11152 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18-107, is
11253 amended to read as follows:
11354 Section 18-107. As used in this title:
11455 1. “Average Daily Attendance ” “Average daily attendance” (ADA)
11556 means the legal average number of pupi ls, early childhood education
11657 programs through grade twelve, in a school district during a school
11758 year as determined pursuant to th e provisions of Section 18-111 of
11859 this title. A day of school for early childhood education programs
11960 and kindergarten shall be at least two and one -half (2 1/2) hours
12061 and, for early childhood education, may be si x (6) hours.;
121-2. “Average Daily Membership ” “Average daily membership ” (ADM)
122-means the average number of pupils present and absent in a school
123-district during a school year. Average Daily Membership daily

89+2. “Average Daily Membership ” “Average daily membership ” (ADM)
90+means the average number of pupils present and absent in a school
91+district during a school year. Average Daily Membership daily
92+membership shall be calculated by dividing the sum of the pupil ’s
15193 total days present and total days absent by the number of days

15395 a. A pupil who has been absent without excuse ten (10)
15496 consecutive days shall be taken off the roll beginni ng
15597 the eleventh day and thereafter shall not be
15698 considered in a district ’s average daily membership
15799 ADM calculation until the pupil is placed on the roll
158100 in the district. For the purpose of this paragraph
159101 subparagraph, consecutive days means days for which
160102 enrollment is recorded.
161103 b. A pupil enrolled in a statewide virtual charter school
162104 who is behind pace and has not completed instructional
163105 activity as defined by Section 3-145.8 of this title
164106 for a fifteen-school-day period, without excuse as
165107 authorized by Section 10-105 of this title, shall be
166108 taken off the roll beginning the sixteenth day and
167109 thereafter shall not be considered in the virtual
168110 charter school’s Average Daily Membership ADM
169111 calculation until the pupil is placed on the roll in
170112 the virtual charter school.; and
171-3. “Total Adjusted Assessed Valuation ” means the sum of public
172-service property assessed valuation, personal property assessed
173-valuation and real property assessed valuation as adjusted pursuant
174-to the provisions of Section 18-109.1 of this title.

140+3. “Total Adjusted Assessed Valuation ” means the sum of public
141+service property assessed valuation, personal property assessed
142+valuation and real property assessed valuation as adjusted pursuant
143+to the provisions of Section 18-109.1 of this title.
201144 4. “Eighty-five percent (85%) of maximum allowable ”, for the
202145 purpose of assessing class size pen alty pursuant to Sections 18-
203146 113.1 and 18-113.2 of this title, means eighty-five percent (85%) of
204147 ten percent (10%) of the preceding year’s net assessed valuation of
205148 a school district. The calculation of indebtedness as provided for
206149 in paragraph a of subs ection G F of Section 18-113.1 and
207150 subparagraph a of paragraph 4 of subsection A of Section 18-113.2 of
208151 this title shall include the outstanding princi pal amount of bonds
209152 issued by the school district plus the principal amount of any bonds
210153 authorized by a vote of the people for issuance but not yet issued
211154 by the school district.
212155 SECTION 2. AMENDATORY 70 O.S. 2021, Section 18-200.1, as
213156 last amended by Section 2, Chapter 488, O.S.L. 2021, is amended to
214157 read as follows:
215158 Section 18-200.1. A. Beginning with the 2022-2023 2024-2025
216159 school year, and each school year thereafter, each school district
217160 shall have its initial allocation of State Aid calculated based on
218161 the ad valorem tax and state dedicated revenue s actually collected
219162 during the preceding fiscal year , the adjusted assessed valuation of
220163 the preceding year and the weighted average daily membership for the
221-school district of the preceding school year. Each school district
222-shall submit the following da ta based on the first nine (9) weeks,
223-to be used in the calculation of the ave rage daily membership of the
224-school district:

