14657 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14758 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -101, as
14859 last amended by Section 5, Chapter 47, 1st Extraordinary Session,
14960 O.S.L. 2023 (47 O.S. Supp. 2023, Section 6 -101), is amended to read

151-Section 6-101. A. No person, excep t those hereinafter

89+Section 6-101. A. No person, except those hereinafter
90+expressly exempted in Sections 6 -102 and 6-102.1 of this title,
91+shall operate any motor vehicle upon a highway in this state unless
18092 the person has a valid Oklahoma driver license for the class of
18193 vehicle being operated under the provisions of this title. No
18294 person shall be permitted to possess more than one valid license at
18395 any time, except as provided in paragraph 4 of subsection F of this
18496 section.
18597 B. 1. No person shall operate a Class A co mmercial motor
18698 vehicle unless the person is eighteen (18) years of age or older and
18799 holds a valid Class A commercial license, except as provided in
188100 paragraph 5 of this subsection and subsection F of this section.
189101 Any person holding a valid Class A commerc ial license shall be
190102 permitted to operate motor vehicles in Classes A, B, C and D, except
191103 as provided for in paragraph 4 of this subsection.
192104 2. No person shall operate a Class B commercial motor vehicle
193105 unless the person is eighteen (18) years of age or o lder and holds a
194106 valid Class B commercial license, except as provided in paragraph 5
195107 of subsection F of this section. Any person holding a valid Class B
196108 commercial license shall be permitted to operate motor vehicles in
197109 Classes B, C and D, except as provi ded for in paragraph 4 of this
198110 subsection.
199111 3. No person shall operate a Class C commercial motor vehicle
200112 unless the person is eighteen (18) years of age or older and holds a
201-valid Class C commercial li cense, except as provided in subsection F

140+valid Class C commercial license, except as provided in subsection F
141+of this section. Any person holding a valid Class C commercial
229142 license shall be permitted to operate motor vehicles in Classes C
230143 and D, except as provided for in paragraph 4 of this subsection.
231144 4. No person under twenty -one (21) years of age sha ll be
232145 licensed to operate any motor vehicle which is required to be
233146 placarded for hazardous materials pursuant to 49 C.F.R., Part 172,
234147 subpart F, except as provided in subsection F of this section;
235148 provided, a person eighteen (18) years of age or older may be
236149 licensed to operate a farm vehicle which is required to be placarded
237150 for hazardous materials pursuant to 49 C.F.R., Part 172, subpart F,
238151 except as provided in subsection F of this section.
239152 5. A person at least seventeen (17) years of age who
240153 successfully completes all exa minations required by law may be
241154 issued by Service Oklahoma:
242155 a. a restricted Class A commercial license which shall
243156 grant to the licensee the privilege to operate a Class
244157 A or Class B commercial motor vehicle for harvest
245158 purposes or a Class D motor vehicle , or
246159 b. a restricted Class B commercial license which shall
247160 grant to the licensee the privilege to operate a Class
248161 B commercial motor vehicle for harvest purposes or a
249162 Class D motor vehicle.
250-6. No person shall operate a Class D motor vehicle unless the
251-person is sixteen (16) years of age or older a nd holds a valid Class
252-D license, except as provided for in Section 6 -102 or 6-105 of this

190+6. No person shall operate a Class D motor vehicle unless the
191+person is sixteen (16) years of age or older and holds a valid Class
192+D license, except as provided for in Section 6 -102 or 6-105 of this
279193 title. Any person holding a valid Class D license shall be
280194 permitted to operate motor vehicles in Class D only.
281195 C. Any person issued a driver license pursuant to this section
282196 may exercise the privilege thereby granted upon all streets and
283197 highways in this state.
284198 D. No person shall operate a motorcycle or motor -driven cycle
285199 without having a valid Class A, B, C or D license with a motorcycle
286200 endorsement. Except as otherwise provided by law, any new applicant
287201 for an original driver license shall be required to successfully
288202 complete a written examination, vision examination and driving
289203 examination for a motorcycle as prescrib ed by the Department of
290204 Public Safety, in conjunction with Service Oklahoma, and a certified
291205 state-approved motorcycle basic rider course approved by the
292206 Department, in conjunction with Service Oklahoma, if the applicant
293207 is seventeen (17) years of age or y ounger to be eligible for a
294208 motorcycle endorsement thereon. The written examination and driving
295209 examination for a motorcycle shall be waived by Service Oklahoma
296210 upon verification that the person has successfully completed a
297211 certified Motorcycle Safety Fou ndation rider course approved by the
298212 Department, in conjunction with Service Oklahoma.
299-E. Except as otherwise provided by law, any person who lawfully

