357-2. If a school district intends to provide retirement benefits
358-to a teacher such that the teacher 's salary would be less than the
359-amounts set forth in t he minimum salary schedule specified in
360-subsection A of this section, the d istrict shall be required to
361-provide written notification to th e teacher prior to his or her
362-employment or, if already employed by the district, no later than
363-thirty (30) days prior to the date the district elects to prov ide
364-retirement benefits such that t he teacher's salary would be less
365-than the minimum salary sched ule.
366-C. Any of the degrees referred to in this section shall be from
367-a college recognized by the State Board of Educa tion. The Board
368-shall accept teaching e xperience from out-of-state school districts
369-that are accredited by the state board of education o r appropriate
370-state accrediting agency for the districts. The Board shall accept
371-teaching experience from out -of-country schools that are accredited
372-or otherwise endorsed by the appropriate na tional or regional
373-accrediting or endorsement authority. Out -of-country certification
374-documentation in a language other than English shall be analyzed by

401-an educational credential evaluation service in accordance with
402-industry standards and guidelines and approved by the State
403-Department of Education. The person see king to have credit granted
404-for out-of-country teaching experience shall be responsible for all
405-costs of the analysis by a credential evaluation service. The Board
406-shall accept teaching experi ence from primary and secondary schools
407-that are operated by th e United States Department of Defense or are
408-affiliated with the United States Department of State.
409-D. For the purpose of state salary increments and retirem ent,
410-no teacher shall be granted cr edit for more than five (5) years of
411-active duty in the militar y service or out-of-state or out-of-
412-country teaching experience as a certified teacher or its
413-equivalent. Nothing in this section shall prohibit boards of
414-education from crediting more years o f experience on district salary
415-schedules than those allowed fo r state purposes.
416-E. The State Board of Education shall recognize, for purposes
417-of certification and salary increment s, all the years of experience
418-of a:
419-1. Certified teacher who teaches in t he educational program of
420-the Department of Corrections, beginn ing with fiscal year 1981;
421-2. Vocational rehabilitation counselor under the Department of
422-Human Services if the couns elor was employed as a certified teacher
423-by the State Department of Educati on when the Division of Vocational
424-Rehabilitation was transferr ed from the State Board of Career and

451-Technology Education or the State Board of Education to the Oklahoma
452-Public Welfare Commission on July 1, 1968;
453-3. Vocational rehabilitation counselor whi ch were completed
454-while employed by the Department of Human Ser vices if such counselor
455-was certified as a teacher or was eligible for certification as a
456-teacher in Oklahoma;
457-4. Certified teacher which were completed whil e employed by the
458-Child Study Center located at University Hospital, if the teacher
459-was certified as a teacher in Oklahoma; and
460-5. Certified school psychologist or psychometrist which were
461-completed while employed a s a doctoral intern, psychological
462-assistant, or psychologist with any agen cy of the State of Oklahoma
463-if the experience primarily involve d work with persons of school - or
464-preschool-age and if the person was, at the time the experience was
465-acquired, certified as, or eligible for certification as , a school
466-psychologist or psychome trist.
467-F. The provisions of this section shall not apply to te achers
468-who have entered into postretirement employment with a public school
469-in Oklahoma and are still receiving a mont hly retirement benefit.
470-G. If a person employed as certified personnel, as defined in
471-Section 26-103 of this title, by a school district during the 2017-
472-2018 2022-2023 school year was receiving a salary above the step
473-level indicated by the State Minimum Salary Schedule for the 2017-
474-2018 2022-2023 school year, the person shall receive a salary

