3969 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1135.2, as
4070 amended by Section 2, Chapter 397, O.S.L. 2022 (47 O.S. Supp. 2022,

98+Section 1135.2 A. Service Oklahoma is hereby authorized to
4499 design and issue appropriate official special license plates to
45100 persons in recognition of their service or awards as provided by
46101 this section.

50102 Special license plates shall not be transferred to any ot her
51103 person but shall be removed from the vehicle upon transfer of
52104 ownership and retained. The special license plate may then be used
53105 on another vehicle but only after such other vehicle has been
54106 registered for the current year.

56107 Special license plates shal l be renewed each year by Service
57108 Oklahoma or a licensed operator. Se rvice Oklahoma shall annually
58109 notify by mail all persons issued special license plates. The
59110 notice shall contain all necessary informati on and shall contain
60111 instructions for the renewal procedure upon presentation to a
61112 licensed operator or Service Oklahom a. The license plates shall be
62113 issued on a staggered system except for legislative plates and
63114 amateur radio operator license plates.

65115 Service Oklahoma is hereby directed to develop and i mplement a
66116 system whereby licensed operators are permitted to accept
67117 applications for special license plates authorized under this
68118 section. The licensed operator shall confirm the applicant's
69119 eligibility, if applicable, collect and deposit any amount
70120 specifically authorized by law, accept and process the necessary
71121 information directly into such system and generate a receipt

72148 accordingly. For performance of these duties, licensed operators
73149 shall retain the fee provided in Section 1141.1 of this title for
74150 registration of a motor vehicle. The licensed operator fees for
75151 acceptance of applications and renewals shall be paid out of the
76152 Oklahoma Tax Commission Reimbursement Fund. Beginning January 1,
77153 2023, the licensed operator fees for acceptance of application s and
78154 renewals shall be paid out of the Service Oklahoma Reimbursement
79155 Fund.

81156 B. The special license plates provided by this section are as
82157 follows:

84158 1. Prisoner of War License Plates - such plates shall be
85159 designed for honorably discharged or present memb ers of the United
86160 States Armed Forces and civilians who were former pr isoners of war
87161 held by a foreign country and who can provide proper certification
88162 of that status. Such persons may apply for a prisoner of war
89163 license plate for no more than two vehicle s with each vehicle having
90164 a rated carrying capacity of one (1) ton or less. The surviving
91165 spouse of any deceased former prisoner of war, if the spouse has not

94166 since remarried, or if remarried, the remarria ge is terminated by
95167 death, divorce, or annulment, may apply for a prisoner of war
96168 license plate for one vehicle with a rated carrying capacity of one

102199 2. National Guard License Plates - such plates shall be
103200 designed for active or retired members of the Oklahoma Nati onal
104201 Guard. Retirees who are eligible for such p lates shall provide
105202 proof of eligibility upon initial application, but shall not be
106203 required to provide proof of eligibility annually;

108204 3. Air National Guard License Plates - such plates shall be
109205 designed for active or retired members of the Oklahoma Air N ational
110206 Guard. Retirees who are eligible for such plates shall provid e

114209 4. United States Ar med Forces License Plates - such plates
115210 shall be designed for active, retired, former or reserve members of
116211 the United States Armed Forces, and shall identify which branch of

118213 Force, Marines or Coast Guard, according to the branch of ser vice to
119214 which the member belongs or did belong. Former members who ha ve
120215 been dishonorably discharged shall not be eligible for such plates.
121216 Persons applying for such license plate must show proof of presen t
122217 or past military service by presenting a valid Uniformed Services
123218 Identity Card or the United States Department of De fense Form

137254 6. Missing In Action License Plates - such plates shall be
138255 designed to honor members of t he United States Armed Forces who are
139256 missing in action. The spouse o f such missing person, if the spouse
140257 has not since remarried, or if remarried, the remarriage is
141258 terminated by death, divorce, or annulme nt, and each parent of the
142259 missing person may app ly for a missing in action license plate upon
143260 presenting proper certif ication that the person is missing in action
144261 and that the person making the application is the qualifying spouse
145262 or the parent of the mis sing person. The qualifying spouse and each
146263 parent of the missing person may each apply for the missing in
147264 action license plate for each vehicle with a rated carrying capacity
148265 of one (1) ton or less;

150266 7. Purple Heart Recipient License Plates - such plates shall be
151267 designed for any resident of this state presenting proper
152268 certification from the United States Department of Veterans Affairs
153269 or the Armed Forces of the United States certifying that such

155297 Such persons may apply for a Purple Heart recipient license plate
156298 for vehicles having a rated carrying capacity of one (1) ton or
157299 less. The surviving spouse of any deceased veteran who has been
158300 awarded the Purple Heart military decoration, if such spouse has not
159301 since remarried, or if remarried, the remarriage has been terminated
160302 by death, divorce or annulment, may apply for such plate for one
161303 vehicle with a rated carrying capacity of one (1) ton or less. The
162304 license plate created by this paragraph shall be exempt from the fee
163305 provided by this section for special license plates;