240+E. Except as otherwise provided by law, any person who lawfully

338253 F. 1. Any person eighteen (18) years of age or older may apply
339254 for a restricted Class A, B or C commercial learner permit. Service
340255 Oklahoma, after the applicant has passed all parts of the
341256 examination for a Class D license and has successfully passed all
342257 parts of the examination for a Class A, B or C commercial license
343258 other than the driving e xamination, may issue to the applicant a
344259 commercial learner permit which shall entitle the person having
345260 immediate lawful possession of the commercial learner permit and a
346261 valid Oklahoma driver license or provisional driver license pursuant
347262 to Section 6-212 of this title to operate a Class A, B or C
348263 commercial motor vehicle upon the public highways solely for the
349-purpose of behind-the-wheel training in accordance with rules
350-promulgated by the Department.
351-2. This commercial learner permit shall be issued for a period
352-as provided in Section 6 -115 of this title of one hundred eighty

291+purpose of behind-the-wheel training in accordance with rules
292+promulgated by the Department.
293+2. This commercial learner perm it shall be issued fo r a period
294+as provided in Section 6 -115 of this title of one hundred eighty
379295 (180) days, which may be renewed one time for an additional one
380296 hundred eighty (180) days; provided, such commercial learner permit
381297 may be suspended, revoked, canceled, denied or d isqualified at the
382298 discretion of the Department, with notice to Service Oklahoma, for
383299 violation of the restrictions, for failing to give the required or
384300 correct information on the application or for violation of any
385301 traffic laws of this state pertaining to the operation of a motor
386302 vehicle. Except as otherwise provided, the lawful possessor of a
387303 commercial learner permit who has been issued a commercial learner
388304 permit for a minimum of fourteen (14) days may have the restriction
389305 requiring an accompanying dri ver removed by satisfactorily
390306 completing a driver's examination; provided, the removal of a
391307 restriction shall not authorize the operation of a Class A, B or C
392308 commercial motor vehicle if such operation is otherwise prohibited
393309 by law.
394310 3. No person shall ap ply for and Service Oklahoma shall not
395311 issue an original Class A, B or C driver license until the person
396312 has been issued a commercial learner permit and held the permit for
397313 at least fourteen (14) days. Any person who currently holds a Class
398314 B or C license and who wishes to apply for another class of
399-commercial driver license shall be required to apply for a
400-commercial learner perm it and to hold the permit for at least
401-fourteen (14) days before applying for the Class A or B license, as
402-applicable. Any person who currently holds a Class A, B or C

342+commercial driver license shall be required to apply for a
343+commercial learner permit and to hold the permit for at least
344+fourteen (14) days before applying for the Class A or B license, as
345+applicable. Any pers on who currently holds a Class A, B or C
429346 license and who wishes to add an endorsement or remove a restriction
430347 for which a skills examination is required shall be required to
431348 apply for a commercial learner permit and to hold the permit for at
432349 least fourteen (14) days before applying for the endorsement.
433350 4. A commercial learner permit shall be issued by Service
434351 Oklahoma as a separate and unique document which shall be valid only
435352 in conjunction with a valid Oklahoma driver license or prov isional
436353 driver license pursuant to Section 6 -212 of this title, both of
437354 which shall be in the possession of the person to whom they have
438355 been issued whenever that person is operating a commercial motor
439356 vehicle as provided in this subsection.
440357 5. After one renewal of a commerci al learner permit, as
441358 provided in paragraph 2 of this subsection, a commercial permit
442359 shall not be renewed again. Any person who has held a commercial
443360 learner permit for the initial issuance period and one renewal
444361 period shall not be eligible for and Serv ice Oklahoma shall not
445362 issue another renewal of the permit; provided, the person may
446363 reapply for a new commercial learner permit, as provided for in this
447364 subsection.
448365 G. 1. For purposes of this title:
449-a. "REAL ID Compliant Driver License" or "Identification
450-Card" means a driver license or identific ation card
451-issued by this state that has been certified by the
452-United States Department of Ho meland Security (USDHS)

