53	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	55		SECTION 1. NEW LAW A new section of law to be codified
55	56		in the Oklahoma Statutes as Section 6301 of Title 74, unless there
56	57		is created a duplication in numbering, reads as follows:
57	58		As used in this act:
58	59		1. “Extremely low-income household” means a household income
59	60		not in excess of thirty percent (30%) of the area median income,
60	61		adjusted for the size of the household, as determined by the United
61	62		States Department of Housing and Urban Development;
62	63		2. “Very low-income household” means a household income of more
63	64		than thirty percent (30%) of the area median income but no more than
64		-	fifty percent (50%) of the area median income, adjusted for the size

92	92		of the household, as determined by the United States Department of
93	93		Housing and Urban Development;
94	94		3. “Low-income household” means a household income of more than
95	95		fifty percent (50%) of the area median income but no more than
96	96		eighty percent (80%) of the area median income, adjusted for the
97	97		size of the household, as determined by the United States Department
98	98		of Housing and Urban Deve lopment;
99	99		4. “Moderate-income household” means a household income of more
100	100		than eighty percent (80%) of the area me dian income but no more than
101	101		one hundred twenty percent (120%) of the area median income,
102	102		adjusted for the size of the household, as determined by the United
103	103		States Department of Housing and Urban Development; and
104	104		5. “Middle-income household” means a household that has an
105	105		income of more than one hundred twenty percent (120%) of the area
106	106		median income but no more than one hundred sixty percent ( 160%) of
107	107		the area median income, adjusted for the size of the household, as
108	108		determined by the United States Depart ment of Housing and Urban
109	109		Development.
110	110		SECTION 2. NEW LAW A new section of law to be codified
111	111		in the Oklahoma Statutes as Section 6302 of Title 74, unless there
112	112		is created a duplication in numbering, reads as follows:
113	113		A. There is hereby created until December 30, 2034, the
114	114		Oklahoma Affordable Housing Commission. The Commission shall be

142	141		composed of fifteen (15) members. The members shall serve as
143	142		follows:
144	143		1. Five members shall be appointed by the Governor:
145	144		a. one shall be a person living in an urban area with a
146	145		population more than one hundred thousand (100,000)
147	146		persons according to the latest Federal Decenn ial
148	147		Census,
149	148		b. one shall be a person living in a rural community
150	149		residing in a county with a population less than
151	150		seventy-five thousand (75,000) persons according to
152	151		the latest Federal Decennial Census ,
153	152		c. one shall be an official serving in a city, town, or
154	153		political subdivision in a county with a population
155	154		less than seventy-five thousand (75,000) persons
156	155		according to the lates t Federal Decennial Census,
157	156		d. one shall represent an organization that assists
158	157		special populations, including but not limited to the
159	158		elderly, disabled, veterans, and children
160	159		transitioning out of foster care, in obtaining
161	160		affordable housing, and
162	161		e. one shall represent an Oklahoma rural housing
163	162		authority;
164	163		2. Five members shall be appointed by the President Pro Tempore
165	164		of the Senate:

193	191		a. one shall be a Senator from the majority party who
194	192		shall serve as co-chair of the Commission,
195	193		b. one shall be a Senator fr om the minority party who
196	194		shall serve as co-vice chair of the Commission,
197	195		c. one shall represent a low-income and moderate-to-low-
198	196		income population-serving financial institution or a
199	197		community development financial institution, as
200	198		defined by the Federal Reserve,
201	199		d. one shall be an official serving in a municipality
202	200		with a population more than one hundred thousand
203	201		(100,000) persons according to t he latest Federal
204	202		Decennial Census, and
205	203		e. one shall represent an urban housing authority ;
206	204		3. Five members shall be appointed by the Speaker of the House
207	205		of Representatives:
208	206		a. one shall be a House member from the majority party
209	207		who shall serve as co-chair of the Commission,
210	208		b. one shall be a House member from the minority party
211	209		who shall serve as co -vice chair of the Commission,
212	210		c. one shall represent a federally recognized tribe in
213	211		Oklahoma that provides affordable housing in rural
214	212		areas,
215	213		d. one shall be a representative from a community housing
216	214		development organization, as determined by the United

246	243		e. one shall represent a not -for-profit organization that
247	244		serves low-income Oklahomans expe riencing difficulty
248	245		in obtaining affordable housing ; and
249	246		4. The following shall be ex officio members:
250	247		a. one shall be from the Oklahoma Department of Commerce
251	248		Community Development Division, or his or her
252	249		designee,
253	250		b. one shall be an Oklahoma representative of the U nited
254	251		States Department of Agriculture , and
255	252		c. the Executive Director of the Oklahoma Housing Finance
256	253		Agency, or designee.
257	254		B. For the initial appointments of members to the Commission,
258	255		each appointment shall be for a two -year term. Thereafter , the
259	256		terms of the Commission shall be for three (3) years .
260	257		C. No member of the Commission shall receive a salary or
261	258		reimbursement for duties performed as a member of the Commission;
262	259		however, members may be eligible to receive travel reimbursement as
263	260		provided in the State Travel Reimbursement Act .
264	261		D. The meetings of the Commission shall be subject to the
265	262		Oklahoma Open Meeting A ct.
266	263		E. The Commission shall utilize the resources available to it
267	264		in order to address the needs of extremely low-income households,

296	292		households, and middle -income households in order to promote a
297	293		condition in which suitable housing is available to as many persons
298	294		as possible pursuant to rules promulgated by the Oklahoma Housing
299	295		Finance Agency pursuant to Section 3 of this act.
300	296		SECTION 3. NEW LAW A new section of law t o be codified
301	297		in the Oklahoma Statutes as Section 6303 of Title 74, unless there
302	298		is created a duplication in numbering, reads as f ollows:
303	299		The Oklahoma Housing Finance Agency shall promulgate rules to
304	300		implement:
305	301		1. An initial comprehensive Oklahoma affordable housing
306	302		environmental scan and needs assessment;
307	303		2. A comprehensive Oklahoma affordable housing annual report
308	304		and action plan to be submitted electronically to the Governor and
309	305		the Legislature;
310	306		3. A plan for long-term expansion of affordable housing across
311	307		the state;
312	308		4. An update on the implementation and outcomes of the
313	309		investment in the Oklahoma Housing Stability Program created in
314	310		Section 2903 et seq. of Title 74 of the Oklahoma Statutes ;
315	311		5. Evaluate and make recommendations to the Legislature on
316	312		policies and incentives to increase the development, inventory, and
317	313		diversification of affordable housing; and

345	340		6. Any other rules necessary to carry out the purpose and
346	341		mission of the Oklahoma Affordable Housing Commission pursuant to
347	342		Section 2 of this act.
348	343		SECTION 4. This act shall become effective November 1, 2024.
