16	46		defining terms; requiring health benefit plans to
17	47		cover cost of certain serological tests; amending 63
18	48		O.S. 2021, Section 1-515, which relates to tests for
19	49		syphilis; modifying required frequency of testing ;
20	50		broadening applicability of certain provisions;
21	51		updating statutory language; and providing an

28	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	58		SECTION 1. NEW LAW A new section of law to be codified
31	59		in the Oklahoma Statutes as Section 6060.4b of Title 36, unless
32	60		there is created a duplication in numbering, reads as follows:

34	61		A. As used in this section:

36	62		1. “Health benefit plan” has the same meaning as provided by
37	63		Section 6060.4 of Title 36 of the Oklahoma Statutes ; and

39	64		2. “Medically necessary” means services or supplies provided by
40	65		a health care provider that are:

49	96		c. within the generally accepted standards of medical
50	97		care in the community, and

52	98		d. not solely for the convenience of the insured, the
53	99		insured’s family, or the provider.

55	100		B. A health benefit plan shall cover the cost of medically
56	101		necessary standard serological tests for syphilis required under
57	102		Section 1-515 of Title 63 of the Oklahoma Statutes.

59	103		SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -515, is
60	104		amended to read as follows:

62	105		Section 1-515. A. Every physician, physician assistant, or
63	106		Advanced Practice Registered Nurse attending a pregnant woman in
64	107		Oklahoma this state during gestation shall, in the case of each
65	108		woman so attended, take or cause to be taken a sample of blood of
66	109		such woman at the time of first examination, and shall submit such
67	110		sample to an approved laboratory for a standar d serological test for
68	111		syphilis, when indicated by current guidance of the Centers for
69	112		Disease Control and Prevention .

71	113		B. Every other person permitted by law to attend upon pregnant
72	114		women in the state but not permitted by law to take blood tests
73	115		shall cause a sample of the bloo d of such pregnant wom an to be taken
74	116		by a duly licensed physician, physician assistant, or Advanced
75	117		Practice Registered Nurse, licensed to practice in the State of

76	145		Oklahoma this state, and submitted to an approved laboratory fo r a
77	146		standard serological test for syphilis.

79	147		C. The term “approved laboratory” shall mean a laboratory
80	148		approved for the purposes of this sec tion by the State Commissioner
81	149		of Health. A standard serological test for syphilis shall be one
82	150		recognized as such by the Commissioner. Such laboratory tests shall
83	151		be made, on request, without charge by the State Department of
84	152		Health.

86	153		SECTION 3. This act shall become effective November 1, 2023.
