6060 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6161 SECTION 1. NEW LAW A new section of law to be codified
6262 in the Oklahoma Statutes as Section 20m of Title 74, unless there is
6363 created a duplication in numbering, reads as follows:
6464 A. As used in this section:
6565 1. "Person" means a natural person, corporation, partne rship,
6666 limited liability company, proprietorship, association, municipal
6767 corporation, including any publi c trust which has a municipal

9494 corporation as its beneficiary, or other political subdivision of
9595 this state, including any public trust which has a poli tical
9696 subdivision as its beneficiary, or any other legal entity ; and
9797 2. "Assignment" means the transfer of any claims, causes of
9898 actions or rights held by a person against another party to the
9999 State of Oklahoma by the Attorney General. Assignment completely
100100 transfers the person's legal rights to the Attorney General and
101101 creates privity between the Attorney General and the party against
102102 whom the claims are instituted, authorizing the Attorney General to
103103 stand in the shoes of the person. Assignment only includes
104104 affirmative claims and not liabilities of the person as defined in
105105 subsection D of Section 2013 of Title 12 of the Oklahoma Sta tutes.
106106 B. 1. The State of Oklahoma, through the Attorney General, is
107107 hereby explicitly authorized to accept assignments from any person,
108108 as defined subsection A of this section, for the purpose of
109109 representing said claims in legal matters or proceedings within the
110110 jurisdiction of the State of O klahoma.
111111 2. Assignments to the State of Oklahoma shall be made in
112112 accordance with applicable law.
113113 C. 1. The Attorney General, upon accepting an assignment
114114 pursuant to this section, shall have the authority to represent the
115115 assigned claims in all legal m atters or proceedings.
116116 2. The Attorney General shall ex ercise the same duties and
117117 responsibilities towards the assigned claims as towards any other

144144 claims managed by the Office of the Attorney General, subject to the
145145 terms and conditions of an assignment agreement.
146146 D. 1. Nothing in this statute shall be construe d to require
147147 the Oklahoma Attorney General to accept any assignment, nor shall it
148148 limit the Attorney General 's discretion to decline an assignment for
149149 any reason deemed appropriate by the Attorney General or his or her
150150 designee.
151151 2. Assigned claims are not sub ject to Section 20i of Title 74
152152 of the Oklahoma Statutes .
153153 3. All legal rights and benefits given to the Attorney General
154154 shall remain in full force and effect for the assigned claims.
155155 E. 1. In carrying out the provisions of this section, the
156156 Office of the Attorney General shall only accept assignment when it
157157 determines it is in the best interest of the public.
158158 2. In determining the best interest of the public, the Attorney
159159 General shall consider factors such as:
160160 a. protection of public health, safety, and welfare ;
161161 b. economic vitality and job creation ;
162162 c. environmental sustainability , and
163163 d. equity and fair treatment for a ll citizens.
164-F. The provisions of thi s section shall only apply when a n
165-emergency is declared by the Governor pursuant to Executive Order as
166-a result of a natural disaster .

193190 SECTION 2. It being immediately necessa ry for the preservation
194191 of the public peace, health or safety, an emergency is hereby
195192 declared to exist, by reason whereof this act shall take effec t and
196193 be in full force from and after its passage and approval.