501-increase amount equal to the amount indicated provided for in
502-subsection A of this section for the step level indicated for the
503-person including the full amount of i ncrease assigned to the step
504-pursuant to the provi sions of this act, provided they remain the
505-person remains employed by the same district , unless the hours or
506-the duties of the certified personnel are redu ced proportionately.
507-SECTION 2. NEW LAW A new section of law not to be
508-codified in the Oklahoma Statu tes reads as follows:
509-It is the intent of the Legislature to pr ovide funding through
510-the appropriations process to fund comparable salary increases to
511-teachers employed by the following state agencies: State Board of
512-Career and Technology Education, State Department of Rehabilitative
513-Services, State Department of Corrections, and the Office of
514-Juvenile Affairs.
515-SECTION 3. NEW LAW A new section of law not to be
516-codified in the Oklahoma Statutes reads as follo ws:
517-The provisions of this act shall not become effective as law
518-unless both Enrolled Ho use Bill No. 1935 of the 1st Session of the
519-59th Oklahoma Legislatu re and Enrolled House Bill No. 2775 of the
520-1st Session of the 59th Oklahoma Legislature beco me enacted as law.
521-SECTION 4. This act shall become effective July 1, 2023.
522-SECTION 5. It being immediately necessary for the preservation

95+1. A recipient shall be eligible to receive assistance pursuant
96+to the TANF program only for a lif etime total of five (5) years,

65999 2. Single parents receiving temporary assista nce pursuant to
660100 the TANF program shall participate in work activit ies for a minimum
661101 of twenty (20) hours per week during the month. Two-parent families
662102 receiving temporary assistance pursuant to the TANF progr am shall
663103 participate in work activities for a minimum of thirty-five (35)
664104 hours per week during the month;
665105 3. A recipient must be engaged in one or more of the work
666106 activities set out i n paragraph 4 of this subsection as soon as
667107 required by the Department of Human Services pursuant to the TANF
668108 program, but not later than twenty-four (24) months after
669109 certification of the application for assistance, u nless the person
670110 is exempt from work r equirements under rules promulgated by the
671111 Commission Director pursuant to the STARS;
672112 4. The Department shall devel op and describe categories of
673113 approved work activities for the TAN F program recipients in
674114 accordance with this paragraph. Work activities t hat qualify in
675115 meeting the requirements include, but are not limited t o:
676116 a. (1) unsubsidized employment which is ful l-time
677117 employment or part-time employment that is not
678118 directly supplemented by federal or state funds,
679-(2) subsidized private sector employm ent which is
680-employment in a private for -profit enterprise or

709150 Prior to receiving any sub sidy or incentive, the
710151 employer shall enter into a written contract with
711152 the Department, and
712153 (3) subsidized public sector employment which is
713154 employment by an agency of a federal, state, or
714155 local governmental entity which is directly
715156 supplemented by federa l or state funds. Prior to
716157 receiving any subsidy or incentive, the employ er
717158 shall enter into a written contract with the
718159 Department.
719160 Subsidized hourly employment or unsubsidized hourly
720161 employment pursuant to this subparagraph shall only be
721162 approved by the Department as work activity if such
722163 employment is subject to:
723164 (a) the federal minimum wage requirements
724165 pursuant to the Fair Labor Standards Ac t of
725166 1938, as amended,
726167 (b) the federal Social Security tax and Medicare

775217 employment to a recipient who successfully completes

812255 h. literacy and adult basic education programs,
813256 i. vocational-educational programs, not to exceed twelve
814257 (12) months for any individual, which are directed
815258 toward vocational-educational training and education
816259 directly related to employmen t,
817260 j. education programs which are directly related to
818261 specific employment opportunities, if a recipient has
819262 not received a high school diploma or General
820263 Equivalency Degree General Educational Development
821264 certificate, and
822265 k. child care for other STARS rec ipients. The recipient
823266 must meet training and licensing requirements for
824267 child care providers as required b y the Oklahoma Child
825268 Care Facilities Licensing Act;
826-5. Single, custodial parents with a child up to one (1) year of
827-age may be exempt from work act ivities for a lifetime total
828-exemption of twelve (12) mon ths;

