2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 74 O.S. 2021, Section 85.44D.1, is
3057 amended to read as follows:

3258 Section 85.44D.1 A. 1. A sole source acquisition is exempt
3359 from competitive bidding procedures as a sole source or requirements
3460 of this act, but a sole brand a cquisition is subject to such
3561 competitive bidding requirements.

3762 2. For each sole source or sole brand acquisition, the state
3863 agency shall retain in the state agency's acquisition file and
3964 attach to the requisition, a certification signed by the chief
4065 administrative officer of the state agency, in the following form:

96151 3. A court order requiring a particular acquisition, but which
97152 does not specify a brand or supplier shall not substitute for the
98153 certification required by this section or otherwise invalidate
99154 acquisition procedures required b y the Oklahoma Central Purchasing
100155 Act.

102156 4. Upon a determination by the Director of the Office of
103157 Management and Enterprise Services that there are reasonable grounds
104158 to believe that a violation of this section has occurred, the
105159 Director shall send findings to the Attorney General that support
106160 the determination. The Attorney General shall review the findings
107161 and determine whether to investigate or prosecute the person.

109162 5. Prior to approving a requisition for a sole source or sole
110163 brand acquisition, the Pur chasing Division shall require the signed
111164 certification documenting the need for a sole source or sole brand
112165 acquisition and shall retain the certification in accordance with
113166 state record retention requirements.

115194 6. For a sole source or sole brand acquisit ions exceeding the
116195 fair and reasonable acquisition threshold amount and not requiring
117196 submission of a requisition to the Purchasing Division, the state
118197 agency's certified procurement officer shall retain, in the
119198 acquisition file, the signed certification d ocumenting the need for
120199 the sole source or sole brand acquisition in accordance with state
121200 record retention requirements.

123201 B. By the fifteenth day of each month, or the first worki ng day
124202 thereafter, the Office of Management and Enterprise Services shall
125203 provide a report to:

127204 1. The Speaker of the House of Representatives and the
128205 President Pro Tempore of the Senate; and

130206 2. Any member of the Legislature requesting the report.

132207 The report shall detail sole source and sole brand acquisitions
133208 by state agencies for the month prior to the month preceding the
134209 submission of the report. The report shall be titled "Monthly Sole
135210 Source and Sole Brand Contracting Report of Oklahoma State Agencie s"
136-and indicate the time period of the report. The report shall be ENR. H. B. NO. 1019 Page 4

137212 provided by the Director of the Office of Management and Enterprise
138213 Services or the Director's designee. The report shall be in
139214 columnar database format and shall include at least the following
140215 fields of information: state agency number; state agency name; date

143245 requisition; if disapproved, the reason why such cont ract
144246 requisition was disapproved; estimated amount of the requisition
145247 acquisition; purchase order amount; purchase order number; actual
146248 business name of supplier; supplier federal employer identification
147249 number; and the commodity classification listing at the appropriate
148250 level to distinguish between similar acquisitions. Informat ion
149251 required by this subsection shall be reported and maintained on each
150252 report through the next reporting period after an acquisition is
151253 made. The applicable data in the fields o f information specified in
152254 this subsection shall be listed even if the state agency requisition
153255 is disapproved.

155256 C. 1. The State Department of Health shall be exempt from
156257 requests for proposals for sole source acquisitions for the Nurse -
157258 Family Partnership Program and the Children First Program.

159259 2. The provisions of this subsecti on shall cease to have the
160260 force and effect of law on November 1, 2029.

162261 SECTION 2. It being immediately necessary for the preservation
163262 of the public peace, health or safety, an emergency is hereby
164263 declared to exist, by reason whereof this act shall take effect and
