33	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	60		SECTION 1. AMENDATORY 2 O.S. 2021, Section 16 -2, is
36	61		amended to read as follows:
37		-
38	62		Section 16-2. As used in the Oklahoma Forestry Code:
39		-
40	63		1. "Control line" means a constructed or natural barrier and
41	64		treated fire edge used to control a fire;
42		-
43	65		2. "Director" means the Director of Forestry of the Oklahoma
44	66		Department of Agriculture, Food, and Forestry;

46	94		2. 3. "Division" means the Forestry Division of the Oklahoma
47	95		Department of Agriculture, Food, and Forestry;

49	96		3. 4. "Established property line" means any boundary line which
50	97		has been:

52	98		a. recognized by adjoining land owners as a boundary and
53	99		uncontested for at least fifteen (15) years including,
54	100		but not limited to, fence lines, roads, and natural
55	101		features,

57	102		b. established by a registered land surveyor, or
58		-
59	103		c. uncontested for at least fifteen (15) years;
60		-
61	104		5. "Fire line" means the actively burning or burned perimeter
62	105		of an uncontrolled wildfire of any size that necessitates the use of
63	106		direct or indirect tactical suppression acti ons to control the
64	107		wildfire;

66	108		4. 6. "Forest rangers" means all employees of the Forestry
67	109		Division who have responsibilities in forest and natural resource
68	110		protection, including laborers, mechanics, and other employees who
69	111		assist in forest and natural resource protection;
70		-
71	112		5. 7. "Forest" means a tract of land that is at least ten
72	113		percent (10%) stocked by trees of any size, whether of commercial or
73	114		noncommercial species, or formerly having tree cover and not
74	115		currently developed for nonforest non-forest use, including
75	116		woodlands, woodlots, windbreaks, and shelterbelts;

77	144		8. "Hazardous duty" means actions performed on or near the fire
78	145		line required to fight and control wildfires in order to protect
79	146		lives, property, forests, and natural resources as well as functio ns
80	147		associated with wildland hazardous fuels reduction work to mitigate
81	148		and reduce wildfire threat to lives, property, forests, and natural
82	149		resources;

84	150		6. 9. "Logging or timber harvesting operations" means the
85	151		cutting or harvesting of and removal of timber from a site, leaving
86	152		the root mass intact;
87		-
88	153		7. 10. "Owner" means the possessor of a fee interest, a tenant,
89	154		lessee, occupant, or other person in lawful control of land;

91	155		8. 11. "Prescribed burning" means the controlled application of
92	156		fire by the owner or designated agent of croplands, rangelands, or
93	157		forestlands of fire to naturally occurring vegetative fuel under
94	158		specified environmental conditions and following appropriate
95	159		precautionary measures , which causes intended to keep the fire to be
96	160		confined to a predetermined area and accomplish land management
97	161		objectives;

99	162		9. 12. "Timber" means live and dead trees and the profit in any
100	163		live and dead trees including, but not limited to, bark, foliage,
101	164		wood, vines, firewood, crossties, and shrubbery;

103	165		10. 13. "Timber owner" means any person who owns the right to
104	166		cut or harvest timber at the time the timber is to be cut or
105	167		harvested, or who legally owns the severed timber;

108	196		forests, grasslands, fields, or cr oplands; and

112	199		prairies, marshes, and swamps forest, prairie, marsh, and swamp; and

115	201		the Forestry Division whose duty to fight wildfires includes
116	202		incident management, fire suppression, and hazardous wildland fuel
117	203		mitigation.

119	204		SECTION 2. AMENDATORY 2 O.S. 20 21, Section 16-4, is
120	205		amended to read as follows:

122	206		Section 16-4. It shall be the duty of the State Board of
123	207		Agriculture under terms the Board determines shall best serve the
124	208		public interest to assist and cooperate with federal and state
125	209		departments, educational institutions, counties, towns,
126	210		corporations, or individuals; to gather and disseminate information
127	211		about forests, their care and management; to prevent and extinguish
128	212		wildfires; to enforce all laws pertaining to forests and woodlands
129	213		wildlands; and to monitor the health, inventory, and co ndition of
130	214		the state's forest resources.