393+a. "REAL ID Compliant Driver License" or "Identificati on
394+Card" means a driver license or identification card
395+issued by this state that has been certified by the
396+United States Department of Homeland Security (USDHS)
479397 as compliant with the requirements of the REAL ID Act
480398 of 2005, Public Law No. 109-13. A REAL ID Compliant
481399 Driver License or Identification Card and the process
482400 through which it is issued incorporate a variety of
483401 security measures designed to protect the integrity
484402 and trustworthiness of the license or card. A REAL ID
485403 Compliant Driver License or Ide ntification Card will
486404 be clearly marked on the face indicating that it is a
487405 compliant document, and
488406 b. "REAL ID Noncompliant Driver License" or
489407 "Identification Card" means a driver license or
490408 identification card issued by this state th at has not
491409 been certified by the United States Department of
492410 Homeland Security (USDHS) as being compliant with the
493411 requirements of the REAL ID Act of 2005. A REAL ID
494412 Noncompliant Driver License or Identification Card
495413 will be clearly marked on the face indicating that it
496414 is not compliant with the federal REAL ID Act of 2005
497415 and is not acceptable for official federal purposes.
498416 The driver license or identification card will have a
499-unique design or color indicator that clearly
500-distinguishes it from a compliant license or card .

528447 a. Application for an original REAL ID Compliant or REAL
529448 ID Noncompliant Driver License or Identification Card
530449 shall be made to Service Oklahoma.
531450 b. Service Oklahoma employees shall perform all do cument
532451 recognition and other requirements needed for approval
533452 of an original REAL ID Compliant or REAL ID
534453 Noncompliant Driver License or Identification Card
535454 application.
536455 c. Upon approval of an original REAL ID Compliant or REAL
537456 ID Noncompliant Driver Licen se or Identification Card
538457 application, the applicant may take the approved
539458 application document to a licensed operator to receive
540459 a temporary driver license or identification card.
541460 d. The licensed operator shall process the approved REAL
542461 ID Compliant or REAL ID Noncompliant Driver License or
543462 Identification Card application and upon payment shall
544463 provide the applicant a temporary driver license or
545464 identification card. A temporary driver license or
546465 identification card shall afford the ho lder the
547466 privileges otherwise granted by the specific class of
548467 driver license or identification card for the period
549-of time listed on the temporary driver license or
550-identification card or the period of time prior to the
551-applicant receiving a RE AL ID Compliant or REAL ID

582502 a. Application for renewal or replacement of a REAL ID

584504 made to Service Oklahoma or to a licensed operator;
585505 provided, such licensed operator is authorized to
586506 process application for REAL ID Compliant Driver
587507 Licenses and Identification Cards. A licensed
588508 operator may process the voluntary do wngrade of a REAL
589509 ID Compliant Commercial Driver License to any lower
590510 class license upon request of the licensee; provided,
591511 no additional endorsements or restrictions are placed
592512 on the license.
593513 b. Service Oklahoma employees or authoriz ed licensed
594514 operators shall perform all document recognition and
595515 other requirements needed for approval of a renewal or
596516 replacement REAL ID Compliant Driver License or
597517 Identification Card application.
598-c. Upon approval of a renewal or replace ment REAL ID
599-Compliant Driver License or Identification Card
600-application, the applicant may receive a temporary

639560 e. For purposes of this title, an application for a REAL
640561 ID Compliant Driver License or Identif ication Card by
641562 an individual with a valid Oklahoma -issued driver
642563 license or identification card shall be considered a
643564 renewal of a REAL ID Compliant Driver License or
644565 Identification Card.
645566 4. REAL ID Noncompliant Driver License and Identification Card
646567 Renewal and Replacement:
647-a. Application for renewal or replacement of a REAL ID

887813 ($13.50) of an 8-year license shall be deposited to the Service
888814 Oklahoma Computer Imaging System Revolving Fund to be used solely
889815 for the purpose of administration and maintenance of the
890816 computerized imaging system of Service Oklahoma;
891817 3. Ten Dollars ($10.00) of a 4 -year license or Twenty Dollars
892818 ($20.00) of an 8-year license shall be deposited to the Department
893819 of Public Safety Revolving Fund for all original or renewal
894820 issuances of licenses through October 31, 20 22. Beginning November

931858 sixty-four (64) years of age during the calendar year of issuance or
932859 renewal of a Class D license or motorcycle endorsement shall be
933860 charged the following prorated fee:

