No. 3696 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 STATE OF OKLAHOMA 2nd Session of the 59th Legislature (2024) COMMITTEE SUBSTITUTE FOR ENGROSSED HOUSE BILL 3683 By: Kannady and Luttrell of the House and Hall of the Senate COMMITTEE SUBSTITUTE An Act relating to the Oklahoma Department of Commerce; providing short title; creating the Defense Workforce Grant Program; providing for administration and purpose; specifying authorized and unauthorized expenses; limiting location of certain work; requiring alternative financing; requiring certain reports; establishing the Defense Workforce Grant Program Revolving Fund; establishing fund nature; authorizing certain budgeting and expenditure of funds for certain purposes; providing for codification; providing an effective date; and declaring an emergency. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 5062.41 of Title 74, unless there is created a duplication in numbering, reads as follows: This act shall be known and may be cited as the “Defense Workforce Grant Program ”. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 5062.42 of Title 74, unless there is created a duplication in numbering, reads as follows: A. There is hereby created the Defense Workforce Grant Program which shall be administered by the Oklahoma Department of Commerce . B. The program shall increase the workforce in this state, specifically the workforce dedicated to federal defense contract work. The program shall help provide gap financing to two or more companies actively working with the United States Department of Defense or any United States Military Branch to expand current contracts or secure new contracts for new work. C. Grant funds may only be used for equipment, supplies, and training necessary to expand operations in response to requests from the United States Department of Defense or any United States Military Branch. Grant funds shall not be used for renewal of contracts with the United States Department of Defense or any Unit ed States Military Branch. D. The location of the work to be provided through the program shall be in a county of the state with a population of less than seventy-five thousand (75,000) people according to the most recent Federal Decennial Census . The applying company shall have available other sources of funding dedicated to helping finance the new project or the expansion of an existing project. Req. Beginning July 1, 2025, the Oklahoma Department of Commerce shall electronically provide an annual report to the Governor, the Speaker of the House of Representatives, the President Pro Tempore of the Senate, the Appropriations and Budget Chair of the House of Representatives, and the Appropriations Chair of the Senate that includes, but is not limited to, the number of awards that have been granted, the percentage of those funds that have been expended, and the increased number of employees that h ave been hired by awardees. SECTION 3. NEW LAW A new section of l aw to be codified in the Oklahoma Statutes as Section 5062.43 of Title 74, unless there is created a duplication in numbering, reads as follows: There is hereby create d in the State Treasury a revolving fund for the Oklahoma Department of Commerce to be designated the “Defense Workforce Grant Program Revolving Fund ”. The fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all monies received by the Department from appropriations, donations, grants, or other sources of funding specifically designated for deposit to the Defense Workforce Grant Program Revolving Fund. All monies accruing to the credit of the fund are hereby approp riated and may be budgeted and expended by the Department for the purpose of the Defense Workforce Grant Program. Expenditures from the fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for Req. The De partment may retain one p ercent (1%) of all funds otherwise deposited to the fund to cover administrative costs related to the Defense Workforce Grant Program. SECTION 4. This act shall become effective July 1, 2024. SECTION 5.
