230419 redistribution of monies in some manner to a retirement system for
231420 purposes of reducing the unfunded liability of such system or the
232421 earmarking of a portion of the revenue from a tax to a retirement
233422 system or increasing the percentage of the reven ue earmarked from a
234423 tax to a retirement system;

236424 6. “Reduction-in-cost amendment” means an amendment to a
237425 retirement bill having a fiscal impact which reduces the cost of the
238426 bill as such cost is determined by the actuarial investigation for
239427 the bill prepared pursuant to Section 3109 of this title;

241428 7. “Retirement bill” means any bill or joint res olution
242429 introduced or any bill or joint resolution amended by a member of
243430 the Oklahoma Legislature which creates or amends any law directly
244431 affecting a retirement system. A retirement bill shall not mean a
245432 bill or resolution that impacts the revenue of an y state tax in
246433 which a portion of the revenue generated from such tax is earmarked
247434 for the benefit of a retirement system;

250462 retirement bill creating or establishing a retirement system and any
251463 other retirement bill other than a nonfiscal retirement bill; and

283511 duties are to preserve the public peace, protect life and property,
284512 prevent crime, serve warrants, enforc e all laws and municipal
285513 ordinances of this state, and any political subdivision thereof, and
286514 who is authorized to bear arms in the ex ecution of such duties;

288515 6. “Member” means all eligible officers of a participating
289516 municipality and any person hired by a participating municipality
290517 who is undergoing police training to become a permanent police
291518 officer of the municipality. Effective July 1, 1987, a me mber does
292519 not include a “leased employee” as defined under Section 414(n)(2)
293520 of the Internal Revenue Code o f 1986, as amended. Effective July 1,
294521 1999, any individual who agrees with the participating munic ipality
295522 that the individual’s services are to be performed as a leased
296523 employee or an independent contractor shall not be a member
297524 regardless of any classifi cation as a common law employee by the
298525 Internal Revenue Service or any other governmental agency, o r any
299526 court of competent jurisdiction. A member s hall include eligible
300527 commissioned officers of the Oklahoma State Bureau of Narcotics and
301528 Dangerous Drugs Control, the Oklahoma State Bureau of Investigation,
302529 and the Alcoholic Beverage Laws Enforcement Com mission who elect to
303530 participate in the System pursuant to Section 50-111.5 of this

306532 7. “Normal retirement date ” means the date at which the member
307533 is eligible to receive the unreduced payments of the member’s

313563 continues past the normal retirement date of the member, the actual

318567 8. “Credited service” means the period of service used to
319568 determine the eligibility for and the amount of benefits payable to
320569 a member. Credited service shall consist of t he period during which
321570 the member participated in the System or the predecessor munic ipal
322571 systems as an active employee in an eligible membership
323572 classification, plus any service prior to the establishment of the
324573 predecessor municipal system s which was credited under the
325574 predecessor municipal systems or credited service granted by the
326575 State Board;

328576 9. “Participating municipality” means a municipality which is
329577 making contributions to the System on behalf of i ts officers. The
330578 Oklahoma State Bureau of Narcoti cs and Dangerous Drugs Control, the
331579 Oklahoma State Bureau of Investigation, and the A lcoholic Beverage
332580 Laws Enforcement Commission shall be treated in the same manner as a
333581 participating municipality only re garding those members who elect to
334582 participate in the System pursuant to Section 50-111.5 of this

337610 10. “Permanent total disabili ty” means incapacity due to
338611 accidental injury or occupational disease, to earn any wages in the
339612 employment for which the member is physically suited and reasonably
340613 fitted through education, training or experience. Further, the
341614 member must be declared one hundred percent (100%) impaired as
342615 defined by the “American Medical Association’s Guides to the
343616 Evaluation of Permanent I mpairment” American Medical Associa tion
344617 Guides to the Evaluation of Permanent Impairment on the basis of a
345618 physical medical examination by a physician licens ed to practice
346619 medicine in this state, as selected by the State Board;

348620 11. “Permanent partial disa bility” means permanent disability
349621 which is less than permanent total disability as defined in this
350622 section. The member must be declar ed no greater than nin ety-nine
351623 percent (99%) impaired as defined by the “American Medical
352624 Association’s Guides to the Evaluation of Permanent Impairment ”
353625 American Medical Association Guides to the Evaluation of Permanent

356626 Impairment on the basis of a physic al medical examination by a
357627 physician licensed to practice medicine in this state, as selected

360629 12. “Permanent in-line disability” means when a police officer
361630 serving in any capacity at a regular police department of a
362631 participating municipality becomes so p hysically or mentally
363632 disabled, as determined by an independent medical examiner,
364633 psychiatrist, or psychologist selected by the State Board, while in,

