3560 SECTION 1. AMENDATORY 2 O.S. 2021, Section 16 -2, is

4694 2. 3. "Division" means the Forestry Division of the Oklahoma
4795 Department of Agriculture, Food, and Forestry;

5298 a. recognized by adjoining land owners as a boundary and
5399 uncontested for at least fifteen (15) years including,
54100 but not limited to, fence lines, roads, and natural

61104 5. "Fire line" means the actively burning or burned perimeter
62105 of an uncontrolled wildfire of any size that necessitates the use of
63106 direct or indirect tactical suppression acti ons to control the
64107 wildfire;

66108 4. 6. "Forest rangers" means all employees of the Forestry
67109 Division who have responsibilities in forest and natural resource
68110 protection, including laborers, mechanics, and other employees who
69111 assist in forest and natural resource protection;

71112 5. 7. "Forest" means a tract of land that is at least ten
72113 percent (10%) stocked by trees of any size, whether of commercial or
73114 noncommercial species, or formerly having tree cover and not
74115 currently developed for nonforest non-forest use, including
75116 woodlands, woodlots, windbreaks, and shelterbelts;

77144 8. "Hazardous duty" means actions performed on or near the fire
78145 line required to fight and control wildfires in order to protect
79146 lives, property, forests, and natural resources as well as functio ns
80147 associated with wildland hazardous fuels reduction work to mitigate
81148 and reduce wildfire threat to lives, property, forests, and natural
82149 resources;

84150 6. 9. "Logging or timber harvesting operations" means the
85151 cutting or harvesting of and removal of timber from a site, leaving
86152 the root mass intact;

88153 7. 10. "Owner" means the possessor of a fee interest, a tenant,
89154 lessee, occupant, or other person in lawful control of land;

91155 8. 11. "Prescribed burning" means the controlled application of
92156 fire by the owner or designated agent of croplands, rangelands, or
93157 forestlands of fire to naturally occurring vegetative fuel under
94158 specified environmental conditions and following appropriate
95159 precautionary measures , which causes intended to keep the fire to be
96160 confined to a predetermined area and accomplish land management
97161 objectives;

99162 9. 12. "Timber" means live and dead trees and the profit in any
100163 live and dead trees including, but not limited to, bark, foliage,
101164 wood, vines, firewood, crossties, and shrubbery;

103165 10. 13. "Timber owner" means any person who owns the right to
104166 cut or harvest timber at the time the timber is to be cut or
105167 harvested, or who legally owns the severed timber;

107195 11. 14. "Wildfires" means any fire which is not controlled on
108196 forests, grasslands, fields, or cr oplands; and

110197 12. "Wild lands" 15. "Wildland" means any undeveloped lands
111198 land regardless of kind of vegetative plant cover including forests,
112199 prairies, marshes, and swamps forest, prairie, marsh, and swamp; and

114200 16. "Wildland firefighter" means any fores t ranger employed by
115201 the Forestry Division whose duty to fight wildfires includes
116202 incident management, fire suppression, and hazardous wildland fuel
117203 mitigation.

119204 SECTION 2. AMENDATORY 2 O.S. 20 21, Section 16-4, is
120205 amended to read as follows:

122206 Section 16-4. It shall be the duty of the State Board of
123207 Agriculture under terms the Board determines shall best serve the
124208 public interest to assist and cooperate with federal and state
125209 departments, educational institutions, counties, towns,
126210 corporations, or individuals; to gather and disseminate information
127211 about forests, their care and management; to prevent and extinguish
128212 wildfires; to enforce all laws pertaining to forests and woodlands
129213 wildlands; and to monitor the health, inventory, and co ndition of
130214 the state's forest resources.

137246 the enforcement of the Oklahoma Forestry Code, shall have the
138247 following powers, authority, and duties:

140248 1. To enforce the provisions of this code and other forest and
141249 forest protection laws of this state;

143250 2. To prevent, mitigate, detect, extinguish suppress, and
144251 investigate wildfires in this state;

146252 3. To provide wildfire fighting wildland firefighting crews,
147253 who shall be under the control and direction of forest rangers and
148254 other designated agents of the Division;

150255 4. To appoint district for esters, assistant district foresters,
151256 investigators, rangers , and other employees;

153257 5. To use the resources of the Division on state -owned parks
154258 and other state-administered land to prevent and suppress fires
155259 wildfires, to mitigate hazardous wildland fuels , and to establish
156260 fire fighting wildland firefighting crews, who shall be authorized
157261 to suppress fires wildfires on state land;

