70+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

97+SECTION 1. NEW LAW A new section of law to be codified
98+in the Oklahoma Statutes as Section 1370.10 of Title 68, unless
99+there is created a duplication in numbering, reads as follows:
100+A. Notwithstanding the provisions of Section 1370 of Title 68
101+of the Oklahoma Statutes and in accordance with the provisions of
102+this act, any county of this state may levy a sales tax not to
103+exceed one percent (1%) upon the gross proceeds or gross receipts
104+derived from all sales or services in the county upon which a
105+consumer’s sales tax is levied by the state, except as provided in
106+paragraph 8 of Section 1357 of Title 68 of the Oklahoma Statutes,
107+subject to the following conditions:
108+1. The proceeds of such sales tax shall be used solely for the
109+purpose of funding emergency medical services; and
110+2. Before a sales tax may be levied by the county, the
111+imposition of the tax shall first be approved by a majority of the
112+registered voters of the county voting thereon a t a special election
113+called by resolution of the board of county commissioners.
114+B. The board of county commissioners shall create a limited -
115+purpose fund and deposit therein any revenue generated by any sales
116+tax levied pursuant to the provisions of subsec tion A of this
117+section. The fund shall be placed in an insured or collateralized
118+interest-bearing account, and the interest which accrues to the fund
119+shall be retained in the fund. Monies in the limited -purpose fund
120+shall be expended only as accumulated and only for the purpose

147+specifically described in paragraph 1 of subsection A of this
148+section.
149+C. 1. All sales tax collected pursuant to subsection A of this
150+section, and the interest accrued from the collections as provided
151+in subsection B of this sect ion, within an ambulance service
152+district established pursuant to Section 9C of Article X of the
153+Oklahoma Constitution shall be apportioned in the same manner as the
154+ad valorem collections for the ambulance service district by the
155+county treasurer. Ambula nce service districts that receive monies
156+collected pursuant to this section shall be subject to an audit by
157+the State Auditor and Inspector.
158+2. All sales tax collected pursuant to subsection A of this
159+section, and the interest accrued from the collection s as provided
160+in subsection B of this section, outside of an ambulance service
161+district shall be expended pursuant subsection A of this section and
162+shall be subject to the purchasing policy of the county. Any
163+emergency medical services receiving funds fro m a county collected
164+pursuant to this section shall enter into an agreement with the
165+county and adhere to the provisions of the county resolution
166+approved pursuant to subsection A of this section.
167+3. Every county expending or apportioning monies pursuant to
168+this section shall verify that all emergency medical services
169+receiving monies collected pursuant to this section are licensed and
170+in good standing with the EMS Division of the State Department of

197+Health. Any emergency medical services found by a count y to be in
198+violation of the agreement, made pursuant to paragraph 2 of this
199+subsection, with the county or in violation of the resolution
200+adopted pursuant to subsection A of this section shall be prohibited
201+from receiving monies collected pursuant to this section until the
202+county determines the entity is no longer in violation of the
203+agreement or resolution.
204+D. As used in this section, “emergency medical services” means
205+any emergency medical services system which provides for the
206+organization and appropria te designation of personnel, facilities,
207+and equipment for the effective and coordinated delivery of health
208+care services primarily under emergency conditions within the voting
209+county.
210+E. A proposition otherwise authorized by the provisions of
211+subsection A or subsection B of this section shall be placed before
212+the voters of the applicable county at an election to be held on the
213+same date as:
214+1. Any regularly scheduled federal, state , or county election
215+held in that county;
216+2. A special election held in t hat county for a federal, state ,
217+or county office; or
218+3. A special election held in that county for another county
219+proposition or a state question.
220+SECTION 2. This act shall become effective November 1, 2024. ”

33311 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

59358 section. The fund shall be placed in an insured or collateralized
60359 interest-bearing account, and the interest which accru es to the fund
61360 shall be retained in the fund. Monies in the limited-purpose fund
62361 shall be expended only as accumulated and only for the purpose
63362 specifically described in paragraph 1 of subsection A of this
64363 section.

66-C. 1. All sales tax collected pursuant to subsection A of this
67-section, and the interest accrued from the collections as prov ided
68-in subsection B of this sect ion, within an ambulance service
69-district established pursuant to Section 9C of Article X of the
70-Oklahoma Constitution shall be apportioned in the same manner as the
71-ad valorem collections for the ambulance service district by the
72-county treasurer. Ambula nce service districts that receive monies
73-collected pursuant to this section shall be subject to an audit by
74-the State Auditor and Inspector.

76-2. All sales tax collected pursuant to subsection A of this
77-section, and the interest accrued from the collection s as provided
78-in subsection B of this section, outside of an ambulance service
79-district shall be expended pursuant subsection A of this section and
80-shall be subject to the purchasing policy of the county. Any
81-emergency medical services receiving funds fro m a county collected
82-pursuant to this section shall enter into an agreement with the
83-county and adhere to the provisions of the county resolution
84-approved pursuant to subsection A of this section.

86-3. Every county expendi ng or apportioning monies pursuant to
87-this section shall verify that all emergency medical services
88-receiving monies collected pursuant to this section are licensed and
89-in good standing with the EMS Division of the State Department of
90-Health. Any emergenc y medical services found by a count y to be in
91-violation of the agreement, made pursuant to paragraph 2 of this ENR. H. B. NO. 1967 Page 3
92-subsection, with the county or in violation of the resolution
93-adopted pursuant to subsection A of this section shall be prohibited
94-from receiving monies collected pursuant to this section until the
95-county determines the entity is no longer in violation of the
96-agreement or resolution.

98-D. As used in this section, “emergency medical services” means