296+5. Single, custodial parents with a child up to one (1) year of
297+age may be exempt from work act ivities for a lifetime total
298+exemption of twelve (12) mon ths;
855299 6. In order to receive assistance, unmarried teen parents of a
856300 minor child at least twelve (12) weeks of age must participate in
857301 educational activities or work activi ties approved by the state;
858302 7. For single-parent families, except for teen parents,
859303 educational activities, other than vocational -technical training, do
860304 not count toward meeting the required twe nty (20) hours of work
861305 activity. For two-parent families, educational activities, excep t
862306 vocational-technical training, do not count toward meet ing the
863307 required thirty-five (35) hours of work act ivity;
864308 8. A teen parent must live at home or in an approved , adult-
865309 supervised setting as specified in Section 230.55 of this title to
866310 receive TANF assistance;
867311 9. A recipient must comply with immunization requirements
868312 established pursuant to the TANF prog ram;
869313 10. A recipient shall be subject to the increment in b enefits
870314 for additional children established by Section 230.58 of this title;
871315 11. The following recipient resources are exempt from resource

914359 12. 11. An applicant who applies and is otherwise eligible to
915360 receive TANF benefits but who h as resided in this state less than
916361 twelve (12) months shall be subject to Section 230.57 of this title;
917362 13. 12. The recipient shall enter into a pe rsonal
918363 responsibility agreement with the Department for receipt of
919364 assistance pursuant to Section 230.65 of this title;
920365 14. 13. The Department shall, beginning November 1, 2012 on the
921366 effective date of this act, screen all adult applicants for TANF
922367 recipients as part of the required TANF employability plan to
923368 determine if they are engaged in the illega l use of a controlled
924369 substance or substances. If the Department has made a determination
925370 that the applicant recipient is engaged in the illegal use of a
926-controlled substance or substances, the applicant’s request for TANF
927-cash benefits shall be denied. The Commission for Human Services
928-recipient’s TANF employability plan shall include substance abuse

399+cash benefits shall be denied. The Commission for Human Services
400+recipient’s TANF employability plan shall include substance abuse
955401 treatment and, if appropriate, mental health counseling, as part of
956402 the assigned work activities required by paragraph 4 of this
957403 subsection. The Director shall adopt rules to implement the
958404 requirements of this paragraph cons istent with the following:
959405 a. the Department shall create a c ontrolled substance
960406 screening process to be administered at the time of
961407 application during the assessment process that
962408 determines the TANF employability plan. The process
963409 shall, at a minimum, in clude a Substance Abuse Subtle
964410 Screening Inventory (SASSI) or other similar screening
965411 methods. If necessary to establish a reasonable
966412 expectation of certainty, the Department is authorized
967413 to use further screening methods, whi ch may include,
968414 but are not limited to, a clinical interview, and
969415 consideration of the Department’s history with the
970416 applicant, and an Addictions Severity Index (ASI) . If
971417 the Department has reasonable cause to believe that
972418 the applicant recipient is engaged in the ille gal use
973419 of a controlled substance or substances, the
974420 Department is authorize d, though not required, to
975421 request administration of a chemical drug test , such
976-as urinalysis. The cost of all such initial
977-screenings shall not be borne by the applicant
978-recipient, and

449+as urinalysis. The cost of all such initial
450+screenings shall not be borne by the applicant
451+recipient, and
1005452 b. if at any time during the controlled substance
1006453 screening process, the applicant recipient refuses to
1007454 participate without good cause, that refusal shall
1008455 lead to a denial closure of TANF benefits,
1009456 c. if the Department, as the result of a controlled
1010457 substance screening process, has determined that the
1011458 applicant is engaged i n the illegal use of a
1012459 controlled substance or substances, the applicant’s
1013460 request for TANF cash benefits shall be denied,
1014461 subject to the following:
1015462 (1) if there has not already been a chemical d rug
1016463 test administered as part of the controlled
1017464 substance screening process, the applica nt may
1018465 submit proof of a negative chemical drug test
1019466 from a state certified laboratory to challenge
1020467 the Department’s finding that the applicant is
1021468 engaged in the illega l use of a controlled
1022469 substance or substances. Proof of the chemical
1023470 drug test must be submitted to the Department no
1024471 later than the tenth calendar day following
1025472 denial. If denial is communicate d by mail, the
1026-ten (10) day window begins on the day after th e
1027-date of mailing of the denial notice to the
1028-applicant’s last-known address. The deni al