165306 8. Pearl Harbor Survivor License Pl ates - such plates shall be
166307 designed for any resident of this state who can be verified by the
167308 United States Department of Veterans Affai rs or the Armed Forces of
168309 the United States as be ing:

170310 a. a member of the United States Armed Forces on December
171311 7, 1941,

173312 b. stationed on December 7, 1941, during the hours of
174313 7:55 a.m. to 9:45 a.m. Hawaii time at Pearl Harbor,

195353 b. stationed in February of 1945 on or in the immediate
196354 vicinity of the island of Iw o Jima, and

198355 c. a recipient of an honorable discharge from the United

201357 Such person may apply for an Iwo Jima license p late for each
202358 vehicle with a rated carrying capac ity of one (1) ton or less.

204359 Such license plate shall have the legend " Oklahoma OK" and shall
205360 contain three letters and three numbers. Between the letters and
206361 numbers shall be a logo of the flag -raising at Iwo Jima. Below the
207362 letters, logo and numbers, th e plate shall contain the words "FEB."
208363 at the left, "Iwo Jima" in the center and "1945" at the right. Such
209364 plates shall not be subject to the design requirements of any other
210365 license plates prescribed by la w other than the space for the
211366 placement of the yearly decals for each succeeding year of

214394 10. D-Day Survivor License Plates - such plates shall be
215395 designed for any resident of this state who can be verified by the
216396 United States Department of Veterans Affairs or the Armed Forces of
217397 the United States as being:

219398 a. a member of the United States Armed Forces on June 6,

224400 b. a participant in the Allied invasion of the coast of
225401 Normandy on June 6, 1944; provided, if such
226402 participation cannot be verified by the United St ates

229405 discretion, accept evidence of such participation from
230406 the person applying for the license plate, and

232407 c. a recipient of an honorable discharge from the United
233408 States Armed Forces.

235409 Such person may apply for a D -Day Survivor license plate for
236410 each vehicle with a rated carrying capacity of one (1) ton or less;

238411 11. Killed in Action License Plates - such plates shall be
239412 designed to honor members of the U nited States Armed Forces who were
240413 killed in action. The spouse of th e deceased person, if the spouse

245444 the qualifying spouse of the deceased person. The qualifying spouse
246445 may apply for a killed in action license plate for no more than two
247446 vehicles with each vehicle with a rat ed carrying capacity of one (1)
248447 ton or less. The fee provided by this section for the special
249448 license plate authorized by this paragraph shall be in addition to
250449 all other registration fees provided by law, except the registra tion
251450 fees levied by Section 11 32 of this title. Beginning November 1,
252451 2021, the killed in action license plate shall be designed to honor
253452 members of the United States Armed Forces who were killed in action
254453 while engaged in combat with a hostile force. Th e parents,
255454 siblings, half-siblings, grandparents or spouse of the dece ased
256455 person, if the spouse has not remarried, or if remarried, the
257456 remarriage is terminated by death, divorce or annulment, may apply
258457 for a killed in action license plate upon presenting proper
259458 certification that the person was killed in action and that th e
260459 person making the application is the qualifying spouse or family
261460 member of the deceased person. The qualifying spouse or family
262461 member may apply for a killed in action license plate f or no more
263462 than two vehicles with each vehicle with a rated carrying c apacity
264463 of one (1) ton or less. The license plate shall have a white
265464 background and the legend "Killed in Action" and shall contain any

268465 combination of numbers and letters from one to a maximum of seven in
269466 black, as for personalized license plates. To the left of the
270467 numbers and letters shall be the Battlefield Cross in gold. The

274496 12. Gold Star Families License Plates - such plates shall be
275497 designed to honor members of the United States Armed Forces who were
276498 killed while on active duty. The parents, siblings, half -siblings
277499 or grandparents of the deceased person may ap ply for a gold star
278500 license plate upon presenting proper certification that the person
279501 was killed while on active duty and that the person making the
280502 application is the parent, sibling, half -sibling or grandparent of
281503 the deceased person. The family member may apply for a gold star
282504 families license plate for no more than two vehicles with each
283505 vehicle having a rated carrying capacity of one (1) ton or less.
284506 The fee provided by this section for the special li cense plate
285507 authorized by this paragraph shall be in addition to all other
286508 registration fees provided by law, except th e registration fees
287509 levied by Section 1132 of this title;

289510 13. Military Decoration License Plates - such plates shall be
290511 designed for any resident of this state who has been awarded the
291512 Distinguished Service Medal, t he Distinguished Service Cross, the
292513 Distinguished Flying Cross, the Bronze Star military decoration or
293514 the Silver Star military decoration. Such persons may apply for a
294515 military decoration license plate for each vehicle with a rated
295516 carrying capacity of o ne (1) ton or less;

297543 14. Vietnam Veteran License Plates - such plates shall be
298544 designed for honorably discharged or present members of the United
299545 States Armed Forces who served in the Vietnam Conflict. Such
300546 persons may apply for a Vietnam veteran license plate for each
301547 vehicle with a rated carr ying capacity of one (1) ton or less;

