54111 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

56112 SECTION 1. NEW LAW A new section of law to be codified
57113 in the Oklahoma Statutes as Section 1-879.11 of Title 63, unless
58114 there is created a duplication in numbering, reads as follows:
59-
60115 This act shall be known and may be cit ed as the “Alzheimer’s
61116 Disease and Related Dementia Infrastructure Act”.

63117 SECTION 2. NEW LAW A new section of law to be codified
64118 in the Oklahoma Statutes as Section 1-879.12 of Title 63, unless
65119 there is created a duplication in numb ering, reads as follows:

67120 As used in this act:
68-
69121 1. “Alzheimer’s Disease and Related Dementia State Plan” or
70122 “state plan” means a plan developed by the state in conjunction with
71123 stakeholders for meeting the needs of individuals with Alzheimer’s
72124 disease and related dementia and their caregivers;
73-
74125 2. “Caregiver” means any person other than a paid provider who
75126 provides care for a person with dementia; and
76-
77127 3. “Dementia” means a degenerative disease of the centra l
78128 nervous system characterized especially by prematu re cognitive
79129 deterioration. This includes Alzheimer’s disease and related

86160 b. Creutzfeldt-Jakob disease,

88161 c. frontotemporal dementia ,

90162 d. Huntington’s disease,

94164 f. Lewy body dementia,

96165 g. Parkinson’s disease,

98166 h. progressive supranuclear palsy,

103169 irreversible deterioration of intellectual fac ulties.

105170 SECTION 3. NEW LAW A new section of law to be codified
106171 in the Oklahoma Statutes as Section 1-879.13 of Title 63, unless
107172 there is created a duplication in numbering, reads as follows:

109173 A. The State Department of Health shall compile and publish an
110174 Alzheimer’s Disease and Related Dementia State Plan and shall update
111175 the state plan every four (4) years. The Department shall consult
112176 with relevant stakeholders when compiling and updating the state
113177 plan.

115178 B. Components of the state plan shall include, but not be

128213 4. Public policy recommendations concerning Alzheimer ’s disease
129214 and related dementia for state policymakers; and

131215 5. Information on all grant awardees, projects, and amounts
132216 awarded under Section 5 of this act.

134217 C. The Department shall publish the state plan on its Internet
135218 website and shall submit the state plan to the Speaker of the

137220 Oklahoma State Senate, the Governor, and the appropriate cabinet

140222 D. The State Department of Health shall create and publish an
141223 annual report that consists of the progress of implementing the
142224 state plan, and the use and distribu tion of the Dementia Caregive r
143225 Support Group and Education Pr ogram Development Fund and the
144226 Alzheimer's Disease and Rel ated Dementia Research Fund.

146227 E. The Department shall publish the annual report on its
147228 Internet website.

150256 in the Oklahoma Statutes as Section 1-879.14 of Title 63, unless

153258 There is hereby created in the State Treasury a revolving fund
154259 for the State Department of Health to be designated the “Dementia
155260 Caregiver Support Group and Education Program Development Fund”.
156261 The fund shall be a continuing fund, n ot subject to fiscal year
157262 limitations, and shall c onsist of all monies deposited to the credit
158263 of the fund by law. All monies accruing to the credit of the fund
159264 are hereby appropriated and may b e budgeted and expended by the
160265 Department for the purpose of awarding grants as described in
161266 Section 5 of this act. Expenditures from the fund shall be made
162267 upon warrants issued by the State Treasurer against claims filed as
163268 prescribed by law with the Director o f the Office of Management and
164269 Enterprise Services for appr oval and payment.

166270 SECTION 5. NEW LAW A new section of law to be c odified
167271 in the Oklahoma Statutes as Section 1-879.15 of Title 63, unless
168272 there is created a dup lication in numbering, reads as follows:

170273 A. The State Department of Health shall develop a program to
171274 award grants to nonprofit organizations operating in areas of this
172275 state that meet the United States Census Bureau classification of
173276 “rural” to support community efforts to establish support groups and
174277 evidence-based community education programs for caregivers of

176305 available funding, the grants shall be awarded annuall y.

178306 B. The Department shall develop an appli cation process and
179307 eligibility requirements for receiving the grants. The Depart ment
180308 shall be responsible for distributing and managing the grant awards.

182309 C. The State Commissioner of Health may promulgate rules as
183310 necessary to implement this act .

185311 D. The State Department of Health shall include information on
186312 the awardee(s), project(s), and dollars awarded in the ann ual report
187313 as described in Section 3 of this act.

