NEW LAW A new section of law to be codified in the Oklahoma Statutes as Se ction 5062.41 of Title 74, unless there is created a duplication in numbering, reads as follows: This act shall be known and may be cited as the “Defense Workforce Grant Program ”. SECTION 2. NEW LAW A new section of law to be codifi ed in the Oklahoma Statutes as Section 5062.42 of Title 74, unless there is created a dup lication in numbering, reads as follows: A. There is hereby created the Defense Workforce Grant Program which shall be administered by the Oklahoma Department of Commerce. The program shall increase the workforce in this state, specifically the workforce dedicated to federal defense contract work. The program shall help provide gap financing to two or more companies actively working with the United States Departme nt of Defense or any United States Military Branch to expand current contracts or secure new contracts for new work. C. Grant funds may only be used for equipment, supplies, and training necessary to expand operations in response to requests from the United States Department of Defense or any United States Military Branch. Grant funds shall not be used for renewal of contracts with the United States Department of Defense or any United States Military Branch. D. The location of the work to be provided through the program shall be in a county of the state with a population of less than seventy-five thousand (75,000) people according to the most recent Federal Decennial Census . The applying company shall have available other sources of funding dedicated to helping finance the new project or the expansion of an existing project. E. Beginning July 1, 2025, the Oklahoma Department of Commerce shall electronically provide an annual report to the Governor, the Speaker of the House of Representatives, the Preside nt Pro Tempore of the Senate, the Appropriations and Budget Chair of the House of Representatives, and the Appropriations Chair of the Senate that includes, but is not limited to, the number of awards that have been SENATE FLOOR VERSION - HB3683 SFLR Page 3 (Bold face denotes Committee Amendments) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 granted, the percentage of those funds t hat have been expended, and the increased number of employees that have been hired by awardees. SECTION 3. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 5062.43 of Title 74, unless there is created a duplication in numbering, reads as follows: There is hereby created in the State Treasu ry a revolving fund for the Oklahoma Department of Commerce to be designated the “Defense Workforce Grant Program Revolving Fund ”. The fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all monies received by the Department from appropriations, donations, grants, or other sources of funding specifically designated for deposit to the Defense Workforce Grant Program Revolving Fu nd. All monies accruing to the credit of the fund are hereby appropriated and may be bud geted and expended by the Department for the purpose of the Defense Workforce Grant Program. Expenditures from the fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for approval and payment. The Department may retain one percent (1%) of all funds otherwise deposited to the fund to cover administ rative costs related to the Defense Workforce Grant Program. SECTION 4. This act shall become effective July 1, 2024. SECTION 5.
