49+BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
50+SECTION 1. AMENDATORY 59 O.S. 2021, Section 6005, is
51+amended to read as follows:
52+Section 6005. A. For purposes of this act:
53+1. "Franchisor" means any person who grants a franchise and
54+participates in the franchis e relationship. Unless otherwise
55+stated, it includes subfranchisors. For purposes of this
56+definition, a "subfranchisor" means a person who functions as a
57+franchisor by engaging in both pre -sale activities and p ost-sale
58+performance;
59+2. "Franchisee" means any person who is granted a franchise;

114-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
115-SECTION 1. AMENDATORY 59 O.S. 2021, Section 6005, is

117-Section 6005. A. For purposes of this act:

152-3. "Franchise" means any continuing commercial relationship or
153-arrangement, whatever it may be called, in which the term s of the
15490 offer or contract specify , or the franchise seller promises or
15591 represents, orally or in writing, that:
15692 a. the franchisee will obtain the right to operate a
15793 business that is identified or associated with the
15894 franchisor's trademark, or to offer, sell or
15995 distribute goods, services or commodities that are
16096 identified or associated with the f ranchisor's
16197 trademark,
16298 b. the franchisor will exert or has authority to exert a
16399 significant degree of control over the franchisee's
164100 method of operation, or provide significant assistance
165101 in the franchisee's method of operation, and
166102 c. as a condition of obtaining or commencing operation of
167103 the franchise, the franchisee makes a required payment
168104 or commits to make a required payment to the
169105 franchisor or its affiliate.
170106 B. A franchisor shall not be considered the empl oyer of a
171107 franchisee or a franchisee's emplo yees.
172108 C. The employees of a franchisee shall not be considered
173109 employees of the franchisor neither shall the employees of a
174110 franchisor be considered employees of a franchisee.
175111 SECTION 2. This act shall become effective November 1, 2024.
