54	57		BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
55	58		SECTION 1. NEW LAW A new section of law to be codified
56	59		in the Oklahoma Statutes as Section 1450.1 of Title 12, unless there
57	60		is created a duplication in num bering, reads as follows:
58	61		A. Any person who, by means of a telecommunication or other
59	62		electronic communication device, either:
60	63		1. Makes any comment, request, suggestion, or proposal which is
61	64		obscene, lewd, lascivious, filthy, or indecent;
62	65		2. Makes a telecommunication or other electronic communicatio n,

90	94		intimidating, harassing, or threatening to inflict injury or
91	95		physical harm to any person or prop erty of that person;
92	96		3. Makes a telecommuni cation or other electronic communication,
93		-	whether or not conversation ensues, for the purpose of putting the

94	98		party in fear of physical harm or de ath;
95	99		4. Makes a telecommunica tion or other electronic communication,

100	104		5. Makes a telecommunication or other ele ctronic communication,
101		-	including text, sound, or images, for the purpose of intimidating or
102		-	threatening a person, to alter his or her mode o f carrying on
103		-	business, or to interrupt the carrying on of business;
	105	+	including text, sound, or images for the purpose of intimidating or
	106	+	threatening a person to alter his or her mode o f carrying on
	107	+	business or to interrupt the carrying on of business;
104	108		6. Knowingly permits any telecommunication or oth er electronic
105	109		communication under the control of the pers on to be used for any
106	110		purpose prohibited by this section; or
107	111		7. In conspiracy or concerted action with other persons, makes
108	112		repeated calls or el ectronic communications or simultaneous calls or
109	113		electronic communications solely to harass any person at the called
110	114		number,
111	115		shall be liable for online harassment and liable for any damages
112	116		sustained by the person or persons injur ed as a result thereof.
113	117		B. As used in this section:

140	145		1. "Electronic communication" and "telecommunication" means any
141	146		type of telephonic, electronic or radio communications, or
142	147		transmission of signs, signals, data, writings, image s, and sounds
143	148		or intelligence of any nature by telephone, including cellular
144	149		telephones, wire, cable, radi o, electromagnetic, photoelectronic or
145		-	photo-optical system, or the creation, display, management, storage,
	150	+	photo-optical system or the creation, display, management, storage,
146	151		processing, transmission or distribution of images, text, voice,
147	152		video or data by wire, cable or wireless means, including the
148	153		internet. The term includes:
149	154		a. a communication initiated by electronic mail, instant
150	155		message, network call, or facsimile machine including
151	156		text, sound or images,
152	157		b. a communication made to a pag er, or
153	158		c. a communication including text, sound, or images
154	159		posted to a social m edia or other public media source;
155	160		and
156	161		2. "Person" means either a natural person or entity.
157	162		C. At the time of filing a petition for an action pursuant to
158	163		this section, the plaintiff may re quest injunctive relief to prevent
159	164		any further intimidation, haras sment, threat, or abuse by means of a
160	165		telecommunication or other electronic communication device. The
161	166		plaintiff may be awarded damages as provided in su bsection D of this
162	167		section.

189	195		D. Actual damages shall include but not be limited to funds
190	196		spent related to counseling or libel. Punitive damages of not less
191	197		than Five Hundred Dollars ($500.00) per individual may be awarded to
192	198		the injured party or parties. The prevailing party in any act ion
193	199		under this section shall be entitled t o court costs and reasonable
194	200		attorney fees.
195	201		E. The remedies provided for in this section are cumulative and
196	202		shall be in addition to any others provided for by law.
197	203		SECTION 2. This act shall become effective November 1, 2023.
