28166 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

30167 SECTION 1. AMENDATORY 21 O.S. 2021, Section 842.3, is
31168 amended to read as follows:

33169 Section 842.3 A. All body piercing operators, tattoo op erators
34170 and artists shall be prohibited from performing body piercing or
35171 tattooing unless licensed in the appropriate catego ry by the State
36172 Department of Health. The State Board of Health shall promulgate
37173 rules regulating body piercing and tattooing which shall include,
38174 but not be limited to:

40175 1. Artist temporary and permanent licensure;

42176 2. Facility operator temporary and permanent licensure;

73221 body piercing and tattoo operators.

75222 B. A city or county may adopt any regulations that do not
76223 conflict with, or are more comprehensive than, the provisions of
77224 this section or with the rules promulgated by the Department. This
78225 section does not limit the abil ity of a city or county to require an

79252 applicant to obtain any further business licenses or permits that
80253 the city or county deems appropriate.

82254 C. 1. The State Department of Health shall not grant or issue
83255 a license to a body piercing or tattoo operator if the place of
84256 business of the body piercing or tattoo operator is within one
85257 thousand (1,000) feet of a c hurch, school, or playground.

87258 2. The provisions of this subsecti on shall not apply to the
88259 renewal of licenses or to new applications for locations whe re body
89260 piercing or tattoo operators are licensed at the time the
90261 application is filed with the Departmen t.

92262 3. As used in this subsection:

94263 a. "church" means an establishment, other than a private
95264 dwelling, where religious services are usually
96265 conducted,

98266 b. "school" means an establishment, other than a private
99267 dwelling, where the usual processes of education are
100268 usually conducted, and

102269 c. "playground" means a place, other t han grounds at a
103270 private dwelling, that is provided by the public or
104271 members of a community for recreation.

106272 D. A body piercing or tattoo operator applying for license
107273 renewal or for a new li cense to perform at an existing body piercing
108274 or tattoo place of business shall pay a certification fee

109301 established by the Department by rule to determine if the exemptions
110302 provided for in paragraph 2 of subsection C of this section apply .

112303 E. A body piercing or tattoo operator applying for license
113304 renewal or for a new license under subsection C of this section
114305 shall publish notice of the license applica tion or renewal at least
115306 once a week for three (3) consecutive weeks in a newspaper of
116307 general circulation nearest to the proposed location of the business
117308 and most likely to give notice to interested citizens of the county,
118309 city, and community in which th e applicant proposes to engage in
119310 business. The publication shall identify the exact location at
120311 which the proposed business is to be operated.

122-D. A body piercing or tattoo operator applying for a new
123-license shall publish notice of the license application one time in
124-a newspaper of general circulation nearest to the proposed location
125-of the body piercing or tattoo business most likely to give notice
126-to interested citizens of the county, city, and community in whi ch

139317 a violation of Section 842.1 of this title or rules promulgated
140318 pursuant thereto and, in addition to any criminal penalty imposed,
141319 the Department may impose an administrative fine not to e xceed Five
142320 Thousand Dollars ($5,000.00) per violation per day , and may suspend,
143321 revoke, or deny the license of the establishment , or may impose both
144322 such administrative fine and suspension, revocation, or denial for
145323 any such violation;

147350 2. Whenever it shall appear that any pers on is engaged or about
148351 to engage in any acts o r practices which constitutes or will
149352 constitute a violation of the provisions of Sect ion 842.1 of this
150353 title, or of any rule, or order thereunder, the Department, the
151354 Attorney General, or the district attorney of any relevant county
152-may bring an action in the relevant district court or in Oklahoma
153-County to enjoin such acts or practices and to enforce compliance
154-with this act or any rule, order , or temporary or permanent
155-injunction shall be gr anted without bond. The Department, the
156-Attorney General, and the district attorney shall transmit such