938865 2. Any person sixty -five (65) years of age or older during the
939866 calendar year of issuance or renewal of a Class D license or

941868 P. No person who has bee n honorably discharged from active
942869 service in any branch of the Armed Forces of the United States or
943870 Oklahoma National Guard and who has been certified by the United
944871 States Department of Veterans Affairs, its successor or the Armed
945872 Forces of the United Sta tes to be a disabled veteran in receipt of
946-compensation at the one-hundred-percent rate for a permanent
947-disability sustained through m ilitary action or accident resulting
948-from disease contracted while in such active service and regi stered

976904 Veterans Affairs shall be charged a fee for the issuance,
977905 replacement or renewal of an Oklahoma driver license; provided, that
978906 if a veteran has been previously exempt from a fee pursuant to this
979907 subsection, no registration with the veterans registry shall be
980908 required.
981909 Q. In accordance with the provisions of subsection G of this
982910 section, Service Oklahoma is authorized to promulgate rules for the
983911 issuance and renewal of driver licenses authorized pursuant to th e
984912 provisions of Sections 6 -101 through 6-309 of this title; provided,
985913 that no such rules applicable to the issuance or renewal of REAL ID
986914 Noncompliant Driver Licenses shall create more stringent standards
987915 than such rules applicable as of January 1, 2017, u nless directly
988916 related to a specific change in statutory law concerning standards
989917 for REAL ID Noncompliant Driver Licenses. Applications, upon forms
990918 approved by Service Oklahoma, for such licenses shall be handled, in
991919 accordance with the provisions of sub section G of this section, by
992920 the licensed operator; provided, Service Oklahoma is authorized to
993921 assume these duties in any county of this state. Each licensed
994922 operator accepting applications for driver licenses shall receive
995923 Six Dollars ($6.00) for a 4-year REAL ID Noncompliant Driver License
996-or Twelve Dollars ($12.00) for an 8-year REAL ID Noncompliant Driver
997-License or Ten Dollars ($ 10.00) for a 4-year REAL ID Compliant
998-Driver License or Twenty Dollars ($20.00) for an 8 -year REAL ID

1025954 Compliant Driver Lic ense to be deducted from the total collected for
1026955 each license or renewal application accepted through June 30, 2023.
1027956 Beginning July 1, 2022, and ending on June 30, 2023, each motor
1028957 license agent or licensed operator accepting applicat ions for driver
1029958 licenses for individuals over the age of sixty -five (65) years or
1030959 for applications for drivers pursuant to subsection P of this
1031960 section shall receive Six Dollars ($6.00) for a 4 -year driver
1032961 license or Twelve Dollars ($12.00) for an 8 -year driver license to
1033962 be deducted daily by the motor license agent or licensed operator
1034963 receipts. Beginning July 1, 2023, these fees shall be retained by
1035964 the licensed operator pursuant to subsection E of Section 1141.1 of
1036965 this title. The fees received by the licensed operator, au thorized
1037966 by this subsection, shall be used for operating expenses. The
1038967 amount retained pursuant to this subsection shall not be retained by
1039968 any state agency. The fees received by the licensed operator,
1040969 authorized by this subsection, shall be used for ope rating expenses.
1041970 For purposes of this subsection, "licensed operator" shall mean an
1042971 individual who obtains a license from the Service Oklahoma Operator
1043972 Board to operate a designated Service Oklahoma location and offers
1044973 third-party fulfillment of designate d services to be rendered by
1045974 Service Oklahoma.
1046-R. Notwithstanding the provisions of Section 1104 of this title

1004+subsections H and M of this section, the first Sixty Thousand
10751005 Dollars ($60,000.00) of all monies collected pursuant to this
10761006 section shall be paid by the Oklahoma Tax Commission to the State
10771007 Treasurer to be deposited in the General Revenue Fund of the State
10781008 Treasury.
10791009 The next Five Hundred Thousand Dollars ($500,000.00) of monies
10801010 collected pursuant to this section shall be paid by the Tax
10811011 Commission to the State Treasurer to be deposited each fiscal year
10821012 under the provisions of this section to the credit of the Department
10831013 of Public Safety Restricted Revolving Fund for the purpose of the
10841014 Oklahoma Law Enforcement Telecommunications System. All other
10851015 monies collected in excess of Five Hundred Sixty Thousand Dollars
10861016 ($560,000.00) each fiscal year shall be apportioned as provided in
10871017 Section 1104 of this title, except as otherw ise provided in this
10881018 section.
10891019 S. Service Oklahoma shall retain the images displayed on
10901020 licenses and identification cards issued pursuant to the provisions
10911021 of Sections 6-101 through 6-309 of this title which may be used
10921022 only:
10931023 1. By a law enforcement agency for purposes of cri minal
10941024 investigations, missing person investigations or any law enforcement
1095-purpose which is deemed necessary by the Commissioner of Public
1096-Safety;
1097-2. By the driver licensing agency of another state for its
1098-official purpose; and

