3056 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-101, as

3258 Section 2-101), is amended to read as follows:

52101 dispenses, prescribes, administers or uses for scientific purposes
53102 controlled dangerous substances but does not include a common or
54103 contract carrier, public warehouser or employee thereof, or a person
55104 required to register under the Uniform Controlled Dangerous

58106 3. "Board" means the Advisory Board to the Director of the
59107 Oklahoma State Bureau of Narcotics and Dangerous Drugs Control;

61108 4. "Bureau" means the Oklahoma State Bureau of Narcotics and

64110 5. "Coca leaves" includes cocaine and any compound,
65111 manufacture, salt, derivative, mixture or preparation of coca

72143 7. "Control" means to add, remove or change the placement of a
73144 drug, substance or immediate precursor under the Uniform Controlled
74145 Dangerous Substances Act;

76146 8. "Controlled dangerous substance" means a drug, substance or
77147 immediate precursor in Schedules I through V of the Uniform
78148 Controlled Dangerous Substances Act or any drug, substance or
79149 immediate precursor listed either temporarily or permanently as a
80150 federally controlled substance. Any conflict between state and
81151 federal law with regard to the particular schedule in which a
82152 substance is listed shall be resolved in favor of state law;

84153 9. "Counterfeit substance" means a controlled substance which,
85154 or the container or labeling of which without authorization , bears
86155 the trademark, trade name or other identifying marks, imprint,
87156 number or device or any likeness thereof of a manufacturer,
88157 distributor or dispenser other than the person who in fact
89158 manufactured, distributed or dispensed the substance;
90159 10. "Deliver" or "delivery" means the actual, constructive or

160+attempted transfer from one person to another of a controlled
92161 dangerous substance or drug paraphernalia, whether or not there is
93162 an agency relationship;

95163 11. "Dispense" means to deliver a controlled danger ous
96164 substance to an ultimate user or human research subject by or
97165 pursuant to the lawful order of a practitioner, including the
98166 prescribing, administering, packaging, labeling or compounding

100195 "Dispenser" is a practitioner who delivers a controlled dangerous
101196 substance to an ultimate user or human research subject;

103197 12. "Distribute" means to deliver other than by administering
104198 or dispensing a controlled dangerous substance;

106199 13. "Distributor" means a commercial entity engaged in the
107200 distribution or reverse distribution of narcotics and dangerous
108201 drugs and who complies with all regulations promulgated by the
109202 federal Drug Enforcement Administration and the Oklahoma State
110203 Bureau of Narcotics and Dangerous Drugs Control;

112204 14. "Drug" means articles:

114205 a. recognized in the official United States Pharmacopeia,
115206 official Homeopathic Pharmacopoeia of the United
116207 States, or official National Formulary, or any
117208 supplement to any of them,

119209 b. intended for use in the diagn osis, cure, mitigation,
120210 treatment or prevention of disease in man or other
121211 animals,

123212 c. other than food, intended to affect the structure or
124213 any function of the body of man or other animals, and

126214 d. intended for use as a component of any article
127215 specified in this paragraph;

129216 provided, however, the term "drug" does not include devices or their

132245 15. "Drug-dependent person" means a person who is using a
133246 controlled dangerous substance and who is in a state of psychic or
134247 physical dependence, or both, arising from administration of that
135248 controlled dangerous substance on a continuous basis. Drug

137250 include a strong compulsion to take the substance on a continuous
138251 basis in order to experience its psychic effects, or to avoid the
139252 discomfort of its absence;

141253 16. "Home care agency" means any sole proprietorship,
142254 partnership, association, corporation, or other organization which
143255 administers, offers, or provides home care serv ices, for a fee or
144256 pursuant to a contract for such services, to clients in their place
145257 of residence;

147258 17. "Home care services" means skilled or personal care
148259 services provided to clients in their place of residence for a fee;
149-
150260 18. "Hospice" means a centrally administered, nonprofit or for-
151261 profit, medically directed, nurse-coordinated program which provides
152262 a continuum of home and inpatient care for the terminally ill
153263 patient and the patient's family. Such term shall also include a
154264 centrally administered, n onprofit or for-profit, medically directed,
155265 nurse-coordinated program if such program is licensed pursuant to
156266 the provisions of the Uniform Controlled Dangerous Substances Act.
157267 A hospice program offers palliative and supportive care to meet the
158268 special needs arising out of the physical, emotional and spiritual

159296 stresses which are experienced during the final stages of illness
160297 and during dying and bereavement. This care is available twenty-
161298 four (24) hours a day, seven (7) days a week, and is provided on the
162299 basis of need, regardless of ability to pay. "Class A" Hospice
163300 refers to Medicare-certified hospices. "Class B" refers to all
164301 other providers of hospice services;

166302 19. "Imitation controlled substance" means a substance that is
167303 not a controlled dangerous substance, which by dosage unit
168304 appearance, color, shape, size, markings or by representations made,
169305 would lead a reasonable person to believe that the substance is a
170306 controlled dangerous substance. In the event the appearance of the
171307 dosage unit is not r easonably sufficient to establish that the
172308 substance is an "imitation controlled substance", the court or
173309 authority concerned should consider, in addition to all other
174310 factors, the following factors as related to "representations made"
175311 in determining wheth er the substance is an "imitation controlled
176312 substance":

178313 a. statements made by an owner or by any other person in
179314 control of the substance concerning the nature of the
180315 substance, or its use or effect,

183317 may be resold for inordinate profit,

189348 person in control of the substance to avoid detection
190349 by law enforcement authorities,