189314 E. This fund shall sunset five (5) years from the enactment of
190315 this act.

192316 SECTION 6. NEW LAW A new section of law to be codif ied
193317 in the Oklahoma Statutes as Section 1-879.16 of Title 63, unless
194318 there is created a duplicat ion in numbering, re ads as follows:

196319 A. There is hereby created in the State Treasury, subject to
197320 the availability of funds, a revolving fund for the State Department
198321 of Health to be designated the "Alzheimer's Disease and Related
199322 Dementia Research Fund ". The Alzheimer's Disease and Related
200323 Dementia Research Fund shall be a continuing fund, not subject to
201324 fiscal year limitations, and shall consist of all monies dep osited
202325 to the credit of the fund by law. All monies accruing to the credit
203326 of the fund are hereby appropriated and m ay be budgeted and expended
204327 by the State Department of Health for the purpos es listed in Section

206355 warrants issued by t he State Treasurer against claims filed as
207356 prescribed by law with the Directo r of the Office of Management and
208357 Enterprise Services for approval and payme nt.

210358 B. The awards shall be made through an awards committee of
211359 seven (7) members, coordinated by the Dementia Services Manager ,
212360 consisting of three (3) representatives from the sc ientific and
213361 medical communities, three (3) members of the general public, a nd
214362 the Dementia Services Manager .

216363 C. The awards shall be given annually to selected applicants
217364 residing and performing research in the State of Oklahoma in order
218365 to support research into the causes of Alzheimer's disease and
219366 related dementia, methods of treatment, ways that families can cope
220367 with the stresses of the disease, and the imp act of the disease on
221368 Oklahoma.

223369 D. Information on the awardee, project, and dollars awarded
224370 shall be included in the annual report as described in Section 3 of
225371 this act.

234404 health district to serve Oklahoma resident s.

236405 B. The State Department of Health shall have a dementia-
237406 specific trained and certified community health worker, health
238407 educator, or other relevant employee in each health district by
239408 identifying and train ing one (1) relevant employee in three (3)
240409 health districts the year after the enactment of this act, then one
241410 (1) relevant employee in three (3) health districts each year
242411 following until each health district ha s one (1) dementia-specific
243412 trained and certified relevant employee serving each health district
244413 or by year four after the enactment of this act, whichever comes
245414 first.

247415 C. Each health district shall select an emplo yee to receive the
248416 dementia-specific training and certification based on that
249417 district’s assessment of the employee's capabilities, worklo ad,
250418 competency, and interest. The health district shall oversee the
251419 employee in the employee’s day-to-day capacity.

253420 D. The State Department of Health-trained and -certified
254421 dementia-specific employee shall serve Oklahoma residents in the
255422 following manner:

257423 1. Connect caregivers and perso ns living with Alzheimer's
258424 disease or related dementia to community resources;

260425 2. Provide community outreach, engag ement, and education on
261426 Alzheimer's disease and related dementia ; and

263453 3. Help connect caregivers and persons living with Alzheimer's
264454 disease or related dementia to relevant e ducation and support

267456 E. The State Department of Health -trained and -certified
268457 dementia-specific employee shall complete a dementia care training
269458 program recognized by the Centers for Medicare and Medicaid Services
270459 (CMS) from a certified training s ource or trainer.

272460 F. The State Department of Health -trained and -certified
273461 dementia-specific employee shall complete annual continuing
274462 education.

276463 G. Each health district shall work with the employee acting as
277464 the director or manager of federal funds pertaining to the
278465 development of a dementia -friendly public health system to share
279466 data and quality metrics on the trained and certified dementia -
280467 specific employee’s impact in local communities. Data and quality
281468 metrics shall be established by the Center for Chronic Disease
282469 Prevention and Health Promotion .

284470 H. The oversight of the trained and certified dementia-specific
285471 employee’s certification status, continu ing education, data and
286472 quality metrics analysis, and impact reporting shall reside with the
287473 employee acting as the director or manager of federal funds
288474 pertaining to the development of a dementia -friendly public health
289475 system. As part of this oversight, the employee acting as the
290476 director or manager of fede ral funds pertaining to the development

292504 percent (10%) of administrative funds to ensure sustainability of
293505 the integrity of the trained and certified dementi a-specific
294506 employee program.

296507 I. The State Department of Health shall include information on
297508 the implementation of the trained and certified dementia-specific
298509 employees and the data and quality metrics achieved in local
299510 communities in the annual report as described in Section 3 of this
300511 act.

302512 SECTION 8. NEW LAW A new s ection of law to be codified
303513 in the Oklahoma Statutes as Section 1280.5 of Title 59, unless there
304514 is created a duplication in numbering, reads as follows:

306515 Curriculum for certified community healt h workers shall include,
307516 but not be limited to, training on Alzheimer’s disease and related

310518 SECTION 9. REPEALER 63 O.S. 2021, Sections 1-879.2 and
