113+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
114+SECTION 1. NEW LAW A new section of law to be codified
115+in the Oklahoma Statutes as Section 1017.7 of Title 56, unless there
116+is created a duplication in numbering, reads as follows:
117+A. As used in this section:
118+1. “PACE” stands for programs of all -inclusive care for the
119+elderly; and
120+2. The terms “PACE program agreement ”, “PACE organization”,
121+“participant” and “state administering agency ” have the same meaning
122+as provided by 42 C.F.R., Section 460.6.
123+B. The Oklahoma Health Care Authority shall serve as the state
124+administering agency responsible for administering PACE program
125+agreements under 42 C.F.R., Part 460, Subpart C.
126+C. The Authority shall enforce the federal regulations of the
127+Centers for Medicare and Medicaid Services governing PACE codified
128+at 42 C.F.R., Part 460. The Authority shall have all the powers and
129+duties provided to the state administering agency under 42 C.F.R.,
130+Part 460.

157+D. PACE organizations shall be exempt from licensure by the
158+State Department of Health under the Home Care Act, the Adult Day
159+Care Act, or any other act that governs a different type of facility
160+or provider. This subsection shall not be construed to prevent the
161+Department from enforcing such acts with respect to facilities or
162+providers contracted by the PACE organ ization to provide services to
163+PACE program participants.
164+E. The Authority may, as necessary, execute an interagency
165+agreement with the State Department of Health to carry out any of
166+the functions of the state administering agency under 42 C.F.R.,
167+Part 460.
168+F. The Oklahoma Health Care Authority Board may promulgate
169+rules as necessary to implement this section.
170+SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -872, is
171+amended to read as follows:
172+Section 1-872. As used in the Adult Da y Care Act:
173+1. “Adult day care center” or “center” means a facility which
174+provides basic day care services to unrelated impaired adults for
175+more than four (4) hours in a twenty -four-hour period. A center
176+shall be a distinct entity, either freestanding or a separate
177+program of a larger organization. A center shall have a separately
178+verifiable staff, space, budget and participant record system. The
179+terms “adult day care center” adult day care center or “center”
180+center shall not include retirement centers and, senior citizen

209+2. “Basic day care services” means supervised health, social
210+supportive, and recreational services in a structured daytime
211+program which serves functionally impaire d adults who continue to
212+live in their own homes, usually with the aid of family care givers;
213+3. “Department” means the State Department of Health; and
214+4. “Participant” means any person attending an adult day care
215+center.
216+SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -1961, is
217+amended to read as follows:
218+Section 1-1961. As used in the Home Care Act:
219+1. “Board” means the State Board of Health;
220+2. “Certification” means verification of appropriate training
221+and competence establish ed by the State Commissioner of Health by
222+rules promulgated pursuant to the Home Care Act for home health
223+aides and home care agency administrators;
224+3. “Department” means the State Department of Health;
225+4. “Healthcare “Health care provider” means a physi cian,
226+physician assistant or Advanced Practice Registered Nurse recognized
227+by the Oklahoma Board of Nursing as a Certified Nurse Practitioner
228+or a Clinical Nurse Specialist;
229+5. “Home care agency” means any sole proprietorship,
230+partnership, association, co rporation or other organization which
231+

257+administers, offers or provides home care services, for a fee or
258+pursuant to a contract for such services, to clients in their place
259+of residence. The term “home care agency” home care agency shall
260+not include:
261+a. individuals who contract with the Department of Human
262+Services to provide personal care services, provided
263+such individuals shall not be exempt from
264+certification as home health aides,
265+b. organizations that contract with the Oklahoma Health
266+Care Authority as Intermediary Services Organizations
267+(ISO) to provide federal Internal Revenue Service
268+fiscal and supportive services to Oklahoma Consumer-
269+Directed Personal Assistance Supports and Support
270+Services (CD-PASS) waiver program participants who
271+have employer responsibility for hiring, training,
272+directing and managing an individual personal care
273+attendant, or
274+c. CD-PASS waiver program employer participants , or
275+d. PACE organizations as defined by 42 C.F.R., Section
276+460.6;
277+6. “Home care services” means skilled or p ersonal care services
278+provided to clients in their place of residence for a fee;

305+7. “Home health aide” means an individual who provides personal
306+care to clients in their temporary or permanent place of residence
307+for a fee;
308+8. “Home care agency administra tor” means a person who
309+operates, manages, or supervises, or is in charge of a home care
310+agency;
311+9. “Personal care” means assistance with dressing, bathing,
312+ambulation, exercise or other personal needs;
313+10. “Skilled care” means home care services perform ed on a
314+regular basis by a trained Respiratory Therapist/Technician
315+respiratory therapist/technician or by a person currently licensed
316+by this state including but not limited to a Licensed Practical
317+Nurse, Registered Nurse, Physical Therapist, Occupational Therapist,
318+Speech Therapist physical therapist, occupational therapist, speech
319+therapist, or Social Worker social worker;
320+11. “Standby assistance” means supervision of client directed
321+activities with verbal prompting and infrequent, incidental hands -on
322+intervention only; and
323+12. “Supportive home assistant” means an individual employed by
324+a home care agency who provides standby assistance to ambulatory
325+clients, in conjunction with other companionship or homemaker
326+services, in the temporary or permanent pl ace of residence of the
327+client for a fee.

470+B. 1. The Oklahoma Health Care Authority shall serve as the

472+program agreements under 42 C.F.R., Part 460, Subpart C. The
473+Authority may enter into PACE program agreements with PACE
474+organizations and the Centers for Medicare and M edicaid Services.
475+2. The Authority shall enforce applicable federal laws and
476+regulations governing PACE organizations, including, but not limited
477+to, regulations of the Centers for Me dicare and Medicaid Services
478+codified at 42 C.F.R. , Part 460. The Authority may enter into an
479+agreement with the State Depart ment of Health to carry out any
480+duties or functions of the state administering agenc y under 42
481+C.F.R., Part 460 or other applicable federal laws or regulations.
482+C. 1. The State Department of H ealth shall create and issue to
483+qualifying applicants a license for PACE organizations. Qualifying
484+PACE organizations shall at a minimum meet all requirements of 42
485+C.F.R., Part 460, Subpart B.
486+2. The Department shall perform onsite visits and other
487+necessary monitoring of PACE organizations under 42 C.F.R., Part

524+D. The Oklahoma Health Care Authority Board and the State
525+Commissioner of Health shall promulgate rules to imple ment this
526+section.