192350 e. prior convictions, if any, of an owner, or any other
193351 person in control of the object, under state or
194352 federal law related to controlled substances or fraud,

197354 f. the proximity of the substances to controlled
198355 dangerous substances;

200356 20. "Immediate precursor" means a substance which the Director
201357 has found to be and by regulation designates as being the principal
202358 compound commonly used or produced primarily for use, and which is
203359 an immediate chemical intermediary used, or likely to be us ed, in
204360 the manufacture of a controlled dangerous substance, the control of
205361 which is necessary to prevent, curtail or limit such manufacture;

207362 21. "Laboratory" means a laboratory approved by the Director as
208363 proper to be entrusted with the custody of control led dangerous
209364 substances and the use of controlled dangerous substances for
210365 scientific and medical purposes and for purposes of instruction;

212366 22. "Manufacture" means the production, preparation,
213367 propagation, compounding or processing of a controlled danger ous
214368 substance, either directly or indirectly by extraction from
215369 substances of natural or synthetic origin, or independently by means
216370 of chemical synthesis or by a combination of extraction and chemical

217398 synthesis. "Manufacturer" includes any person who pac kages,
218399 repackages or labels any container of any controlled dangerous
219400 substance, except practitioners who dispense or compound
220401 prescription orders for delivery to the ultimate consumer;

222402 23. "Marijuana" means all parts of the plant Cannabis sativa
223403 L., whether growing or not; the seeds thereof; the resin extracted
224404 from any part of such plant; and every compound, manufacture, salt,
225405 derivative, mixture or preparation of such plant, its seeds or

228407 a. the mature stalks of such plant o r fiber produced from

236413 mixture or preparation of such mature stalks (ex cept

243418 e. for any person participating in a clinical trial to
244419 administer cannabidiol for the treatment of severe
245420 forms of epilepsy pursuant to Section 2-802 of this

250451 f. for any person or the parents, legal guardians or
251452 caretakers of the person who have received a written
252453 certification from a physician licensed in this state
253454 that the person has been diagnosed by a physician as
254455 having Lennox-Gastaut syndrome, Dravet syndrome, also
255456 known as severe myoclonic epilepsy of infancy, or any
256457 other severe form of epilepsy that is not adequately
257458 treated by traditional medical therapies, spasticity
258459 due to multiple sclerosis or due to paraplegia,
259460 intractable nausea and vomiting, appetite stimulation
260461 with chronic wasting diseases, the substance
261462 cannabidiol, a nonpsychoactive cannabinoid, found in
262463 the plant Cannabis sativa L. or any other preparation
263464 thereof, that has a tetrahydrocannabinol concentration
264465 of not more than three-tenths of one percent (0.3%)
265466 and that is delivered to the patient in the form of a
266467 liquid,
267468 g. any federal Food-and-Drug-Administration-approved drug
268469 or substance, or
470+h. industrial hemp, from the plant Cannabis sativa L. and
471+any part of such plant, whether growing or not, with a
472+delta-9 tetrahydrocannabinol concentration of not more

275502 Oklahoma Industrial Hemp Program and may be shipped

278504 24. "Medical purpose" means an intention to utilize a
279505 controlled dangerous substance for physical or mental treatment, for
280506 diagnosis, or for the prevention of a disease condition not in
281507 violation of any state or federal law and not for the purpose of
282508 satisfying physiological or psychological dependence or other abuse;

284509 25. "Mid-level practitioner" means an Advanced Practice
285510 Registered Nurse as defined and within parameters specified in
286511 Section 567.3a of Title 59 of the Oklahoma Statutes, or a certified
287512 animal euthanasia technician as defined in Section 698.2 of Title 59
288513 of the Oklahoma Statutes, or an animal control officer registered by
289514 the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control
290515 under subsection B of Section 2-301 of this title within the
291516 parameters of such officer's duties under Sections 501 throug h 508
292517 of Title 4 of the Oklahoma Statutes;

294518 26. "Narcotic drug" means any of the following, whether
295519 produced directly or indirectly by extraction from substances of
296520 vegetable origin, or independently b y means of chemical synthesis,

319564 27. "Opiate" or "opioid" means any Schedule II, III, IV or V

321566 liability similar to morphine or being capable of conversion into a
322567 drug having such addiction-forming or addiction -sustaining
323568 liability. The terms do not include, unless specifically designated
324569 as controlled under the Uniform Controlled Dangerous Substances Act,
325570 the dextrorotatory isomer of 3-methoxy-n-methyl-morphinan and its
326571 salts (dextromethorphan). The terms do include the racemic and

330601 somniferum L., except the seeds thereof;

373657 distribute, dispense, conduct research with respect
374658 to, use for scientific purposes or administer a
375659 controlled dangerous substance in the course of

378661 33. "Production" includes the manufacture, planting,
379662 cultivation, growing or harvesting of a controlled dangerous
380663 substance;

382664 34. "State" means the State of Oklahoma or any other state of

385666 35. "Ultimate user" means a person who lawfully possesses a
386667 controlled dangerous substance for the person's own use or for the
387668 use of a member of the person's household or for administration to

392672 materials of any kind which are used, intended for use, or fashioned

565969 marijuana, specifically including any tetrahydrocannabinols derived

6671163 ultrasound, ionizing, radiation, scalpels, probes or needles that
6681164 cause localized alteration or transportation of live human tissue by
6691165 cutting, burning, vaporizing, freezing, suturing, probing or
6701166 manipulating by closed reduction for major dislocations or
6711167 fractures, or otherwise altering by any mechanical, thermal, light-
6721168 based, electromagnetic or chemical means.
