2956 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1040.75, is

4494 performance, taken as a whole, has the following

4696 (1) the average person eighteen (18) years of age or
4797 older applying contemporary community standards
4898 would find that the material or performance has a
4999 predominant tendency to appeal to a pru rient
50100 interest in sex to minors, and

52101 (2) the average person eighteen (18) years of age or
53102 older applying contemporary community standards
54103 would find that the material or performance
55104 depicts or describes nudity, sexual conduct ,
56105 sexual excitement or sadomaso chistic abuse in a
57106 manner that is patently offensive to prevailing
58107 standards in the adult community with respect to
59108 what is suitable for minors, and

61109 (3) the material or performance lacks serious
62110 literary, scientific, medical, artistic, or
63111 political value for minors, or

65112 b. any description, exhibition, presentation or
66113 representation, in whatever form, of inappropriate

69115 3. "Inappropriate violence " means any description or
70116 representation, in an interactive video game or computer software,

76148 that the interactive video game or computer software
77149 is patently offensive to prevail ing standards in the
78150 adult community with respect to what is suitable for
79151 minors, and

81152 b. the interactive video game or computer software lacks
82153 serious literary, scientific, medical, artistic, or
83154 political value for minors bas ed on, but not limited
84155 to, the following criteria:

86156 (1) is glamorized or gratuitous,

88157 (2) is graphic violence used to shock or stimulate,

90158 (3) is graphic violence that is not contextually
91159 relevant to the material,

93160 (4) is so pervasive that it serves as the thread
94161 holding the plot of the mat erial together,

96162 (5) trivializes the serious nature of realistic

99164 (6) does not demonstrate the consequences or effects
100165 of realistic violence,

102166 (7) uses brutal weapons designed to inflict the
103167 maximum amount of pain and damage,

108197 (9) depicts lead characters who resort to violence

111199 4. "Nudity" means the:

113200 a. showing of the human male or female genitals, pubic
114201 area, or buttocks with less than a full opaque

117203 b. showing of the female breast with less than a full
118204 opaque covering of any portion of the female breast

121206 c. depiction of covered male genitals in a discernibly
122207 turgid state;

124208 5. "Sexual conduct" means acts of masturbation, homosexuality,
125209 sexual intercourse, or physical contact with a person 's clothed or
126210 unclothed genitals, pubic area, buttocks, or, if such person be a
127211 female, breast, or fellatio, cunnilingus, anal intercourse, or any
128212 other intrusion, however slight, of any part of a person 's body or
129213 of any object into the genital or anal openings of another person 's
130214 body, or depictions or descriptions of sexual bestiality,
131215 sadomasochism, masturbation, or excretory functions ;
216+6. "Sexual excitement" means the condition of human male or
217+female genitals when in a state of sexual stimulation or arousal;

135245 7. "Sadomasochistic abuse " means flagellation or torture by or
136246 upon a person clothed or naked or the condition of being fettered,
137247 bound or otherwise physically restrained on the part of one so
138248 clothed or naked;

140249 8. "Material" means anything tangible that is capable of being
141250 used or adapted to arouse prurient interest, whether through the
142251 medium of reading, observation, sound, or in any other manner
143252 including, but not limited to, anything printed or writte n, any
144253 book, magazine, newspaper, pamphlet, poster, print, picture, figure,
145254 image, description, drawing, pictorial representation, motion
146255 picture film, record, recording tape, CD -ROM disk, Magnetic Disk
147256 Memory, Magnetic Tape Memory , photograph, video tape, computer
148257 software or video disk, film, transparency, slide, audiotape, audio
149258 disk, computer tape, video game, or any other medium used to
150259 electronically produce or reproduce images on a screen, or any
151260 mechanical, chemical, o r electronic reproduction. Mat erial includes
152261 undeveloped photographs, molds, printing plates, and other latent
153262 representational objects whether or not processing or other acts are
154263 required to make the content of the material apparent ;

156264 9. "CD-ROM" means a compact disk with read only me mory which
157265 has the capacity to store audio, video and written materials and may
158266 be used by computer to play or display materials harmful to minors;

160267 10. "Magnetic Disk Memory " means a memory system that stores
161268 and retrieves binary data on record -like metal or plastic disks

165298 11. "Magnetic Tape Memory " means a memory system that stores
166299 and retrieves binary data on magnetic recording tape;

168300 12. "Performance" means any motion pictur e, film, video tape,
169301 played record, phonograph or tape, preview, trailer, play, show,
170302 skit, dance, or other exhibition performed or presented to or before
171303 an audience of one or more, with or without consideration;

173304 13. 10. "Knowingly" means having general knowledge of, or
174305 reason to know, or a belief or ground for belief which warrants
175306 further inspection or inquiry of both:

177307 a. the character and content of any material or
178308 performance which is reasonably susceptible of
179-examination by the defendant, and ENR. H. B. NO. 3456 Page 5
309+examination by the defendant, and
180310 b. the age of the minor. However, an honest mistake,
181311 shall constitute an excuse from liability pursuant to
182312 this act if the defendant made a reasonable bona fide
183313 attempt to ascertain the true age of such minor;

185314 14. 11. "Person" means any individual, partnership,
186315 association, corporation, or other legal entity of any kind; and

188316 15. 12. "A reasonable bona fide attempt " means an attempt to
189317 ascertain the true age of the minor by requiring production of a
190318 driver license, marriage license, birth certificate or other

192347 relying solely on the oral allegations or apparent age of the minor.

194348 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1040.76, is
195349 amended to read as follows:

197350 Section 1040.76 The Legislature finds that protecting minor
198351 children from overtly sexual and violent content is a legitimate
199352 objective that should be actively enforced.

201353 The Legislature further finds that the protection of the right
202354 of the people to engage in the freedo m of speech and expression is a
203355 sacred right in the United States ; however, such performances and
204356 materials may not contain depictions of sexual conduct, nudity, or
205357 inappropriate violence which are harmful to minor children .

207358 Therefore, it is the intent of the Legislature that these
208359 provisions be diligently enforced to protect minor children while
209360 also protecting the free speech rights of the public.

211361 No person, including but not limited to any persons having
212362 custody, control or supervision of any commercial establishment,
213363 shall knowingly:

215364 1. Display material which is harmful to minors in such a way
216365 that minors, as a part of the invited general public, will be
217366 exposed to view such material. Provided, however, a person shall be
218367 deemed not to have "displayed" material harmful to minors if the
219368 material is kept behind devices commonly known as "blinder racks" so

221397 view;

223398 2. Sell, furnish, present, distribute, allow to view, or
224399 otherwise disseminate t o a minor, with or without consideration, any
225400 material which is harmful to minors; or

227401 3. Present to a minor or participate in presenting to a minor,
228402 with or without consideration, any performance which is harmful to a
229403 minor.

231404 SECTION 3. This act shall become effective November 1, 2024.
