138-SECTION 1. NEW LAW A new section of law to be codified
139-in the Oklahoma Statutes as Section 93 of Title 73, unless there is

219-Oklahoma Capitol Improvement Authority and the Office of Management
220-and Enterprise Services shall notify the membership of the
221-legislative liaison committee Capitol Liaison in advance of any
222-meeting in which official or formal action is to be taken by
223-furnishing the proposed agenda in writing at le ast twenty-four (24)
224-hours in advance of such meeting.
225-B. The Oklahoma Capitol Improvement Authority and the Office of
226-Management and Enterprise Services shall provide such information,
227-records, testimony, or recommendations as the committee Capitol

229-C. All proposals for enhancement, modification, preservation,

269-Section 345. A. In addition to any other authorization
270-provided by law, the Oklahoma Capitol Improvement Authority is
271-authorized to issue obligations to acquire real property, together
272-with improvements located thereon, and personal property to
273-construct improvements to real property and to provide funding for
274-repairs, refurbishments and improvements to real and personal
275-property of the Oklahoma State Capitol Building in a total amount
276-not to exceed One Hundred Twenty Million Dollars ($120,000,000.00).
277-The funds shall be used for the renovation, repair and remodeling of
278-the Oklahoma State Capitol Building.
279-B. The Authority may h old title to the propert y and
280-improvements until such time as any obligations issued for this
281-purpose are retired or defeased and may lease the property and
282-improvements to the Office of Management and Enterprise Services.
283-Upon final redemption or defeasa nce of the obligations c reated
284-pursuant to this section, title to the property and improvements
285-shall be transferred from the Oklahoma Capitol Improvement Authority
286-to the Office of Management and Enterprise Services.
287-C. For the purposes of paying the cos ts for construction of t he
288-real property and improvements, and providing funding for the
289-project authorized in subsection A of this section, and for the
290-purpose authorized in subsection D of this section, the Authority is
291-hereby authorized to borrow monies on the credit of the in come and
292-revenues to be derived from the leasing of such property and

319-improvements and, in anticipation of the collection of such income
320-and revenues, to issue negotiable obligations in a total amount not
321-to exceed One Hundred Twent y Million Dollars ($120, 000,000.00)
322-whether issued in one or more series. The Authority is authorized
323-to capitalize interest on the obligations issued pursuant to this
324-section for a period of not to exceed one (1) year from the date of
325-issuance. For subsequent fiscal years, it is the intent of the
326-Legislature to appropriate to the Office of Management and
327-Enterprise Services sufficient monies to make rental payments for
328-the purpose of retiring the obligations created pursuant to this
329-section. To the exte nt funds are available f rom the proceeds of the
330-borrowing authorized by this subsection, the Oklahoma Capitol
331-Improvement Authority shall provide for the payment of professional
332-fees and associated costs related to the project authorized in
333-subsection A of this section.
334-D. The Authority may issue obligations in one or more series
335-and in conjunction with other issues of the Authority. The
336-Authority is authorized to hire bond counsel, financial consultants,
337-and such other professionals as it may deem necess ary to provide for
338-the efficient sale of the obligations and may utilize a portion of
339-the proceeds of any borrowing to create such reserves as may be
340-deemed necessary and to pay costs associated with the issuance and
341-administration of such obligations.

368-E. The obligations authori zed under this section may be sold at
369-either competitive or negotiated sale, as determined by the
370-Authority, and in such form and at such prices as may be authorized
371-by the Authority. The Authority may enter into agreements with su ch
372-credit enhancers and liquidity providers as may be determined
373-necessary to efficiently market the obligations. The obligations
374-may mature and have such provisions for redemption as shall be
375-determined by the Authority, but in no event shall the final
376-maturity of such obligati ons occur later than ten (10) years from
377-the first principal maturity date.
378-F. Any interest earnings on funds or accounts created for the
379-purposes of this section may be utilized as partial payment of the
380-annual debt service or for the purposes directed b y the Authority.
381-G. The obligations issued under this section, the transfer
382-thereof and the interest earned on such obligations, including any
383-profit derived from the sale thereof, shall not be subject to
384-taxation of any kind by the State of Oklahoma this state, or by any
385-county, municipality or political subdivision therein.
386-H. The Authority may direct the investment of all monies in any
387-funds or accounts created in connection with the offering of the
388-obligations authorized under this section. Such inve stments shall
389-be made in a manner consistent with the investment guidelines of the
390-State Treasurer. The Authority may place additional restrictions on
403+meeting in which official or formal action is to be taken by
404+furnishing the proposed agenda in writing at least twenty-four (24)
405+hours in advance of such meeting.
406+B. The Oklahoma Capitol Improvement Authority and the Office of
407+Management and Enterprise Services shall provide such information,

