	47	+	Commerce; providing short title; creating the Defense
	48	+	Workforce Grant Program; providing for administration

	51	+	requiring alternative financing; requiring certain
	52	+	reports; establishing the Defense Workforce Grant

53	62		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	63		SECTION 1. NEW LAW A new section of law to be codified
55	64		in the Oklahoma Statutes as Section 5062.41 of Title 74, unless
56	65		there is created a duplication in numbering, reads as follows:
57	66		This act shall be known and may be cited as the “Defense
58	67		Workforce Grant Program ”.
59		-	SECTION 2. NEW LAW A new section of law to be codifi ed
60		-	in the Oklahoma Statutes as Section 5062.42 of Title 74, unless
61		-	there is created a dup lication in numbering, reads as follows:
62		-	A. There is hereby created the Defense Workforce Grant Program
63		-	which shall be administered by the Oklahoma Department of Commerce.

	94	+	SECTION 2. NEW LAW A new section of law to be codified
	95	+	in the Oklahoma Statutes as Section 5062.42 of Title 74, unless
	96	+	there is created a duplication in numbering, reads as follows:
	97	+	A. There is hereby created the Defense Workforce Grant Program
	98	+	which shall be administered by the Oklahoma Department of Commerce .
91	99		B. The program shall increase the workforce in this state,
92	100		specifically the workforce dedicated to federal defense contract
93	101		work. The program shall help provide gap financing to two or more
94	102		companies actively working with the United States Department of
95	103		Defense or any United States Military Branch to expand current
96	104		contracts or secure new contracts for new work.
97	105		C. Grant funds may only be used for equipment, supplies, and
98	106		training necessary to expand operations in response to requests from
99	107		the United States Department of Defense or any United States
100	108		Military Branch. Grant funds shall not be used for renewal of
101	109		contracts with the United States Department of Defense or any Unit ed
102	110		States Military Branch.
103	111		D. The location of the work to be provided through the program
104	112		shall be in a county of the state with a population of less than
105	113		seventy-five thousand (75,000) people according to the most recent
106	114		Federal Decennial Census . The applying company shall have available
107	115		other sources of funding dedicated to helping finance the new
108	116		project or the expansion of an existing project.
109		-	E. Beginning July 1, 2025, the Oklahoma Department of Commerce
110		-	shall electronically provide an annual report to the Governor, the
111		-	Speaker of the House of Representatives, the Preside nt Pro Tempore
112		-	of the Senate, the Appropriations and Budget Chair of the House of
113		-	Representatives, and the Appropriations Chair of the Senate that
114		-	includes, but is not limited to, the number of awards that have been

	143	+	E. Beginning July 1, 2025, the Oklahoma Department of Commerce
	144	+	shall electronically provide an annual report to the Governor, the
	145	+	Speaker of the House of Representatives, the President Pro Tempore
	146	+	of the Senate, the Appropriations and Budget Chair of the House of
	147	+	Representatives, and the Appropriations Chair of the Senate that
	148	+	includes, but is not limited to, the number of awards that have been
142	149		granted, the percentage of those funds that have been expended, and
143	150		the increased number of employees that h ave been hired by awardees.
144	151		SECTION 3. NEW LAW A new section of l aw to be codified
145	152		in the Oklahoma Statutes as Section 5062.43 of Title 74, unless
146	153		there is created a duplication in numbering, reads as follows:
147	154		There is hereby create d in the State Treasury a revolving fund
148	155		for the Oklahoma Department of Commerce to be designated the
149	156		“Defense Workforce Grant Program Revolving Fund ”. The fund shall be
150	157		a continuing fund, not subject to fiscal year limitations, and shall
151	158		consist of all monies received by the Department from
152	159		appropriations, donations, grants, or other sources of funding
153	160		specifically designated for deposit to the Defense Workforce Grant
154	161		Program Revolving Fund. All monies accruing to the credit of the
155	162		fund are hereby approp riated and may be budgeted and expended by the
156	163		Department for the purpose of the Defense Workforce Grant Program.
157	164		Expenditures from the fund shall be made upon warrants issued by the
158	165		State Treasurer against claims filed as prescribed by law with the
159	166		Director of the Office of Management and Enterprise Services for
160		-	approval and payment. The Department may retain one percent (1%) of
161		-	all funds otherwise deposited to the fund to cover administ rative
162		-	costs related to the Defense Workforce Grant Program.
163		-	SECTION 4. This act shall become effective July 1, 2024.
164		-	SECTION 5. It being immediately necessary for the preservation
165		-	of the public peace, health or safety, an emergency is hereby