191+school district of the preceding school year. Each school district
192+shall submit the following da ta based on the first nine (9) weeks,
193+to be used in the calculation of the ave rage daily membership of the
194+school district:
251195 1. Student enrollment by grade level;
252196 2. Pupil category counts; and
253197 3. Transportation supplement data.
254198 On or before December 30, the State Department of Education
255199 shall determine each school district ’s current year allocation
256200 pursuant to subsection D of t his section. The State Department of
257201 Education shall complete an audit, using procedures established by
258202 the Department, of the st udent enrollment by grade level data, pupil
259203 category counts, and transportation supplement data to be used in
260204 the State Aid Formula pursuant to subsection D of this section by
261205 December 1 and by January 15 shall notify each school district of
262206 the district’s final State Aid allocation for the current school
263207 year. The January payment of State Aid and each subsequent payment
264208 for the remainder of the school year shall be based on the final
265209 State Aid allocation as calculated in subsecti on D of this section.
266210 Except for reductions made due to the assessment of penalties by the
267211 State Department of Education according to law, the January payment
268212 of State Aid and each subsequent payment for the remainder of the
269213 school year shall not decrease by an amount more than the amount
270214 that the current chargeable revenue increases for that district.
271-B. The State Department of Education shall retain n ot less than

242+B. The State Department of Education shall retain n ot less than
243+one and one-half percent (1 1/2%) four percent (4%) of the total
244+funds appropriated for financial support of schools, to be used to
245+make midyear adjustments in State Aid and which shall be reflec ted
301246 in the final allocations. If the amount of appropriated funds,
302247 including the one and one-half percent (1 1/2%) four percent (4%)
303248 retained, remaining after Jan uary 1 of each year is no t sufficient
304249 to fully fund the final allocations, the Department sha ll
305250 recalculate each school district’s remaining allocation pursuant to
306251 subsection D of this section using the reduced amount of
307252 appropriated funds.
308253 C. On and after July 1, 1997, the amoun t of State Aid each
309254 district shall receive shall be the sum of the F oundation Aid, the
310255 Salary Incentive Aid, and the Transportation Supplement, as adjusted
311256 pursuant to the provisions of subsection G E of this section and
312257 Section 18-112.2 of this title; provi ded, no district having per
313258 pupil revenue in excess of three hundr ed percent (300%) of the
314259 average per pupil reven ue of all districts shall receive any State
315260 Aid or Supplement in State Aid.
316261 The July calculation of per pupil revenue shall be determined by
317262 dividing the district’s second preceding year’s total weighted
318263 average daily membership (ADM) into the district’s preceding year’s
319264 total revenues excluding federal revenue, insurance loss payments,
320265 reimbursements, recovery of overpa yments and refunds, unuse d
321-reserves, prior expenditur es recovered, prior year surpluses, an d
322-less the amount of any transfer fees paid in t hat year.
323-The December calculation of per pupil revenue shall be

295+The December calculation of per pupil revenue shall be
296+determined by dividing the district’s preceding year’s total

352298 preceding year’s total revenues excluding federal revenue, insurance
353299 loss payments, reimbursements, recovery of overpayments and refunds,
354300 unused reserves, prior e xpenditures recovered, pr ior year surpluses,
355301 and less the amount of any transf er fees paid in that year.
356302 D. For the 1997-98 2024-25 school year, and each school ye ar
357303 thereafter, Foundation Aid, the Transportation Su pplement, and
358304 Salary Incentive Aid shall be calc ulated as follows:
359305 1. Foundation Aid shall be det ermined by subtracting the am ount
360306 of the Foundation Program Income from the cost of the Foundation
361307 Program and adding to this difference the Transportation Su pplement.
362308 a. The Foundation Program shall be a d istrict’s higher
363309 weighted average daily membership based on the first
364310 nine (9) weeks of the current school year or the
365311 preceding school year of a school dis trict, as
366312 determined by the provisions of subsection A of
367313 Section 18-201.1 of this title and paragra phs 1, 2, 3,
368314 and 4 of subsection B of Section 18 -201.1 of this
369315 title, multiplied by the Base Foundation Support
370316 Level. However, for the portion of weighted
371-membership derived from nonresident, transferred
372-pupils enrolled in online courses, the Foundation
373-Program shall be a district’s weighted average dai ly
374-membership of the preceding school year or the first