365660 and in consequence of, the performance of authorizing activities
366661 while on duty as an officer that he or s he is unable to perform the
367662 required duties of a police officer;

369663 13. “Beneficiary” means a member’s surviving spouse or any
370664 surviving children, incl uding biological and adopted children, at
371665 the time of the member ’s death. The surviv ing spouse must have b een
372666 married to the member for the thirty (30) continuous months
373667 immediately preceding the member ’s death, provided a surviving
374668 spouse of a member who died while in, and as a consequence of, the
375669 performance of the member ’s duty for a participating municipal ity,
376670 shall not be subject to the thirty-month marriage requirement for
377671 survivor benefits. A surviv ing child of a member shall be a
378672 beneficiary until reaching eighteen (18) years of age or twenty-two
379673 (22) years of age if the child is enrolled full time full-time and
380674 regularly attending a public or private school or any institution of
381675 higher education. Any child adopted by a member after the member’s
382676 retirement shall be a beneficiary only if the child is adopted by
383677 the member for the t hirty (30) continuous months preceding the
384678 member’s death. Any child who is adopted by a member after the
385679 member’s retirement and such member dies accidentally or as a
386680 consequence of the performance of the member’s duty as a police
387681 officer shall not be su bject to the thirty-month adoption
388682 requirement. This definition of beneficiary shall be in addition to
389683 any other requirement set forth in this article;

1311+SECTION 4. AMENDATORY 11 O.S. 2021, Section 50 -110, as

1359+B. Each municipality shall pick up under the provisions of
1360+Section 414(h)(2) of the Internal Revenue Code of 1986 and pay the
1361+contribution which t he member is required by law to make to the
1362+System for all compensation earned after December 31, 1988.
1363+Although the contributions so picked up are designated as member
1364+contributions, such contributions shall be tr eated as contributions
1365+being paid by the municipality in lieu of contributions by the
1366+member in determining tax treatment under the Internal Revenue Code
1367+of 1986 and such picked up picked-up contributions shall not be
1368+includable in the gross income of the member until such amounts are
1369+distributed or made available to th e member or the beneficiary of
1370+the member. The member, by the terms of this System, shall n ot have
1371+any option to choose to receive the contributions so picked up
1372+directly and the picked up picked-up contributions must be paid by
1373+the municipality to the Sy stem.

1409+SECTION 5. AMENDATORY 11 O.S. 2021, Section 50-111.1, is
1410+amended to read as follows:
1411+Section 50-111.1. A. A member who terminat es service before
1412+normal retirement date, other than by death or disability, shall,
1413+upon application filed with the State Oklahoma Police Pension and
1414+Retirement Board, be refunded from the Oklahoma Police Pension and
1415+Retirement Fund an amount equal to the accumulated contributions the
1416+member has made to the Fund fund, but excluding any interest or any
1417+amount contributed by the municipality or state. If a memb er
1418+withdraws the member’s accumulated contributions, such member shall
1419+not have any recourse agains t the System for any type of additional
1420+benefits including, but n ot limited to, disability benefits. If a
1421+member has completed ten (10) years of credited se rvice at the date
1422+of termination, the member may elect a vested benefit in lieu of
1423+receiving the member’s accumulated contributions.

1451+credited service elects the vested benefit, the member shall be
1452+entitled to a monthly retirement annuity commencing on the date the
1453+member reaches fifty (50) years of age or the date the member would

1455+employment continued uninterrupted, whichever is later. The annual
1456+amount of such retirement annuity shall be equal to two and one-half

1469+benefit dies prior to being eligible to receive benefits , the
1470+member’s beneficiary shall be entit led to the member’s normal
1471+monthly accrued retirement benefits on the date the deceased member
1472+would have been eligi ble to receive the benefit.

1508+received because of a member ’s prior termination may be repaid by
1509+trustee-to-trustee transfers of non -Roth funds from a Section 403(b)
1510+annuity, an eligible Section 457(b) plan, and/or a Section 401(a)
1511+qualified plan. Those members who at the time of termination of
1512+employment could not w ithdraw any of their acc umulated contributions
1513+shall receive credited service for the time employed as an officer
1514+prior to any such termination upon proper application and approval
1515+by the Board. To receive credit f or such service, all required
1516+contributions and interest shall be paid within ninety (90) days of
1517+Board approval of the application. The provisions of this
1518+subsection shall not apply to any member who is receiving benefits
1519+from the System as of July 1, 19 87.
1520+D. If an active member dies and does not leave a surviving
1521+beneficiary under paragraph 13 of Section 50-101 of this title, the
1522+accumulated contributions made to the System by the member shall be

