16059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
16160 SECTION 1. AMENDATORY 22 O.S. 2021, Section 1355.7, is
16261 amended to read as follows:
16362 Section 1355.7. A. If the Executive Director determines that a
16463 conflict of interest exists at the trial level between a defendant
16564 client of the Oklahoma Indigent Defense Syst em and an attorney
16665 employed or contracted by the System, or that efficient management
16766 of System resources justify re assignment, the case may be reassi gned
16867 by the Executive Director to another attorney employed by the
169-System, or to a private attorney with w hom the System has a contract
170-for indigent defense or who is included on a list of attorneys as
171-provided in subsection C B of this section.

19898 B. If the Executive Director determines that a conflict of
19999 interest exists at the trial level between a defendant a nd an
200100 attorney who represents ind igents either pursuant to a contract with
201101 the System or as assigned by the System, the case may be reassigned
202102 by the Executive Director to an attor ney employed by the System,
203103 another attorney who represents indigents pursua nt to a contract
204104 with the System, or another private attorney who has agreed to
205105 accept such assignments pursuant to subsection C of this section.
206106 C. Assignment of a case by the System to a private attorney in
207107 all counties of this state served by the Syste m shall be from a list
208108 of attorneys willing to accept such assignments and who meet the
209109 qualifications established by the System for such the assignments.
210110 D. C. Payment to such private attorneys shall be made by the
211111 System and shall be at rates approved b y the System, subject to the
212112 statutory limits established in Sections 1355.8 and 1355.13 of this
213113 title for cases at the trial level .
214114 SECTION 2. AMENDATORY 22 O.S. 2021, Section 1355.13, is
215115 amended to read as follows:
216116 Section 1355.13. A. In every case in which t he defendant is
217117 subject to the death penalty and an attorney or attorneys other than
218118 an attorney or attorneys employed by the Indigent Defense Syste m are
219-assigned to the case by the System to provide representation, an
220-attorney or attorneys must submit a claim or claims in accordance
221-with the provisions of the Indigent Defense Act in such detail as

146+assigned to the case by the System to prov ide representation, an
147+attorney or attorneys must submit a claim or claims in accordance
148+with the provisions of the Indigent Defense Act in such detail as
248149 required by the System. Except as provided in subsecti on B of this
249150 section, total compensation for n on-System attorneys who ser ve as
250151 lead counsel in capital cas es shall not exceed Twenty Thousand
251152 Dollars ($20,000.00) per case. Total compensati on for a non-System
252153 attorney who is co-counsel with a System or no n-System attorney in a
253154 capital case shall not exceed Five Thousand Dollar s ($5,000.00)
254155 Twenty-five Thousand Dollars ( $25,000.00) per case.
255156 B. The maximum statutory fee establ ished in this section may be
256157 exceeded only upon a determination made by the Execu tive Director
257158 and approved by the Board that t he case is an exceptional one which
258159 requires an extraordinary amou nt of time to litigate , and that the
259160 request for extraordinary attorney fees is reas onable.
260161 SECTION 3. AMENDATORY 22 O .S. 2021, Section 1358, is
261162 amended to read as follows:
262163 Section 1358. If the Executive Director determines that a
263164 conflict exists afte r evaluating a case assigned pursuant to Section
264165 1356 of this title or that the efficient management of System
265166 resources justify reassignment, the Executive Director sh all
266167 reassign the case in the same manner as is provided for conflicts
267168 case reassignments at the trial level in Section 1355.7 of this
268169 title, unless the case is from a county subject to the provisions of
269-Section 138.1a of Title 19 of the Oklahoma Statutes and the indigent
270-defendant was not represented at trial by the coun ty indigent

197+Section 138.1a of Title 19 of the Oklahoma Statutes a nd the indigent
198+defendant was not represented at trial by the coun ty indigent
199+defender. If the Executive Director determines a conflict exists in
298200 a case from a county subject to the provisions of Section 138.1 a of
299201 Title 19 of the Oklahoma Statutes and the indigent defendant was not
300202 represented at trial by the county ind igent defender, the county
301203 indigent defender shall be appointed to represent the indigent
302204 defendant. The appointment of the county indigent def ender shall be
303205 made by the district court at t he time the appeal is initiated o r by
304206 the Court of Criminal Appeal s after the appeal is initiated. If the
305207 district court, at the time the appeal is initiated, or the Court of
306208 Criminal Appeals, after the appeal has been initiated, determines
307209 that the county indigent defender also has a co nflict of interest in
308210 the case, the district court, initially or on remand from the Court
309211 of Criminal Appeals, shall appoint counsel in the same manner as is
310212 provided for conflicts at the trial level in Section 138.7 of Tit le
311213 19 of the Oklahoma Statutes, b y reassigning the case to another
312214 county indigent defender, an attorney who represents indigents
313215 pursuant to contract, or a private attorney has agreed to accept
314216 such appointments.
315217 SECTION 4. This act shall become effective November 1, 2023.