132	215		SECTION 3. AMENDATORY 2 O.S. 2021, Section 16 -8, is

137	246		the enforcement of the Oklahoma Forestry Code, shall have the
138	247		following powers, authority, and duties:

140	248		1. To enforce the provisions of this code and other forest and
141	249		forest protection laws of this state;
142		-
143	250		2. To prevent, mitigate, detect, extinguish suppress, and
144	251		investigate wildfires in this state;
145		-
146	252		3. To provide wildfire fighting wildland firefighting crews,
147	253		who shall be under the control and direction of forest rangers and
148	254		other designated agents of the Division;
149		-
150	255		4. To appoint district for esters, assistant district foresters,
151	256		investigators, rangers , and other employees;
152		-
153	257		5. To use the resources of the Division on state -owned parks
154	258		and other state-administered land to prevent and suppress fires
155	259		wildfires, to mitigate hazardous wildland fuels , and to establish
156	260		fire fighting wildland firefighting crews, who shall be authorized
157	261		to suppress fires wildfires on state land;

159	262		6. To be reimbursed on an actual cost basis for all services
160	263		provided to state parks and other land administered by the State of
161	264		Oklahoma;

163	265		7. To investigate cases of forest timber theft;
164		-
165	266		8. To make available for sale surplus state vehicles directly
166	267		to rural fire departments or municipal fire departments, in cities
167	268		or towns under ten thousan d (10,000) population. State vehicles may
168	269		be offered for sale only after approval is given in writing by the

170	298		made of each vehicle and a price set by the Office of Management and
171	299		Enterprise Services. The Forestry Division may o nly receive the
172	300		amount authorized by the Office of Management and Enterprise
173	301		Services for the sale of the vehicle;

175	302		9. To purchase equipment from the Rural Fire Defense Equipment
176	303		Revolving Fund's inventory, when advant ageous to the state, and to
177	304		reimburse the Revolving Fund; and

179	305		10. To plan and conduct prescribed burning at the request and
180	306		expense of landowners on public or private land for the purpose of
181	307		controlling Eastern Redcedar and other invasive or exotic species,
182	308		for hazardous fuel reduction, wildl ife habitat manipulation,
183	309		ecosystem restoration, or achieving silvicultural objectives.
184	310		Forestry Division employees shall be protected under The
185	311		Governmental Tort Claims Act and shall not be personally liable
186	312		beyond the limits established therein for acti vities pursuant to
187	313		this paragraph unless gross negligence is established in a competent
188	314		court of law.

190	315		B. Forest rangers, and the fire fighting firefighting crews
191	316		under their control and direction, may enter upon any land for the
192	317		purpose of preventing and suppressing wildfires and to enforce the
193	318		provisions of the Oklahoma Forestry Code and other wildfire and
194	319		forest protection laws of this state.

196	347		C. Forest rangers, employees of the Division, and all persons
197	348		under contract or agreement with the Division to a ssist in fire
198	349		fighting firefighting operations, as well as persons called upon by
199	350		forest rangers or other authorized employees of the Division to
200	351		assist in fire fighting firefighting under the direction or
201	352		supervision of employees of the Division, may, in the performance of
202	353		their duties, set backfires, dig trenches, cut firelines construct
203	354		control lines, and carry on all customary activities in the fighting
204	355		of wildfires without incurring liability to any person.

206	356		D. Under the direction of forest rangers and upon written
207	357		receipt of permission consent of the landowner, county officers and
208	358		employees may, in the performance of their duties and without
209	359		incurring liability to any person, cut firelines construct control
210	360		lines and carry out all customary activities for conducting
211	361		prescribed burns to mitigate hazardous wildland fuels for the
212	362		prevention of to prevent wildfires on private lands.

214	363		E. Upon written consent from a landowner or designated agent,
215	364		forest rangers, in the performance of their duties and without
216	365		incurring liability to any person, may construct control lines,
217	366		carry out all customary activities for conducting prescribed burns,
218	367		and utilize mechanized equipment to reduce hazardous wildland fuels
219	368		in order to mitigate or reduce the effects of wildfires on lives,
220	369		property, forests, and natural resources on private and public lands
221	370		in this state.

223	398		1. The Director of the Forestry Division may appoint, subject
224	399		to the approval of the State Board of Agriculture, special of ficers
225	400		who shall have the power and au thority to arrest. The special
226	401		officers shall have power and authority throughout the state, under
227	402		the direction and control of the Division, to enforce the criminal
228	403		provisions contained in the Oklahoma Forestry Code, other laws
229	404		relating to forests and wi ldfires and the Oklahoma Agricultural
230	405		Code.

232	406		2. The special officers shall have power and authority to make
233	407		arrests with or without warrants for violations of the criminal
234	408		provisions of the Oklahoma Forestry Code, othe r laws relating to
235	409		forests and wildfires and the Oklahoma Agricultural Code to the same
236	410		extent and under the same limitations and duties as peace officers
237	411		under the provisions of Chapter 3 of Title 22, Chapter 3 of the
238	412		Oklahoma Statutes.