1666+1. “System” means the Oklahoma Police Pension and Retire ment
1667+System and all predecessor municipal Police Pension and Retirement
1668+Systems police pension and retirement systems ;
1669+2. “Article” means Article 50 of thi s title;
1670+3. “State Board” means the Oklahoma Police Pension and
1671+Retirement Board;
1672+4. “Fund” means the Oklahoma Police Pension and Retirement
1673+Fund;
1674+5. “Officer” means any duly appointed and sworn full-time
1675+officer of the regular police department of a municipality whose
1676+duties are to preserve the public peace, protect life and property,
1677+prevent crime, serve warrants, enforce all laws and municipal
1678+ordinances of this state, and any politi cal subdivision thereof, and
1679+who is authorized to bear arms in the ex ecution of such duties;
1680+6. “Member” means all eligible officers of a participating
1681+municipality and any person hired by a participating municipality
1682+who is undergoing police training to become a permanent police
1683+officer of the municipality. Effective July 1, 1987, a member does
1684+not include a “leased employee” as defined under Section 414(n)(2)
1685+of the Internal Revenue Code of 1986, as amended. Effective July 1,
1686+1999, any individual who a grees with the participating municipality
1687+that the individual’s services are to be performed as a leased
1688+employee or an independent contractor shall not be a member
1689+regardless of any classification as a common law employee by the RBS No. 3512

1718+commissioned officers of the Oklahoma State Bureau of Narcotics and
1719+Dangerous Drugs Control, the Oklahoma State Bureau of Investigation,
1720+and the Alcoholic Beverage Laws Enforcement Commission who elect to
1721+participate in the System pursuant to Section 50 -111.5 of this
1722+title;
1723+7. “Normal retirement date ” means the date at which the member
1724+is eligible to receive the unreduced payments of the member ’s
1725+accrued retirement benefit. Such date shall be the first day of the
1726+month coinciding with or following the date the member completes
1727+twenty (20) years of credited service. If the member’s employment
1728+continues past the normal retirement date of the member, the actual
1729+retirement date of the member shall be the first day of the m onth
1730+after the member terminates employment with more than twenty (20)
1731+years of credited service;
1732+8. “Credited service” means the period of service used to
1733+determine the eligibility for and the amount of benefits payable to
1734+a member. Credited service shall consist of the period during which
1735+the member participated in the System or the predecessor munic ipal
1736+systems as an active employee in an eligible membership
1737+classification, plus any s ervice prior to the establishment of the
1738+predecessor municipal system s which was credited under the RBS No. 3512

1767+9. “Participating municipality ” means a municipality which is
1768+making contributions to the System on behalf of its officers. The
1769+Oklahoma State Bureau of Narcotics and Dangerous Drugs Control, the
1770+Oklahoma State Bureau of Investigation, and the A lcoholic Beverage
1771+Laws Enforcement Commission shall be treated in the same manner as a
1772+participating municipality only regarding those members who elect to
1773+participate in the System pursuant to Section 50 -111.5 of this
1774+title;
1775+10. “Permanent total disabili ty” means incapacity due to
1776+accidental injury or occupational disease , to earn any wages in the
1777+employment for which the member is physically suited and reasonably
1778+fitted through education, training or experience. Further, the
1779+member must be declared one hundred percent (100%) impaired as
1780+defined by the “American Medical Association ’s Guides to the
1781+Evaluation of Permanent Impairment ” American Medical Associa tion
1782+Guides to the Evaluation of Permanent Impairment on the basis of a
1783+physical medical examination by a physician licensed to practice
1784+medicine in this state, as selected by the State B oard;
1785+11. “Permanent partial disability ” means permanent disability
1786+which is less than permanent total disability as defined in this
1787+section. The member must be declar ed no greater than ninety -nine
1788+percent (99%) impaired as defined by the “American Medical RBS No. 3512

1818+physician licensed to practice medicine in this state, as s elected
1819+by the State Board;
1820+12. “Permanent in-line disability” means when a police officer
1821+serving in any capacity at a regular police department of a
1822+participating municipality becomes so physically or mentally
1823+disabled, as determined by an independent m edical examiner,
1824+psychiatrist, or psychologist selected by the State Board, while in,
1825+and in consequence of, the performance of authorizing activities
1826+while on duty as an officer that he or she is unable to perform the
1827+required duties of a police officer;
1828+13. “Beneficiary” means a member’s surviving spouse or any
1829+surviving children, including biological and adopted children, at
1830+the time of the member ’s death. The surviv ing spouse must have been
1831+married to the member for the thirty (30) continuous months
1832+immediately preceding the member ’s death, provided a surviving
1833+spouse of a member who died while in, and as a consequence of, the
1834+performance of the member ’s duty for a participating municipality,
1835+shall not be subject to the thirty -month marriage requiremen t for
1836+survivor benefits. A surviving child of a member shall be a
1837+beneficiary until reaching eighteen (18) years of age or twenty -two
1838+(22) years of age if the child is enrolled full time full-time and RBS No. 3512

