5457 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
5558 SECTION 1. NEW LAW A new section of law to be codified
5659 in the Oklahoma Statutes as Section 1450.1 of Title 12, unless there
5760 is created a duplication in num bering, reads as follows:
5861 A. Any person who, by means of a telecommunication or other
5962 electronic communication device, either:
6063 1. Makes any comment, request, suggestion, or proposal which is
6164 obscene, lewd, lascivious, filthy, or indecent;
6265 2. Makes a telecommunication or other electronic communicatio n,

9094 intimidating, harassing, or threatening to inflict injury or
9195 physical harm to any person or prop erty of that person;
9296 3. Makes a telecommuni cation or other electronic communication,
93-whether or not conversation ensues, for the purpose of putting the

9599 4. Makes a telecommunica tion or other electronic communication,

100104 5. Makes a telecommunication or other ele ctronic communication,
101-including text, sound, or images, for the purpose of intimidating or
102-threatening a person, to alter his or her mode o f carrying on
103-business, or to interrupt the carrying on of business;

104108 6. Knowingly permits any telecommunication or oth er electronic
105109 communication under the control of the pers on to be used for any
106110 purpose prohibited by this section; or
107111 7. In conspiracy or concerted action with other persons, makes
108112 repeated calls or el ectronic communications or simultaneous calls or
109113 electronic communications solely to harass any person at the called
110114 number,
111115 shall be liable for online harassment and liable for any damages
112116 sustained by the person or persons injur ed as a result thereof.

140145 1. "Electronic communication" and "telecommunication" means any
141146 type of telephonic, electronic or radio communications, or
142147 transmission of signs, signals, data, writings, image s, and sounds
143148 or intelligence of any nature by telephone, including cellular
144149 telephones, wire, cable, radi o, electromagnetic, photoelectronic or
145-photo-optical system, or the creation, display, management, storage,
150+photo-optical system or the creation, display, management, storage,
146151 processing, transmission or distribution of images, text, voice,
147152 video or data by wire, cable or wireless means, including the
148153 internet. The term includes:
149154 a. a communication initiated by electronic mail, instant
150155 message, network call, or facsimile machine including
151156 text, sound or images,
152157 b. a communication made to a pag er, or
153158 c. a communication including text, sound, or images
154159 posted to a social m edia or other public media source;
155160 and
156161 2. "Person" means either a natural person or entity.
157162 C. At the time of filing a petition for an action pursuant to
158163 this section, the plaintiff may re quest injunctive relief to prevent
159164 any further intimidation, haras sment, threat, or abuse by means of a
160165 telecommunication or other electronic communication device. The
161166 plaintiff may be awarded damages as provided in su bsection D of this
162167 section.

189195 D. Actual damages shall include but not be limited to funds
190196 spent related to counseling or libel. Punitive damages of not less
191197 than Five Hundred Dollars ($500.00) per individual may be awarded to
192198 the injured party or parties. The prevailing party in any act ion
193199 under this section shall be entitled t o court costs and reasonable
194200 attorney fees.
195201 E. The remedies provided for in this section are cumulative and
196202 shall be in addition to any others provided for by law.
197203 SECTION 2. This act shall become effective November 1, 2023.
