26146 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28147 SECTION 1. AMENDATORY 12 O.S. 2021 , Section 1805, is
29148 amended to read as follows:

31149 Section 1805. A. Any information received by a mediator or a
32150 person employed to assist a mediator, throug h files, reports,
33151 interviews, memoranda, case summaries, or notes a nd work products of
34152 the mediator, is privileged and confidential.

36153 B. No part of the proceeding shall be con sidered a matter of
37154 public record.
155+C. No mediator, initiating party, or respondi ng party in a
156+mediation proceeding shall be subject to administrati ve or judicial
157+process requiring di sclosure of any matters discussed or shall
158+disclose any information obtai ned during any part of the mediation
159+proceedings including but not limited to mediation scheduling,
160+attendance, participation, or discussion of any proposed se ttlement

187+agreement, items agreed upon or disputed, or the intent of the
188+parties.
50189 D. Each mediation session shall be informal. No adjudication
51190 sanction or penalty may be made or imposed by the mediator or the
52191 program.

54192 E. No mediator, employee, or agent of a mediator shall be he ld
55193 liable for civil damages for any statement or decision made in the
56194 process of mediating or settling a dispute unless th e action of such
57195 person was a result of gross negligence with m alicious purpose or in
58196 a manner exhibiting willful disregard of the rig hts, safety, or
59197 property of any party to the mediation.

61198 F. If a party who has participated in mediation brings an
62199 action for damages against a mediator a rising out of mediation, for
63200 purposes of that action the privilege provided for in subsection A
64201 of this section shall be deemed to be waived as to the party
65202 bringing the action.

67203 SECTION 2. This act shall become effective November 1, 2023.