1866+higher education. Any child adopted by a member after the member’s
1867+retirement shall be a beneficiary only if the child is adopted by
1868+the member for the t hirty (30) continuous months preceding the
1869+member’s death. Any child who is adopted by a member after the
1870+member’s retirement and such member dies accidentally or as a
1871+consequence of the performance of the member ’s duty as a police
1872+officer shall not be su bject to the thirty-month adoption
1873+requirement. This definition of beneficiary shall b e in addition to
1874+any other requirement set forth in this article;
1875+14. “Executive Director” means the managing officer of the
1876+System employed by the State Board;
1877+15. “Eligible employer” means any municipality with a municipal
1878+police department;
1879+16. “Entry date” means the date as of which an eligible
1880+employer joins the System. The first entry date pursuant to this
1881+article shall be January 1, 1981;
1882+17. “Final average salary” means the average paid base salary
1883+of the member for normally scheduled hours ove r the highest salaried
1884+thirty (30) consecutive months of the last six ty (60) months of
1885+credited service. Effective July 1, 2016, the following shall apply

1916+b. for purposes of determining the normal disability
1917+benefit only, final average salary shall be based on
1918+the member’s total service if less than thirty (30)

1920+c. in addition to other applicable limitations, and
1921+notwithstanding any other provision to t he contrary,
1922+for plan years beginning on or after July 1, 2002, the
1923+annual compensation of each “Noneligible Member”
1924+noneligible member taken into account under the System
1925+shall not exceed the Economic Growth and Tax Relief
1926+Reconciliation Act of 2001 (EGTRRA) annual
1927+compensation limit. The EGTRRA annual compensation
1928+limit is Two Hundred Thousand Dollars ($200,000.00),
1929+as adjusted by the Commissioner for increases in the
1930+cost of living in accordance with Section
1931+401(a)(17)(B) of the Internal Revenue Code of 1986, as
1932+amended. The annual compensation limit in effect for
1933+a calendar year applies to any perio d, not exceeding
1934+twelve (12) months, over which compensation is
1935+determined (“determination period”) beginning in such

1969+who first became a member duri ng a plan year
1970+commencing on or after July 1, 1996,
1971+d. for plan years beginning on or a fter July 1, 2002, any
1972+reference in the System to the annual compensation
1973+limit under Section 401(a)(17) of the Internal Revenue
1974+Code of 1986, as amended, shall mean the EGTRRA annual
1975+compensation limit set forth in this provision, and
1976+e. effective January 1, 2008, back pay, within the
1977+meaning of Section 1.415(c) -2(g)(8) of the Income Tax
1978+Regulations, shall be treated as paid base salary for
1979+the limitation year to which t he back pay relates to
1980+the extent the back pay represents wages and
1981+compensation that would otherwise be included in this
1982+definition;
1983+18. “Accrued retirement benefit ” means, for benefits computed
1984+prior to the effective date of this act, two and one-half percent (2
1985+1/2%) of the member’s final average salary multiplied by the

3019+affecting a retirement system. A retirement bill shall not mean a
3020+bill or resolution that impacts the revenue of any state tax in
3021+which a portion of the revenue generated from such tax is earmarked
3022+for the benefit of a retirement system;
3023+8. “Retirement bill having a fiscal impact ” means any
3024+retirement bill creating or establishing a retirement system and any

3052+9. “Retirement system” means the Teachers’ Retirement System of
3053+Oklahoma, the Oklahoma Public Employees Retirement System, the
3054+Uniform Retirement System for Justices and Judges, the Oklahoma
3055+Firefighters Pension and Retirement System, the Oklahoma Police
3056+Pension and Retirement System, the Oklahoma Law Enforcement
3057+Retirement System, or a retirement system established after January
3058+1, 2006.
3059+SECTION 13. Sections 1 through 4 of this act shall become
3060+effective in accordance with the provisions of Section 58 of Article
3061+V of the Oklahoma Co nstitution.
3062+SECTION 14. Section 5 of this act shall become effective July
3063+1, 2024.
3064+SECTION 15. It being immediately necessary for the p reservation
3065+of the public peace, health or safety, an emergency is hereby
3066+declared to exist, by reason whereof this act shall take effect and