240	413		3. In connection with the enforcement of the criminal
241	414		provisions, the special officers and other state investigators or
242	415		law enforcement officers may go upon all premises when necessary for
243	416		the enforcement of laws. All special officers shall be ex officio
244	417		forest rangers and shall be under the control and direc tion of the
245	418		Division; except, the Director may at any time, for cause, remove
246	419		any powers and authority of arrest conferred. Special officers
247	420		shall have the same right and authority to carry arms as the

251	450		SECTION 4. AMENDATORY 2 O.S. 2021, Section 16 -21, is
252	451		amended to read as follows:

254	452		Section 16-21. The Division shall organize fo rest protection
255	453		areas to prevent, dete ct, and suppress wildfires most effectively,
256	454		and may employ forest rangers to have charge of its activities in
257	455		each area; may subdivide each area into patrol areas; may construct
258	456		lookout towers, roads, bridges, firelines control lines, office
259	457		facilities, and communication facilities; may purchase tools for
260	458		firefighting as well as other necessary supplies and equipment; and
261	459		may carry on all activities necessary to protect the area
262	460		effectively from fires.

264	461		SECTION 5. AMENDATORY 2 O.S. 2021, Section 16-28.2, is
265	462		amended to read as follows:

267	463		Section 16-28.2 A. 1. The provisions of this section apply to
268	464		a prescribed burn.

270	465		2. Any owner wishing to set fire to land in order to conduct a
271	466		prescribed burn shall comply with the provisions of t his section.

273	467		B. 1. Within sixty (60) days prior to conducting a prescribed
274	468		burn, the owner of the land to be burned shall orally or in writing
275	469		notify all landowners whose lands adjoin the owner's land to be
276	470		burned.

278	498		2. If any landowner is burning on a la rge, consolidated tract
279	499		of land in which there are multiple adjacent owners, only those
280	500		owners with adjoining land within one (1) mile of the proposed burn
281	501		area must be notified.

283	502		3. The owner shall include in the written notice or shall
284	503		orally notify the adjoining landowners of the proposed date and
285	504		location of the burn and a telephone number where the owner can be
286	505		reached for information regarding the prescribed burn.

288	506		C. In addition to notification of adjoining prope rty owners
289	507		pursuant to subsection B of this section, the owner of the land to
290	508		be burned shall complete the prescribed burn notification plan
291	509		specified in subsection D of this section and shall submit such plan
292	510		to the rural fire department nearest the land to be burned. If the
293	511		land to be burned is in a protection area, the owner shall also
294	512		submit a copy of the notification plan to the local office or local
295	513		representative of the Forestry Division nearest to the land to be
296	514		burned.

298	515		D. Any person wishing to co nduct a prescribed burn shall
299	516		complete this a Prescribed Burn Notification Plan form, distributed
300	517		prescribed by the Oklahoma Department of Agriculture, Food, and
301	518		Forestry, which shall be in substantially the following form: .

363	603		The original copy of the form must shall be filed with the rural
364	604		fire department nearest to the land to be burned. I f conducting a
365	605		prescribed burn within a protection area, a copy of the prescribed
366	606		burn notification plan must shall be filed with the local office or
367	607		local representative of the Forestry Division nearest to the land to
368	608		be burned. A copy of the plan shall be retained by the owner of the
369	609		land to be burned.

371	610		E. 1. Whether the land is located within or outside a
372	611		protection area, the owner of the land to be burned shall, within
373	612		forty-eight (48) hours of conducting a prescribed burn, notify the
374	613		rural fire department receiving a copy of the prescrib ed burn
375	614		notification plan that the prescribed burn will be conducted.

377	615		2. Within a protection area, the owner of the land to be burned
378	616		shall also, within the time period required by Section 7 16-28.1 of
379	617		this act title, notify the local office or local repr esentative of
380	618		the Forestry Division receiving a copy of the prescribed burn
381	619		notification plan.

383	620		F. A prescribed burn conducted pursuant to provisions of this
384	621		section shall:
385		-
386	622		1. Be considered in the public interest and shall not
387	623		constitute a public or priva te nuisance; and

392	653		G. 1. Any owner conducting a prescribed burn who is found by a
393	654		court of law to have caused damages or injury as a result of
394	655		accident or by ordinary ne gligence shall only be civilly liable for
395	656		actual damages resulting from the prescribed burn.

397	657		2. Any owner conducting a prescribed burn who is found by a
398	658		court of law to have committed gross negligence in conducting th e
399	659		prescribed burn may be found to be b oth civilly liable for the
400	660		amount of damage done by the fire, and criminally liable pursuant to

403	662		3. Any owner setting or causing to be set on fire land as
404	663		authorized by this section, and as a result of gross negligence
405	664		permitting the fire to spread beyond the control of the owner or
406	665		beyond the bounds of the owner's land, shall be deemed guilty of a
407	666		misdemeanor, and upon conviction thereof, be fined a sum not more
408	667		than Five Hundred Dollars ($500.00), or imprisonment in the cou nty
409	668		jail for a period not more than six (6) months.