303548 15. Police Officer License Plates - such plates shall be
304549 designed for any currently employed, rese rve or retired municipal
305550 police officer or full -time, reserve or retired univer sity police
306551 officer certified by the Cou ncil on Law Enforcement Education and
307552 Training or common education police officer certified by the Council
308553 on Law Enforcement Education a nd Training. Police officers may
309554 apply for police officer license plates for v ehicles with a rated

312555 capacity of one (1) ton or less or for a motorcycle upon proof of
313556 employment by or retirement from a municipal, university or common
314557 education police depart ment by either an identification card or
315558 letter from the chief of the police de partment or the Oklahoma
316559 Police Pension and Retirement Board. Retirees who are eligible for
317560 such plates shall provide proof of eligibility upon initial
318561 application but shall no t be required to provide proof of
319562 eligibility annually. The license plates sha ll be designed in
320563 consultation with muni cipal police departments of this state;
321564 provided, the license plate for motorcycles may be of similar design
322565 to the license plate for mot or vehicles or may be a new design in
323566 order to meet space requirements for a mo torcycle license plate;

325593 16. World War II Veteran License Plates - such plates shall be
326594 designed to honor honorably discharged former members of the United
327595 States Armed Forces w ho are residents of this state and who can be
328596 verified by the Military Departme nt of the State of Oklahoma, the
329597 Department of Veterans Affairs or the Armed Forces of the United
330598 States as having served on federal active duty anytime during the
331599 period from September 16, 1940, to December 7, 1945. The form er
332600 members may apply for a Wor ld War II Veteran license plate for
333601 vehicles with a rated carrying capacity of one (1) ton or less.

335602 The license plate shall have the legend "Oklahoma" and shall
336603 contain, in the center of the plate, either the Thunderbird Insig nia
337604 of the 45th Infantry Divis ion in the prescribed red and gold
338605 coloring or the emblem of the Army, Navy, U.S. Army Air Corps,
339606 Marines or Coast Guard according to the branch of service to which
340607 the member belonged. For the purpose of license plate
341608 identification, the plate shall cont ain four digits, two digits at
342609 the left and two digits at the right of the insignia or emblem.

346612 17. Korean War Veteran License Plates - such plates shall be

376663 designed to honor American Red Cross volunteers and staff wh o are
377664 residents of this state. Such persons must present an
378665 identification card issued by the American Red Cross and bearing a

410743 23. Civil Air Patrol License Plates - such plates shall be
411744 designed and issued to any person who is a member of the Civil Air

1540+shall retain the fee provided in Section 1141.1 of this title for
1541+registration of a motor vehicle. The lice nsed operator fees for

1543+Oklahoma Tax Commission Reimburseme nt Fund. Beginning January 1,
1544+2023, the licensed operator fees for acceptance of applications and
1545+renewals shall be paid out of the Service Oklahoma Reimbursement

1547+If fewer than one hundred of any type of special lice nse plates
1548+authorized prior to Ja nuary 1, 2004, are issued prior to January 1,
1549+2006, Service Oklahoma shall discontinue issuance and renewal of
1550+that type of special l icense plate. Any such authorized special
1551+license plate registrant shall be allowed to di splay the license
1552+plate upon the designated vehicle until the reg istration expiration
1553+date. After such time the expired special lic ense plate shall be
1554+removed from the vehicle.
1555+Except as otherwise provided in law, for special license plates
1556+authorized on or after July 1, 2004, no special license plates shall
1557+be developed or issued by Service Oklahoma until Service Oklahoma
1558+receives one hundred (100) prepaid applicatio ns therefor. The
1559+prepaid applications must be received by Service Oklahoma within one
1560+hundred eighty (180) days of the eff ective date of the authorization

2700+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
2701+SECTION 4. AMENDATORY 47 O.S. 2021, Section 1135. 3, as
2702+amended by Section 162, Chapter 282, O.S.L. 2022 (47 O.S. Supp.
2703+2022, Section 1135.3 ), is amended to read as follows:
2704+Section 1135.3. A. Service Oklahoma is hereby authorized to

2744+license plates. The notice shall contain all ne cessary information
2745+and shall contain instructions for the renewal procedure upon
2746+presentation to a licensed operator or Ser vice Oklahoma. The
2747+license plates shall be issued on a staggered system.
8482748 Service Oklahoma is hereby directed to develop and impleme nt a
8492749 system whereby licensed opera tors are permitted to accept
8502750 applications for special license plates authorized under this
8512751 section. The licensed operator shall c onfirm the applicant ’s
8522752 eligibility, if applicable, collect and deposit any amount
8532753 specifically authorized by law, accept and p rocess the necessary
8542754 information directly into such system and generate a receipt
8552755 accordingly. For performance of these duties, l icensed operators
8562756 shall retain the fee provided in Section 1141.1 of this title for