417-the investment of such monies if necessary to enhance the
418-marketability of the o bligations.
419-I. There is hereby created a State Capitol Repair Expenditure
420-Oversight Committee. The proceeds from the sale of obligations
421-issued pursuant to the provisions of this section and Section 1 of
422-Enrolled House Bill No. 3168 of the 2nd Session of the 55th Oklahoma
423-Legislature that are needed for repairs to the interior and exterior
424-of the State Capitol shall be subject to the approval of the State
425-Capitol Repair Expenditure Oversight Committee; provided, however,
426-the expenditure of those proceeds shall be subject to a re quest for
427-proposal process.
428-The Committee shall be composed of nine (9) members as follows:
429-1. Three persons to be appointed by the Governor, one of whom
430-shall serve as chair of the Committee;
431-2. Three legislators to be appointed by the Speaker of the
432-House of Representatives, two of whom shall be members of the
433-majority political party and one of whom shall be a member of the
434-minority political party; and
435-3. Three legislators to be appointed by the President Pro
436-Tempore of the Senate, two of whom shall be members of the majority
437-political party and one of whom shall be a member of the minority
438-political party. Five members of the Committee shall constitute a
439-quorum and the vote of five members shall be necessary for any
440-action taken by the Committee. T he Committee shall be staffed by
453+with improvements located thereon, and personal property to
454+construct improvements to real property and to provide funding for
455+repairs, refurbishments and improvements to real and personal
456+property of the Oklahoma State Capitol Building in a total amount
457+not to exceed One Hundred Twenty Million Dollars ($120,000,000.00).

468+C. For the purposes of paying the cos ts for construction of the
469+real property and improvements, and providing funding for the
470+project authorized in subsection A of this section, and for the
471+purpose authorized in subsection D of this section, the Authority is
472+hereby authorized to borrow monies on the credit of the income and
473+revenues to be derived from the leasing of such property and
474+improvements and, in anticipation of the collection of such income
475+and revenues, to issue negotiable obligations in a total amount not
476+to exceed One Hundred Twent y Million Dollars ($120,000,000.00)

468-Committee shall be subject to the Oklahoma Open Meeting Act.
469-J. The Committee shall deliver a preliminary plan for the
470-renovation, repair and remodeling o f the State Capitol to the
471-Director of the Office of Management and Enterprise Services no
472-later than December 31, 2014. The preliminary plan shall include
473-the following components:
474-1. Establishment of the Office of Management and Enterprise
475-Services’ goal and criteria for use by the vendor; and
476-2. Selection criteria for the design-build team vendor to be
477-selected through a Request For Proposal process.
478-K. Following receipt of the preliminary plan as approved by the
479-Committee, the Office of Management a nd Enterprise Services shall
480-solicit Requests For Proposals to select the vendor for the project.
481-L. The Committee shall deliver a final plan to the Director of
482-the Office of Management and Enterprise Services no later than June
483-30, 2015. The final plan shall include the following components:
484-1. Approval of the final scope of work developed by the vendor;
485-and
486-2. Approval of the project phasing developed by the vendor.
487-M. Following delivery of the final plan, the Committee shall
488-continue to oversee the expenditure of proceeds from the sale of
489-obligations issued pursuant to the provisions of this section and
490-Section 1 of Enrolled House Bill No. 3168 of the 2nd Session of the
503+whether issued in one or more series. The Authority is authorized
504+to capitalize interest on the obligations issued pursuant to this
505+section for a period of not to exceed one (1) year from the date of
506+issuance. For subsequent fiscal years, it is the intent of the
507+Legislature to appropriate to the Office of Management and
508+Enterprise Services sufficient monies to make rental payments for
509+the purpose of retiring the obligations created pursuant to this
510+section. To the exte nt funds are available from the proceeds of the
511+borrowing authorized by this subsection, the Oklahoma Capitol
512+Improvement Authority shall provide for the payment of professional
513+fees and associated costs related to the project authorized in
514+subsection A of this section.
515+D. The Authority may issue obligations in one or more series
516+and in conjunction with other issues of the Authority. The
517+Authority is authorized to hire bond counsel, financial consultants,
518+and such other professionals as it may deem necess ary to provide for
519+the efficient sale of the obligations and may utilize a portion of
520+the proceeds of any borrowing to create such reserves as may be
521+deemed necessary and to pay costs associated with the issuance and
522+administration of such obligations.
523+E. The obligations authorized under this section may be sold at
524+either competitive or negotiated sale, as determined by the
525+Authority, and in such form and at such prices as may be authorized
526+by the Authority. The Authority may enter into agreements with su ch

