An Act ENROLLED SENATE BILL NO. 292 By: Stanley of the Senate and Roe of the House An Act relating to sexually transmitted infections; defining terms; requiring health benefit plans to cover cost of certain serological tests; amending 63 O.S. 2021, Section 1-515, which relates to tests for syphilis; modifying required frequency of testing ; broadening applicability of certain provisions; updating statutory language; and providing an effective date. SUBJECT: Sexually transmitted infections BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 6060.4b of Title 36, unless there is created a duplication in numbering, reads as follows: A. As used in this section: 1. “Health benefit plan” has the same meaning as provided by Section 6060.4 of Title 36 of the Oklahoma Statutes ; and 2. “Medically necessary” means services or supplies provided by a health care provider that are: a. provided for the diagnosis of syphilis, b. necessary for and appropriate to the diagnosis of syphilis, ENR. S. B. NO. 292 Page 2 c. within the generally accepted standards of medical care in the community, and d. not solely for the convenience of the insured, the insured’s family, or the provider. B. A health benefit plan shall cover the cost of medically necessary standard serological tests for syphilis required under Section 1-515 of Title 63 of the Oklahoma Statutes. SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-515, is amended to read as follows: Section 1-515. A. Every physician, physician assistant, or Advanced Practice Registered Nurse attending a pregnant woman in Oklahoma this state during gestation shall, in the case of each woman so attended, tak e or cause to be taken a sample of blood of such woman at the time of first examination, and shall submit such sample to an approved laboratory for a standar d serological test for syphilis, when indicated by current guidance of the Centers for Disease Control and Prevention. B. Every other person permitted by law to attend upon pregnant women in the state but not permitted by law to take blood tests shall cause a sample of the bloo d of such pregnant wom an to be taken by a duly licensed physician, physician assistant, or Advanced Practice Registered Nurse, licensed to practice in the State of Oklahoma this state, and submitted to an approved laboratory fo r a standard serological test for syphilis. C. The term “approved laboratory” shall mean a laboratory approved for the purposes of this sec tion by the State Commissioner of Health. A standard serological test for syphilis shall be one recognized as such by the Commissioner. Such laboratory tests shall be made, on request, without charge by the State Department of Health.