347+membership of the preceding school year or the first
401348 nine (9) weeks of the current school year, whichev er
402349 is greater, as determined by the provisions of
403350 subsection A of Section 18-201.1 of this title and
404351 paragraphs 1, 2, 3, and 4 of subsection B of Sect ion
405352 18-201.1 of this title, mul tiplied by the Base
406353 Foundation Support Level.
407354 b. The Foundation Program Inc ome shall be the sum of the
408355 following:
409356 (1) The adjusted assessed valuation of the current
410357 school year of the school district , minus the
411358 previous year protested ad valorem tax revenu es
412359 held as prescribed in Section 2884 of Title 68 of
413360 the Oklahoma Statutes, multiplied by the mills
414361 levied the amount of ad valorem tax collections
415362 received by the school district from the proceeds
416363 of the levy during the preceding fiscal year, as
417364 levied pursuant to subsection (c) of Section 9 of
418365 Article X of the Oklahoma Constitution, if
419366 applicable, as adjusted in subs ection (c) of
420367 Section 8A of Article X of the Oklahoma
421-Constitution. For purposes of this subsection,
422-the “adjusted assessed valuation of the current
423-school year” shall be the adjusted assessed

395+Constitution. For purposes of this subsection,
396+the “adjusted assessed valuation of the current
397+school year” shall be the adjusted assessed
450398 valuation on which tax revenues are collected
451399 during the current school year, and
452400 (2) Seventy-five seventy-five percent (75%) of the
453401 amount received by the school district from the
454402 proceeds of the county levy during the preceding
455403 fiscal year, as levied pursuant to subsection (b)
456404 of Section 9 of Article X o f the Oklahoma
457405 Constitution, and
458406 (3) Motor Vehicle Collections motor vehicle
459407 collections, and
460408 (4) Gross Production Tax gross production tax, and
461409 (5) State Apportionment state apportionment, and
462410 (6) R.E.A. Tax tax.
463411 The items listed in divisions (1), (3), (4), (5), and
464412 (6) of this subparagraph shall consist of the amounts
465413 actually collected from such s ources during the
466414 preceding fiscal year calculated on a per capita basis
467415 on the unit provided for by law for the distribution
468416 of each such revenue.
469-2. The Transportation Supplement shall be equal to the average
470-daily haul times the per capita allowance times the appropriate
471-transportation factor.

598549 b. Divide the district’s adjusted assessed valuation of
599550 the current school year minus the previous year ’s
600551 protested ad valorem tax revenues held as prescribed
601552 in Section 2884 of Title 68 of the Oklahoma Statutes,
602553 by one thousand (1,000) and su btract the quotient from
603554 the product of subparagraph a of this paragraph. The
604555 remainder shall not be less than zero (0) Subtract the
605556 amount received by the school dis trict from the
606557 proceeds of the levy during the preceding fiscal year,
607558 as levied pursuant to subsection (c) of Section 9 of
608559 Article X of the Oklahoma Constitution above the
609560 fifteen (15) mills required to support Foundation Aid
610561 pursuant to division (1) of subparagraph b of
611562 paragraph 1 of this subse ction, not including the
612563 county four-mill levy, by the product of subparagraph
613564 a of this paragraph. The remainder shall not be less
614565 than zero and shall be the Salary Incentive Aid of the
615566 district.
616567 c. Multiply the number of mills levied for general fund
617568 purposes above the fifteen (15) mills required to
618569 support Foundation Aid pursuant to division (1) of
619-subparagraph b of paragraph 1 of this subsection, not
620-including the county four-mill levy, by the remainder

648600 shall be the Salary Incentiv e Aid of the district.
649601 E. By June 30, 1998, the State Department of Education sha ll
650602 develop and the Department and all school distr icts shall have
651603 implemented a student identification system which is consistent with
652604 the provisions of subsections C and D o f Section 3111 of Title 74 of
653605 the Oklahoma Statutes. The student identification s ystem shall be
654606 used specifically for the purpose o f reporting enrollment data by
655607 school sites and by school districts, the administration of the
656608 Oklahoma School Testing Progr am Act, the collection of approp riate
657609 and necessary data pursuant to the Oklahoma Educational Indicators
658610 Program, determining studen t enrollment, establishing a student
659611 mobility rate, allocation of the State Aid Formula and midyear
660612 adjustments in funding f or student growth. This enrollment data
661613 shall be submitted to the State Departmen t of Education in
662614 accordance with rules promulgate d by the State Board of Education .
663615 Funding for the development, implementation, personnel training and
664616 maintenance of the s tudent identification system sha ll be set out in
665617 a separate line item in the alloc ation section of the appropriation
666618 bill for the State Board of Education for each year.
667619 F. 1. In the event that ad valorem taxes of a school district
668620 are determined to be u ncollectible because of bankrupt cy, clerical
669-error, or a successful tax protest, a nd the amount of such taxes
670-deemed uncollectible e xceeds Fifty Thousand Dollars ($50,00 0.00) or

