53	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	53		SECTION 1. AMENDATORY 62 O.S. 2021, Section 34.27, is
55	54		amended to read as follows:
56	55		Section 34.27 A. There is hereby established the State
57	56		Governmental Technology Applications Revie w Board. The Board shall
58	57		be composed of the follo wing members:
59	58		1. The Director of th e Office of Management and Enterprise
60	59		Services or a designee;
61	60		2. Four Three representatives from different state agencies,
62	61		boards, commissions, or authorities to be appoint ed by the Governor,
63	62		at least one of which shall be employed by a law enforcement ag ency;

91	89		3. Two members who are not state government employees to be
92	90		appointed by the Speaker of the House of Representatives; and
93	91		4. Two members who are not state government employees to be
94	92		appointed by the President Pro Tempore of the Senate ; and
95	93		5. One member to be appointed by the Chief Justice of the
96	94		Oklahoma Supreme Court .
97	95		B. Members of the Board shall serve for terms of two (2) years.
98	96		The Board shall select a chair from among its members .
99	97		C. Members of the Boar d shall not receive compensation for
100	98		serving on the Board, but shall be reimbursed for travel expenses
101	99		incurred in the performance of their duties by their respective
102	100		agencies or appointing authority in accord ance with the State Tr avel
103	101		Reimbursement Act.
104	102		D. Notwithstanding any other section of law, any member of the
105	103		Board attending a meeting via teleconference shall be counted as
106	104		being present in person and shall count toward the determination of
107	105		whether a quorum of the Board is pr esent at the meeting.
108	106		E. The Board shall have the duty and re sponsibility of:
109	107		1. Reviewing for approval all convenience fees and merchant
110	108		fees as defined in Section 34.25 of this title and changes in
111	109		convenience fees and merchant fe es charged by state ag encies,
112	110		boards, commissions, or authorities;
113	111		2. Monitoring all portal systems and applications for portal
114	112		systems created by state agencies, boards, commissions, or

142	139		authorities, reviewing portal systems applications approved or
143	140		denied by the Information S ervices Division of the O ffice of
144	141		Management and Enterprise Se rvices, and making recommendations to
145	142		the Legislature and Governor to encourage greater use o f the open-
146	143		systems concept as is defined in Section 34.26 of this title;
147	144		3. Granting an exemption fo r a specific license or p ermit to a
148	145		state agency from the requ irements of Section 34.24.1 of this title.
149	146		The exemption shall be limited in time as warranted by the
150	147		circumstances. The Board shall grant the exemption only if
151	148		presented compelling evidence t hat the issuance of the l icense or
152	149		permit requires the provisi on of information that cannot be provided
153	150		through an online licensing or permitting process a nd that the
154	151		failure of the applicant to provide the information would create a
155	152		significant risk to th e integrity of the licens e or permit. The
156	153		exemption provided for in this paragraph shall not apply to license
157	154		renewals pursuant to the Oklahoma Vehicle License and Registration
158	155		Act;
159	156		4. Providing ongoing oversight of implementation o f the plan of
160	157		action developed by the Chief Inf ormation Officer pursuant to
161	158		Section 34.11.1 of this title and approving any amendments to the
162	159		plan of action;
163	160		5. Approving charges to state agencies established by the
164	161		Information Services Division pursuant to Section 35.5 of thi s title
165	162		for shared services as defined in Section 35.3 of this title;

196	192		schools of the state may recover the cost of i nstructional
197	193		technology resources issued by the schools ; and
198	194		8. Providing ongoing oversight and approval of all rates set or
199	195		changed by the Office of Management and Enterprise Services .
200	196		SECTION 2. This act shall bec ome effective November 1, 2024.
