
257157 testing as a requirement. If the defendant refuses or fails to
258158 complete the assessment and evaluation or diversion program , the
259159 court may impose punishment as provided for in paragraph 1 of this
260160 subsection.
261161 3. Any person who violates this section a third time within ten
262162 (10) years shall, upon conviction, be guilty of a misdemeanor
263163 punishable by a fine not exceeding One Thousand Dollars ($1,000.00),
264164 imprisonment in the county jail for a minimum of thirty (30) days ,
265165 or by both such fine and imprisonment. The court may, with the
266166 consent of the defendant, order the defendant to complete a
267167 substance abuse assessment and evaluation and to com plete a
268168 diversion program for up to three (3) years following the date of
269169 conviction. At the discretion of the court, the diversion program
270170 may include drug testing as a requirement . If the defendant refuses
271-or fails to complete the assessment and evaluation or d iversion
272-program, the court may impose punishment as provided for in
273-paragraph 1 of this subsection.

199+program, the court may impose punishment as provided for in
200+paragraph 1 of this subsection.
300201 4. a. Any person who violates this section a fourth time
301202 within ten (10) year s shall, upon conviction, be
302203 guilty of a felony punishable by a fine not exceeding
303204 Five Thousand Dollars ($5,000.00), imprisonment in the
304205 custody of the Department of Corrections for not less
305206 than one (1) year nor mo re than five (5) years , or by
306207 both such fine and imprisonment .
307208 b. Upon a verdict or plea of guilty or upon a plea of
308209 nolo contendere, but before a judgment of guilt of a
309210 violation of this paragr aph, the court may, without
310211 entering a judgment of guilt and with the consent of
311212 the defendant, defer further proceedings upon the
312213 specific conditions prescribed by the co urt not to
313214 exceed a three-year period. The court may, with the
314215 consent of the defend ant, order the defendant to
315216 complete a substance abuse asse ssment and evaluation
316217 and to complete a diversi on program for up to three
317218 (3) years.
318219 c. Upon successful completion of the court-ordered
319220 substance abuse assessment and evaluation and
320221 diversion program ordered by the court within the time
321-prescribed, the felony charge shall be changed to a
322-misdemeanor. If the defendant refuses or fails to
323-complete the assessment and evaluation or diversion

249+prescribed, the felony charge shall be changed to a
250+misdemeanor. If the defendant refuses or fails to
251+complete the assessment and evaluation or diversion
350252 program, the court may impose punishment as provided
351253 for in subparagraph a of this paragraph.
352254 5. The provisions of this subsection shall not apply f or
353255 violations related to the possession of marijuana .
354256 C. Any person convicted of a ny offense described in thi s
355257 section shall, in addition to any fine imposed, pay a special
356258 assessment trauma-care fee of One Hundred Dolla rs ($100.00) to be
357259 deposited into the Trauma Care Assistance Revolving Fund created in
358260 Section 1-2530.9 of this title.
359261 SECTION 2. This act shall become effective November 1, 2023.