709662 2. In the event that th e amount of funds a school district
710663 receives for reimbursement from the Ad Valorem Reim bursement Fund is
711664 less than the amount of funds claimed for reimbursement by the
712665 school district due to insufficiency of funds as pr ovided in Section
713666 193 of Title 62 of the Oklahoma Statutes, then the school district’s
714667 assessed valuation for the school yea r that such ad valorem
715668 reimbursement is calculated in the State Aid Formula shall be
716669 adjusted accordingly.
717670 G. 1. Notwithstanding the provisions of Section 18 -112.2 of
718671 this title, a school district shall have its State Aid reduced by an

798753 documentation supporting those reasons . The Department shall review
799754 all school district penalty protest documentation and notify each
800755 district by March 15 of its finding and the final penalty to be
801756 assessed to each district. General fund balance penalties shall be
802757 assessed to all school districts by April 1.
803758 3. Any school district which receives p roceeds from a tax
804759 settlement or a Federal Emergency Management Agency settlement
805760 during the last two (2) months of the preceding fiscal year shall be
806761 exempt from the penalti es assessed in this subsection, if the
807762 penalty would occur solely as a result of r eceiving funds from the
808763 tax settlement.
809764 4. Any school district which receives an increase in State Aid
810765 because of a change in Foundation Aid and/or Salary Incentive Aid
811766 factors during the last two (2) months of the preceding fiscal ye ar
812767 shall be exempt from t he penalties assessed in this subsection, if
813768 the penalty would occur solely as a result of receiving funds from
814769 the increase in State Aid.
815770 5. If a school district does not r eceive Foundation Aid and/or
816771 Salary Incentive Aid during the preceding fiscal year, th e State
817772 Board of Education may waive the penalty assessed in this subsection
818773 if the penalty would result in a loss of more than forty percent
819-(40%) of the remaining State Aid to be allocated to the school

847803 the Board determines the penalty will cause the school district not
848804 to meet remaining financial obligations.
849805 6. Any school district which receives gross pr oduction revenue
850806 apportionment during the 2002 -2003 school year or in any subseque nt
851807 school year that is greater than the gross production revenue
852808 apportionment of the preceding school year shall be exempt from the
853809 penalty assessed in this subsection, if t he penalty would occur
854810 solely as a result of the gross pr oduction revenue apportio nment, as
855811 determined by the State Board of Education.
856812 7. Beginning July 1, 2003, school districts that participate in
857813 consolidation or annexation pursuant to the provisions of the
858814 Oklahoma School Voluntary Consolidation and Annexa tion Act shall be
859815 exempt from the penalty assessed in this subsection for the school
860816 year in which the consolidation or annexation occurs and for the
861817 next three (3) fiscal years.
862818 8. Any school district which receives proceeds from a sales tax
863819 levied by a municipality pursuant to Section 22-159 of Title 11 of
864820 the Oklahoma Statutes or proceeds from a sales tax levied by a
865821 county pursuant to Section 1370 of Title 68 of the Oklahoma Statutes
866822 during the 2003-2004 school year or the 2004 -2005 school year shall
867823 be exempt from the penalti es assessed in this subsection, if the
868-penalty would occur solely as a result of receiving funds from the
869-sales tax levy.