159262 6. To be reimbursed on an actual cost basis for all services
160263 provided to state parks and other land administered by the State of
161264 Oklahoma;

163265 7. To investigate cases of forest timber theft;

165266 8. To make available for sale surplus state vehicles directly
166267 to rural fire departments or municipal fire departments, in cities
167268 or towns under ten thousan d (10,000) population. State vehicles may
168269 be offered for sale only after approval is given in writing by the

169297 Office of Management and Enterprise Services and an evaluation is
170298 made of each vehicle and a price set by the Office of Management and
171299 Enterprise Services. The Forestry Division may o nly receive the
172300 amount authorized by the Office of Management and Enterprise
173301 Services for the sale of the vehicle;

175302 9. To purchase equipment from the Rural Fire Defense Equipment
176303 Revolving Fund's inventory, when advant ageous to the state, and to
177304 reimburse the Revolving Fund; and

179305 10. To plan and conduct prescribed burning at the request and
180306 expense of landowners on public or private land for the purpose of
181307 controlling Eastern Redcedar and other invasive or exotic species,
182308 for hazardous fuel reduction, wildl ife habitat manipulation,
183309 ecosystem restoration, or achieving silvicultural objectives.
184310 Forestry Division employees shall be protected under The
185311 Governmental Tort Claims Act and shall not be personally liable
186312 beyond the limits established therein for acti vities pursuant to
187313 this paragraph unless gross negligence is established in a competent
188314 court of law.

190315 B. Forest rangers, and the fire fighting firefighting crews
191316 under their control and direction, may enter upon any land for the
192317 purpose of preventing and suppressing wildfires and to enforce the
193318 provisions of the Oklahoma Forestry Code and other wildfire and
194319 forest protection laws of this state.

196347 C. Forest rangers, employees of the Division, and all persons
197348 under contract or agreement with the Division to a ssist in fire
198349 fighting firefighting operations, as well as persons called upon by
199350 forest rangers or other authorized employees of the Division to
200351 assist in fire fighting firefighting under the direction or
201352 supervision of employees of the Division, may, in the performance of
202353 their duties, set backfires, dig trenches, cut firelines construct
203354 control lines, and carry on all customary activities in the fighting
204355 of wildfires without incurring liability to any person.

206356 D. Under the direction of forest rangers and upon written
207357 receipt of permission consent of the landowner, county officers and
208358 employees may, in the performance of their duties and without
209359 incurring liability to any person, cut firelines construct control
210360 lines and carry out all customary activities for conducting
211361 prescribed burns to mitigate hazardous wildland fuels for the
212362 prevention of to prevent wildfires on private lands.

214363 E. Upon written consent from a landowner or designated agent,
215364 forest rangers, in the performance of their duties and without
216365 incurring liability to any person, may construct control lines,
217366 carry out all customary activities for conducting prescribed burns,
218367 and utilize mechanized equipment to reduce hazardous wildland fuels
219368 in order to mitigate or reduce the effects of wildfires on lives,
220369 property, forests, and natural resources on private and public lands
221370 in this state.

223398 1. The Director of the Forestry Division may appoint, subject
224399 to the approval of the State Board of Agriculture, special of ficers
225400 who shall have the power and au thority to arrest. The special
226401 officers shall have power and authority throughout the state, under
227402 the direction and control of the Division, to enforce the criminal
228403 provisions contained in the Oklahoma Forestry Code, other laws
229404 relating to forests and wi ldfires and the Oklahoma Agricultural
230405 Code.

232406 2. The special officers shall have power and authority to make
233407 arrests with or without warrants for violations of the criminal
234408 provisions of the Oklahoma Forestry Code, othe r laws relating to
235409 forests and wildfires and the Oklahoma Agricultural Code to the same
236410 extent and under the same limitations and duties as peace officers
237411 under the provisions of Chapter 3 of Title 22, Chapter 3 of the
238412 Oklahoma Statutes.

240413 3. In connection with the enforcement of the criminal
241414 provisions, the special officers and other state investigators or
242415 law enforcement officers may go upon all premises when necessary for
243416 the enforcement of laws. All special officers shall be ex officio
244417 forest rangers and shall be under the control and direc tion of the
245418 Division; except, the Director may at any time, for cause, remove
246419 any powers and authority of arrest conferred. Special officers
247420 shall have the same right and authority to carry arms as the

248448 sheriffs of this state. The compensation of special officers shall
249449 be fixed and paid by the Division from its funds.