520-N. The Director of the Office of Management and Enterprise
521-Services shall have responsibility to substantially implement t he
522-plan as presented by the Committee; provided, the President Pro
523-Tempore of the Senate or the Speaker of the House of Representatives
524-shall approve all proposed designs related to renovation, repair and
525-remodeling of space within the State Capitol Buildi ng under the
526-management and control of the Legislature and allocated to that
527-officer’s house of the Legislature pursuant to the provisions of
528-Section 15.1 of this title, and any subsequent changes to such
529-plans. Joint approval of the President Pro Tempore of the Senate
530-and the Speaker of the House of Representatives shall be required
531-for such plans for space under the management and control of the
532-Legislature and not allocated to a specific house of the
533-Legislature. Such approval shall be in writing.
534-O. Insofar as they are not in conflict with the provisions of
535-this section, the provisions of Section 151 et seq. of this title
536-shall apply to this section.
537-SECTION 4. AMENDATORY 74 O.S. 2021, Section 4101, is
538-amended to read as foll ows:
539-Section 4101. As used in Sections 4101 through 4108 4110.1 of
540-this title:
553+credit enhancers and liquidity providers as may be determined
554+necessary to efficiently market the obligations. The obligations
555+may mature and have such provisions for redemption as shall be
556+determined by the Authority, but in no event shall the final
557+maturity of such obligations occur later than ten (10) years from
558+the first principal maturity date.
559+F. Any interest earnings on funds or accounts created for the
560+purposes of this section may be utilized as partial payment of the
561+annual debt service or for the purposes directed by the Authority.
562+G. The obligations issued under this section, the transfer
563+thereof and the interest earned on such obligations, including any
564+profit derived from the sale thereof, shall not be subject to
565+taxation of any kind by the State of Oklahoma this state, or by any
566+county, municipality or political subdivision therein.
567+H. The Authority may direct the investment of all monies in any
568+funds or accounts created in connection with the offering of the
569+obligations authorized under this section. Such investments shall
570+be made in a manner consistent with the investment guidelines of the
571+State Treasurer. The Authority may place additiona l restrictions on
572+the investment of such monies if necessary to enhance the
573+marketability of the o bligations.
574+I. There is hereby created a State Capitol Repair Expenditure
575+Oversight Committee. The proceeds from the sale of obligations
576+issued pursuant to the provisions of this section and Section 1 of

570-highest quality of art objects available to include paintings,
571-murals, graphic arts, art photography and sculpture, aesthet ically
572-aligned with recognized values, creat ed by the conscious use of
573-skill and creative imagination;
574-3. “Design standards” means a document that is produced for the
575-purpose of guiding review of propos ed alterations to the Oklahoma
576-State Capitol and grounds.
577-Design standards set the acceptable level of finishes for the
578-historic fabric, features, and materials in use in the Oklahoma
579-State Capitol.
580-This document establis hes specifications for alterations which,
581-if followed, will provide compatible design;
582-4. “Enhancement” means an increase or improvement upon the
583-quality, value, or extent of the original design intent of the
584-Oklahoma State Capitol or grounds;
585-5. “Grounds” means all land surrounding the Oklahoma State
586-Capitol and bordered by Lincoln Boulevard;
587-6. “Maintenance” means keeping spaces, structures , and
588-infrastructure in proper operating condition i n a routine,
589-scheduled, or anticipated fashion to prevent failure or degradation;
603+Enrolled House Bill No. 3168 of the 2nd Session of the 55th Oklahoma
604+Legislature that are needed for repairs to the interior and exterior
605+of the State Capitol shall be subject to the approval of the State
606+Capitol Repair Expenditure Oversight Committee; provided, however,
607+the expenditure of those proceeds shall be subject to a request for
608+proposal process.
609+The Committee shall be composed of nine (9) members as follows:
610+1. Three persons to be appointed by the G overnor, one of whom
611+shall serve as chair of the Committee;
612+2. Three legislators to be appointed by the Speaker of the
613+House of Representatives, two of whom shall be members of the
614+majority political party and one of whom shall be a member of the
615+minority political party; and
616+3. Three legislators to be appointed by the President Pro
617+Tempore of the Senate, two of whom shall be members of the majority
618+political party and one of whom shall be a member of the minority
619+political party. Five members of the Com mittee shall constitute a
620+quorum and the vote of five members shall be necessary for any
621+action taken by the Committee. The Committee shall be staffed by
622+employees of the Office of Management and Enterprise Services. The
623+Committee shall be subject to the Oklahoma Open Meeting Act.