11291060 computerized images may obtain them through OLETS or th rough NLETS.
11301061 Photographs or computerized images may be obtained by law
11311062 enforcement one inquiry at a time.
11321063 The computer system and related equipment acquired for this
11331064 purpose must conform to industry standards for interoperability and
11341065 open architecture. T he Department of Public Safety may promulgate
11351066 rules to implement the provisions of this subsection.
11361067 T. No person may hold more than one state -issued or territory-
11371068 issued REAL ID Compliant Driver License or REAL ID Compliant
11381069 Identification Card from Oklahom a or any other state or territory.
11391070 Service Oklahoma shall not issue a REAL ID Compliant Driver License
11401071 to a person who has been previously issued a REAL ID Compliant
11411072 Driver License or REAL ID Compliant Identification Card until such
11421073 license or identificat ion card has been surrendered to Service
11431074 Oklahoma by the applicant. Service Oklahoma may promulgate rules
1144-related to the issuance of replacement REAL ID Compliant Driver
1145-Licenses in the event of loss or the ft.
1146-U. Beginning May 24, 2021, and ending on June 30, 2023, in
1147-addition to the amounts provided in subsection Q of this section, a

11751107 processed application for a REAL ID Compliant 4 -year Driver License
11761108 and Ten Dollars ($10.0 0) for each processed application for a REAL
11771109 ID Compliant 8-year Driver License. Any additional amounts provided
11781110 pursuant to this subsection shall not be retained by Service
11791111 Oklahoma.
11801112 V. 1. No later than November 1, 2025, all credentials,
11811113 including REAL ID Compliant and REA L ID Noncompliant driver licenses
11821114 and identification cards, processed in this state by Service
11831115 Oklahoma or a licensed operator shall be printed primarily within
11841116 the boundaries of this state. In the event of an emergency or if
11851117 not economically feasible and practicable, Service Oklahoma may
11861118 elect, with notice to the Governor, the President Pro Tempore of the
11871119 Oklahoma State Senate, and the Speaker of the Oklahoma House of
11881120 Representatives, to print the credentials outside the boundaries of
11891121 this state. Service Oklahoma may promulgate rules to implement the
11901122 provisions of this subsection.
11911123 2. An applicant for a credential to be issued by Service
11921124 Oklahoma, including REAL ID Compliant and REAL ID Noncompliant
11931125 driver licenses and identification cards may request exp edited
1194-delivery of the credential. For those electing for expedited
1195-delivery, there shall be assessed, in addition to any other fees
1196-provided for by law, an expedit ed delivery fee of Forty Dollars
1197-($40.00), plus the cost of postage. The expedited delivery shall be

12261159 processing and printing of credentials as set forth in this
12271160 subsection, Service Oklahoma is authorized to purch ase real estate
12281161 including, but not limited to, buildings or units, for no more than
12291162 appraised value or, in the alternative, the Executive Director of
12301163 Service Oklahoma is authorized to enter into a lease -purchase
12311164 agreement for the acquisition of such buildings or units from the
12321165 person or entity that will develop or build the buildings or units.
1233-For the purposes of the purchase or build -out of the new facility,
1234-Service Oklahoma is hereby e xempted from the requirements of the
1235-Public Competitive Bidding Act of 1974 as provided in Sections 1 01
1236-through 139 of Title 61 of the Okl ahoma Statutes. Service Oklahoma
1237-shall be required to collect multiple bids from qualified
1238-contractors for the build-out of new facilities.
12391166 SECTION 2. It being immediately necessary for the preservation
12401167 of the public peace, health or safety, an emergency is hereby
12411168 declared to exist, by re ason whereof this act shall take effect and
12421169 be in full force from and after its passage and approval.