251450 SECTION 4. AMENDATORY 2 O.S. 2021, Section 16 -21, is
252451 amended to read as follows:

254452 Section 16-21. The Division shall organize fo rest protection
255453 areas to prevent, dete ct, and suppress wildfires most effectively,
256454 and may employ forest rangers to have charge of its activities in
257455 each area; may subdivide each area into patrol areas; may construct
258456 lookout towers, roads, bridges, firelines control lines, office
259457 facilities, and communication facilities; may purchase tools for
260458 firefighting as well as other necessary supplies and equipment; and
261459 may carry on all activities necessary to protect the area
262460 effectively from fires.

264461 SECTION 5. AMENDATORY 2 O.S. 2021, Section 16-28.2, is
265462 amended to read as follows:

267463 Section 16-28.2 A. 1. The provisions of this section apply to
268464 a prescribed burn.

270465 2. Any owner wishing to set fire to land in order to conduct a
271466 prescribed burn shall comply with the provisions of t his section.

273467 B. 1. Within sixty (60) days prior to conducting a prescribed
274468 burn, the owner of the land to be burned shall orally or in writing
275469 notify all landowners whose lands adjoin the owner's land to be
276470 burned.

278498 2. If any landowner is burning on a la rge, consolidated tract
279499 of land in which there are multiple adjacent owners, only those
280500 owners with adjoining land within one (1) mile of the proposed burn
281501 area must be notified.

283502 3. The owner shall include in the written notice or shall
284503 orally notify the adjoining landowners of the proposed date and
285504 location of the burn and a telephone number where the owner can be
286505 reached for information regarding the prescribed burn.

288506 C. In addition to notification of adjoining prope rty owners
289507 pursuant to subsection B of this section, the owner of the land to
290508 be burned shall complete the prescribed burn notification plan
291509 specified in subsection D of this section and shall submit such plan
292510 to the rural fire department nearest the land to be burned. If the
293511 land to be burned is in a protection area, the owner shall also
294512 submit a copy of the notification plan to the local office or local
295513 representative of the Forestry Division nearest to the land to be
296514 burned.

298515 D. Any person wishing to co nduct a prescribed burn shall
299516 complete this a Prescribed Burn Notification Plan form, distributed
300517 prescribed by the Oklahoma Department of Agriculture, Food, and
301518 Forestry, which shall be in substantially the following form: .

364604 fire department nearest to the land to be burned. I f conducting a
365605 prescribed burn within a protection area, a copy of the prescribed
366606 burn notification plan must shall be filed with the local office or
367607 local representative of the Forestry Division nearest to the land to
368608 be burned. A copy of the plan shall be retained by the owner of the
369609 land to be burned.

371610 E. 1. Whether the land is located within or outside a
372611 protection area, the owner of the land to be burned shall, within
373612 forty-eight (48) hours of conducting a prescribed burn, notify the
374613 rural fire department receiving a copy of the prescrib ed burn
375614 notification plan that the prescribed burn will be conducted.

377615 2. Within a protection area, the owner of the land to be burned
378616 shall also, within the time period required by Section 7 16-28.1 of
379617 this act title, notify the local office or local repr esentative of
380618 the Forestry Division receiving a copy of the prescribed burn
381619 notification plan.

383620 F. A prescribed burn conducted pursuant to provisions of this
384621 section shall:

386622 1. Be considered in the public interest and shall not
387623 constitute a public or priva te nuisance; and

389651 2. Be considered a property right of the property owner if
390652 vegetative fuels are used.

392653 G. 1. Any owner conducting a prescribed burn who is found by a
393654 court of law to have caused damages or injury as a result of
394655 accident or by ordinary ne gligence shall only be civilly liable for
395656 actual damages resulting from the prescribed burn.

397657 2. Any owner conducting a prescribed burn who is found by a
398658 court of law to have committed gross negligence in conducting th e
399659 prescribed burn may be found to be b oth civilly liable for the
400660 amount of damage done by the fire, and criminally liable pursuant to
401-paragraph 3 of this subsection. ENR. H. B. NO. 3192 Page 10

403662 3. Any owner setting or causing to be set on fire land as
404663 authorized by this section, and as a result of gross negligence
405664 permitting the fire to spread beyond the control of the owner or
406665 beyond the bounds of the owner's land, shall be deemed guilty of a
407666 misdemeanor, and upon conviction thereof, be fined a sum not more
408667 than Five Hundred Dollars ($500.00), or imprisonment in the cou nty
409668 jail for a period not more than six (6) months.

411669 SECTION 6. This act shall become effective November 1, 2024.
