169 | 67 | | Section 2-402. A. 1. It shall be unlawful for any person |
---|
170 | 68 | | knowingly or intentionally to possess a controlled dangerous |
---|
171 | 69 | | substance unless such substance was obtained d irectly, or pursuant |
---|
200 | 99 | | otherwise authorized by this act Section 2-101 et seq. of this |
---|

---|
202 | 101 | | 2. It shall be unlawful for any p erson to purchase any |
---|
203 | 102 | | preparation excepted from the provi sions of the Uniform Controlled |
---|
204 | 103 | | Dangerous Substances Act pursua nt to Section 2-313 of this title in |
---|
205 | 104 | | an amount or within a time interval other than that permitt ed by |
---|
206 | 105 | | Section 2-313 of this title. |
---|
207 | 106 | | 3. It shall be unlawful for any person or business to sell, |
---|
208 | 107 | | market, advertise or label any product containing ephedrine, its |
---|
209 | 108 | | salts, optical isomers, or salts of optical isomers, for the |
---|
210 | 109 | | indication of stimulation, mental alertness, weight loss, appetite |
---|
211 | 110 | | control, muscle development, energy or other indication which is not |
---|
212 | 111 | | approved by the pertinent federal OTC Final Monograph, Ten tative |
---|
213 | 112 | | Final Monograph, or FDA -approved new drug application or its legal |
---|
214 | 113 | | equivalent. In determ ining compliance with this requirement, the |
---|
215 | 114 | | following factors shall be considered: |
---|
216 | 115 | | a. the packaging of the product, |
---|
217 | 116 | | b. the name of the product, and |
---|
218 | 117 | | c. the distribution and promotion of the product, |
---|
219 | 118 | | including verbal representations made at the point of |
---|
220 | 119 | | sale. |
---|
250 | 150 | | 2. Any person who violates this section a second time within |
---|
251 | 151 | | ten (10) years, upon conviction, shall be guilty of a misdemeanor. |
---|
252 | 152 | | The court may, with the consen t of the defendant, order the |
---|
253 | 153 | | defendant to complete a substa nce abuse assessment and evaluation |
---|
254 | 154 | | and to complete a diversion program for up to one (1) year following |
---|
255 | 155 | | the date of conviction in lieu of other punishments. At the |
---|
256 | 156 | | discretion of the court, the diversion program may include drug |
---|
257 | 157 | | testing as a requirement. If the defendant refuses or fails to |
---|
258 | 158 | | complete the assessment and evaluation or diversion program , the |
---|
259 | 159 | | court may impose punishment as provided for in paragraph 1 of this |
---|
260 | 160 | | subsection. |
---|
261 | 161 | | 3. Any person who violates this section a third time within ten |
---|
262 | 162 | | (10) years shall, upon conviction, be guilty of a misdemeanor |
---|
263 | 163 | | punishable by a fine not exceeding One Thousand Dollars ($1,000.00), |
---|
264 | 164 | | imprisonment in the county jail for a minimum of thirty (30) days , |
---|
265 | 165 | | or by both such fine and imprisonment. The court may, with the |
---|
266 | 166 | | consent of the defendant, order the defendant to complete a |
---|
267 | 167 | | substance abuse assessment and evaluation and to com plete a |
---|
268 | 168 | | diversion program for up to three (3) years following the date of |
---|
269 | 169 | | conviction. At the discretion of the court, the diversion program |
---|
270 | 170 | | may include drug testing as a requirement . If the defendant refuses |
---|
300 | 201 | | 4. a. Any person who violates this section a fourth time |
---|
301 | 202 | | within ten (10) year s shall, upon conviction, be |
---|
302 | 203 | | guilty of a felony punishable by a fine not exceeding |
---|
303 | 204 | | Five Thousand Dollars ($5,000.00), imprisonment in the |
---|
304 | 205 | | custody of the Department of Corrections for not less |
---|
305 | 206 | | than one (1) year nor mo re than five (5) years , or by |
---|
306 | 207 | | both such fine and imprisonment . |
---|
307 | 208 | | b. Upon a verdict or plea of guilty or upon a plea of |
---|
308 | 209 | | nolo contendere, but before a judgment of guilt of a |
---|
309 | 210 | | violation of this paragr aph, the court may, without |
---|
310 | 211 | | entering a judgment of guilt and with the consent of |
---|
311 | 212 | | the defendant, defer further proceedings upon the |
---|
312 | 213 | | specific conditions prescribed by the co urt not to |
---|
313 | 214 | | exceed a three-year period. The court may, with the |
---|
314 | 215 | | consent of the defend ant, order the defendant to |
---|
315 | 216 | | complete a substance abuse asse ssment and evaluation |
---|
316 | 217 | | and to complete a diversi on program for up to three |
---|
317 | 218 | | (3) years. |
---|
318 | 219 | | c. Upon successful completion of the court-ordered |
---|
319 | 220 | | substance abuse assessment and evaluation and |
---|
320 | 221 | | diversion program ordered by the court within the time |
---|
350 | 252 | | program, the court may impose punishment as provided |
---|
351 | 253 | | for in subparagraph a of this paragraph. |
---|
352 | 254 | | 5. The provisions of this subsection shall not apply f or |
---|
353 | 255 | | violations related to the possession of marijuana . |
---|
354 | 256 | | C. Any person convicted of a ny offense described in thi s |
---|
355 | 257 | | section shall, in addition to any fine imposed, pay a special |
---|
356 | 258 | | assessment trauma-care fee of One Hundred Dolla rs ($100.00) to be |
---|
357 | 259 | | deposited into the Trauma Care Assistance Revolving Fund created in |
---|
358 | 260 | | Section 1-2530.9 of this title. |
---|
359 | 261 | | SECTION 2. This act shall become effective November 1, 2023. |
