| 163 | 99 | | significant degree of control over the franchisee's |

| 164 | 100 | | method of operation, or provide significant assistance |

| 165 | 101 | | in the franchisee's method of operation, and |
|---|
| 166 | 102 | | c. as a condition of obtaining or commencing operation of |
|---|
| 167 | 103 | | the franchise, the franchisee makes a required payment |
|---|
| 168 | 104 | | or commits to make a required payment to the |
|---|
| 169 | 105 | | franchisor or its affiliate. |
|---|
| 170 | 106 | | B. A franchisor shall not be considered the empl oyer of a |
|---|
| 171 | 107 | | franchisee or a franchisee's emplo yees. |
|---|
| 172 | 108 | | C. The employees of a franchisee shall not be considered |
|---|
| 173 | 109 | | employees of the franchisor neither shall the employees of a |
|---|
| 174 | 110 | | franchisor be considered employees of a franchisee. |
|---|
| 175 | 111 | | SECTION 2. This act shall become effective November 1, 2024. |