1055503 notice is considered to be mailed on the date
1056504 that appears on the notice, unless otherwise

1058506 (2) if denied due to the provisions of this
1059507 subparagraph, an applicant shall not be approved
1060508 until one (1) year has passed since the date of
1061509 denial,
1062510 (a) if the applicant is denied due to the
1063511 provisions of this paragraph, the Department
1064512 shall provide a list of substance abuse
1065513 treatment programs to the deni ed applicant,
1066514 (b) if an applicant has successfully complied
1067515 with a recommended substance abuse treatment
1068516 program after the date of denial, the
1069517 applicant may be approved for cash benefits
1070518 after six (6) months have passed since the
1071519 date of denial, rather tha n the required one
1072520 (1) year, and
1073521 (3) if an applicant has been denied TANF cash
1074522 benefits two times due to the provisions of this
1075523 subparagraph, the applicant shall be ineligible
1076-for TANF benefits fo r a period of three (3) years

1104553 d. child-only cases and minor parents under eighteen (1 8)
1105554 years of age are not sub ject to the provisions of this

1107556 e. in cases where the application for TANF benefits is
1108557 not for child-only benefits, but there is not a parent
1109558 who has been deemed eligible for cash benefits under
1110559 the provisions of th is paragraph, any cash bene fits
1111560 for which the dependent children of the family are
1112561 still eligible shall not be affected and may be
1113562 received and administered by an appropriate third
1114563 party approved by the Department for the benefit of
1115564 the members of the hous ehold;
1116565 15. 14. a. As a condition of participating in the STARS, all
1117566 recipients are deemed to have given authorization for
1118567 the release of any and all information necessary to
1119568 allow all state and f ederal agencies to meet the
1120569 program needs of the recipient.
1121570 b. The recipient shall be pr ovided a release form to sign
1122571 in order to obtain the required information. Failure
1123572 to sign the release form may result in case closure;
1124573 and
1125-16. 15. The recipient shall comply with all other conditions
1126-and requirements of the ST ARS, and rules of the Commission
1127-promulgated pursuant thereto.

601+16. 15. The recipient shall comply with all other conditions
602+and requirements of the ST ARS, and rules of the Commission
603+promulgated pursuant thereto.
1154604 B. 1. Agencies of this state involved in providing services to
1155605 recipients pursuant to the STARS shall exchange i nformation as
1156606 necessary for each agency to accomplish objectives and fulfill
1157607 obligations created or impose d by the STARS and rules promulgated
1158608 pursuant thereto.
1159609 2. Information received pursuant to the STARS shall be
1160610 maintained by the applicable agency and , except as otherwise
1161611 provided by this subsection, shall be disclosed only in a ccordance
1162612 with any confidentiality provisions applicable to the agency
1163613 originating the information.
1164614 3. The various agencies of the sta te shall execute operating
1165615 agreements to facilitate information exchanges pursuant to the
1166616 STARS.
1167617 C. In implementing the TANF program, the Departmen t shall:
1168618 1. Provide assistance to aliens pursuant to Section 230.73 of
1169619 this title;
1170620 2. Provide for the clos ure of the TANF case when the adult
1171621 recipient refuses to cooperate with agreed upon work activities or
1172622 other case requirements pursuant to the TANF program;
1173623 3. Provide for the sanctioning of parents who do not require
1174624 their minor children to attend school ; and
1175-4. Deny temporary assistance to fug itive felons.
1176-D. In order to ensure that the needy citizens of this state are
1177-receiving necessary benefit s, the Department shall maintain a

653+D. In order to ensure that the needy citizens of this state are
654+receiving necessary benefit s, the Department shall maintain a
1204655 listing of all recipients receiving public assistance. The listing
1205656 shall reflect each recipient ’s income, social security number, and
1206657 the programs in which the recipient is participating includ ing, but
1207658 not limited to, TANF, food stamps, child care, and medical
1208659 assistance.
1209660 E. The Department is hereby authorized to establish a grant
1210661 diversion program and emergency assi stance services.
1211-SECTION 7. This act shall become effective Ju ly 1, 2023.
