5352 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5453 SECTION 1. AMENDATORY 62 O.S. 2021, Section 34.27, is
5554 amended to read as follows:
5655 Section 34.27 A. There is hereby established the State
5756 Governmental Technology Applications Revie w Board. The Board shall
5857 be composed of the follo wing members:
5958 1. The Director of th e Office of Management and Enterprise
6059 Services or a designee;
6160 2. Four Three representatives from different state agencies,
6261 boards, commissions, or authorities to be appoint ed by the Governor,
6362 at least one of which shall be employed by a law enforcement ag ency;

9189 3. Two members who are not state government employees to be
9290 appointed by the Speaker of the House of Representatives; and
9391 4. Two members who are not state government employees to be
9492 appointed by the President Pro Tempore of the Senate ; and
9593 5. One member to be appointed by the Chief Justice of the
9694 Oklahoma Supreme Court .
9795 B. Members of the Board shall serve for terms of two (2) years.
9896 The Board shall select a chair from among its members .
9997 C. Members of the Boar d shall not receive compensation for
10098 serving on the Board, but shall be reimbursed for travel expenses
10199 incurred in the performance of their duties by their respective
102100 agencies or appointing authority in accord ance with the State Tr avel
103101 Reimbursement Act.
104102 D. Notwithstanding any other section of law, any member of the
105103 Board attending a meeting via teleconference shall be counted as
106104 being present in person and shall count toward the determination of
107105 whether a quorum of the Board is pr esent at the meeting.
108106 E. The Board shall have the duty and re sponsibility of:
109107 1. Reviewing for approval all convenience fees and merchant
110108 fees as defined in Section 34.25 of this title and changes in
111109 convenience fees and merchant fe es charged by state ag encies,
112110 boards, commissions, or authorities;
113111 2. Monitoring all portal systems and applications for portal
114112 systems created by state agencies, boards, commissions, or

142139 authorities, reviewing portal systems applications approved or
143140 denied by the Information S ervices Division of the O ffice of
144141 Management and Enterprise Se rvices, and making recommendations to
145142 the Legislature and Governor to encourage greater use o f the open-
146143 systems concept as is defined in Section 34.26 of this title;
147144 3. Granting an exemption fo r a specific license or p ermit to a
148145 state agency from the requ irements of Section 34.24.1 of this title.
149146 The exemption shall be limited in time as warranted by the
150147 circumstances. The Board shall grant the exemption only if
151148 presented compelling evidence t hat the issuance of the l icense or
152149 permit requires the provisi on of information that cannot be provided
153150 through an online licensing or permitting process a nd that the
154151 failure of the applicant to provide the information would create a
155152 significant risk to th e integrity of the licens e or permit. The
156153 exemption provided for in this paragraph shall not apply to license
157154 renewals pursuant to the Oklahoma Vehicle License and Registration
158155 Act;
159156 4. Providing ongoing oversight of implementation o f the plan of
160157 action developed by the Chief Inf ormation Officer pursuant to
161158 Section 34.11.1 of this title and approving any amendments to the
162159 plan of action;
163160 5. Approving charges to state agencies established by the
164161 Information Services Division pursuant to Section 35.5 of thi s title
165162 for shared services as defined in Section 35.3 of this title;

193189 6. Functioning in an advisory capacity to the Chief Information
194190 Officer; and
195191 7. Approving a plan by which public elementary and secondary
196192 schools of the state may recover the cost of i nstructional
197193 technology resources issued by the schools ; and
198194 8. Providing ongoing oversight and approval of all rates set or
199195 changed by the Office of Management and Enterprise Services .
200196 SECTION 2. This act shall bec ome effective November 1, 2024.