896853 9. Any school district which has an amount of carry over in the
897854 general fund of the district in excess of the limits established in
898855 paragraph 1 of this subsection during the fiscal years beginning
899856 July 1, 2020, July 1, 2021, July 1, 2022, and July 1, 2023, shall
900857 not be assessed a general fund balance penalt y as provided for in
901858 this subsection.
902859 10. 9. For purposes of calculating the general fund balance
903860 penalty, the terms “carryover” and “general fund balance” shall not
904861 include federal revenue.
905862 H. F. In order to provide startup funds for the implementation
906863 of early childhood programs, State Aid may be advanced to schoo l
907864 districts that initiall y start early childhood instruction at a
908865 school site. School districts that desire such advanced funding
909866 shall make application to the State Department of Education no later
910867 than September 15 of each year and advanced funding shal l be awarded
911868 to the approved districts no later than October 30. The advanced
912869 funding shall not exceed the per pupil amount of State Aid as
913870 calculated in subsection D of this section per anticipated Head
914871 Start eligible student . The total amount of advanc ed funding shall
915872 be proportionately reduced from the monthly payments of the
916873 district’s State Aid payments during the last six (6) months of the
917874 same fiscal year.

996955 SECTION 3. AMENDATORY 70 O.S. 2021, Section 18-201.1, is

998957 Section 18-201.1. A. Beginning with the 2020-21 school year,
999958 and each school year thereafter, the weighted membership of a school
1000959 district for calculation of Foundation Ai d purposes pursuant to
1001960 paragraph 1 of subsection D of Section 18-200.1 of this title shall
1002961 be the sum of the weighted pupil grade level calculation, the
1003962 weighted pupil category calculation, the weighted district
1004963 calculation, and the weighted teacher experie nce and degree
1005964 calculation. The weighted membership of a school district for
1006965 calculation of Salary Ince ntive Aid purposes pursuant to paragraph 3
1007966 of subsection D of Section 18 -200.1 of this title shall be the sum
1008967 of the weighted pupil grade level calculat ion, the weighted pupil
1009968 category calculation, the weighted district calculatio n, and the
1010969 weighted teacher experience and degree calculation.
1011970 B. Beginning with the 2022 -2023 school year, the weighted
1012971 calculations provided for in subsection A of this sectio n shall be
1013972 based on the higher weighted average daily membership of the first
1014973 nine (9) weeks of the curr ent school year or the preceding school
1015974 year of a school district, unless otherwise specified . The higher
1016975 of the two (2) weighted average daily members hips shall be used

13951362 - isolation formula. Provided, that the addit ional square miles
13961363 allowed for geographical barriers shall not exceed thirty percent
13971364 (30%) of the district ’s actual size.
13981365 c. State Aid funds which a district is calculated to
13991366 receive as a result of the weighted district
14001367 calculation shall be restricted as f ollows:
14011368 If, after the weighted district calculation is
14021369 applied, the district ’s projected per pupil
14031370 revenue exceeds one hundred fifty percent (150%)
14041371 of the projected state average pe r pupil revenue,
14051372 then the district’s State Aid shall be reduced by
14061373 an amount that will restrict the d istrict’s
14071374 projected per pupil revenue to one hundred fifty
14081375 percent (150%) of the project ed state average per
14091376 pupil revenue. Provided, in applying the
14101377 restriction provided in this division, the
14111378 district’s State Aid shall not be re duced by an
14121379 amount greater than by the amount of State Aid
14131380 which was generated by the weighted district
14141381 calculation.
14151382 The July calculation of the projected per pupil
14161383 revenue shall be determined by dividing the district’s

1418-weighted by the pupil grade level, the pupil category,

14581426 The December calculation of the projected per pupil
14591427 revenue shall be determined by dividing the higher of
14601428 the district’s first nine (9) weeks of the current
14611429 school year or the preceding school year ’s average
14621430 daily membership (ADM) as weighte d by the pupil grade
14631431 level, the pupil category, the district and the
14641432 teacher experience degree index calculations for
14651433 projected State Aid into the district ’s projected
14661434 total revenues including funds for the December

15101479 4. The weighted teacher experience and degree calculation sh all
15111480 be determined in acco rdance with the teacher experience and degree
15121481 index. The State Department of Education shall determine an index
15131482 for each state teacher by using data suppl ied in the school
15141483 district’s teacher personnel reports of the preceding year and
15151484 utilizing the index as follows:
