An Act ENROLLED HOUSE BILL NO. 2747 By: Miller, Conley, Roe, Cantrell, Manger, Martinez, Pittman, Hill, Boatman, Provenzano, Wallace, Alonso-Sandoval, West (Tammy), Munson, Hefner, Dollens, and Stark of the House and Haste and Rogers of the Senate An Act relating to Alzheimer's disease and related dementia; creating the Alzheimer's Disease and Related Dementia Infrastructure Act; providing short title; defining terms; requiring the State Department of Health to compile and update certain state plan; listing components of state plan ; requiring certain publication and submission of state plan; requiring the State Department of Health to create and publish an annual report; creating the Dementia Caregiver Support Group and Education Pro gram Development Fun d; specifying type of fund and source of monies; providing for expenditure of fun ds; stating allowable expenses; directing development of program for certain grant awards; providing for annual awards subject to available funding; provid ing for application and eligibility for receipt of awards; imposing certain duties on the Department; providing rules; creating the Alzheimer's Disease and Related Dementia Research Fund; requiring the State Department of Health to maintain a minimum of one dementia-specific trained and certified e mployee in each health district; requiring certain curriculum to include specified training; repealing 63 O.S. 2021, Sections 1-879.2 and 1-879.3, which relate to the Alzheimer's Research Adv isory Council and duties, development, and enhancement of the Core Neuropathy ENR. H. B. NO. 2747 Page 2 Laboratory; providing for c odification; and providing an effective date. SUBJECT: Alzheimer's disease BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1-879.11 of Title 63, unless there is created a duplication in numbering, reads as follows: This act shall be known and may be cit ed as the “Alzheimer’s Disease and Related Dementia Infrastructure Act”. SECTION 2. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1-879.12 of Title 63, unless there is created a duplication in numb ering, reads as follows: As used in this act: 1. “Alzheimer’s Disease and Related Dementia State Plan” or “state plan” means a plan developed by the state in conjunction with stakeholders for meeting the needs of individuals with Alzheimer’s disease and related dementia and their caregivers; 2. “Caregiver” means any person other than a paid provider who provides care for a person with dementia; and 3. “Dementia” means a degenerative disease of the centra l nervous system characterized especially by prematu re cognitive deterioration. This includes Alzheimer’s disease and related dementia and diagnoses which are similarly marked by irreversible deterioration of intellectual faculties with concomitant emotion al disturbance resulting from organic brain disorde r, such as: a. chronic traumatic encephalopathy, b. Creutzfeldt-Jakob disease, c. frontotemporal dementia, d. Huntington’s disease, ENR. H. B. NO. 2747 Page 3 e. Korsakoff syndrome, f. Lewy body dementia, g. Parkinson’s disease, h. progressive supranuclear palsy, i. vascular dementia, or j. any other neurocognitive disorder that results in the irreversible deterioration of intellectual fac ulties. SECTION 3. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1-879.13 of Title 63, unless there is created a duplication in numbering, reads as follows: A. The State Department of Health shall compile and publish an Alzheimer’s Disease and Related Dementia State Plan and shall update the state plan every four (4) years. The Department shall consult with relevant stakeholders when compiling and updating the state plan. B. Components of the state plan shall include, but not be limited to: 1. Information on statewide coordination and service system development for Alzheimer’s disease and related dementia ; 2. Information on education, support, and other available services for Alzheimer’s disease and related dementia ; 3. Progress reports, updates, and measures of improvement or decline in relevant metrics regarding dementia diagnosis, treatment, services, and outcomes as compared to the previous state plan; 4. Public policy recommendations concerning Alzheimer ’s disease and related dementia for state policymakers; and 5. Information on all grant awardees, projects, and amounts awarded under Section 5 of this act . C. The Department shall publish the state plan on its Internet website and shall submit the state plan to the Speaker of the Oklahoma House of Representatives, the President Pro Temp ore of the ENR. H. B. NO. 2747 Page 4 Oklahoma State Senate, the Governor, and the appropriate cabinet secretary. D. The State Department of Hea lth shall create and publish an annual report that consists of the progress of implementing the state plan, and the use and distribu tion of the Dementia Caregive r Support Group and Education Program Development Fund and the Alzheimer's Disease and Related Dementia Research Fund. E. The Department shall publish the annual report on its Internet website. SECTION 4. NEW LAW A n ew section of law to be codified in the Oklahoma Statutes as Section 1-879.14 of Title 63, unless there is created a duplication in numbering, reads as follows: There is hereby created in the State Treasury a revolving fund for the State Department of Health to be designated the “Dementia Caregiver Support Group and Education Program Development Fund”. The fund shall be a continuing fund, n ot subject to fiscal year limitations, and shall c onsist of all monies deposited to the credit of the fund by law. All monies accruing to the credit of the fund are hereby appropriated and may b e budgeted and expended by the Department for the purpose of awarding grants as described in Section 5 of this act. Expenditures from the fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for appr oval and payment. SECTION 5. NEW LAW A new section of law to be c odified in the Oklahoma Statutes as Section 1-879.15 of Title 63, unless there is created a dup lication in numbering, reads as follows: A. The State Department of Health shall develop a program to award grants to nonprofit organizations operating in areas of this state that meet the United States Census Bureau classification of “rural” to support community efforts to establish support groups and evidence-based community education programs for caregivers of persons with Alzheimer’s disease and related dementia. Subject to available funding, the grants shall be awarded annually. B. The Department shall de velop an application process and eligibility requirements for receiving the grants. The Depart ment shall be responsible for distributing and managing the grant awards. ENR. H. B. NO. 2747 Page 5 C. The State Commissioner of Health may promulgate rules as necessary to implement th is act. D. The State Department of Health shall include information on the awardee(s), project(s), and dollars awarded in the ann ual report as described in Section 3 of this act. E. This fund shall sunset five (5) years from the enactment of this act. SECTION 6. NEW LAW A new section of law to be codif ied in the Oklahoma Statutes as Section 1-879.16 of Title 63, unless there is created a duplicat ion in numbering, re ads as follows: A. There is hereby created in the State Treasury, subject to the availability of funds, a revolving fund for the State Department of Health to be designated the "Alzheimer's Disease and Related Dementia Research Fund ". The Alzheimer's Disease and Related Dementia Research Fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all monies dep osited to the credit of the fund by law. All monies accruing to the credit of the fund are hereby appropriated and m ay be budgeted and expended by the State Department of He alth for the purposes listed in Section 5 of this act. Expenditures from the fund shall be made upon warrants issued by t he State Treasurer against claims filed as prescribed by law with the Directo r of the Office of Management and Enterprise Services for approval and payment. B. The awards shall be made through an awards committee of seven (7) members, coordinated by the Dementia Services Manager , consisting of three (3) representatives from the sc ientific and medical communities, three (3) members of t he general public, and the Dementia Services Manager . C. The awards shall be given annually to selected applicants residing and performing research in the State of Oklahoma in order to support research into the causes of Alzheimer's disease and related dementia, methods of treatment, ways that families can cope with the stresses of the disease, and the imp act of the disease on Oklahoma. D. Information on the awardee, project, and dollars awarded shall be included in the annual report as described in Section 3 of this act. ENR. H. B. NO. 2747 Page 6 SECTION 7. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1 -879.17 of Title 63, unless there is created a duplicati on in numbering, reads as follows: A. The State Department of Health shall maintain a minimum of at least one (1) dementia-specific trained and certified community health worker, health educator , or other relevant employee in each health district to serve Oklahoma resident s. B. The State Department of Health shall have a dementia- specific trained and certified community health worker, health educator, or other relevant employee in each health district by identifying and train ing one (1) relevant employee in three (3) health districts the year after the enactment of this act, then one (1) relevant employee in three (3) health districts each year following until each health district ha s one (1) dementia-specific trained and certified relevant employee serving each health district or by year four after the enactment of th is act, whichever comes first. C. Each health district shall select an emplo yee to receive the dementia-specific training and certification based on that district’s assessment of the employee's capabilities, worklo ad, competency, and interest. The health district shall oversee the employee in the employee’s day-to-day capacity. D. The State Department of Health-trained and -certified dementia-specific employee shall serve Oklahoma residents in the following manner: 1. Connect caregivers and persons living w ith Alzheimer's disease or related dementia to community resources; 2. Provide community outreach, engag ement, and education on Alzheimer's disease and related dementia ; and 3. Help connect caregivers and persons living with Alzheimer's disease or related dementia to relevant education and support groups. E. The State Department of Health -trained and -certified dementia-specific employee shall complete a dementia care training program recognized by the Centers for Medicare and Medicaid Services (CMS) from a certified training source or trainer. ENR. H. B. NO. 2747 Page 7 F. The State Department of Health -trained and -certified dementia-specific employee shall complete annual continuing education. G. Each health district shall work with the employee acting as the director or manager of federal funds pertaining to the development of a dementia -friendly public health system to share data and quality metrics on the trained and certified dementia - specific employee’s impact in local communities. Data and quality metrics shall be established by the Center for Chronic Disease Prevention and Health Promotion . H. The oversight of the trained and certified dementia-specific employee’s certification status, continu ing education, data and quality metrics analysis, and impact reporting shall reside with the employee acting as the director or manager of federal funds pertaining to the development of a dementia -friendly public health system. As part of this oversight, the employee acting as the director or manager of fede ral funds pertaining to the development of a dementia-friendly public health system shall receive up to ten percent (10%) of administrative funds to ensure sustainability of the integrity of the trained and certified dementi a-specific employee program. I. The State Department of Health shall include information on the implementation of the trained and certified dementia-specific employees and the data and quality metrics achieved in local communities in the annual report as described in Section 3 of this act. SECTION 8. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1280.5 of Title 59, unless there is created a duplication in numbering, reads as follows: Curriculum for certified community healt h workers shall include, but not be limited to, training on Alzheimer’s disease and related dementia. SECTION 9. REPEALER 63 O.S. 2021, Sections 1-879.2 and 1-879.3, are hereby repealed. SECTION 10. This act shall become effective November 1, 2023. ENR. H. B.
